Over the past twenty years, economic theory has begun to play a central role in antitrust matters. In earlier days, the application of antitrust rules was viewed almost entirely in formal terms; now it is widely accepted that the proper interpretation of these rules requires an understanding of how markets work and how firms can alter their efficient functioning. The aim of this article is to show that human persons belong, ontologically, in social ontology. After setting out my views on ontology, I turn to persons and argue that they have first-person perspectives in two stages (rudimentary and robust) essentially. Then I argue that the robust stage of the first-person persective is social, in that it requires a language, and languages require linguistic communities. Then I extend the argument to cover the rudimentary stage of the first-person perspective as well. (...) I conclude by enumerating ways in which human persons differ from nonhuman animals. (shrink)

A framework is introduced consisting of five baselines of ethical justification for professional persuasive communications. The models provide a conceptual structure by which to identify and analyze the ethical reasoning, underlying justifications, motivations, and decision making in professional persuasive practices. Although the emphasis of this article is on defining the constructs, their ethical soundness as justification for persuasive practices and their usefulness in establishing direction and methodologies for research in persuasive also are addressed.

We human persons have an abiding interest in understanding what kind of beings we are. However, it is not obvious how to attain such an understanding. Traditional analytic metaphysicians start with a priori accounts of the most general, abstract features of the world— e.g., accounts of properties and particulars—features that, they claim, in no way depend upon us or our activity.1 Such accounts are formulated in abstraction from what is already known about persons and other things, and are used as (...) constraints on metaphysical investigation of everything else. So, if we accept traditional metaphysics, we should be prepared to yield to abstruse pronouncements—either by giving up our most secure beliefs about the world that we encounter or by abandoning our conception of what those beliefs are really about. Collaborative remembering is essential to enabling teams to build shared understanding of projects and their progress. This article presents an analysis of collaborative remembering sequences in a corpus of interactions collected in a workplace where a team of designers developed a video television commercial. On the basis of coding and analysing linguistic and bodily behaviors in 158 such sequences, extracted from over 45 hours of video recordings, recurrent patterns of collaborative remembering processes were identified, relating to the interplay of work (...) roles. Routine infant circumcision is one of the most common surgical procedures performed in the U.S. Despite its broad societal acceptance, the practice is not without controversy. The stories included in this symposium offer rich insight into the diverse set of attitudes, values, and beliefs related to the practice of circumcision. They additionally offer insight into the complex web of personal, interpersonal, and social dynamics that inform the circumcision choices parents make for their children, the reasons parents make them, and how (...) others can influence decisional choices. More broadly, these narratives raise important ethical questions mirrored today in broader contemporary bioethical and public discourse on the scope and limits of parental authority to make decisions for their children, power dynamics in medical decision making, and the ethics of healthcare activism. In this commentary, I discuss three sets of themes related to the ethics of circumcision running through the symposium narratives, comment on the ethical tensions and questions which emerge from each set of themes, gently problematize some of the rhetoric surrounding the ethical permissibility of circumcision, and gesture towards the future of bioethical inquiry on circumcision discourse. In this book Richard Foley formulates the problem of the authority of others’ testimony, and of the rationality of one’s own beliefs, in terms of trust. Part 1 discusses the appropriateness of trust in one’s own cognitive faculties and beliefs, while part 2 argues that those assessments provide a basis for trust in others’ beliefs as well as those of one’s earlier and later selves. He does not offer us an analysis of trust or what it is to speak of (...) trust as rational or reasonable. He simply uses the notion to discuss what is surely one form of the problem of the rationality of belief. Rationality, in this book as in his earlier works, The Theory of Epistemic Rationality and Working Without a Net, is understood from a strict internalist and first-person perspective. Assessments of the rationality of opinions, like assessments of decisions, are claims, from a particular perspective, about how effectively the belief or decision promotes a goal or set of goals. With respect to belief and rational belief, the goal is what Foley calls the traditional “epistemic goal” of accurate and comprehensive beliefs. On his view, the perspective from which the assessment is made is the individual’s, taken on reflection. From the start, Foley’s understanding of rationality involves the first-person perspective. Rational belief is belief that will stand up to an individual’s own self-criticism. (shrink)

Since the onset of the latest United States (U.S.) recession (beginning in December 2007), the U.S. economy has been posting high unemployment levels consistently exceeding 8 percent. Of specific interest, the U.S. Department of Labor, Bureau of Labor Statistics (BLS), reports on a specific subset of the U.S. unemployed: the long‐term unemployed, defined as those who are unemployed for 27 weeks and over. Since December 2009, the share of the long‐term unemployed of the total U.S. unemployed has exceeded 40 percent (...) (through April 2012), the highest level since 1948 when data was first collected. A phenomenon of this recession is an alleged public bias by American private sector employers against hiring the long‐term unemployed, or even simply those unemployed. While the authors support the removal of discrimination against the unemployed in job advertisements, they cannot support the larger notion of including those who are unemployed as a protected class of employees. Becoming or being unemployed is a state that one can change, and based on the lack of research on how widespread this discrimination is (beyond anecdotal stories or limited research surveys), they believe that extending protection under equal employment opportunity legislation would be overreaching and inappropriate at this time. The book begins by offering a general account of what evidential ambiguity consists in and uses it to try to make sense of the idea that our world is religiously ambiguous in some sense. In a detailed examination of Quine's Two Dogmas of Empiricism, I argue that Quine fails to make the case that there are no analytical truths in ordinary language. Drawing on admissions he makes with regard to definitions and languages' relationship to pragmatic considerations, and an examination of his arguments concerning the interdefinability of the terms `synonymous', and `analytic', I argue that analytic truths exist as deducible consequences of the various uses to which language or sub-languages are put.

This chapter presents the text of a lecture on Great Britain's unwritten constitution given at the British Academy's 2009 Maccabaean Lecture on Jurisprudence. This text criticises some of the recent developments related to the British constitution and expresses concern whether Britain has a constitution at all. It proposes the establishment of some body or institution independent of government to plan constitutional reform in a coherent manner, and for the renewal of public interest in constitutional affairs.

Advances in technology are bringing greater insight into the mind, raising a host of privacy concerns. However, the basic psychological mechanisms underlying the perception of privacy violations are poorly understood. Here, we explore the relation between the perception of privacy violations and access to information related to one’s “self.” In two studies using demographically diverse samples, we find that privacy violations resulting from various monitoring technologies are mediated by the extent to which the monitoring is thought to provide access to (...) self-relevant information, and generally neuromonitoring did not rate among the more invasive monitoring types. However, brain monitoring was judged to be more of a privacy violation when described as providing access to self-relevant information than when no such access was possible, and control participants did not judge the invasiveness of neuromonitoring any differently than those told it provided no access to self-relevant information. Mitchell et al.'s claim, that their propositional theory is a single-process theory, is illusory because they relegate some learning to a secondary memory process. This renders the single-process theory untestable. The propositional account is not a process theory of learning, but rather, a heuristic that has led to interesting research.

“Doing Gender,” West and Zimmerman's landmark article, highlighted the importance of social interaction, thus revealing the weaknesses of socialization and structural approaches. However, despite its revolutionary potential for illuminating how to dismantle the gender system, doing gender has become a theory of gender persistence and the inevitability of inequality. In this article, the author argues that we need to reframe the questions to ask how we can undo gender. Research should focus on when and how social interactions become less gendered, (...) whether gender can be irrelevant in interaction, whether gendered interactions always underwrite inequality, how the institutional and interactional levels work together to produce change, and interaction as the site of change. In this paper the very earliest relationship of mother and newborn will be described phenomenologically through an interlacing of Donald Winnicott''s work on maternal holding with Maurice Merleau-Ponty''s concepts of flesh and chiasm. Merleau-Ponty''s thinking suggests that the holding relationship described by Winnicott is formed as much by the infant''s holding of the mother as it is by mother''s holding of her infant. Both flex and bend towards each other and inscribe each other yet retain their own particularity. Further specification (...) and articulation of the lived body of both arises from the ongoing overlapping and sedimenting of past and current touches, movements, sounds, and sightings initiated internally and externally. Examples drawn from fieldwork and secondary sources will illustrate this ongoing embodied relationship. (shrink)
