This study examines how individual members of the public make moral sense of the potentially conflicting “economic problem” or “public health problem” representations of the COVID-19 crisis when judging responsible business behavior. The data are based on a qualitative survey involving a thought experiment with 119 participants in the United States conducted at the initial stage of the pandemic. This article proposes a typology matrix using the theories of cognitive polyphasia and cognitive dissonance to understand better individual moral sensemaking of (...) responsible business behavior in the context of a societal paradox in which there are contradictory and interdependent demands between important social objectives. The typology, referred to as the 4R Model of Moral Sensemaking of Competing Social Problems, provides insights for how companies may be perceived when responding to competing social problems, expanding the micro-CSR (corporate social responsibility) and paradox literatures. With the rise of globalization, the debate around free trade versus fair trade and liberalism versus protectionism has become increasingly complicated. At times, the regulations of the World Trade Organization seem to pit developed markets against emerging markets as governments attempt to expand international trade while at the same time protecting local industry. To this end, antidumping measures have been extensively developed as a way to block foreign low-cost goods from entering domestic markets. In response, some exporters have begun to (...) circumvent these antidumping measures using strategies such as transhipment, assembly operations, and slightly modified products. While previous studies have addressed the ethical aspects of antidumping measures, this study will focus on the ethics of circumvention strategies with a special focus on the theories on legal compliance and, specifically, civil disobedience and conscientious evasion. For the past fifty years anxiety over naturalism has driven debates in social theory. One side sees social science as another kind of natural science, while the other rejects the possibility of objective and explanatory knowledge. _Interpretation and Social Knowledge_ suggests a different route, offering a way forward for an antinaturalist sociology that overcomes the opposition between interpretation and explanation and uses theory to build concrete, historically specific causal explanations of social phenomena.

In discussions surrounding epistemology and rationality, it is often useful to assume an agent is rational or ideally rational. Often, this ideal rationality assumption is spelled out along the following lines: -/- 1. The agent believes everything about a situation which the evidence entitles her to believe and nothing which it does not. -/- 2. The agent believes all the logical consequences of any of her beliefs. -/- 3. The agent knows her own mind: if she believes P, she believes (...) that she believes P; and if she doesn't believe P, she believes that she doesn't believe P. -/- 4. The agent believes nothing of the form 'P and it is not the case that P.' -/- 5. If an agent's background belief-set satisfies 1-4 and if rationality requires the agent to add P to her belief-set, then the resulting belief-set will also satisfy 1-4. -/- While individually plausible, there are cases in which holding on to 1-5 generates paradox. Some resolve such paradoxical cases by granting 1-5 but arguing while ideally rational agents can exist, they can't possibly ever find themselves in such a situation: such case descriptions are epistemically incoherent. Others allow that rational agents can coherently find themselves in such odd circumstances, and argue that it's more reasonable to weaken our concept of ideal rationality and give up premise (2) above. However, this strategy has also been rejected. My aim in this paper is to defend the utility of positing an ideally rational agent in such paradoxical circumstances. I argue in such cases we should give up (2), in particular the assumption that (necessarily) if an ideally rational agent believes both P and the conditional, if P then Q, then she believes Q.. What's important is to hold on to the goal of positing ideal rationality: to maximize the amount of true or probably true information a thinker can justifiably believe in a given circumstance. Normally that will mean holding on to (2), but these unusual paradoxical cases are best handled by giving up (2). (shrink)

In this article I argue that vanity, the desire for and delight in the favorable opinion of others, plays a fundamental role in Hume's account of moral motivation. Hume says that vanity and virtue are inseparable, though he does not explicitly say how or why this should be. I argue that Hume's account of sympathy can explain this alliance. In resting moral sentiment on sympathy, Hume gives a fundamental role to vanity as it becomes either a mediating motive to virtue (...) or else strengthens the otherwise weak motive of moral sentiment. In this paper, I investigate Aristotle’s claim in 'Nicomachean Ethics' III.1 about situations that “overstrain human nature.” By setting out and answering several interpretative questions about such situations, I offer a comprehensive interpretation of this passage. I argue that in (at least some of) these cases, the agent voluntarily does something wrong, even though there is a right action available. Furthermore, I argue that Aristotle would think it is possible for a rare agent to perform the right action in (at (...) least some of) these cases, overcoming the limitations of human nature by identifying with the divine part of the soul. At the end of the 19th century, the vocabulary of sexuality - perversion - became one of the primary means by which people began to articulate and think about their individuality, their sense of self. Joining authors like Ian Hacking and Arnold Davidson, I suggest the importance of a ‘style of reasoning’ to the creation of sexual kinds at the end of the 19th century, a kind of reasoning that might be styled as historical. For the invert to become possible (...) as a human kind, the conceptual space for an understanding of inverts as specific kinds needed to be cleared. In France, this was accomplished by conceiving individuals as elaborated historically, as the product of prior generations, and by differentiating them from other kinds of people via notions of heredity and degeneration. The invert was plotted within the meta-récit of French progress (and national degeneration). This logic of ‘historicization’ also entailed the scrutiny of the patient’s past in order to reveal his or her ‘nature’ as pathological. Understanding the conceptualization of inversion as including, in part, a ‘pursuit of memory’ provides a window onto the vexing question of how people come to take up their classifications; that is, how discourses interact with the subjects they purport to describe. Through the ‘pursuit of memory’, persons were encouraged to (re)describe their pasts in terms of the present diagnosis. An essential attribute of the literature on ‘inversion’ was precisely such an historically formed understanding of pathological individuals; an understanding that ushered in the transformation from acts to natures, from individuals to kinds, from sodomites to homosexuals. Wild horses are becoming dependent on transitional environments between domesticity and wildness. In Dutch new nature areas they are learning to perform roles as ecological surrogates for their extinct ancestors. In the U.S. wild horses are 'feral' and exist in numbers deemed to be in excess of the carrying capacity of semi-arid public range lands. The federal government is removing and relocating thousands to long-term holding pastures. The capabilities approach of Nussbaum (2006) allows us to evaluate this transitional environment against (...) a threshold of opportunities to exercise capabilities judged to be central to their flourishing as wild horses. One finds in the systems of natural languages some explicit means of elaborating not only upon the directness of the causal relationship believed to exist between two events X and Y (i.e. some means of specifying just how inevitably event X gives or gave rise to event Y), but also some manner of indicating just who or what is understood to be the primary instigator of the caused event. This paper attempts to give a complete and coherent account of how Hume’s moral psychology can explain the cultivation of moral character. I argue that the outcome of a fully formed moral character is an agent who strengthens her calm moral sentiments into settled principles of action. I then take up the question of how the process of strengthening moral sentiments might occur, rejecting the possibilities of sympathy, “reflection,” and “resolution” because either they are too weak or else they make (...) the passion violent, preventing the essential calm nature of moral sentiments. I next argue that custom and the non-moral motives of pride and the love of fame play the critical roles in character formation. Custom can be considered as both the process of education, whereby certain impressions are habitually and formally inculcated into us by educators, and the process of experience in society and conversation, whereby we learn to associate pleasure with the virtues and pain with the vices. In both these processes, Hume implicitly appeals to certain non-moral motives, especially pride and the love of fame, in order to launch the effects of custom. (shrink)

Hume says that sympathy is the source of our moral feeling of approval for useful qualities. But does Hume give the same psychological explanation of our approval of immediately agreeable qualities as he does to our approval of useful qualities? Does he trace our moral approbation of immediately agreeable qualities to sympathy? Some commentators, including Rachel Cohon and Don Garrett, argue that he does not. Let us call this view the ‘narrow view’ of sympathy in contrast to the ‘wide view’ (...) of sympathy, which holds that sympathy is required for every moral sentiment. There is indeed some apparent textual evidence in Hume’s work that seems to support the narrow view. My aim in this paper is to examine that evidence and show how it is merely apparent, in particular by showing how a number of passages can be and are misread. I thus want to argue indirectly for the wide view. (shrink)

One year ago I entitled my review of Japanese elections . Candidates running against the establishment were defeating candidates who had until recently appeared unbeatable. Most notably, outsider candidates were defeating ainori (supported by all major parties) candidates in gubernatorial elections. A prime example of an outsider candidate defeating the establishment was Prime Minister Koizumi, who defeated the LDP establishment to win the leadership of the LDP. Koizumi's election and subsequent popularity appears to have dampened the trend. Most notably, a (...) well-qualified challenger failed to unseat the incumbent in the Shizuoka gubernatorial election. Once Koizumi's popularity faded, however, the trend in favour of outsiders reappeared. Given an attractive alternative, establishment candidates continue to find themselves in trouble. The clearest recent example comes from the Yokohama mayoral election. (shrink)

Much can be gained by specifying the operation of the emulation process. A brief review of studies from diverse domains, including complex motor-skill representation, emotion perception, and face memory, highlights that emulation theory offers precise explanations of results and novel predictions. However, the neural instantiation of the emulation process requires development to move the theory from armchair to laboratory.

This case recounts the founding of HealthSouth Rehabilitation, its rapid growth, financial mishandlings and the struggle former CFO Aaron Beam had in dealing with a conscience that kept him awake at night. Beam had met HealthSouth founder Richard Scrushy when applying for a job with Lifemark Hospital Corporation in Texas in 1980. After Lifemark was bought by AMI in 1983, Scrushy invited Beam to join him in the launching of his new company in Birmingham, Alabama. The uniqueness of the hospital (...) was that it would provide inpatient surgery for those who had suffered an injury, but it would also provide outpatient services such as rehabilitation, nutrition guidance and psychological counseling. This type of structure was appealing to insurance companies because it would move the patient out of the hospital much quicker and save the cost of extended hospitalization. The company experienced rapid growth and went public within three years of launch. By 1996, the top executives of the company realized that they would not be able to meet Wall Street analysts’ forecasts which would affect the price of their stock and reduce their holdings. They decided to “cook the books” temporarily to meet quarterly expectations. However, once the financial mishandling had begun, the executives found it difficult to reverse their actions and report accurate numbers to the public. Beam decided to retire from the company in 1996; and after this action, he continued to find it difficult to sleep at night because of his involvement in the fraud. The issue in the case is whether Beam should consider coming forward and revealing to the Securities and Exchange Commission how the books had been doctored so that he could salvage his damaged conscience. Fallibilism is the philosophical view that reconciles our ability to have knowledge with our constant vulnerability to error: we know even though our basis for knowledge might have failed to be adequate. In the central chapter, I trace a parallel between fallibilism and compatibilism. Recent work in the philosophy of free agency has drawn attention to a connection between freedom and personhood . I suggest that a similar connection is crucial in epistemology: only persons can know, and knowledge must be (...) connected with what constitutes a subject as a cognitive person. Fallibilism and compatibilism offer what I call world-involving theories of personhood: what constitutes one as a person essentially involves how one is connected to the world. These world-involving theories face difficulties in showing how a person can be properly related to the thing known or to an action . I argue that fallibilism and compatibilism are incapable of resolving these problems and, hence, that world-involving theories of personhood are fundamentally flawed. Other chapters develop closely related themes: the proper analysis of fallibilism, the importance of the intellectual virtues and their role in epistemic agency, the kinds of accidentality that may undermine knowledge, and disjunctivism as a response to skepticism. Disjunctivism is a view that attempts to combine fallibilism with the ability to have a direct awareness of the truth . I examine this view as it is developed both in current epistemology and by the ancient Stoics. (shrink)

This essay argues that a restatement of Thomistic natural law reasoning is increasingly necessary in jurisprudential debate about international law. Mindful of Pope John Paul II's call for a renewal of international law, the essay engages with the present-day tension between Morgenthau-type realism and neo-Kantian discourse-oriented cosmopolitanism. The essay addresses whether the former is sufficiently realistic in our global 21st century context, and whether the latter is adequately cosmopolitan. Attention is drawn to Aquinas's understanding of the relation between custom, consent (...) and political authority in order to expose some of the limits of present-day statism, and to suggest that Thomistic natural law reasoning is, potentially at least, better able to cope with the intractable disagreement that characterises 21st century global relations than some forms of neo-Kantian jurisprudence. The first passage quoted above is the only certain evidence we have about Tacitus' early career, until we come to his tenure of the praetorship in A.D. 88. His career before that date has been the subject of much speculation, so it is surprising that no notice has been taken of the second passage. Syme does not even mention it, and C.W. Mendell merely describes it as ‘curious’. The reason for its dismissal is presumably that the post of a bibliothecis (...) was equestrian, while Tacitus was a senator. Yet in view of our lack of other evidence about his early career, it seems at least worth considering how Pastrengo came to make his statement, even if we conclude he was wrong. (shrink)

ABSTRACTSpiritual trial is indeed ‘spiritual’ – it is possible only in someone who is not utterly spiritless as Kierkegaard means the word – but it is not true, as Kierkegaard’s pseudonyms occasionally maintain, that it makes sense only as a religious category, unless religious is redefined in radically general terms, as Kierkegaard in fact does, along with the ideas of offense, anxiety, inwardness, and desire. Every existing individual has some minimal acquaintance with spiritual trial, if only as an anxiety about (...) a continual imminent possibility. I argue that spiritual trial, as Kierkegaard and his pseudonyms intend it – although they do not of course put it in these Levinasian terms – is inseparable from a certain phenomenology of the subject that begins with Kierkegaard and that turns spiritual trial into something essential to becoming a self, the result of one’s vulnerability to alterity, one’s anxiety to defend one’s autonomy against the experience of the other as other. Spiritual trial, in Kierkegaard’s strict sense, is therefore best understood as a special form of a very ordinary, basic experience, a kind of primordial trauma, of which Emmanuel Levinas has so far given us the most complete phenomenological description. This paper rejects a view of science called "methodological naturalism." -/- According to many defenders of mainstream science and Darwinian evolution, anti-evolution critics--creationists and intelligent design proponents--are conceptually and epistemologically confusing science and religion, a supernatural view of world. These defenders of evolution contend that doing science requires adhering to a methodology that is strictly and essentially naturalistic: science is essentially committed to "methodological naturalism" and assumes that all the phenomena it investigates are entirely natural and consistent with the laws (...) of physics. Thus encountering any unexplained phenomenon, science assumes a priori that there is some natural cause and will only test a natural hypothesis. Since by definition supernatural causes are assumed to be not subject to the constraints of physical or natural law as understood by science, supernatural hypotheses and explanations must be banned from proper science. Science simply can't say that God did, or did not do it. -/- I argue that the success of science is directly relevant to rational belief in supernatural causes, and that in fact science can and does say in particular cases that "God didn't do it." I suggest that pro-evolution proponents can better defend science and the theory of evolution by rejecting methodological naturalism. -/- . (shrink)

Medizinethische Entscheidungsfindungsmodelle müssen nachweisen können, weshalb die mit ihnen getroffenen Entscheidungen richtig oder zumindest „belastbar“ sind. Hierfür sind theoretische Rechtfertigungsansätze aus der Ethik unverzichtbar. Der Klinischen Ethik wird aber mitunter ein Mangel an theoretischer Fundierung vorgeworfen. Um diesem Vorwurf entgegenzutreten, soll unter Bezugnahme auf ein Projekt der Klinischen Ethik („METAP“) die ethische Unterstützung in Form der ethischen Fallbesprechung und der Ethikkonsultation mittels Prinzipienethik und Diskursethik gerechtfertigt werden. Prinzipienethik und Diskursethik können einander über das Medium der ethischen Fallbesprechung oder Ethikkonsultation fruchtbar (...) ergänzen. So können einige theoretische und praktische Schwächen der beiden Ansätze durch den jeweils anderen abgefedert werden. Die Diskursethik übernimmt bspw. die Sicherung der ethischen Gültigkeit von moralischen Entscheidungen bzw. Handlungsnormen und vermindert dadurch ein Rechtfertigungsdefizit, welches bei einem rein prinzipienorientierten Verfahren auftritt. Umgekehrt antwortet die Prinzipienethik u. a. auf Fragen der ethischen Angemessenheit und dient v. a. der adäquaten Einzelfallentscheidung. Durch die Integration des einen Ansatzes in den anderen ist eine umfassendere Rechtfertigungsleistung erzielbar als bei einem alleinigen Einsatz von Prinzipienethik oder Diskursethik. Selbst wenn einige Herausforderungen bestehen bleiben und auch das integrierte Modell moralische Dissense nicht immer verhindern kann, vermag es durch seine „doppelte“ Absicherung (Prinzipien und Diskurs) ein praktisches Vertrauen in die getroffene ethische Entscheidung zu stärken und so der Klinischen Ethik mehr „Robustheit“ zu geben, als sie bisher besitzt. We regularly wield powers that, upon close scrutiny, appear remarkably magical. By sheer exercise of will, we bring into existence things that have never existed before. With but a nod, we effect the disappearance of things that have long served as barriers to the actions of others. And, by mere resolve, we generate things that pose significant obstacles to others' exercise of liberty. What is the nature of these things that we create and destroy by our mere decision to do (...) so? The answer: the rights and obligations of others. And by what seemingly magical means do we alter these rights and obligations? By making promises and issuing or revoking consent When we make promises, we generate obligations for ourselves, and when we give consent, we create rights for others. Since the rights and obligations that are affected by means of promising and consenting largely define the boundaries of permissible action, our exercise of these seemingly magical powers can significantly affect the lives and liberties of others. "What does it really mean to "be undocumented," particularly in the contemporary United States? Political philosophers, policymakers and others often define the term "undocumented migrant" legalistically-that is, in terms of lacking legal authorization to live and work in one's current country of residence. Socially Undocumented: Identity and Immigration Justice challenges such a pure "legalistic understanding" by arguing that being undocumented should not always be conceptualized along such lines. To be socially undocumented, it argues, is to possess a real, visible, and (...) embodied social identity that does not always track one's actual legal status in the United States. By integrating a descriptive/phenomenological account of socially undocumented identity with a normative/political account of how the oppression with which it is associated ought to be dealt with as a matter of social justice, this book offers a new vision of immigration ethics. It addresses concrete ethical challenges associated with immigration, such as the question of whether open borders are morally required, the militarization of the Mexico-U.S. border, the perilous journey that many Mexican and Central American migrants undertake to get to the United States, the difficult experiences of many socially undocumented women who cross U.S. borders to seek prenatal care while visibly pregnant, and more"--. Food media have become a formidable part of adolescents’ food environments. This study sought to explore how and why adolescents use food media by focusing on selectivity and motives for consumption. We conducted in-depth, semi-structured interviews with 31 Flemish adolescents aged 12 to 16. Food media were both incidentally consumed and selectively sought for education, social utility, and entertainment. The levels of selectivity and motives for consumption varied among the different food media platforms. Incidental consumption was more prevalent with TV (...) cooking shows compared to online food media. The dominant motives for TV cooking show consumption were companionship and entertainment, while online food media were used for a more diverse range of motives dominated by information/inspiration and social interaction. Some participants consumed food media to get motivation and inspiration to improve health and fitness while others consumed food media to watch appetizing and aesthetically pleasing food content. The social environment in the form of friends and family as well as existing food preferences were dominant psychosocial factors for both traditional and online food media use. Future research is warranted to explore how incidental exposure and the identified motives for use relate to food media effects. (shrink)

: Feminist epistemologists have found the atomistic view of knowers provided by classical epistemology woefully inadequate. An obvious alternative for feminists is Lynn Hankinson Nelson's suggestion that it is communities that know. However, I argue that Nelson's view is problematic for feminists, and I offer instead a conception of knowers as "individuals-in-communities." This conception is preferable, given the premises and goals of feminist epistemologists, because it emphasizes the relations between knowers and their communities and the relevance of these relations for (...) epistemic assessments. Furthermore, it provides a sense of epistemic agents as active reflective inquirers, capable of transforming and improving knowledge-seeking practices. (shrink)
