Strokes of Luck provides a detailed and wide-ranging examination of the role of luck in moral and political philosophy. The first part tackles debates in moral luck, which are concerned with the assignment of blameworthiness to individuals who are separated only by lucky differences. ‘Anti-luckists’ think that an agent who, for example, attempts and succeeds in an assassination and an agent who attempts and fails are equally blameworthy. This book defends an ‘anti-anti-luckist’ argument, according to which the successful assassin is (...) more blameworthy than the unsuccessful one. Moreover, the successful assassin is, all things equal, a worse person than the unsuccessful one. The worldly outcomes of our acts can make an all-important difference, not only to how bad our acts can be deemed, but to how bad we are. The second part enters into debates about distributive justice. It is argued that the attempt to neutralize luck in the distribution of advantages among individuals does not deserve its prominence in political philosophy: the ‘luck egalitarian’ programme is flawed. A better way forward is to re-invest in John Rawls’s ‘justice as fairness, which demonstrates a superior way of taming the bad effects of luck and unchosen disadvantage. (shrink)

This article examines how a non-anthropocentric virtue ethics can truly avoid an anthropocentric bias in the ethical evaluation of a situation where the environment is at stake. It argues that a non-anthropocentric virtue ethics capable of avoiding the pitfall of an anthropocentric bias can only conceive of the ultimate good—from which virtues are defined—in reference to an ecological self. Such a self implies that the natural environment is not simply a condition for human flourishing, or something that complements it by (...) adding the proper good of animals, organisms or ecosystems. Fulfilment is not that of a human self, but that of an ecological self: the natural environment or nature is not an external but an internal good. Therefore, the virtues or character traits that such an ecological self must nurture and develop leads us ultimately to distinguish—without opposing them—three different forms of virtue ethics applied to the environment, depending on whether it is anthropocentric or non-anthropocentric and whether nature is considered extrinsically or intrinsically. Such distinctions are also crucial to determine how we conceive of the political community and the collective goals that virtuous citizens assign to it (for instance, to preserve biodiversity, to tackle climate change, and so on). In this paper I argue for a special kind of injustice I call “trust injustice.” Taking Miranda Fricker's work on epistemic injustice as my starting point, I argue that there are some ethical constraints on trust relationships. If I am right about this, then we sometimes have duties to maintain trust relationships that are independent of the social roles we play.

Abstract:Our critics confuse the role normative ethical theory can take in business ethics. We argue that as a practical discipline, business ethics must focus on norms, not the theories from which the norms derive. It is true that our original work is defective, but not in its form, but in its neglect of contemporary advances in feminist ethics.

Abstract:When people reason on the basis of moral rules, do they suppose that in the absence of a prohibitory rule they are free to act, or do they suppose that morality always requires a justification establishing a permission to act? In this essay we present a series of learning experiments that indicate when learners tend to close their system on the basis of natural liberty and when on the principle of residual prohibition. Those who are taught prohibitory rules tend to (...) infer natural liberty while those taught permission rules tend to infer residual prohibition. In mixed cases, where learners are taught both types of rules, there is some tendency to suppose that natural liberty is the default. Both natural liberty and its denial can be learned; is there a reason to adopt one system of moral rules or the other? We argue that systems of social morality based on a principle of natural liberty have a striking advantage over their competitors: they are well adapted to effectively exploring the constant novel circumstances that arise in open, dynamic, societies. In this article, we examine how affect influences judgment and thought, but also how thought transforms affect. The general thesis is that the nature and impact of affective reactions depends largely on their objects. We view affect as a representation of value, and its consequences as dependent on its object or what it is about. Within a review of relevant literature and a discussion of the nature of emotion, we focus on the role of the object of affect in governing (...) both the nature of emotional reactions and the impact of affect and emotion on cognition and action. Although emotion is always about the here and now, the capacity for abstract thought means that the human here and now includes imagination as well as perception. Indeed, the hopes and fears that dominate human lives often involve things only imagined. (shrink)

Republican liberty, as recently defended by Philip Pettit and Quentin Skinner, characterises liberty in terms of the absence of domination, instead of, or in addition to, the absence of interference, as favoured by Berlin-style negative liberty. This article considers several claims made on behalf of republican liberty, particularly in Pettit's and Skinner's recent writings, and finds them wanting. No relevant moral or political concern expressed by republicans, it will be contended here, fails to be accommodated by negative liberty.

Public reason liberalism is a family of theories according to which liberal political institutions, social structures, and/or basic social rules are politically or morally justified if and only if they can be endorsed from the perspective of each and every free and equal "reasonable and rational" person. Let us call these persons "the members of the justificatory public." Public reason liberalism idealizes the members of the justificatory public in three senses. First, the members of the justificatory public are assumed to (...) be free from at least some of the cognitive distortions and biases that often characterize actual people; we suppose that they generally reason in a sound way on the basis of relevant information. Different versions of public reason liberalism press this idealization quite far, while others insist on a "moderate idealization." Secondly, the members of the justificatory public are idealized insofar as it is assumed that each is a good-willed person, concerned with living with others on terms that are mutually acceptable. In Rawls's language, we suppose that they are not simply rational, but "reasonable": they have a form of "moral sensibility" according to which they are ready to propose fair terms of cooperation, and are willing to abide by them "provided others can be relied on to do likewise." The members of the justificatory public are thus idealized insofar as they are assumed to be moved by their sense of justice, or their aim to respect others as free and equal persons. This leads to a third idealization: by assuming that the members of the justificatory public are moved by this moral sensibility, it is supposed that they do not pay attention to their reasons to ignore their sense of justice . More generally, any specific version of public reason liberalism will hold that some reasons of actual people are not relevant to the justificatory question: the members of the justificatory public "bracket" these reasons in their deliberations. For some years now, the significance of truth for politics has been intensely debated under the buzzword “post-truth.” However, this cannot hide the fact that political theory and philosophy have systematically neglected the relationship between truth and politics throughout their history. This article intends to remedy this desideratum by differentiating the various modes in which truth is referred to and invoked in the political field. To this end, the main strands of the post-truth debate are reconstructed and their shortcomings are (...) pointed out. Second, based on a contrasting reading of Habermas and Foucault, possible starting points for systematizing the relationship between truth and politics are discussed. Third, and as a prolegomenon to such a systematization, the article proposes a cartography of political truth forms and relations along five fault lines: truth as foundation and de-foundation, truth as coercion and freedom, truth as virtue and scandal, truth as secret and transparency, and truth as knowledge and practice. Michael Moehler’s Minimal Morality is a wonderful and important book, from which I have learned a great deal. It reinvigorates rational choice moral theory in the process of confronting what I see as the most important issue in social and moral philosophy today: can those in a deeply morally divided society endorse a common moral framework to structure social cooperation? Is a rational moral order possible under conditions of deep and wide moral diversity? Minimal Morality’s answers are thoughtful and innovative. (...) I am not, however, entirely persuaded that Minimal Morality can fulfil its promise of grounding a cooperative order when ‘traditional’ modes moral justification cannot. (shrink)

In this essay I sketch a philosophical argument for classical liberalism based on the requirements of public reason. I argue that we can develop a philosophical liberalism that, unlike so much recent philosophy, takes existing social facts and mores seriously while, at the same time, retaining the critical edge characteristic of the liberal tradition. I argue that once we develop such an account, we are led toward a vindication of “old” (qua classical) liberal morality—what Benjamin Constant called the “liberties of (...) the moderns.” A core thesis of the paper is that a regime of individual rights is crucial to the project of public justification because it disperses moral authority to individuals thus mitigating what I call the “burdens of justification.” Footnotesa Earlier versions of this essay were presented at the University of North Carolina, Chapel Hill, Philosophy Department workshop on the morality of capitalism, and at the conference on rights theory at the Murphy Institute, Tulane University. This chapter sketches a reading that confirms John Rawls's view that the stability argument of Part Three of Theory of Justice (TJ) was crucial for the success of TJ as a whole, that it was indeed flawed, and that fundamental ideas of Political Liberalism (PL) can be traced to the wide‐ranging consequences of recognizing the flaw in that argument. In Rawls's political liberalism, one can find at least two accounts of the way in which stability considerations enter into justificatory arguments (...) – one repairs the account in TJ and is similarly structured, while another pushes political liberalism in a more radical direction. The chapter briefly discusses how the thin theory of the good is employed in Rawls's stability analysis. It is not “the fact of pluralism” but the “fact of reasonable pluralism” that motivates Rawls's political turn; reasonable pluralism is the result of our best exercise of free practical reason. Uwe Steinhoff’s The Ethics of War and the Force of Law contains an extended critique of ‘moral fundamentalism’, or the project of uncovering an individualist ‘deep morality’ of war governed by the same moral principles and rules that govern ordinary moral life, as well as a more positive account of war that depicts it as a social practice. Much of Steinhoff’s account is indebted to a series of claims involving the standing to blame, reciprocity, and the necessity and proportionality conditions (...) on self-defence. On all these claims, Steinhoff is open to challenge. First, he is arguably over-dependent on ‘standing to blame’ considerations. Second, his commitment to reciprocity is under-explained. Third, the necessity condition does not clearly explain how conventional elements explain the formation of defensive standards. Fourth, there are problems in explaining how the distinct defensive conventions adopted by distinct communities can actually be made to get on to the same page when these communities go to war with each other. It is one of the remarkable and significant consequence of the AIDS epidemic that out of the context of enormous suffering and death there emerged a forceful set of ideas linking the domains of health and human rights. At first, the effort centered on the observation that protecting individuals from discrimination and unwarranted intrusions on liberty were, contrary to previous epidemics, crucial to protecting the public health and interrupting the spread of HIV But in fairly short order, the scope of (...) the health and human rights perspective expanded dramatically to focus on the ways in which the most fundamental social arrangements rendered individuals and communities vulnerable to HIV Racial and ethnic minorities, those who were marginalized, and women were at risk because of their subordinate status. In the face of such an understanding, nothing short of social change could be adequate to the challenge posed by the AIDS epidemic. (shrink)

:Some understand utopia as an ideal society in which everyone would be thoroughly informed by a moral ethos: all would always act on their pure conscientious judgments about justice, and so it would never be necessary to provide incentives for them to act as justice requires. In this essay I argue that such a society is impossible. A society of purely conscientiously just agents would be unable to achieve real justice. This is the Paradox of Pure Conscientiousness. Over many centuries, the homing pigeon has been selectively bred for returning home from a distant location. As a result of this strong selective pressure, homing pigeons have developed an excellent spatial navigation system. This system passes through the hippocampal formation, which shares many striking similarities to the mammalian hippocampus; there are a host of shared neuropeptides, interconnections, and its role in the storage and manipulation of spatial maps. There are some notable differences as well: there are unique connectivity patterns (...) and spatial encoding strategies. This review summarizes the comparisons between the avian and mammalian hippocampal systems, and the responses of single neurons in several general categories: location and place cells responding in specific areas, path and goal cells responding between goal locations, context-dependent cells that respond before or during a task, and pattern, grid, and boundary cells that increase firing at stable intervals. Head-direction cells, responding to a specific compass direction, are found in mammals and other birds but not to date in pigeons. By studying an animal that evolved under significant adaptive pressure to quickly develop a complex and efficient spatial memory system, we may better understand the comparative neurology of neurospatial systems, and plot new and potentially fruitful avenues of comparative research in the future. Rawlsian liberalism is best understood and defended on the basis of a concrete but widely shared ideal of the person as a rational agent capable of normative self?determination in the proper political and economic conditions. In Rawls? recent works, this neo?Kantian ideal of free moral personality is no longer understood as a requirement of rational or moral agency as such, but is a concrete historical ideal or meta?value presupposed by the living tradition of liberal?democratic judgment and practice, which reason can (...) recover through a critical reflection upon this tradition. Read in this way, Rawls? theory of social justice articulates a quite powerful, rational, concrete, historical, and social dimension of modern political identity, which the critics of liberalism cannot plausibly deny. But there are other rival, powerful bourgeois?individualist and patriarchal ideals of personhood, equally rooted in modern political judgments and practices, which Rawlsian liberalism ignores, and which taken together generate the social tensions, instabilities, and conflicts of social justice characteristic of modern liberal?democratic society. Rawlsian theory and liberal political thought requires but essentially lacks a conception of moral reason adequate to comprehend and mediate these normative incoherences built into modern Western political identity. A larger more adequate paradigm of moral reason and political theory is required to overcome these deficiencies. (shrink)

In this article, I appeal to the phenomenon of moral hazard in order to explain how at least some of the inequalities permitted by Luck Egalitarianism can be given an alternative, more plausible grounding than that which is supplied by Luck Egalitarianism. This alternative grounding robs Luck Egalitarianism of a potentially significant source of intuitive support whilst enabling conditional welfare policies to survive the attacks on them made by Elizabeth Anderson, Jonathan Wolff, and others.

Under the title of ‘the axiom of existence’, hereafter, John R. Searle has reduced to compact dictum a view to which many philosophers subscribe: ‘Whatever is referred to must exist’. In this paper I shall offer two major arguments against adopting, at least on certain assumptions. There have been a number of defenses of, among them those arguing that it is fundamental to any systematic philosophy of language or logic.
