Justice, equality, and righteousness—these are some of our greatest moral convictions. Yet in times of social conflict, morals can become rigid, making religious war, ethnic cleansing, and political purges possible. Morality, therefore, can be viewed as pathology-a rhetorical, psychological, and social tool that is used and abused as a weapon. An expert on Eastern philosophies and social systems theory, Hans-Georg Moeller questions the perceived goodness of morality and those who claim morality is inherently positive. Critiquing the ethical "fanaticism" (...) of Western moralists, such as Immanuel Kant, Lawrence Kohlberg, John Rawls, and the utilitarians, Moeller points to the absurd fundamentalisms and impracticable prescriptions arising from definitions of good. Instead he advances a theory of "moral foolishness," or moral asceticism, extracted from the "amoral" philosophers of East Asia and such thinkers as Ludwig Wittgenstein and Niklas Luhmann. The moral fool doesn't understand why ethics are necessarily good, and he isn't convinced that the moral perspective is always positive. In this way he is like most people, and Moeller defends this foolishness against ethical pathologies that support the death penalty, just wars, and even Jerry Springer's crude moral theater. Comparing and contrasting the religious philosophies of Christianity, Daoism, and Zen Buddhism, Moeller presents a persuasive argument in favor of amorality. (shrink)

A wide-ranging collection of philosophical essays in honor of Hans-Georg Gadamer.

We publish here the letters between Gadamer and Ricoeur, as they are found in the Archives of the two philosophers (Gadamer-Archiv in Marbach and Fonds Ricoeur in Paris). Starting from February 1964 and ending on October 2000, the thirty-five letters reproduced here cannot give a complete picture of their much richer correspondence and relations, because it seems that neither Ricoeur, nor Gadamer kept all the letters they received from one another. But altogether, they document their common concerns, their mutual respect, (...) even their intellectual solidarity and finally the particular context that brought them to write to one another, i.e. Ricoeur’s intention to publish a translation of Gadamer’s book, Truth and Method, in a new series he edited for the Seuil Publisher. Having already celebrated his 100th birthday at the time of this lecture, Gadamer speaks of his own experience with polio and the pains of old age, and the influence that his friend and physician, Paul Vogler, had on his approach to the treatment of pain. ZusammenfassungDer Internistenkongress von 1949 war Anlass und Arena einer breit wahrgenommenen Kontroverse zu epistemologischen Fragen der Psychosomatischen Medizin. Der Beitrag verortet zunächst den Kongress in der Nachkriegsgeschichte und zeichnet die Verlaufslinien der Debatte nach. Dabei werden sowohl die Positionen der Sprecher der Psychosomatischen Medizin – Viktor von Weizsäcker und Alexander Mitscherlich – als auch diejenige von Paul Martini, der auf Basis seiner Methodologie klinischer Forschung grundsätzliche Kritik äußerte, rekonstruiert. In einem zweiten Schritt werden die jeweils unterschiedlichen Auffassungen von Kausalität, Evidenz (...) und Subjektivität herausgearbeitet und kontextualisiert. Das Hauptaugenmerk liegt hierbei auf dem konkreten und expliziten Gebrauch dieser Begriffe bei Martini. Schließlich zeige ich, dass diese Ereignisse im Jahr 1949 als Kulmination einer fortdauernden Kontroverse über wissenschaftliche Evidenz in der klinischen Medizin gelesen werden können, die sich mit ihren Beteiligten und Bezugsebenen über mehrere Jahrzehnte erstreckte. Plato's Dialectical Ethics, Gadamer's earliest work, has now been translated into English for the first time. This classic book, published in 1931 and reprinted in 1967 and 1982, is still important today. It is one of the most extensive and imaginative interpretations of Plato's Philebus and an ideal introduction to Gadamer's thinking. It shows how his influential hermeneutics emerged from the application of his teacher Martin Heidegger's phenomenological method to classical texts and problems. The work consists of two chapters. The (...) first, which puts Socratic/Platonic dialectics and ethics in the context of Gadamer's thinking about how we come to shared understanding through conversation, helps to clarify the intentions and trajectory of all Gadamer's subsequent work. The second chapter, on the Philebus, will interest everyone who is concerned with the connection between Plato's discussions of ethics and those of Aristotle, and with the substantive issues of the relation between pleasure and reason that Plato explores and Gadamer interprets. The narrative of the Death of Emperor Hundun 混沌, who finally perishes from the seventh hole that his two fellow Emperors have drilled into his formless body to do him the favor of supplying him with a face, famously concludes the seven Inner Chapters of the Zhuangzi 莊子.1 Perhaps the sudden demise of the story’s protagonist is meant to signal paradoxically to the reader that he or she, too, has, unwittingly, now come to an end and reached a stage of (...) no return. With the completion of the seventh chapter, seven deep holes have been drilled into one’s head and have transformed one irredeemably. “Marx na Universidade!” Esta palavra de ordem sinalizou as reivindicações do Movimento Estudantil, que agitou as universidades alemãs há mais do que cinco décadas, refletindo sobre a missão político-social da formação universitária. O fato de, naquele tempo, a indicação de uma aula sobre a teoria de Karl Marx ter sido sacrificada pela censura dos órgãos políticos da universidade tornou-se incompreensível em nossos dias.[1] Pelo contrário, depois da preocupação intensa com a teoria marxiana nas décadas passadas, o interesse nela parece ter (...) diminuído rapidamente. Acho que foram sobretudo duas razões que levaram a esse processo. Em primeiro lugar, a crítica da economia política foi aceita como teoria científica, tendo enfraquecido assim seu potencial crítico em relação ao desenvolvimento real das sociedades cunhadas pelo capitalismo tardio. Ela tornou-se apenas uma base entre outras na compreensão científica da realidade social.[2] Além disso, a teoria, ela mesma, contém traços objetivistas ao apresentar a análise das estruturas materiais e econômicas, fazendo desaparecer o sujeito humano — fato este, que levou a teoria a aproximar-se aparentemente aos dogmas positivistas da moderna ciência. A teoria de Marx correria, por isso, o risco de mover-se na vizinhança do positivismo científico sacrificando seu impulso emancipatório. Como pôde essa perversão surgir na recepção dessa teoria? Por que esta teoria tão ambiciosa perdeu seu potencial político, deixando-se incluir no pluralismo das teorias científicas? Achando que a teoria de Marx em si mesma não foi inocente quanto a esse processo ou, ao menos, a esse risco, não quero dizer que tivesse refletido de modo insuficiente sobre a emancipação humana. Muito pelo contrário, provarei que a história de sua recepção, assim como a construção teórica da crítica da economia política dão razões significativas para obrigar seu autor a destematizar os sujeitos humanos e, por isso mesmo, chamar a atenção a esse sujeito desaparecido. Em dois passos, explicarei a seguir as razões fundamentadoras dessa tese à primeira vista paradoxal. Na primeira parte da argumentação examinarei o desenvolvimento da teoria de Marx, que se lê como processo de abandono do discurso sobre o sujeito humano, ao passo que na segunda localizarei o destino dos sujeitos e da perspectiva emancipatória, provocados pelas razões internas dessa teoria. Finalmente, incluirei alguns pontos caraterísticos de uma subjetividade humana não dominada pela alienação vigente nas nossas sociedades capitalistas, extraindo assim uma perspectiva produtiva da argumentação anterior. Die Sorgen, die der Tod bereitet, sind nicht allein mehr oder weniger universal oder existentiell, sie sind auch unauflösbar: Mit dem Tod wird man nicht fertig, bis er kommt. Und auch dann wird der Tod bekanntlich eher fertig mit uns als wir mit ihm. Keiner Philosophie oder Religion oder Kunst ist (...) es "endgültig " gelungen ,,durch die Auseinandersetzung mit dem Tod die Besorgnis ihm gegenüber auszulöschen. Dementsprechend versucht der vorliegende Band keinesfalls Antworten - und schon gar nicht "die" Antwort - auf die Fragen des Todes zu geben. Er führt vielmehr eine Reihe von Standpunkten, Einstellungen oder Vorstellungen zum bzw. vom Tode vor und wird für keine(n) Leser(in) das Todesproblem lösen können. Er kann nur an einem eindrucksvollen und tatsächlich jedem(r) nahegehenden Beispiel zeigen, wie man sinnvoll über etwas sprechen, schreiben und denken kann, ohne dabei darüber wirklich schlauer werden zu können. Ein solches Ergebnis ist nun keinesfalls entmutigend, es ist vielmehr eine Einsicht, bei der sich ansonsten so unterschiedliche Denkweisen wie der altchinesische Daoismus und Konfuzianismus einerseits und eine nachkantianische Philosophie des Zeichens andererseits treffen. This paper discusses the meaning of the concept of ‘second-order observation’ used by Niklas Luhmann (1927–1998). Luhmann identifies second-order observation as a defining characteristic of modern world society. According to Luhmann, all social systems construct a social reality on the basis of the observation of observations. Rating agencies in the economy or the peer-review process in the academic system are examples of social mechanisms manifesting second-order observation. Social media also represent organized second-order observation. The paper suggests that in a society (...) based on second-order observation, ‘genuine pretending’ is an adequate mode of existence. This notion is derived from the Daoist text Zhuangzi. It indicates a disassociation from social roles which allows their performers to exercise these roles with ease and, at the same time, maintain a state of sanity. (shrink)

Innovative techniques of developmental biology facilitate the artificial creation of embryo-like entities. This contribution analyses, first, whether certain artificially created embryo-like entities are ‘embryos’ within the meaning of existing statutory law definitions laid down in the Embryo Protection Act, the Stem Cell Act and the Patent Act. These definitions are non-uniform and their interpretation and application with regard to artificially created embryo-like entities is not always conclusive. Accordingly, the legal definitions of the term ‘embryo’ should be harmonised and, thereby, adapted (...) to the state of developmental biology. Any such legislative efforts need to be in conformity with the constitution, primarily with the guarantee of human dignity (Article 1(1) of the Basic Law). However, said provision cannot provide guidance to the legislature because the constitutional status of both embryos and embryo-like entities in vitro is highly disputed. It is held that this irresolvable debate is due to a fundamental lack of a widely shared experience that such entities possess a supreme unique value. This article argues that in such a situation it is, in the first instance, for the legislature (i. e. parliament) to determine the legal status of embryos and embryo-like entities in vitro. This argument is based on a particular doctrinal approach according to which the individual right to respect of one’s human dignity arising from Article 1(1) BL depends on recognition of the relevant entity as being a ‘human’ or a member of ‘humankind’ respectively. Such recognition has, hitherto, not been accomplished with a view to embryos and embryo-like entities in vitro. Against this backdrop, for the time being, the legislature may determine the legal status of embryos and embryo-like entities in vitro, lay down rules regarding their creation and particular use, and, especially, define the legal term ‘embryo’, albeit within some outer constitutional limits. The article, finally, analyses several elements of, and submits a proposal for, a new legal definition of the term ‘embryo’. (shrink)
