This book makes a novel contribution to our understanding of Romance SE constructions by combining both diachronic and synchronic theoretical perspectives along with a range of empirical data from different languages and dialects. The collection, divided into four sections, proposes that SE constructions may be divided into one class that is the result of grammaticalization of a reflexive pronoun up the syntactic tree, from Voice and above, and another class that has resulted from the reanalysis of reflexive and anticausative morphemes (...) as an argument expletive or verbal morpheme generated in positions from Voice and below. The contributions, while varied in both empirical content and theoretical approach, all serve to highlight different aspects of the overarching idea that SE constructions have evolved from these two distinct grammaticalization paths. The book appeals to researchers and academics in the field and closes with a unified approach to various SE constructions that makes important use of its status as a verbal morpheme. In addition to aligning a novel string of empirical contributions under a new theoretical umbrella, a clear research direction emerges from this volume based on the morphosyntactic nature of SE itself: Is it a clitic, an agreement morpheme, or a verbal morpheme? Conferring legal personhood on purely synthetic entities is a very real legal possibility, one under consideration presently by the European Union. We show here that such legislative action would be morally unnecessary and legally troublesome. While AI legal personhood may have some emotional or economic appeal, so do many superficially desirable hazards against which the law protects us. We review the utility and history of legal fictions of personhood, discussing salient precedents where such fictions resulted in abuse or incoherence. Although there is increasing use of eco-labeling, conditions under which eco-labels can command price premiums are not fully understood. In this article, we demonstrate that the certification of environmental practices by a third party should be analyzed as a strategy distinct from—although related to—the disclosure of the eco-certification through a label posted on the product. By assessing eco-labeling and eco-certification strategies separately, researchers can identify benefits associated with the certification process, such as improved reputation in the industry or increased product (...) quality, independently from those associated with the actual label. In the context of the wine industry, we show that eco-certification leads to a price premium while the use of the eco-label does not. (shrink)

This study evaluates responses to the Real Estate Ethical Code. Voice Stress Analysis (VSA) is used to evaluate the responses of real estate sales people to ethically-based questions. The process and the responses given enabled the authors to gain insight into pressure-causing ethical situations and to explore new uses of VSA. Some respondents were stressed while following the ethical code guidelines. Others showed no stress about breaking the formal code. Ethical becoming represents a novel framework for teaching engineering ethics. This framework insists on the complementarity of pragmatism, care, and virtue. The dispositional nature of the self is a central concern, as are relational considerations. However, unlike previous conceptual work, this paper introduces additional lenses for exploring ethical relationality by focusing on indebtedness, harmony, potency, and reflective thought. This paper first reviews relevant contributions in the engineering ethics literature. Then, the relational process ontology of Alfred North Whitehead is described and (...) identified as the foundation of the ethical becoming concept. Following this, ethical becoming is imagined as comprising five components: relationality and indebtedness, harmony and potency (i.e., beauty), care, freedom and reflective thought, and ethical inquiry. Each component will be unpacked and knit together to argue that (1) becoming in all its forms is relational and, therefore, whatever becomes is indebted to all to which it relates; (2) one’s ethical engagement must be directed toward the creation of harmony and potency; (3) care practices are necessary to ensure that multiplicity is valued and safeguarded in the meeting of needs; (4) the capacity for reflective thought is necessary to fashion one’s self and others in the direction of harmony, potency, and care; and (5) ethical thought and action must operate through a cycle of ethical inquiry. This paper will close with a brief exploration of how ethical becoming could be utilized in engineering education contexts. (shrink)

In this essay I set out to problematize the concepts of intersubjectivity and interaction in the theories of Germany's two foremost social philosophers: Jiirgen Habermas and Niklas Luhmann. To do so, I shall briefly reconstruct Husserl's phenomenological concept of intersubjectivity and its relationship with rational horizons and lifeworlds. I shall then demonstrate the importance of Husserl's thought in the theory of (rational) communicative action in Habermas. The third section deals with the radical rethinking of the subject (and hence intersubjectivity) in (...) the theory of Niklas Luhmann. My principal question will then be: is it possible to reconcile critical theory with systems theory? Or, alternatively: is intersubjectivity a reality or a useful fiction? (shrink)

This paper raises four queries about Simester’s defective engagement with reason account of culpability found in his Fundamentals of Criminal Law: (1) the characterisation of the account in terms of moral ‘vices’; (2) the basis for identifying a vice as a ‘moral’ vice; (3) what is involved in an agent manifesting ‘insufficient care and concern’ for the interests of others; and (4) whether the account is an account of culpability generally, or is instead an account of criminal culpability, i.e., the (...) type of culpability necessary for criminal conviction. Biological fitness is a foundational concept in the theory of natural selection. Natural selection is often defined in terms of fitness differences as “any consistent difference in fitness (i.e., survival and reproduction) among phenotypically different biological entities” (Futuyma 1998, 349). And in Lewontin’s (1970) classic articulation of the theory of natural selection, he lists fitness differences as one of the necessary conditions for evolution by natural selection to occur. Despite this foundational position of fitness, there remains much debate over the (...) nature of fitness, especially whether fitness differences can truly be said to cause evolutionary change. In recent years these debates have crystalized into two camps: (1) causalists, who see fitness differences as being one of the causes of evolutionary change, and (2) statisticalists, who deny the causal efficacy of fitness and instead hold that “fitness is a mere statistical, noncausal property of trait types” (Walsh 2010, 148). This paper discusses the puzzle of blackmail, i.e. the way in which the threat of an otherwise legally permissible action can in some cases constitute blackmail. It argues that the key to understanding blackmail is in terms of coercion and threats, and the effect such threats have on the validity of a victim’s consent. The nature of coercion and of coercive threats is considered in detail to support the thesis that threats are prima facie impermissible, though often justified all-things-considered. The (...) puzzle of blackmail arises due to the fact that the law rarely has regard to an agent’s motives in acting, whereas this is the focus of the puzzling cases. (shrink)

This collection of essays marks the fiftieth anniversary of the publication of Frantz Fanon’s classic study of anticolonial struggle, _The Wretched of the Earth_. Scholars explore the relevance of Fanon’s work for current modes of psychoanalysis, postcolonial theory, and political thought. One contributor reposes a classic question of postcolonial scholarship: what does it mean for a colonial Caribbean man to practice a Continental intellectual tradition? Schelling’s Naturphilosophie was, from the outset, more concerned with ontogeny than ontology, i.e. not on what nature is but on what it does: ubiquitous creation. Therefore, the processes articulated in the Philosophy of Mythology remain instances of a philosophy driven by what might be called a post-naturalist naturalism. The two aims of this paper are, firstly, to demonstrate this nature-philosophical continuity throughout Schelling’s so-called Protean philosophical projects in order, secondly, to re-prepare Schellingian themes for current debates concerning ontology. To this (...) end, I draw on the worldmaking and abundance postulates of Goodman and Feyerabend, respectively, to demonstrate the persistence of Schellingian ontogenetic pathways for remodelling process metaphysics for contemporary philosophy. Experiential evidence shows that pain is associated with common meanings. These include a meaning of threat or danger, which is experienced as immediately distressing or unpleasant; cognitive meanings, which are focused on the long-term consequences of having chronic pain; and existential meanings such as hopelessness, which are more about the person with chronic pain than the pain itself. This interdisciplinary book - the second in the three-volume Meanings of Pain series edited by Dr Simon van Rysewyk - aims to better (...) understand pain by describing experiences of pain and the meanings these experiences hold for the people living through them. The lived experiences of pain described here involve various types of chronic pain, including spinal pain, labour pain, rheumatic pain, diabetic peripheral neuropathic pain, fibromyalgia, complex regional pain syndrome, endometriosis-associated pain, and cancer-related pain. Two chapters provide narrative descriptions of pain, recounted and interpreted by people with pain. Language is important to understanding the meaning of pain since it is the primary tool human beings use to manipulate meaning. As discussed in the book, linguistic meaning may hold clues to understanding some pain-related experiences, including the stigmatisation of people with pain, the dynamics of patient-clinician communication, and other issues, such as relationships between pain, public policy and the law, and attempts to develop a taxonomy of pain that is meaningful for patients. Clinical implications are described in each chapter. This book is intended for people with pain, their family members or caregivers, clinicians, researchers, advocates, and policy makers. (shrink)
