In the ground-breaking 2018 judgment of Navtej Singh Johar v. Union of India, the Hon'ble Supreme Court of India ushered in a new era by decriminalizing homosexuality, marking a pivotal moment in the country's legal history. However, this progressive stride was accompanied by persistent questions concerning homosexual rights that remained unexplored within both cultural and legal frameworks. Despite the legal acknowledgment, members of the homosexual community are often professed merely as 'individuals' and not fully integrated into mainstream society. This perception (...) is aggravated by the absence of a societal 'stamp of marriage,' reinforcing their marginalization. In the realm of Hindu law, the sanctity of marriage is deeply rooted in the scriptures, which explicitly define it as the union of 'two souls.' Remarkably, these very scriptures also assert that a soul is inherently without gender, elucidating that gender is a characteristic exclusive to the human body. It is crucial to recognize that Hindu law, including the relevant Acts, draws extensively from these scriptures, making them a fundamental source of legal principles. The legislation, such as the Hindu Marriage Act, essentially serves to codify and organize the pre-existing Hindu law without seeking to undermine the intrinsic values enshrined within the Holy Scriptures. This article aims to delve into the unaddressed aspects of homosexual rights within the contemporary legal framework, shedding light on the denied rights that persist. While global attitudes are progressing towards recognizing and safeguarding homosexual rights, the Indian government and cultural factors appear hesitant to renounce orthodox and conservative stances. This article seeks to analyse and critique these aspects, exploring the challenges hindering the full acceptance and integration of homosexual individuals into the broader societal fabric despite the transformative legal landscape initiated by the Navtej Singh Johar case. By its nature, comparative education values diversity. Respectfully studying how different groups pursue education provides opportunities to learn about the variety of human experience, expand the boundaries of the field, and ultimately re-understand ourselves. At its core, the field leverages the dynamic space between life as culturally located and being human. This chapter contributes value to comparative education from an Oceanic viewpoint. Oceania is the world region with more water and languages than any other. Because of its diversity and colonial (...) histories, Oceania is a site of creative tension between regionalism and self-determination. Unsurprisingly, conflict exists in the region. However, a key need in our ‘sea of islands’ for sustainability is to live well together. Faced with the uncertainties of the future such as climate change, mutual understanding and support is at a premium. The collaboration of writers; Solomon Islander, Tongan, and Anglo-Welsh, embodies this, as does the chapter’s woven mat-based structure. The thrust of this chapter is that through walking backwards into the future and embracing solidarity through diversity, we can promote a sustainable educational journey that offers the hope of continuity in the face of the challenges ahead. For human interaction, it is important to understand what emotional state others are in. Especially the observation of faces aids us in putting behaviours into context and gives insight into emotions and mental states of others. Detecting whether someone is nervous, a form of state anxiety, is such an example as it reveals a person’s familiarity and contentment with the circumstances. With recent developments in computer vision we developed behavioural nervousness models to show which time-varying facial cues reveal whether someone (...) is nervous in an interview setting. The facial changes, reflecting a state of anxiety, led to more visual exposure and less chemosensory (taste and olfaction) exposure. However, experienced observers had difficulty picking up these changes and failed to detect nervousness levels accurately therewith. This study highlights humans’ limited capacity in determining complex emotional states but at the same time provides an automated model that can assist us in achieving fair assessments of so far unexplored emotional states. BackgroundCarefully planned research is critical to developing policies and interventions that counter physical, psychological and social challenges faced by young people living with HIV/aids, without increasing burdens. Such studies, however, must navigate a ‘vulnerability paradox’, since including potentially vulnerable groups also risks unintentionally worsening their situation. Through embedded social science research, linked to a cohort study involving Adolescents Living with HIV/aids (ALH) in Kenya, we develop an account of researchers’ responsibilities towards young people, incorporating concepts of vulnerability, resilience, and agency (...) as ‘interacting layers’.MethodsUsing a qualitative, iterative approach across three linked data collection phases including interviews, group discussions, observations and a participatory workshop, we explored stakeholders’ perspectives on vulnerability and resilience of young people living with HIV/aids, in relation to home and community, school, health care and health research participation. A total of 62 policy, provider, research, and community-based stakeholders were involved, including 27 ALH participating in a longitudinal cohort study. Data analysis drew on a Framework Analysis approach; ethical analysis adapts Luna’s layered account of vulnerability.ResultsALH experienced forms of vulnerability and resilience in their daily lives in which socioeconomic context, institutional policies, organisational systems and interpersonal relations were key, interrelated influences. Anticipated and experienced forms of stigma and discrimination in schools, health clinics and communities were linked to actions undermining ART adherence, worsening physical and mental health, and poor educational outcomes, indicating cascading forms of vulnerability, resulting in worsened vulnerabilities. Positive inputs within and across sectors could build resilience, improve outcomes, and support positive research experiences.ConclusionsThe most serious forms of vulnerability faced by ALH in the cohort study were related to structural, inter-sectoral influences, unrelated to study participation and underscored by constraints to their agency. Vulnerabilities, including cascading forms, were potentially responsive to policy-based and interpersonal actions. Stakeholder engagement supported cohort design and implementation, building privacy, stakeholder understanding, interpersonal relations and ancillary care policies. Structural forms of vulnerability underscore researchers’ responsibilities to work within multi-sectoral partnerships to plan and implement studies involving ALH, share findings in a timely way and contribute to policies addressing known causes of vulnerabilities. This study aimed to explore the enabling context of the HIV care continuum as perceived by people living with HIV and healthcare professionals. This qualitative study involved in‐depth individual interviews with eight people living with HIV and group interviews with seven nurses and physicians. These interviews took place between March 5, 2021, and July 13, 2022. Thematic analysis was conducted. The main themes that emerged included “network of support and systems,” “personal gains from the care continuum,” “continuity and practicality of (...) healthcare services,” “presence of significant other(s),” and “social belonging.” These themes were structured within the five levels of the socio‐ecological model (system, individual, organizational, interpersonal, and community levels), and 10 subthemes were identified. With the integration of themes, the enabling context was compared to a “care orbit,” indicating that people diagnosed with HIV start treatment at the system level and continue HIV care at other levels. In addition to primary support at the system level, the enabling context also includes individual commitment to care and regular health habits, hospital services, support from significant others, and community culture. Together, the context helps guide people living with HIV into the “orbit” of the care system. (shrink)

A child’s death is a profound loss for mothers and affects hundreds of thousands of women. Mothers report inconsolable and progressive grief that is distinct from depression and impacts daily emotions and functions. The brain mechanisms responsible for this relatively common and profound mental health problem are unclear, hampering its clinical recognition and care. In an initial exploration of this condition, we used resting state functional MRI (fMRI) scans to examine functional connectivity in key circuits, and task-based fMRI to examine (...) brain network activity in grieving mothers in response to pictures of their deceased child and as well as recognizable deceased celebrities and unfamiliar individuals. We compared nine mothers who had lost an adult child and aged-matched control mothers with a living child of a similar age. Additionally, we collected diffusion imaging scans to probe structural connectivity and complemented the imaging studies with neuropsychological assessments. Increased functional activation in Ventral Attention/Salience Networks accompanied by a reduced activation in the medial prefrontal cortex in response to the deceased child’s picture robustly distinguished the grieving mothers from controls. Heightened resting-state functional connectivity between the paraventricular thalamic nucleus (PVT) and the amygdala distinguished the grieving mothers from the controls and correlated with subjective grief severity. Structurally, maternal grief and its severity were associated with alterations in corticolimbic white matter tracts. Finally, grieving mothers performed worse than controls on neuropsychological tests of learning, memory, and executive function, linked with grief severity. Reduced activation in cortical regions inhibiting emotions and changes in the PVT circuitry—a region involved in long-term emotional memories and decision making under conflict—distinguish grieving mothers from controls. Notably, the magnitude of neurobiological changes correlates with the subjective severity of grief. Together, these new discoveries delineate a prevalent and under-recognized mental health syndrome and chart a path for its appreciation and care. (shrink)

Respecting patients’ rights is a fundamental aspect of providing quality healthcare. The present investigation attempts to explore the awareness among patients about their rights in a coastal township in India. A questionnaire-based cross-sectional study was carried out among 215 patients admitted to the wards of a tertiary care teaching hospital in Mangalore. Awareness among patients regarding their rights varied for various issues and ranged between 48.4 and 87.4 %. Awareness about patients’ rights was independent of gender, socio-economic and educational status. (...) Doctors were found to be the most common source of information for patient’s about their rights in the study. Doctors must conform to the relevant legislations and involve patients in all aspects of healthcare. There is a need to increase awareness among patients about their rights to ensure informed decisions and better health care services. (shrink)

This paper examines several passages in which Nietzsche considers burgeoning Christianity’s relationship to the secretive “mystery cults” that flourished alongside the official state religions of ancient Rome. The purpose of this paper is four-fold. i) To shed light on an unexplored aspect of Nietzsche’s philosophy. ii) To explore the intellectual reality behind some of his specific charges concerning Pauline Christianity’s indebtedness to the ancient Mithras cult. iii) To assess the validity of several of Nietzsche’s accusations in this area in light (...) of more recent scholarship. iv) To contrast the middle-period Nietzsche’s treatment of this theme with several of his end-of-career ruminations. I make the case that while some of his later claims concerning this topic are indeed exaggerated, they nonetheless reveal remarkable insight into a fascinating aspect of late antiquity. (shrink)

Nāgārjuna’s “middle path” charts a course between two extremes: Nihilism, and Absolutism, not unlike earlier Buddhism. However, as early Buddhists countinanced constituents of reality as characterizable by essences while macroscopic objects lack such essences, Nāgārjuna argues that all things lack what he calls svabhāva – “own being” – the Sanskrit term for essence. Since everything lacks an essence, it is Empty (śūnya). To lack an essence is to lack autonomy. The corollary of this is that all things are interrelated. The (...) Mahāyāna (Great Vehicle) school of Buddhist thought draws heavily on this insight: if all things are related, individualism has to give way to inclusivity. According to Nāgārjuna, the key to understanding his Middle path philosophy is dharma: ethics. It is only by a prior commitment to ethics that we can properly understand the Buddha's philosophy as teaching no doctrine of reality, for it is not a teaching of metaphysics, but of ethics, which is to say, Dharma. At the center of Dharma is a kind of Contractualism of the Buddhist community (saṅga). A failure to approach emptiness via ethics is like trying to hold a snake dangerously. However, approaching the emptiness of reality via ethics is grounds for optimism: nothing is stuck by essence, and we have reason to believe in positive change made possible by prudent ethical choice. In this module I consider some objections to Nāgārjuna's position from Vedic positions, and Yoga, and identify responses available to Nāgārjuna. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:HUME'S BUNDLES, SELF-CONSCIOUSNESS AND KANT Even if we are inclined to view Hume's attempt to explain ascriptions of personal identity as an abysmal failure, we might still be sympathetic toward his proposal to replace the going substance theory of the nature of mind with his bundle account. Thus we might fault Hume for erecting an unachievably high standard for personal identity, or round on him for excluding bodily criteria (...) 2... from his solution, but nonetheless applaud his spiriting away of the Cartesian soul substance leaving his "true idea of the human mind" (261) as a collection of perceptions in its stead. However, Hume's concern to give an account of the idea of the unity of a human mind in terms of related perceptions has run into notoriously rough sledding, not the least of which is the fact that Hume himself in his Appendix to "Of Personal Identity" seems to abandon his bundle theory in despair. In this paper I shall first be concerned to examine the criticism of his bundle theory which Hume brings forth in the Appendix and explain why I think the core difficulty remains insoluble for Hume. I shall then go on to suggest that the unworkability of Húmete bundle theory is directly tied to his failure to appreciate certain features of the peculiarly first person nature of his question about the make-up of minds. In thus emphasizing the place of the first person voice in my interpretation I am stealing a leaf, if not a chapter, from Kant. But this is as it should be since one of the aims of this essay is to provide an interpretation of Hume's difficulties with his account of the nature of mind which explains part of the reason why 'self-consciousness' (or 'apperception') looms so very large in the Critique of Pure Reason attack upon Hume's type of bundle theory. 60. 1. Hume's Second Thoughts In a burst of self criticism at the Appendix to the section on personal identity, Hume brings forth this objection to his own efforts:...Having thus loosen' d all our particular perceptions, when I proceed to explain the principle of connexion, which binds them together, and makes us attribute to them a real simplicity and identity; I am sensible, that my account is very defective, and that nothing but the seeming evidence of the precedent reasonings cou'd have indue' d me to receive it (635). After additional reflections Hume encapsulates his objection thus:...All my hopes vanish, when I come to explain the principles, that unite our successive perceptions in our thought or consciousness (6SS-6). What is the defect Hume calls to our attention? Notice first that the footnote on page 635 explicitly refers us back to that part of his account Hume considers defective; and when we look back to the text of the Treatise in question, page 260, we find it is precisely there that Hume uses the analogy of a republic to sketch his bundle theory of the unity of mind in terms of the two associative principles, resemblance and causation. So it must somehow be that this account in terms of the associative principles is mistaken. But what then is the mistake? According to Hume it is that he cannot 'explain' the principles which unite the discrete percepts. Now it seems to me there are only two possible things Hume could mean in saying this. He could mean either (1) that the principles which connect the percepts of one mind are instances of the associative principles, but he cannot explain them; or (2) there must be other, non-associative, principles which connect the percepts of a single mind and these he cannot explain. 61. I think we can safely conclude (1) cannot represent Hume's misgivings when he says he is unable to explain the uniting principles of the mental bundles. There is first the fact that he does not call into question his general programme of accounting for the nature of the unity of complex things by the principles of causation, resemblance and contiguity — for example, ships, plants, animals, houses and rivers (e.g. 257f) — but only his... This paper argues that we can see our lives as a snapshot happening now or as a moving picture extending across time. These dual ways of seeing our lives inform how we conceive of the problem of age group justice. A snapshot view sees age group justice as an interpersonal problem between distinct age groups. A moving picture view sees age group justice as a first-person problem of prudential choice. This paper explores these different ways of thinking about age group (...) justice and illustrates them using a principle of respect for human dignity, understood in terms of reasonable support for floor level central human capabilities at each stage of life. I argue that different frames are suitable for different kinds of decisions, and each provides a true, but partial, picture of aging and age group justice. (shrink)

No part ot Plato's writings has been more debated than the three similes in Books VI.-VII. of the Republic, and still there is a diversity of opinion about their meaning. I believe that most of these difficulties arise from certain assumptions about their purpose which need revision. The current view applies the Cave to the Line, as Plato seems to direct, and this application, which is itself attended by considerable difficulties, leads to an assimilation of the two figures till they (...) seem to have much the same content and purpose. Again, as this makes the lower line appear to be the phenomenal world, it is thought that the simile of the sun foreshadows the theme of the Line by hinting at a connexion between the intelligible and the sensible which is made more explicit in the Line. Thus the group of similes seem mainly intended to show the dependence of Becoming upon Being. This paper will argue that such a view depends upon the misrepresentation of the symbolism adopted by Plato, that two antithetical groups of symbols are confused with one another, and that symbols are even identified with antitypes. Owing to these misinterpretations the Form of the Good has been mistaken for a material cause; both the Line and the Cave have been thought to reveal Plato as embarrassed by a dualism between sense and intellect, and the purpose of the Cave in particular, since the error is cumulative, has been completely obscured. This paper will attempt to substitute for current accounts another interpretation which will relate the three similes closely with the political arguments of Book VI., and with the Platonic education which is set forth in close connexion with them.
