Provability, Computability and Reflection.

Decision-making capacity (DMC) is the gatekeeping element for a patient’s right to self-determination with regard to medical decisions. A DMC evaluation is not only conducted on descriptive grounds but is an inherently normative task including ethical reasoning. Therefore, it is dependent to a considerable extent on the values held by the clinicians involved in the DMC evaluation. Dealing with the question of how to reasonably support clinicians in arriving at a DMC judgment, a new tool is presented that fundamentally differs (...) from existing ones: the U-Doc. By putting greater emphasis on the judgmental process rather than on the measurement of mental abilities, the clinician as a decision-maker is brought into focus, rendering the tool more of an evaluation guide than a test instrument. In a qualitative study, the perceived benefits of and difficulties with the tool have been explored. The findings show on the one hand that the evaluation aid provides basic orientation, supports a holistic perspective on the patient, sensitizes for ethical considerations and personal biases, and helps to think through the decision, to argue, and to justify one’s judgment. On the other hand, the room for interpretation due to absent operationalisations, related ambiguities, and the confrontation with one’s own subjectivity may be experienced as unsettling. (shrink)

This paper presents a way of classifying different forms of naturalness and unnaturalness. Three main forms of (un)naturalness are found as the following: history- based (un)naturalness, property-based (un)naturalness and relation-based (un)naturalness. Numerous subforms (and some subforms of the subforms) of each are presented. The subforms differ with respect to the entities that are found (un)natural, with respect to their all-inclusiveness, and whether (un)naturalness is seen as all-or-nothing affair, or a continuous gradient. This kind of conceptual analysis is needed, first, because (...) discussion concerning (un)naturalness is common in current bioethics and environmental ethics, and second, because the terms natural and unnatural are highly ambiguous. Thus, the lack of an exact definition of the type of (un)naturalness may lead into equivocation, other forms of bad argumentation, or at least vagueness. (shrink)

Servant leadership offers a compelling ideal of self-sacrificing individuals who put the needs of others before their own and cultivate a culture of growth in their organisations. Although the theory’s attempts to emphasise the moral, emotional and relational dimensions of leadership are laudable, it has primarily assumed a decontextualised view of leadership untouched by power. This article aims to problematise servant leadership by undertaking an intersectional analysis of an Asian cis-male heterosexual senior manager in Australia. Through in-depth interviews with the (...) manager and his staff, the article shows how his attempts to practice servant leadership were informed by intersecting power dynamics of race, gender, sexuality, age and class that subordinated him to white power. The findings demonstrate the ways servant leadership is necessarily embedded in wider power structures that shape who gets to be a “servant leader” and who remains merely a “servant”. (shrink)

The exchange of forensic DNA data is seen as an increasingly important tool in criminal investigations into organised crime, control strategies and counter-terrorism measures. On the basis of a set of interviews with police professionals involved in the transnational exchange of DNA data between EU countries, this paper examines how forensic DNA evidence is given meaning within the various different ways of constructing a police epistemic culture, it is, a set of shared values concerning valid knowledge and practices normatively considered (...) adequate and legitimate. The police epistemic culture is fuelled by multiple dynamics of boundary work, revealing how police professionals involved in international cooperation (i) define their specific core activities and competencies; (ii) construct particular understandings of valid knowledge and how it should be produced; (iii) enact the police epistemic culture in contrast to the epistemic cultures of the judicial authorities and forensic scientists. Extended algorithmic logic (EAL) as introduced in [18] is a modified version of extended +-valued algorithmic logic. Only two-valued predicates and two-valued propositional variables occur in EAL. The role of the +-valued logic is restricted to construct control systems (stacks) of pushdown algorithms whereas their actions are described by means of the two-valued logic. Thus EAL formalizes a programming theory with recursive procedures but without the instruction CASE.The aim of this paper is to discuss EAL and prove the completeness theorem. (...) Given the relevance and frequent presence in academic research of the notion of “biopolitics” – developed by the philosopher Michel Foucault –, this article seeks to contribute to the understanding of this notion and its conceptual emergence. To this end, the article analyses the four books published by M. Foucault prior to the initial use of the term “biopolitics” in the second half of the 1970s, aiming so to identify within them the presence of constituent elements of the notion. Elements (...) were found in these books that would later form the conceptualization of biopolitics and inform studies on the subject, particularly the problematization of population and biological life. However, this article did not aim to uncover a biopolitical analysis placed before Foucault’s establishment of the notion; rather, it identified clues related to medicine, biology, statistics, and population present in Foucault’s earlier works that can enhance the understanding of the concept of biopolitics and its historicity. Rousseau and Geneva reconstructs the main aspects of Genevan socio-economic, political and religious thought in the first half of the eighteenth century. In this way Dr Rosenblatt effectively contextualizes the development of Rousseau's thought from the First Discourse through to the Social Contract. Over time Rousseau has been adopted as a French thinker, but this adoption obscures his Genevan origin. Dr Rosenblatt points out that he is, in fact, a Genevan thinker and illustrates for the first time that Rousseau's classical (...) republicanism, his version of natural law theory, his civil religion, and his hostility to the arguments of doux commerce theorists are all responses to the political use of such arguments in Geneva. The author also points out that it was this relationship with Geneva that played an integral part in his development into an original political thinker. (shrink)

Recent years have seen a remarkable renewal of interest in the thought of Benjamin Constant . For long recognized as the author of the literary masterpiece Adolphe, Constant is now receiving increasing attention for his political writings. Paperback editions of his major works are presently available in both French and English, helping to establish his growing reputation as a founding father of modern liberalism. Constant's stature as a seminal liberal thinker has benefited from the recent climate of opinion in the (...) Western world and, in particular, from the return to fashion of liberalism as a social and political doctrine. Paradoxically, however, this political climate has also led to some problems, since presentist concerns have left an undeniable imprint on the image we have of Constant. (shrink)

In 2012, the Swedish newspaper Dagens Nyheter published a series of articles criticising Swedish national level gymnastics for being abusive. This text analyses the subsequent debate by identifying the discursive and rhetorical resources used by the involved parties. The analysis shows how the parties negotiate accountability, manage dilemmas of stake and what the possible social consequences of these are. Five narratives are singled out in the debate: the counter narrative, the victim narrative, the defence-speech narrative, the expert narrative and the (...) ‘not-us-narrative’. In these narratives, the involved parties used rhetorical resources to account for reality. Hence, the gymnastics community, the research community, individuals and journalists are all portrayed as actors co-producing a social problem. (shrink)

Perhaps for the first time in history, the turn of a millennium is directly reflected in philosophy-as an apocalyptic end of philosophy. Recently, an attempt to channel apocalyptic into messianic has been undertaken by Derrida in his Spectres of Marx. However, Derrida's endeavor does not relate directly to philosophy and thus does not alter its apocalyptic landscape. Considering the critical state of contemporary philosophy, it is unclear whether such an alteration can be performed in the West. A radical reinterpretation appears (...) to be much more probable when undertaken from an outside position. It may be that this is the case with the Philosophia Universalis developed by the Russian-American David Zilberman from classical Hindu philosophies and applied, as a new synthesis, to Western philosophy. Major ideas of the Philosophia Universalis as well as its principal results and achievements comprise the content of this presentation. (shrink)

The study deals with the conception of personal immortality in Miguel de Unamuno’s works. The starting point of his reflections is a particular person of “flesh and blood“ and his authentic existence. Unamuno’s “hunger of immortality“ is inspired by man’s confrontation with the phenomenon of death. For Unamuno existential phenomena of suffering and anxiety seem to be the keyword to the authentic existence and God then becomes a guarantor of individual immortality. The study concentrates on Unamuno’s conception of God in (...) the spirit of panentheism and Spanish Krausism. It observes Unamuno’s philosophical sources of information when discussing the question of immortality from Pythagoras to Platon while opposing the views of impersonal immortality (e.g. B. Spinoza). His theological argumentation is based mainly on S. Kierkegaard, St. Paul and Spanish mystics. His philosophical ideas are extracted especially from his works The Tragic Sense of Life, The Agony of Christianity and The Intimate Diary. His novella Saint Emmanuel The Good, Martyr serves as a fictional illustration of his ideas. The study concludes with the evaluation of Unamuno as an author writing “philosophizing literature“ and as a predecessor of existentialist literature, who was orientated towards Christian personalism. This article argues that while ethical leadership in mainstream theorising is assumed to be a cognitive exercise, leaders’ bodies in fact play a significant role in the social construction of ethical leadership. Their bodies become particularly potent when leaders are depicted via the interplay between visual and verbal modes in the media. In order to extend current understandings of ethical leadership, this study employs a discourse analytic approach to examine how visual and verbal devices convey ethical leadership for two of (...) Australia’s major bank chief executive officers—John Stewart and Ralph Norris—before and during the global financial crisis. Based on the analysis, this article demonstrates that ethical leadership is constructed through the confluence of elite and working class masculinities that is multimodally embodied and disembodied. The article suggests that what it means to be an ethical leader is invariably informed by class-based patriarchal norms that can serve to reinforce the masculinisation of ethics. (shrink)

Purpose The purpose of this paper is to report on empirical work conducted to open up algorithmic interpretability and transparency. In recent years, significant concerns have arisen regarding the increasing pervasiveness of algorithms and the impact of automated decision-making in our lives. Particularly problematic is the lack of transparency surrounding the development of these algorithmic systems and their use. It is often suggested that to make algorithms more fair, they should be made more transparent, but exactly how this can be (...) achieved remains unclear. Design/methodology/approach An empirical study was conducted to begin unpacking issues around algorithmic interpretability and transparency. The study involved discussion-based experiments centred around a limited resource allocation scenario which required participants to select their most and least preferred algorithms in a particular context. In addition to collecting quantitative data about preferences, qualitative data captured participants’ expressed reasoning behind their selections. Findings Even when provided with the same information about the scenario, participants made different algorithm preference selections and rationalised their selections differently. The study results revealed diversity in participant responses but consistency in the emphasis they placed on normative concerns and the importance of context when accounting for their selections. The issues raised by participants as important to their selections resonate closely with values that have come to the fore in current debates over algorithm prevalence. Originality/value This work developed a novel empirical approach that demonstrates the value in pursuing algorithmic interpretability and transparency while also highlighting the complexities surrounding their accomplishment. ver since the traditional criteria for medical decision-making capacity (understanding, appreciation, reasoning, evidencing a choice) were formulated, they have been criticized for not taking sufficient account of emotions or values that seem, according to the critics and in line with clinical experiences, essential to decision-making capacity. The aim of this paper is to provide a nuanced and structured overview of the arguments provided in the literature emphasizing the importance of these factors and arguing for their inclusion in competence evaluations. Moreover, (...) a broader reflection on the findings of the literature is provided. Specific difficulties of formulating and measuring emotional and valuational factors are discussed inviting reflection on the possibility of handling relevant factors in a more flexible, case-specific, and context-specific way rather than adhering to a rigid set of operationalized criteria. The Covid-19 induced United Kingdom-wide lockdown in 2020 saw choirs face a unique situation of trying to continue without being able to meet in-person. Live networked simultaneous music-making for large groups of singers is not possible, so other “virtual choir” activities were explored. A cross sectional online survey of 3948 choir members and facilitators from across the United Kingdom was conducted, with qualitative analysis of open text questions, to investigate which virtual choir solutions have been employed, how choir members and (...) facilitators experience these in comparison to an “in-person” choir, and whether the limitations and opportunities of virtual choir solutions shed light on the value of the experience of group singing as a whole. Three virtual choir models were employed: Multi-track, whereby individuals record a solo which is mixed into a choral soundtrack; Live streamed, where individuals take part in sessions streamed live over social media; Live tele-conferencing, for spoken interaction and/or singing using tele-conferencing software. Six themes were identified in the open text responses: Participation Practicalities, encompassing reactions to logistics of virtual models; Choir Continuity, reflecting the responsibility felt to maintain choir activities somehow; Wellbeing, with lockdown highlighting to many the importance of in-person choirs to their sense of wellbeing; Social Aspects, reflecting a sense of community and social identity; Musical Elements, whereby the value of musical experience shifted with the virtual models; Co-creation through Singing, with an overwhelming sense of loss of the embodied experience of singing together in real-time, which is unattainable from existing virtual choir models. The experiences, activities and reflections of choir singers during lockdown present a unique perspective to understand what makes group singing a meaningful experience for many. Co-creation through Singing needs further investigation to understand the impact of its absence on virtual choirs being able re-create the benefits of in-person choirs. (shrink)

The dynamic approach to understanding of the human consciousness, its cognitive activities and cognitive architecture is one of the most promising approaches in the modern epistemology and cognitive science. The conception of embodied mind is under discussion in the light of nonlinear dynamics and of the idea co-evolution of complex systems developed by the Moscow scientific school. The cognitive architecture of the embodied mind is rather complex: data from senses and products of rational thinking, the verbal and the pictorial, logic (...) and intuition, the analytical and synthetic abilities of perception and of thinking, the local and the global, the analogue and the digital, the archaic and the post-modern are intertwined in it. In the process of cognition, co-evolution of embodied mind as an autopoietic system and its surroundings takes place. The perceptual and mental processes are bound up with the structure of human body. Nonlinear and circular connecting links between the subject of cognition and the world constructed by him can be metaphorically called a nonlinear cobweb of cognition. Cognition is an autopoietic activity because it is directed to the search of elements that are missed; it serves to completing integral structures. According to the theory of blow-up regimes in complex systems elaborated by Sergey P.Kudyumov and his followers, the idea of co-evolution is connected with the concept of tempoworlds. To co-evolve means to start to develop in one and the same tempoworld and to use the possibility – in case of a proper intergation into a whole structure – to accelerate the tempo of evolution. The cognitive activities of the human being can be considered as a movement (active walk) in landscapes of co-evolution when he cognizes and changes environment and is changed himself by the very activities. The similar conclusion can be drawn from Francisco Varela’s conception of enactive cognition. (shrink)

RESUMEN El artículo propone definir la integridad moral a partir de la autorreflexión, la meta emoción y la identidad. Se parte de la autorreflexión de H. Frankfurt y se amplía su evaluación de los deseos mediante los conceptos de autorreflexión débil y fuerte de C. Taylor. Si bien las emociones tienen relevancia en la motivación, lo que cuenta para evaluar la reflexividad de alguien son sus acciones. Se plantea que las emociones, aun sin cristalizar en acción, son relevantes para determinar (...) la identidad moral. Así mismo, se presentan las metaemociones como un tipo de deseo de segundo orden que no se enlaza necesariamente a la volición, pero que tiene potencial similar a las voliciones de segundo orden. Se propone considerar a las emociones morales, según las define C. Korsgaard, como equivalentes a las metaemociones que, junto con las razones, determinan la integridad moral. ABSTRACT The purpose of the article is to define moral integrity on the basis of self-reflection, meta-emotion, and identity. Starting out from H. Frankfurt’s notion of self-reflection, the article expands his assessment of desires with the help of C. Taylor‘s concepts of strong and weak self-reflection. While it is true that emotions are relevant for motivation, it is an individual’s actions that count when assessing reflexivity. The article suggests that emotions, even when they have not materialized into actions, are relevant in determining moral identity. Likewise, it discusses meta-emotions as a type of second-order desire that is not necessarily linked to volition, but whose potential is similar to that of second-order volitions. It suggests that moral emotions, according to C. Korsgaard, be considered equivalent to meta-emotions, which, together with reasons, determine moral integrity. (shrink)
