Donald Davidson has shocked his readers by arguing that assertion is not a conventional activity, thus attacking what was taken to be a truism by most philosophers of language. The paper claims that Davidson's argument is seriously flawed by his failure to distinguish a number of questions which should be kept separate. Assertion is a matter of seriousness, not of sincerity; departures from seriousness are marked by techniques which are undeniably conventional. There are no parallel indicators of seriousness, i. e. But this necessary absence of a conventional marker of seriousness from our communicative repertoire does not imply that the activity of asserting is not conventional. This book constitutes the outcome of an international conference held at the Otto-Mobes-Volkswirtschaftsschule, Graz-Stifting( Austria), from June 16 to 22, 1974. The conference was initiated by a project group working on determinants and controls of social science development at the In stitute for Advanced Studies and Scientific Research in Vienna and or ganized by the editors of this volume. It was held under the auspices of the Austrian Ministry of Science and Research. The main topics of the conference were those (...) at the forefront of the 'state of argumentation' (to borrow from one of our contributors) in philosophy and sociology of science ever since the controversy between Thomas S. Kuhn and Sir Karl R. Popper has sharpened our awareness for the methodological and substantial presuppositions involved with questions of growth and development in science. Let us give two examples of those topics. The borderline between sociology of science and philo sophy of science has become more and more unclear; while the work of at least some philosophers of science comes to have an empirical flavour, sociologists of science are increasingly apt to include logical and methodo logical components of the research process as their objects of examina tion. A wide-ranging collection of philosophical essays in honor of Hans-Georg Gadamer.

We publish here the letters between Gadamer and Ricoeur, as they are found in the Archives of the two philosophers (Gadamer-Archiv in Marbach and Fonds Ricoeur in Paris). Starting from February 1964 and ending on October 2000, the thirty-five letters reproduced here cannot give a complete picture of their much richer correspondence and relations, because it seems that neither Ricoeur, nor Gadamer kept all the letters they received from one another. But altogether, they document their common concerns, their mutual respect, (...) even their intellectual solidarity and finally the particular context that brought them to write to one another, i.e. Ricoeur’s intention to publish a translation of Gadamer’s book, Truth and Method, in a new series he edited for the Seuil Publisher. For centuries, the ancient Chinese philosophical text the _Daodejing (Tao Te Ching)_ has fascinated and frustrated its readers. While it offers a wealth of rich philosophical insights concerning the cultivation of one's body and attaining one's proper place within nature and the cosmos, its teachings and structure can be enigmatic and obscure. Hans-Georg Moeller presents a clear and coherent description and analysis of this vaguely understood Chinese classic. The plan for this volume emerged during the international Leipzig conference commemorating the centenary of the death of Gustav Fechner.

Niklas Luhmann (1927-1998) was a German sociologist and system theorist who wrote on law, economics, politics, art, religion, ecology, mass media, and love. Luhmann advocated a radical constructivism and antihumanism, or "grand theory," to explain society within a universal theoretical framework. Nevertheless, despite being an iconoclast, Luhmann is viewed as a political conservative. Hans-Georg Moeller challenges this legacy, repositioning Luhmann as an explosive thinker critical of Western humanism. Moeller focuses on Luhmann's shift from philosophy to theory, which introduced (...) new perspectives on the contemporary world. For centuries, the task of philosophy meant transforming contingency into necessity, in the sense that philosophy enabled an understanding of the necessity of everything that appeared contingent. Luhmann pursued the opposite--the transformation of necessity into contingency. Boldly breaking with the heritage of Western thought, Luhmann denied the central role of humans in social theory, particularly the possibility of autonomous agency. In this way, after Copernicus's cosmological, Darwin's biological, and Freud's psychological deconstructions of anthropocentrism, he added a sociological "fourth insult" to human vanity. A theoretical shift toward complex system-environment relations helped Luhmann "accidentally" solve one of Western philosophy's primary problems: mind-body dualism. By pulling communication into the mix, Luhmann rendered the Platonic dualist heritage obsolete. Moeller's clarity opens such formulations to general understanding and directly relates Luhmannian theory to contemporary social issues. He also captures for the first time a Luhmannian attitude toward society and life, defined through the cultivation of modesty, irony, and equanimity. (shrink)

In The Beginning of Philosophy Gadamer explores the layers of interpretation and misinterpretation that have built up over 2500 years of Presocratic scholarship. Using Plato and Aristotle as his starting point his analysis moves effortlessly from Simplicius and Diogenes Laertius to the 19th-century German historicists right through to Hegel, Nietzsche and Heidegger. Gadamer shows us how some of the earliest philosophical concepts such as truth, equality, nature, spirit and being came to be and how our understanding of them today is (...) deeply indebted to Presocratic thinkers. The book is based on a series of lectures delivered by Gadamer in 1967 which were then translated into English and edited by Gadamer for this collection. Justice, equality, and righteousness—these are some of our greatest moral convictions. Yet in times of social conflict, morals can become rigid, making religious war, ethnic cleansing, and political purges possible. Morality, therefore, can be viewed as pathology-a rhetorical, psychological, and social tool that is used and abused as a weapon. An expert on Eastern philosophies and social systems theory, Hans-Georg Moeller questions the perceived goodness of morality and those who claim morality is inherently positive. Critiquing the ethical "fanaticism" (...) of Western moralists, such as Immanuel Kant, Lawrence Kohlberg, John Rawls, and the utilitarians, Moeller points to the absurd fundamentalisms and impracticable prescriptions arising from definitions of good. Instead he advances a theory of "moral foolishness," or moral asceticism, extracted from the "amoral" philosophers of East Asia and such thinkers as Ludwig Wittgenstein and Niklas Luhmann. The moral fool doesn't understand why ethics are necessarily good, and he isn't convinced that the moral perspective is always positive. In this way he is like most people, and Moeller defends this foolishness against ethical pathologies that support the death penalty, just wars, and even Jerry Springer's crude moral theater. Comparing and contrasting the religious philosophies of Christianity, Daoism, and Zen Buddhism, Moeller presents a persuasive argument in favor of amorality. (shrink)

Hans-Georg Gadamer, the major proponent of philosophical hermeneutics, reveals himself here as a highly sensitive reader and critic of the German literary tradition. This is not the work of a specialist as narrowly defined in the typical literary study. Although he is a master of the techniques of criticism, Gadamer always sees the study of literature as a fundamentally human activity where human beings, generation after generation, pose their questions to an encroaching darkness that threatens to rob them (...) of their confidence in the meaning of life and death. Never pedantic or antiquarian, these studies show such literary giants of the German past as Goethe and Hölderlin as our contemporaries. Gadamer demonstrates his ability to achieve the creative interplay of literature and philosophy which, in isolation, easily degenerate into sterile academic games. Typical of this dialogue are essays on Rainer Maria Rilke, including an examination of a problem of punctuation in one of his poems. What would be, in less capable hands, one more solution to a literary problem, turns out to be one of Gadamer's creative approaches to the mystery of man's relation to time and death. (shrink)

Hans-Georg Gadamer is considered to have made the most important contribution to hermeneutics of this century through his major work, Truth and Method. Born in Marburg on February 11, 1900, he earned his doctorate under Paul Natorp, the Plato scholar, in 1922 and completed his habilitation thesis on Plato's dialectical ethics under Martin Heidegger in 1928. He spent the major portion of his teaching career at the University of Heidelberg, becoming emeritus professor in 1968. In retirement he became (...) widely known in the United States through his regular fall courses at Boston college and his numerous lectures at major universities throughout the century. (shrink)

"All men by nature desire to know"-this is the famous first sentence of Aristotle's Metaphysics. It is interesting to note how knowledge, at least since Aristotle, could be understood as a desire, as a mental craving, so to speak. When understood as a desire, knowledge necessarily goes along with a certain absence, a lack. Those who crave for knowledge are not yet fully in its possession, they are still on the search.

Wang Bo’s Zhuangzi: Thinking Through the Inner Chapters is the first title of a new book series on “Contemporary Chinese Scholarship in Daoist Studies” by Three Pines Press, an independent U.S. publisher of academic literature on Daoism and scholarly translations of Daoist texts. It is also part of a larger current wave of translations of contemporary philosophical works by Chinese authors into English. In this new development, as in the case of Wang’s book, a publication is often sponsored by private (...) donations and/or public institutions and organizations from China, and I believe it should be welcomed wholeheartedly. This volume makes available for the first time in English the most important of Hans-Georg Gadamer's extensive writings on art and literature. The principal text included is 'The Relevance of the Beautiful', Gadamer's most sustained treatment of philosophical aesthetics. The eleven other essays focus particularly on the challenge issued by modern painting and literature to our customary ideas of art, and use that challenge to revitalize our understanding of it. Gadamer demonstrates the continuing importance of such concepts as (...) imitation, truth, symbol, and play for our appreciation of contemporary art, and thereby establishes its continuity with the Western tradition. The essays here are not technical and are readily accessible to the beginning student and the general reader. The collection as a whole serves to illustrate the practice of hermeneutics and to introduce Gadamer's thought. Robert Bernasconi provides an introduction clarifying the central aims of the essays and their relations to Gadamer's major work, Truth and Method, and to the philosophy of art since Kant. Plato's Dialectical Ethics, Gadamer's earliest work, has now been translated into English for the first time. This classic book, published in 1931 and reprinted in 1967 and 1982, is still important today. It is one of the most extensive and imaginative interpretations of Plato's Philebus and an ideal introduction to Gadamer's thinking. It shows how his influential hermeneutics emerged from the application of his teacher Martin Heidegger's phenomenological method to classical texts and problems. The work consists of two chapters. This is seen as one of the few standard works of German post-war philosophy which has achieved worldwide recognition. Innovative techniques of developmental biology facilitate the artificial creation of embryo-like entities. This contribution analyses, first, whether certain artificially created embryo-like entities are ‘embryos’ within the meaning of existing statutory law definitions laid down in the Embryo Protection Act, the Stem Cell Act and the Patent Act. These definitions are non-uniform and their interpretation and application with regard to artificially created embryo-like entities is not always conclusive. Accordingly, the legal definitions of the term ‘embryo’ should be harmonised and, thereby, adapted (...) to the state of developmental biology. Any such legislative efforts need to be in conformity with the constitution, primarily with the guarantee of human dignity (Article 1(1) of the Basic Law). However, said provision cannot provide guidance to the legislature because the constitutional status of both embryos and embryo-like entities in vitro is highly disputed. It is held that this irresolvable debate is due to a fundamental lack of a widely shared experience that such entities possess a supreme unique value. This article argues that in such a situation it is, in the first instance, for the legislature (i. e. parliament) to determine the legal status of embryos and embryo-like entities in vitro. This argument is based on a particular doctrinal approach according to which the individual right to respect of one’s human dignity arising from Article 1(1) BL depends on recognition of the relevant entity as being a ‘human’ or a member of ‘humankind’ respectively. Such recognition has, hitherto, not been accomplished with a view to embryos and embryo-like entities in vitro. Against this backdrop, for the time being, the legislature may determine the legal status of embryos and embryo-like entities in vitro, lay down rules regarding their creation and particular use, and, especially, define the legal term ‘embryo’, albeit within some outer constitutional limits. The article, finally, analyses several elements of, and submits a proposal for, a new legal definition of the term ‘embryo’. (shrink)
