Starting from the impossibility of understanding fundamental rights from the standpoint of natural law doctrine or positivism, the author tackles the issue of rights from a realistic point of view, that is to say from the perspective of law and politics on the one hand, and from the perspective of public morality, on the other. Thus the foundation of fundamental rights is the meeting point of conceptions of social morality that are current in the modern world and the political aspect (...) of the conception of pluralist democracy. . The author analyses the concept of legal security from its historical evolution to its main structural aspects. In the first part he argues that legal security is a historical and cultural concept of the modern world. He considers a series of factors which lead from the general concept of security generated by an ideological monism and the social rigidity characterizing the Middle Ages to the concept of legal security protected by the legal monism of the modern state, where legal (...) security, understood as formal or procedural justice, has become a principle inspiring the entire legal system. Then he considers legal security in the social state as the expression of the relationship between man and his social needs. In the second part the author makes a structural analysis of the concept of legal security in a modern legal order, identifying the different spheres in which it can be found: state,—focusing on procedural guarantees as limits to power—, law—considering the internal functioning of the legal system—, society—stressing the effects of the action of the social state on the idea of legal security. Los intereses científicos y políticos de los filósofos del derecho Gregorio Peces-Barba (1938-2012) y Norberto Bobbio (1909-2004) se reflejan en más de 70 cartas escritas entre 1978 y 2004, es decir, en los años en que en España entró en vigor la nueva Constitución democrática. Un tema recurrente de esta correspondenciaes el diferente enfoque, en ambos países, de la coexistencia entre socialismo y democracia, así como con el comunismo y el eurocomunismo. El resultado es un vivo retrato (...) de la relación de Bobbio con los políticos españoles. El presente ensayo incluye también algunas frases de relevancia seminal extraídas de las cartas de cada uno de los dos, así como las palabras de Peces-Barba conmemorando la muerte de Bobbio en la prensa española: palabras que atestiguan no sólo la afinidad política, sino también el afecto personal de ambos eruditos. El autor menciona que fuera de los am­bientes académicos y organizaciones de derechos humanos, se sabe poco acerca de los derechos humanos, su concepto, fundamentación, historia y sistemas de protección en la región. El autor resalta la labor de divulgación ilustrada de Gregorio Peces Barba en la cultura jurídica y política de España y otros países y sostiene que en (...) América Latina se necesita hacer algo similar. El autor men­ciona que en Chile, recientemente el tema de los derechos humanos ha vuelto al primer plano en el contexto del proceso constituyente y se han producido deba­tes públicos de mucho interés sobre los derechos fundamentales, incluyendo los de carácter social. The growing emphasis on sustainability in the business landscape has prompted scholars and industry practitioners to explore the role of corporate governance, particularly the board of directors, in promoting corporate sustainability. Companies are called upon to operate ethically and to redefine their objectives beyond mere economic pursuits to create social impacts that contribute to sustainability challenges. Corporate governance plays a key role in this regard, as it defines the purpose and ethical orientation of the firm, thereby shaping its sustainability. While (...) previous research has primarily focused on observable board characteristics, this study delves into a critical yet underexplored aspect of sustainable boards, i.e., the sustainability experience. Drawing on the upper echelon and resource dependency theories, our research examines how the sustainability experience of board members influences a firm’s sustainability performance, investigating the moderating effect of board age. We analyzed European listed companies from 2014 to 2020, and our findings show that the effect of board sustainability experience on firm performance is contingent on board age. Specifically, our results show that younger boards amplify the positive effect of sustainability experience, while for older boards, this effect diminishes, up to the point of being completely mitigated, highlighting a potential misalignment between sustainability efforts and ethical business conduct. This study is pioneering in investigating the joint effects of board sustainability experience and board age on a firm’s sustainability, thus, providing valuable contributions to theory and practical recommendations for firms in director recruitment, as well as recommendations for regulatory practices. The purpose of this paper is to study the philosophical basis of the architecture of two Artificial Intelligence systems (AlphaGo and Hide and Seek). The problem considers the elucidation of the epistemological distinction between “knowledge” and “intuition” and questions whether the fulfillment of a programmed metric can be considered as a product of knowledge or, as an example of intuitive thinking. Through the analysis of both examples, it is shown that achieving the desired objective (winning a game of Go and (...) developing new hiding strategies) is not derived from the system’s architecture, but from the AI’s creativity to achieve the desired result; in that sense, it can be confirmed that certain intelligent systems are capable of creative and intuitive thinking. El objetivo del presente artículo es estu- diar los fundamentos filosóficos de la arquitectura de programación en dos sistemas de Inteligencia Artificial (AlphaGo y Hide and Seek). El problema dilucida la distinción epistemológica de los concep- tos “conocimiento”, “intuición” y “abducción”, para definir si el cumplimiento exitoso de una métrica programada, por parte de una computadora, es con- dición suficiente para atribuirle un comportamiento inteligente. A través del análisis de ambos ejemplos se muestran dos cuestiones: i) el cumplimiento exitoso de un objetivo programado ofrece nuevos recursos de conocimiento, ii) dichos conocimientos dependen de la ejecución de un programa cuyo pro- cesamiento es desarrollado por una IA y, por tanto, las operaciones superan las capacidades intelectivas humanas. Las conclusiones apuntan a que las com- putadoras son recursos de conocimiento especiales de comprobación de hipótesis. (shrink)

Background During the first weeks of March 2020 in Spain, the cases of severe respiratory failure progressively increased, generating an imbalance between the clinical needs for advanced life support (ALS) measures and the effective availability of ALS resources. To address this problem, the creation of triage committees (TC) was proposed, whose main function is to select the best candidates to receive ALS. The main objective of our study is to describe the clinical characteristics of the patients evaluated by the TC (...) of the Alcorcón Foundation University Hospital (AFUH) during the first wave of SARS CoV-2. Other objectives are to determine if there are differences between the patients considered candidates / not candidates for ALS and to analyze the functioning of the TC. Methods Retrospective observational study of all patients assessed by the AFUH TC. Results There were 19 meetings, in which 181 patients were evaluated, 65.4% male and with a mean age of 70.1 years. 31% had some degree of functional dependence, the Barthel median was 100 and Charlson 4. 58.5% were not considered a candidate for ALS at that time. The patients considered candidates to receive ALS were younger (72 vs 66; _p_ Conclusions The patients evaluated by the TC had a mean age of 70 years, high comorbidity and almost a third had some degree of functional dependence. More than half were not considered candidates for ALS at that time, these patients being older, with more comorbidity and a worse previous functional situation. TC decisions, based on objective clinical criteria, were almost always respected. Public institutions must get involved in triage procedures, which should and in our opinion must include the creation of TC in health centers. The implementation of Anticipated Decision programs (ADP) would help enable patients affected by triage decisions to participate in them. (shrink)

La autoría de las obras firmadas como “Gregorio Martínez Sierra” se analiza a través de sus textos autobiográficos: Una mujer por caminos de España (1952) y Gregorio y yo: medio siglo de colaboración (1953). Se describe su trayectoria teatral, ensayística y su significación en la lucha por la autodeterminación y modernización de las mujeres.

Philosophical discussions on cognition (ranging from computational and representational approaches to the 4E fra-mework), on the one hand, and those on sound and auditory per-ception, on the other, have hitherto remained apart. In this paper, the author addresses the concept of “auditory cognition”. While committing to the conceptual analysis of the latter, the author in-troduces the discussion of modality-specif ic approaches. Since the contributions made so far in the domain of the philosophy of sound and auditory perception are prone to (...) favor computational-repre-sentational approaches —e.g., the perceptual coherence model (Méndez-Martínez, 2022)—, the exploration of 4E possibilities will lay down a series of questions aimed to encourage future developers from that viewpoint. In that sense, the author explores conceptual entailments and connections between the genealogy of theories within the philosophy of sound and auditory perception, and the hypothesis of the extended cognition (EX). Imperativism is the view that the phenomenal character of the affective component of pains, orgasms, and pleasant or unpleasant sensory experience depends on their imperative intentional content. In this paper I canvass an imperativist treatment of pains as reason-conferring states.

Abstract: Introspection reveals that one is frequently conscious of some form of inner speech, which may appear either in a condensed or expanded form. It has been claimed that this speech reflects the way in which language is involved in conscious thought, fulfilling a number of cognitive functions. We criticize three theories that address this issue: Bermúdez’s view of language as a generator of second-order thoughts, Prinz’s development of Jackendoff’s intermediate-level theory of consciousness, and Carruthers’s theory of inner speech as (...) a rehearsal of action-schemata. We contend they have problems to account for those cases in which inner speech is fragmentary, and for the difference with those instances in which it appears as more sentence-like. In addition, we present verbal overshadowing as a phenomenon that neither of them can easily explain. Finally, we propose an account in which inner speech is fundamentally silent outer speech and argue that it is more explanatory than the alternatives. (shrink)

We present a dynamic model of the evolution of communication in a Lewis signaling game while systematically varying the degree of common interest between sender and receiver. We show that the level of common interest between sender and receiver is strongly predictive of the amount of information transferred between them. We also discuss a set of rare but interesting cases in which common interest is almost entirely absent, yet substantial information transfer persists in a *cheap talk* regime, and offer a (...) diagnosis of how this may arise. -/- . Some mental states have valence—they are pleasant or unpleasant. According to imperativism, valence depends on imperative content, while evaluativism tells us that it depends on evaluative content. We argue that if one considers valence’s informational profile, it becomes evident that imperativism is superior to evaluativism. More precisely, we show that if one applies the best available metasemantics to the role played by (un)pleasant mental states in our cognitive economy, then these states turn out to have imperative rather than evaluative content, (...) since: (i) they are much more informative about behaviour than they are about the world; and (ii) they occupy a stage in the information-processing chain that is closer to behaviour production than it is to the uptake of sensory information. Godfrey-Smith advocates for linking deception in sender-receiver games to the existence of undermining signals. I present games in which deceptive signals can be arbitrarily frequent, without this undermining information transfer between sender and receiver.

The present work aims to present the notion of eidetic agency as a novel account for the understanding of an epistemic normativity based on practices. The eidetic agency (Fonseca, 2020) and (Fonseca, 2023) is a modality of material agency that, scaffolded and extensively, delegates epistemic agency to formal artifacts that become evident in the materiality of the signifiers of artificial languages. Such eidetic artifacts constitute an epistemic normativity that, although it is based on implicit practices and norms of scientific practices, (...) overcome certain problems derived from that reading. The first section of the text presents a definition and general analysis of the project of a normative epistemology based on practices. In the second part, the relationship between practices in science and scientific regulations is deeply analyzed, based on the premises of Martínez and Huang (2011). Finally, a possible solution to the theoretical problems derived from such reading is proposed, with the approach of an epistemic normativity based on eidetic agents. (shrink)

We argue that, in the case of research biobanks, there is a need to replace the currently used informed consent with trusted consent. Accordingly, we introduce a proposal for the structure of the latter. Further, we discuss some of the issues that can be addressed effectively through our proposal. In particular, we illustrate: i) which research should be authorized by donors; ii) how to regulate access to information; iii) the fundamental role played by a Third Party Authority in assuring compliance (...) with the reciprocal expectations and obligations of donors and scientists. Finally, we briefly analyse two issues that might represent important elements of a ‘new alliance’ between researchers and donors to which the trusted consent could pave the way: i) the correlations between needs and rights of the two parties, and ii) possible economic transactions. There has been much discussion of so-called teleosemantic approaches to the naturalization of content. Such discussion, though, has been largely confined to simple, innate mental states with contents such as ?There is a fly here.? Even assuming we can solve the issues that crop up at this stage, an account of the content of human mental states will not get too far without an account of productivity: the ability to entertain indefinitely many thoughts. The best-known teleosemantic theory, Millikan's biosemantics, offers (...) an account of productivity in thought. This paper raises a basic worry about this account: that the use of mapping functions in the theory is unacceptable from a naturalistic point of view. (shrink)

Internal coherence is of great importance for how we think about appreciating objects of aesthetic worth. A disagreement between what we judge to be worthy and what we affectively favor can prevent us from properly grasping its value. However, it is also assumed in the aesthetic domain that our taste changes over time, jeopardising such coherence constraint. These changes can lead to a mismatch between new aesthetic judgments and old aesthetic preferences. This chapter explores a number of issues that emerge (...) from this tension. Using Taylor Swift’s re-recording as a case study, I will explore the relation between fan loyalty and personal authenticity, as well as the role of biographical taste in the reception of these newly recorded albums among Swift’s long-time fanbase. In lieu of an abstract, here is a brief excerpt of the content:FOR A NON-VIOLENT ACCORD: EDUCATING THE PERSON Marie-Louise Martinez Education has been criticized, no doubt justly, for the symbolic violence of its prohibitions and exclusionary rituals that mirror the violence of society (Bourdieu, etc.). But this criticism is short-sighted. When restraints are removed in teaching and education (in the family and in the school), violence wells up anew and produces at least the following two results: access to meaning (...) and knowledge is restricted; access to the law and its structure-inducing prohibitions is restricted. The result is that we foster vulnerable personalities who confuse fiction and reality, and who do not hesitate to turn their violence into acts of hostility directed toward themselves, other people, and society. A further consequence has been a certain violent non-differentiation that has tended in turn to produce a violent re-differentiation ofsociety. There is a nostalgia everywhere today for a return to discipline, to the rule oflaw, etc. One hears talk of the "sanctuary of the classroom" or again of the necessity of preserving a "symbolic cloister." We are not able, purely and simply, to feel remorse for having maintained the rule ofa violent symbolic order. One might ask in what the symbolic consists. How is it connected to teaching and education? Is there not a fundamental violence in the symbolic? Does there exist a less violent symbolic, or even a non-violent one? How might one define it and put it to work in teaching and education? Girardian theory can help us to reinterpret various contributions from a number of authors in the human sciences (Benveniste, Lacan, etc.) and from the personalist philosophy of language. I would like to propose the hypothesis that there are two stages ofthe symbolic: first, a violent symbolic accord and, second, a non-violent threshold within the symbolic, which alone can serve as an appropriate model for teaching and education. 56Marie-Louise Martinez I. We are not using symbolic in its specific sense as metaphorical or figurative language as it occurs in myth and poetry but in a more general sense, i.e., to refer to the totality ofthe sign and code systems employed by human beings, as that which allows for the production and deployment of significations within society. Stemming from the Greek symbolein (to throw or put together, to assemble), the symbolic is that type or order of signs that assembles. Much more than the pure language of linguistics, the symbolic is the totality ofverbal, non-verbal, and para-verbal conventions, of systems ofexchange, and ofrites. It also comprises the regulated use ofbodies and ofnature. Our definition ofthe symbolic is not idealist: more than simply the expression of ideas, it is also interaction and action, on oneself, on others, and the world. It includes technical and bodily activities to the degree that these have been codified. In this sense, the symbolic (in agreement with philosophers as diverse as Cassirer or Clifford Geertz) can be said to embrace the totality of what is called culture. But ifthe symbol throws orputs together, it is necessary to discuss what and why and how it does so. The modern science ofsigns (semiology) has shown that the sign or symbol serves to place in relation. Relying on the contemporary semiology that stems from the American philosopher Pierce, and also on the work of Francis Jacques in France, we can say that this relation, far from being a simple binary one (sign/referent or sign/signifier) is a complex relation which aligns signs with the objects to which they refer, but also with the people deploying those signs. This latter signifying relation, which is intersubjective and social, was invisible in Saussurean semiology. In itself, the symbolic is the product of a complex relation which links people among themselves and the things referred to by the agency of signs. In other words, the basis of the signifying relationship is not the dyad subject/object (relation to objects) but a triadic relation, subject/ subject/object (intersubjective and objectai). Most modern museums would like to become incarnations of a city's greatness, but this greatness is hard to hold or to articulate beyond slogans and shopping districts: it is fleeting, untrustworthy, and rarely sensed by any but a lucky few. The trustees of museums and others in charge of the capital campaign do not respond to that uncertainty with humility but with its opposite: the modern museum aims to be undeniable, doubtless. The hope appears to be that, once built, the museum will show how the city overcame itself to be magnificent and, hopefully, magnanimous—the best aspect of the city preserved, Dorian Gray–like, by the semipermanence of architecture, crystallized dreams transcending social and economic problems.These museums seem, in scale and sacrifice, almost pyramidal. The variety of fictional systems of"reality" can be understood, I diink, as an aspect ofthe phenomenon of style in literary imagination.2 But styles of imagination or of vision, and die style of literary works, are more than simply kinds of fictional worlds. To (...) put in some perspective my attempt at classification of literary works according to their systems of reality, I will make first a few remarks on the notion of style. It is a well-known preliminary problem when speaking of style diat this word seems to have more than one meaning in ordinary usage. I think that some ofits current meanings are rich and important, and that literary knowledge would profit if we could reconstruct them in abstract and defined concepts, so that the notions involved were somewhat clarified. I doubt diat diis is possible with current conceptual tools. We can see what is meant, say, when we hear diat a certain person we know "has style"; and we certainly distinguish diis attribute from others such as elegance, good manners, character, taste, originality, mannerisms, or idiosyncracies. Thus, we occasionally perceive in personal behavior a phenomenon called style. A conceptual description or a satisfactory definition of such a given, however, seems very difficult. Speaking of matters of art and literature, "style" has been used, among other things, to designate both the conventional forms of traditional expression (as in "manuals of style") and the anomalous, convention-breaking forms of highly individuated creation (as in die classic conception of Vosslerian-Spitzerian Stylistics, or in Buffon's "Le style c'est l'homme même," as usually understood). Style, dien, as conformity and style as singularity and deviance; style as impersonal decorum and as presence of a unique personal essence in the work. This perplexing ambiguity may be reducible though. Whether conventional and common or personal and innovative, style appears to be a form that characterizes and holds together a creation or a phenomenal entity. Indeed, the fact that 182 Félix Martínez-Bonati183 singular innovations of style often become the common trait of a school or current and sometimes a part of general tradition seems to indicate that neither singularity nor general acceptance are the most basic elements of die notion of style. On first reflection, we may conceive of style as a formal principle that consistently determines the constitution of die pertinent objects. Nonetíieless, constitutive form is too weak a definition for style, since it would also apply to what is called "technique" and even to genre. We must look for a more specific determination. There is anodier ambiguity in everyday uses of die word "style" diat deserves attention. We speak often of "good style" and "bad style." But sometimes we speak as if no style is bad and the thing that matters is to have style at all and as much of it as possible. Thus, we condemn a work because of its having no style or only a weak one. This contradiction probably derives from the confusion of a particular normative, a general normative, and a merely descriptive notion of style. We should keep, if possible, to a merely descriptive notion. Still another uncertainty of usage, in literary matters, relates to the (not universally accepted) restriction of the notion of style to a linguistic one; style, in this restricted usage, is seen as primarily an attribute of diction. The most numerous of literary studies of die style of singular works have been, so far as I can see, descriptions of idiolects. In many cases, the linguistic peculiarity is taken as an index of the world-view or die style of imagination diat is supposed to have produced the work. Alternative to this approach, indeed complementary, is the study of literary style as an attribute of die fictional entities to which literary discourse refers. We find the latter kind of approach mostly in characterizations of genres or of periods ("the naturalist novel," "romance," "classicism," etc.). In later (...) works, Vattimo insisted on the epistemological virtues of mimetic theory to reform the classical theory of adequacy2 and the theological implications of this reform.3 Mimetic theory definitely unmasks the violence of the "strong metaphysic," to enable the advent of a weak metaphysics and a kenotic theology based on love: "According to him, it is the survival of the victim-based mechanism, albeit in attenuated form, that explains the recurrence of violence in the history of Christianity. To complete Girard's argument, we learn from Heidegger that what Girard calls the victim-based mechanism is metaphysical objectivism."4 The Erlebnis (non-conceptualized experience) of this theological weakening [End Page 147] has occurred as an event from a previous epistemological weakening, which mimetic theory itself contributes to consolidating.5This drift toward the epistemological nihilism generated a debate between Gianni Vattimo and René Girard, who rejected this conclusion drawn from his mimetic theory.6 The transcript of this controversy first appeared in Verità o fede debole? Dialogo su cristianesimo e relativismo (2006) [Christianity, Truth, and Weakening Faith (2011)], a compilation of three dialogues on three fundamental concepts: truth, secularization, and relativism. In the first part, focused on the epistemological question of truth, Girard affirms he isn't accurately recognized in Vattimo´s thought, showing his distance and warning that, unlike the Italian thinker, his thinking is primarily realistic: "Personally, I agree with Vattimo when he says that Christianity is a revelation of love, but I do not exclude that it is also a revelation of truth. Because truth and love coincide and are one in Christianity."7 In the same chapter, Vattimo challenges René Girard for not having extracted the ultimate consequences of his mimetic theory, because he stays trapped in the realistic ontology of a pre-mimetic mentality: [Vattimo:] "In sum, the only thing I really can't go along with in Girard is his faith in the salvific power of truth, whether it be revealed or discovered by science."8However, in the controversy René Girard could not fail to recognize the central thesis of Gianni Vattimo, according to which his work involved a critique of the classical interpretation of judgment: "I think that there is some kind of incompatibility between traditional philosophy and mimetic theory. I feel, for instance, that scholars influenced by Thomism are handicapped in regard to mimetic theory, because they have to work with neatly distinguished categories. Philosophy is looking for logical foundation as well. It is difficult for philosophers to accept a mechanism that triggers opposite effects. Therefore, it always excludes the real anthropological foundation."9 René Girard acknowledges that in his eagerness to keep up the anthropo-genesis, he cannot avoid judging the theory of judgment from the mimetic theory.10 This critique appears since the beginning of his investigation in Things Hidden since the Foundation of the World, when Girard distinguishes between Heraclitus's logos and the logos of John's gospel.11 In Violence and the Sacred he proceeded to investigate the historical origins of both forms of logos and discovered that a hidden reality underlay the evidence of the canonical judicative structure, using the resources of Derridean deconstruction, of which Girard acknowledges his debt.12René Girard's relationship with philosophy is problematic. Mimetic theory criticizes all human cultural constructions, including mythology and philosophy. However, in The Scapegoat René Girard approaches the issue of "judgment" as a place of truth.
