The performance of natural behavior is commonly used as a criterion in the determination of animal welfare. This is still true, despite many authors having demonstrated that it is not a necessary component of welfare –some natural behaviors may decrease welfare, while some unnatural behaviors increase it. Here I analyze why this idea persists, and what effects it may have. I argue that the disagreement underlying this debate on natural behavior is not one about which conditions affect welfare, but a (...) deeper conceptual disagreement about what the state of welfare actually consists of. Those advocating natural behavior typically take a “teleological” view of welfare, in which naturalness is fundamental to welfare, while opponents to the criterion usually take a “subjective” welfare concept, in which welfare consists of the subjective experience of life by the animal. I argue that as natural functioning is neither necessary nor sufficient for understanding welfare, we should move away from the natural behavior criterion to an alternative such as behavioral preferences or enjoyment. This will have effects in the way we understand and measure welfare, and particularly in how we provide for the welfare of animals in a captive setting. (shrink)

The _Analects_ is a compendium of the sayings of Confucius (551-479 b.c.e.), transcribed and passed down by his disciples. How it came to be transformed by Zhu Xi (1130-1200) into one of the most philosophically significant texts in the Confucian tradition is the subject of this book. Scholarly attention in China had long been devoted to the _Analects._ By the time of Zhu Xi, a rich history of commentary had grown up around it. But Zhu, claiming that the _Analects_ was (...) one of the authoritative texts in the canon and should be read before all others, gave it a still more privileged status in the tradition. He spent decades preparing an extended interlinear commentary on it. Sustained by a newer, more elaborate language of metaphysics, Zhu's commentary on the _Analects_ marked a significant shift in the philosophical orientation of Confucianism--a shift that redefined the Confucian tradition for the next eight centuries, not only in China, but in Japan and Korea well. Gardner's translations and analysis of Zhu Xi's commentary on the _Analects_ show one of China's great thinkers in an interesting and complex act of philosophical negotiation. Through an interlinear, line-by-line "dialogue" with Confucius, Zhu effected a reconciliation of the teachings of the Master, commentary by later exegetes, and contemporary philosophical concerns of Song-dynasty scholars. By comparing Zhu's reading of the _Analects_ with the earlier standard reading by He Yan (190-249), Gardner illuminates what is dramatically new in Zhu Xi's interpretation of the _Analects._ A pioneering study of Zhu Xi's reading of the _Analects,_ this book demonstrates how commentary is both informed by a text and informs future readings, and highlights the importance of interlinear commentary as a genre in Chinese philosophy. The present debate over the creation and potential deployment of lethal autonomous weapons, or ‘killer robots’, is garnering more and more attention. Much of the argument revolves around whether such machines would be able to uphold the principle of noncombatant immunity. However, much of the present debate fails to take into consideration the practical realties of contemporary armed conflict, particularly generating military objectives and the adherence to a targeting process. This paper argues that we must look to the targeting process (...) if we are to gain a fuller picture of the consequences of creating or fielding lethal autonomous robots. This paper argues that once we look to how militaries actually create military objectives, and thus identify potential targets, we face an additional problem: the Strategic Robot Problem. The ability to create targeting lists using military doctrine and targeting processes is inherently strategic, and handing this capability over to a machine undermines existing comman.. (shrink)

The problem of justified harm is the problem of explaining why it is permissible to inflict harm for the sake of future benefits in some cases but not in others. In this paper I first motivate the problem by comparing a case in which a lifeguard breaks a swimmer’s arm in order to save her life to a case in which Nazis imprison a man who later grows wiser as a result of the experience. I consider other philosophers’ attempts to (...) explain why the lifeguard’s action was permissible but the Nazis’ action was not. After arguing that principles having to do with consent, expected utility, and the types of harms and benefits at issue do not fully solve the problem, I argue for a causal solution to the problem. The causal solution includes both a causal account of harming and a distinction between causes and mere conditions. It then distinguishes between the lifeguard and Nazi cases with following principle: A harmful action that causes greater benefits can sometimes be justified by those benefits, but a harmful action that does not cause greater benefits cannot be justified by any subsequent benefits that the action, itself, does not cause. Is banning trans fat a bad policy? Resnik (2010) offers two general reasons for thinking so. First, because trans fat bans could lead to the government’s placing other objectionable restrictions upon food choices. Second, that, because we can adequately reduce trans fat consumption through education and mandatory labeling, bans are unnecessary. There are good reasons to reject both claims. First, since any slippery slope towards further restrictions on food choices is easily avoided, trans fat bans do not give the cause (...) for worry that Resnik suggests they do; second, trans fat bans are necessary, in the sense of “necessary” that is relevant to public health policy debates. One of the biggest problems in applications of animal welfare science is our ability to make comparisons between different individuals, particularly different species. Although welfare science provides methods for measuring the welfare of individual animals, there’s no established method for comparing measures between individuals. This problem occurs because of the underdetermination of the conclusions given the data, arising from two sources of variation that we cannot distinguish – variation in the underlying target variable (welfare experience) and in the relationship of (...) measured indicators to the target. In this paper I describe the similarity assumptions that underlie our current applications of interspecies comparisons and examine in which cases they are justified, as well as describing alternative methods we may use when they are not. In the end, all our available options for making interspecies comparisons are imperfect, and we need to make explicit context-specific decisions about which will be best for the task at hand while acknowledging their potential limitations. Future developments in our understanding of the biology of sentience will help strengthen our methods of making welfare comparisons. (shrink)

Students and teachers of Chinese history and philosophy will not want to miss Daniel Gardner's accessible translation of the teachings of Chu Hsi —a luminary of the Confucian tradition who dominated Chinese intellectual life for centuries. Homing in on a primary concern of our own time, Gardner focuses on Chu Hsi's passionate interest in education and its importance to individual development. “The physics of representation” aims to define the word “representation” as used in the neurosciences, argue that such representations as described in neuroscience are related to and usefully illuminated by the representations generated by modern neural networks, and establish that these entities are “representations in good standing”. We suggest that Poldrack succeeds in, exposes some tensions between the broad use of the term in neuroscience and the narrower class of entities that he identifies in the end, and between the meaning (...) of “representation” in neuroscience and in psychology in, and fails in. This results in some hard choices: give up on the broad scope of the term in neuroscience or continue to embrace the broad, psychologically inflected sense of the term, and deny the entities generated by neural nets are representations in the relevant sense. In a recent paper in the Yale Law Journal, Malcolm Thorburn argued that to enjoy a justificatory defence in the criminal law is to have a normative power that is exercised in the circumstances which give rise to the justification. He also argued that where such powers are conferred on private citizens, those citizens should be understood as acting as public officials pro tempore when they exercise them. In this extended reply, I resist both propositions and reply to some of (...) the criticisms that Thorburn makes of my own rival views. I also take the opportunity to explore, philosophically, some of the criminal law relating to consent, self-defence and arrest, and to discuss the connections between the debate over the nature of criminal-law justifications and the debate over the nature of law. We propose that Mealey's model is limited in its description of sociopathy because it does not provide an adequate role for the main organ mediating genes and behavior, namely, the brain. Further, on the basis of our research, we question the view of sociopaths as a homogeneous group.

Xenotransplantation, or the use of animal cells, tissues and organs for humans, has been promoted as an important solution to the worldwide shortage of organs. While scientific studies continue to be done to address problems of rejection and the possibility of animal-to-human virus transfer, socio-ethical and legal questions have also been raised around informed consent, life-long monitoring, animal welfare and animal rights, and appropriate regulatory practices. Many calls have also been made to consult publics before policy decisions are made. This (...) paper describes the Canadian public consultation process on xenotransplantation carried out by the Canadian Public Health Association in an arm’s length process from Health Canada, the ministry overseeing government health policy and regulation. Focusing on six citizen fora conducted around the country patterned after the citizen jury deliberative approach, the paper describes the citizen panelists’ recommendations to hold off on proceeding with clinical trials and the rationales behind this recommendation. The consultation process is discussed in the context of constructive technology assessment, a framework which argues for broader input into earlier stages of technology innovation, particularly at the technology design stage. In attempting to fulfill her duty to protect Sara, Marie ultimately fails morally as a parent. In three parts, this volume in the AP-LS series explores the phenomena of captivity and risk management, guided and informed by the theory, method, and policy of psychological jurisprudence. The authors present a controversial thesis that demonstrates how the forces of captivity and risk management are sustained by several interdependent "conditions of control." For Humeans, many facts—even ones intuitively “about” particular, localized macroscopic parts of the world—turn out to depend on surprisingly global fundamental bases. We investigate some counterintuitive consequences of this picture. Many counterfactuals whose antecedents describe intuitively localized, non-actual states of affairs nevertheless end up involving wide-ranging implications for the global, embedding Humean mosaic. The case of self-undermining chances is a familiar example of this. We examine that example in detail and argue that popular existing strategies such as “holding the laws (...) fixed as laws” or “holding the laws fixed as true” are of no help. Interestingly, we show how a new proposal that draws on the resources of the Mentaculus can yield the right results—but only on the assumption that the Humean can make cross-world identifications. We go on to argue that the Humean cannot make such identifications. We conclude that the root of this trouble is deeper, and its reach broader, than the familiar cases suggest. We think it is very much an open question whether the Humean has sufficient resources to properly conceptualize macroscopic objects or to analyze these “local” counterfactuals. (shrink)

This paper examines how the exercises offered to the young Socrates in the Parmenides can be understood as an educational practice, or a gymnastic that is prior to and instrumental for defining forms. To this end, I argue that the subject of the exercises given to Socrates can be understood as an open and indeterminate ‘one’, rather than a form per se. I show that the description of the gymnastic exercises, the demonstration of the hypotheses themselves, and the language concerning (...) the ‘one’, are consistent with an indeterminate subject ‘one’. In lieu of hand-waving, let us begin our treatment of psychological research on metaphor by considering some common interests shared by psychologists, on the one hand, and by philosophically oriented humanists, on the other. At least four areas have proved sufficiently central to both groups to merit extensive discussion in the respective literatures. At first issue centers on the specificity of the processes involved in metaphor: Is metaphoric skill a capacity especially intertwined with linguistic skills, or is it a much (...) broader human capacity, one identified with general perceptual and conceptual processes? A related question has arisen within the area of language: Is metaphor a special kind of trope, with its own rules, properties, and applications, or should it be closely allied with such other tropes as similes, analogies, or hyperbole? The third issue moves yet further within the circle of metaphor to treat the question of whether all metaphors are of a piece, or whether various types of metaphor each require their own analysis. And a final issue of concern to both groups is the question of whether metaphoric usage or by considering its pragmatic aspects—the various speech acts employed within a community.1 One could go on to state other issues, but this tetrad should suffice to indicate the common body of concern addressed by experimental and humanistic researchers. · 1. In this paper I consider whether psychological unity can moderate moral status. I first explicate a hybrid view on which non-person animals have a utilitarian moral status and persons have a deontological moral status. I then discuss Jeff McMahan's (2002) concept of psychological unity, and I motivate the view that differences in psychological unity might affect the strength of our reasons against harming different individuals.
