The automatic prediction of court case judgments using Deep Learning and Natural Language Processing is challenged by the variety of norms and regulations, the inherent complexity of the forensic language, and the length of legal judgments. Although state-of-the-art transformer-based architectures and Large Language Models (LLMs) are pre-trained on large-scale datasets, the underlying model reasoning is not transparent to the legal expert. This paper jointly addresses court judgment prediction and explanation by not only predicting the judgment but also providing legal experts (...) with sentence-based explanations. To boost the performance of both tasks we leverage a legal named entity recognition step, which automatically annotates documents with meaningful domain-specific entity tags and masks the corresponding fine-grained descriptions. In such a way, transformer-based architectures and Large Language Models can attend to in-domain entity-related information in the inference process while neglecting irrelevant details. Furthermore, the explainer can boost the relevance of entity-enriched sentences while limiting the diffusion of potentially sensitive information. We also explore the use of in-context learning and lightweight fine-tuning to tailor LLMs to the legal language style and the downstream prediction and explanation tasks. The results obtained on a benchmark dataset from the Indian judicial system show the superior performance of entity-aware approaches to both judgment prediction and explanation. (shrink)

The experimental approach in economics is a driving force behind some of the most exciting developments in the field. The 'experimental revolution' was based on a series of bold philosophical premises which have remained until now mostly unexplored. This book provides the first comprehensive analysis and critical discussion of the methodology of experimental economics, written by a philosopher of science with expertise in the field. It outlines the fundamental principles of experimental inference in order to investigate their power, scope and (...) limitations. The author demonstrates that experimental economists have a lot to gain by discussing openly the philosophical principles that guide their work, and that philosophers of science have a lot to learn from their ingenious techniques devised by experimenters in order to tackle difficult scientific problems. Experimental “localism” stresses the importance of context‐specific knowledge, and the limitations of universal theories in science. I illustrate Latour's radical approach to localism and show that it has some unpalatable consequences, in particular the suggestion that problems of external validity (or how to generalize experimental results to nonlaboratory circumstances) cannot be solved. In the last part of the paper I try to sketch a solution to the problem of external validity by extending Mayo's error‐probabilistic approach.

Research indicates that religious values and ethical behavior are closely associated, yet, at a firm level, the processes by which this association occurs are poorly understood. Family firms are known to exhibit values-based behavior, which in turn can lead to specific firm-level outcomes. It is also known that one’s family is an important incubator, enabler, and perpetuator of religious values across successive generations. Our study examines the experiences of a single, multigenerational business family that successfully enacted their religious values in (...) their business. Drawing upon intergenerational solidarity and values-based leadership theory, and by way of an interpretive, qualitative analysis, we find that the family’s religious values enhanced their cohesion and were manifested in their leadership style, which, in turn, led to outcomes for the business. Our findings highlight the processes that underlie the relationship between religious values and organizational outcomes in family firms and offer insights into the role of solidarity in values-based leadership. The answer in a nutshell is: Yes, five years ago, but nobody has noticed. Nobody noticed because the majority of social scientists subscribe to one of the following views: (1) the ‘anomalous’ behaviour observed in standard prisoner’s dilemma or ultimatum game experiments has refuted standard game theory a long time ago; (2) game theory is flexible enough to accommodate any observed choices by ‘refining’ players’ preferences; or (3) it is just a piece of pure mathematics (a tautology). None of these (...) views is correct. This paper defends the view that GT as commonly understood is not a tautology, that it suffers from important (albeit very recently discovered) empirical anomalies, and that it is not flexible enough to accommodate all the anomalies in its theoretical framework. It also discusses the experiments that finally refuted game theory, and concludes trying to explain why it took so long for experimental game theorists to design experiments that could adequately test the theory. The auctions of the Federal Communication Commission, designed in 1994 to sell spectrum licences, are one of the few widely acclaimed and copied cases of economic engineering to date. This paper includes a detailed narrative of the process of designing, testing and implementing the FCC auctions, focusing in particular on the role played by game theoretical modelling and laboratory experimentation. Some general remarks about the scope, interpretation and use of rational choice models open and conclude the paper.

Philosophical dialetheism, whose main exponent is Graham Priest, claims that some contradictions hold, are true, and it is rational to accept and assert them. Such a position is naturally portrayed as a challenge to the Law of Non-Contradiction (LNC). But all the classic formulations of the LNC are, in a sense, not questioned by a typical dialetheist, since she is (cheerfully) required to accept them by her own theory. The goal of this paper is to develop a formulation of the (...) Law which appears to be unquestionable, in the sense that the Priestian dialetheist is committed to accept it without also accepting something inconsistent with it, on pain of trivialism—that is to say, on pain of lapsing into the position according to which everything is the case. This will be achieved via (a) a discussion of Priest's dialetheic treatment of the notions of rejection and denial; and (b) the characterization of a negation via the primitive intuition of content exclusion. Such a result will not constitute a cheap victory for the friends of consistency. We may just learn that different things have been historically conflated under the label of 'Law of Non-Contradiction'; that dialetheists rightly attack some formulations of the Law, and orthodox logicians and philosophers have been mistaken in assimilating them to the indisputable one. We consider the class of pointed varieties of algebras having a lattice term reduct and we show that each such variety gives rise in a natural way, and according to a regular pattern, to at least three interesting logics. Although the mentioned class includes several logically and algebraically significant examples (e.g. Boolean algebras, MV algebras, Boolean algebras with operators, residuated lattices and their subvarieties, algebras from quantum logic or from depth relevant logic), we consider here in greater detail Abelian ℓ-groups, (...) where such logics respectively correspond to: i) Meyer and Slaney’s Abelian logic [31]; ii) Galli et al.’s logic of equilibrium [21]; iii) a new logic of “preservation of truth degrees”. “Nudging” is commonly seen as an appealing form of “Smart legislation” based on the findings of Behavioural sciences and alternative to traditional forms of regulation. However, notwithstanding the ever increasing references and a growing body of literature on its acceptability, a proper definition of the concept seems still lacking, since all the attempts to date have only provided over- or under-inclusive definitions. This chapter purports to offer a more plausible definition. Firstly, the received view and especially Thaler’s and Sunstein’s descriptions (...) of nudging will be examined and subjected to a first critical assessment. Secondly, a few examples will be made of policies enacted all around the world which are usually referred to as cases of nudging. Thirdly, some of the elements which have often been associated to nudging as its definitional features will be tested against the set of examples: such test will show that most of those elements must be done away with. Lastly, a “minimal” definition will be offered. While allowing us to distinguish nudging from other forms of conduct-influencing interventions, the minimal definition will exclude many features as its necessary conditions: among others, those related to specific ends and political ideologies. Improving the evidence in public health is an important goal for the health promotion community. With better evidence, health professionals can make better decisions to achieve effectiveness in their interventions. The relative failure of such evidence in public health is well-known, and it is due to several factors. Briefly, from an epistemological point of view, it is not easy to develop evidence-based public health because public health interventions are highly complex and indeterminate. This paper proposes an analytical explanation of the (...) complexity and indeterminacy of public health interventions in terms of 12 points. Public health interventions are considered as a causal chain constituted by three elements and two levels of evaluation. Public health interventions thus differ from clinical interventions, which comprise two causal elements and one level of evaluation. From the two levels of evaluation, we suggest a classification of evidence into four typologies: evidence of both relations; evidence of the second but not of the first relation; evidence of the first but not of the second relation; and no evidence of either relation. In addition, a grading of indeterminacy of public health interventions is introduced. This theoretical point of view could be useful for public health professionals to better define and classify the public health interventions before acting. (shrink)

As Artificial Intelligence (AI) becomes more and more pervasive in our everyday life, new questions arise about its ethical and social impacts. Such issues concern all stakeholders involved in or committed to the design, implementation, deployment, and use of the technology. The present document addresses these preoccupations by introducing and discussing a set of practical obligations and recommendations for the development of applications and systems based on AI techniques. With this work we hope to contribute to spreading awareness on the (...) many social challenges posed by AI and encouraging the establishment of good practices throughout the relevant social areas. As points of novelty, the paper elaborates on an integrated view that combines both human rights and ethical concepts to reap the benefits of the two approaches. Moreover, it proposes innovative recommendations, such as those on redress and governance, which add further insight to the debate. Finally, it incorporates a specific focus on the Italian Constitution, thus offering an example of how core legislations of Member States might contribute to further specify and enrich the EU normative framework on AI. In this paper we propose a narrative hypothesis on the nature of language and a proto-discursive hypothesis on the origin of our communicative abilities. Our proposal is based on two assumptions. The first assumption, concerning the properties of language, is tied to the idea that global discourse coherence governs the origin of our communicative abilities as well the functioning of these abilities. The second assumption, concerning processing devices, is connected to the idea that the systems of spatial and temporal navigation (...) are implicated in discourse coherence processing. Analysis of the relationship between these two assumptions allows us to integrate the model of language based on clues proposed by Sperber and Wilson with Relevance Theory with the discursive foundation of human communication. In this respect, our proposal can be considered as a tentative extension of Relevance Theory. (shrink)

It is shown that two formally consistent type-free second-order systems, due to Cocchiarella, and based on the notion of homogeneous stratification, are subject to a contingent version of Russell's paradox.

Hindriks’ paper raises two issues: one is formal and concerns the notion of ‘cost’ in rational choice accounts of norms; the other is substantial and concerns the role of expectations in the modification of payoffs. In this commentary I express some doubts and worries especially about the latter: What’s so special with shared expectations? Why do they induce compliance with norms, if transgression is not associated with sanctions?

This paper intends to verify the extent and effectiveness of the transforming appropriation of the Derridean concept of ‘differance’ by Stiegler with respect to the problems that, according to Stiegler, make this creative critical operation necessary; in particular with respect to the most recent question concerning the possibility of thinking about and putting into practice a ‘neganthropological différance’ capable of facing the ecological crisis that today seems to threaten the very existence of life on earth. The paper goes back to (...) Technics and Time 1. to analyze the distinction between ‘vital difference’ and ‘noetic difference’ that constitutes the condition of possibility of the ‘neganthropological différance.’ In this perspective, the distinction proposed by Stiegler seems to re-propose the hierarchically oriented oppositional structure that characterizes metaphysical thought and in particular the opposition between man and animal, attributing to the human being the ability to free himself from the constraints of his biological-natural condition. Finally, the paper attempts to account for the repercussions of this approach on the very possibility of an effective response to the ecological crisis, concluding with a provocation regarding the role that theory can and must play with regard to such an urgent and far-reaching problem. This paper shows the state of the art regarding the possibilities of intervention for the economic and social inclusion of young people Not engaged in Employment, Education, or Training through Massive Open Online Courses in the countries of the European Union, in order to identify and compare good practices and didactic models aimed to contrast the social and economic vulnerabilities of young people. The systematic review, carried out on both generalist and more properly educational databases, has revealed the poor relationship (...) between the two topics in literature, each one moreover only recently made the subject of articulated research. The field of study is therefore open and invites further reflection on its possible developments. Matching NEETs’ needs and business companies’ requirements, students’ motivation during the learning path, keeping balance between e-learning and face-to-face lectures, tutors’ involvement along the course, and relationships with stakeholders remain the main issues identified in the various papers reviewed. The failure of models based on rational expectations to explain the ‘boom and bust’ of financial markets does not support Soros' critique of mainstream economics or his call for a theoretical revolution. Contrary to what Soros says, standard rational choice theory has the conceptual resources to analyse reflexivity. The dynamic of feedback loops for example can be described by simple models based on multiple equilibria and informational cascades. The problem is that agents and theorists sometimes lack the information required to (...) identify equilibria and tipping points. (shrink)

We study some connections between two kinds of emph{overlap} relations: that of point-free geometries in the sense of Grzegorczyk, Whitehead and Clarke, and that recently introduced by Sambin within his constructive approach to topology. The main thesis of this paper is that the overlap relation in the latter sense is a necessary tool for a constructive and intuitionistic development of point-free geometry.
