Among legal scholars, P. J. A. Feuerbach is considered one of the most important German jurists of the 19th century: not only has he established Germany’s modern doctrine of penal law and the Bavarian penal code of 1813, but he is also the founder of the theory of psychological force, i.e. the idea of the threat of punishment (not punishment itself!) as deterrence. Whereas one cannot comprehend Feuerbach’s legal doctrines without their original philosophical justification, namely his concept of the legal (...) subject as a citizen of two worlds, most contemporary interpreters ignore this aspect of Feuerbach’s theory of punishment. Against this reductionist interpretation of Feuerbach, by reconstructing his philosophy of punishment, this article exposes both the theoretical potential and shortcomings of Feuerbach’s main philosophical concepts. This paper seeks to develop a theory of health that aligns with the shift in contemporary medical practice and research toward a temporally extended epidemiological view of health. The paper describes how such a theory is at the core of life course based approaches to health, and finds theoretical grounding in recent work in the philosophy of biology promulgating a process theory of life.

Both in academic and public discussions the term “enlightened” is not only an often used but also an often misused one. Thus, this article again investigates the question “What is Enlightenment?” One main thesis, which for some contemporary self-proclaimed followers of Enlightenment may be a bit hard to swallow, is that it is just the influence of a certain mediaeval thinker on historical Enlightenment that can help to develop a systematic and not only historical concept of Enlightenment. For this purpose, (...) this article combines three problems of this very concept: the discussion on “What is Enlightenment?” in late German Enlightenment; the fuzziness of any distinction between “Enlightenment” and “Counter-Enlightenment”; the very difference between the way that Jewish Enlightenment (Haskala) and “Christian” Enlightenment refer to their mediaeval philosophical ancestors. Electrical membrane fluctuations are treated as due to sequences of ion pulses passing through the membrane. A mathematical procedure is developed which permits calculation of the power spectra for sequences in which the pulses can have Poisson or non-Poisson interval distributions and may or may not have coupled pulse parameters. It is shown that there probably exist specific sequences which are intimately related to membrane 1/f and burst noise. In particular, emphasis is placed upon sequences with non-Poisson interval distributions and (...) their implications for membrane structure. According to Eugenie Scott, methodological materialism---the view that science attempts to explain the world using material processes---does not imply philosophical materialism---the view that all that exists are material processes. Thus one can consistently be both a scientist and a theist. According to Phillip Johnson, however, methodological materialism presupposes philosophical materialism. Consequently, scientists are unable to see the cogency of supernatural explanations, like creationism. I argue that both Scott and Johnson are wrong: scientists are not limited to explaining tbe world using (...) material processes and science does not presuppose materialism. This discussion note offers a preliminary analysis of what recent developments in human germline gene editing tell us about the effectiveness of speculative and anticipatory modes of techno-ethics. It argues that the benefits of speculative discussions are difficult to detect thus far, and that pushing the focal point of ethical discourse well ahead of the current state of technology may prematurely undermine existing norms long before a broad consensus would justify moving beyond them.

This paper explores the ways in which a fuller attention to suffering in the tradition of the early Frankfurt School might valuably inform international political thought. Recent poststructural writing argues that trauma is silenced to prevent it disrupting narratives of order and progress and instead advocates a continual ‘encircling’ of trauma that refuses incorporation into a broader historical narrative. This paper welcomes this challenge to mainstream international ethics: attention to particular suffering provides an important challenge to the abstraction, instrumentalism and (...) universalism of modernity. However, if we simply mark trauma and refuse to incorporate it into any kind of narrative, we cannot profit from the ways in which suffering can illuminate the structures and ways of thinking that create it. Drawing on Adorno's negative dialectics, the paper argues that a dialectical understanding of the relationship between universalising order and disrupting particularity can lead from individual suffering towards a political re-engagement with the universal. RésuméLes modernistes arabes et les humanistes occidentaux considèrent souvent le philosophe musulman Averroès comme l’un des premiers précurseurs de Kant et des Lumières européennes. Contrairement à cette réputation, cet article soutient que ce sont les critiqueurs de Kant, Herder et Tiedemann, qui ont redécouvert Averroès. Tiedemann a été le premier historiographe allemand à donner un compte rendu précis de la pensée d’Averroès. Cela s’est accompagné d’une réévaluation d’Averroès par Herder dans ses Lettres sur les progrès de l’humanité, dans lesquelles il (...) reconnaît la similitude entre son propre concept de l’esprit du temps en tant que raison historique – son alternative au concept des Lumières d’une raison universelle et anhistorique – et le concept d’Averroès d’un intellect matériel unique pour tous les esprits humains individuels.
