We give a precis of our book Insensitive Semantics.

This essay critically examines some classic philosophical and legal theories of privacy, organized into four categories: the nonintrusion, seclusion, limitation, and control theories of privacy. Although each theory includes one or more important insights regarding the concept of privacy, I argue that each falls short of providing an adequate account of privacy. I then examine and defend a theory of privacy that incorporates elements of the classic theories into one unified theory: the Restricted Access/Limited Control (RALC) theory of privacy. Using (...) an example involving data-mining technology on the Internet, I show how RALC can help us to frame an online privacy policy that is sufficiently comprehensive in scope to address a wide range of privacy concerns that arise in connection with computers and information technology. Philosophers take a great deal of interest in the study of meaning, reference, truth and other semantic properties, but remarkably little attention has been paid to the entities that have semantic properties. The view that’s typically taken for granted has two closely related components.

Indexicals are linguistic expressions whose meaning remain stable while their reference shifts from utterance to utterance. Paradigmatic cases in English are ‘I’, ‘here’, and ‘now’. Recently, a number of authors have argued that various constructions in our language harbor hidden indexicals. We say 'hidden' because these indexicals are unpronounced, even though they are alleged to be real linguistic components. Constructions taken by some authors to be associated, or to ‘co-habit’, with hidden indexicals include: definite descriptions and quantifiers more generally (hidden (...) indexical refers to a domain – Davies (1981), Westerstahl (1985), Soames (1986), Higginbotham (1988), Stanley and Williamson (1995)), propositional attitude verbs (hidden indexical refers to a mode of presentation – Richard (1990)), comparative adjectives (hidden indexical refers to comparison classes – Partee (1989), Kamp (1975), Ludlow (1989)). An interesting recent addition is the view that all nouns are associated with a hidden indexical referring to a domain restriction (Stanley and Szabo (2000), Stanley.. (shrink)

Responsibility gaps traditionally refer to scenarios in which no one is responsible for harm caused by artificial agents, such as autonomous machines or collective agents. By carefully examining the different ways this concept has been defined in the social ontology and ethics of technology literature, I argue that our current concept of responsibility gaps is defective. To address this conceptual flaw, I argue that the concept of responsibility gaps should be revised by distinguishing it into two more precise concepts: epistemic (...) responsibility gaps (ERG) and control misalignments (CM). ERG functions as a refined version addressing specific aspects of responsibility attribution. It captures the challenge of identifying who is to blame. CM, on the other hand, introduces a new dimension by focusing on misalignments of control. These revisions offer better guidelines for the development and oversight of artificial agents, both in terms of assigning blame and ensuring the right distribution of control. (shrink)

Privacy concerns involving data mining are examined in terms of four questions: What exactly is data mining? How does data mining raise concerns for personal privacy? How do privacy concerns raised by data mining differ from those concerns introduced by traditional information-retrieval techniques in computer databases? How do privacy concerns raised by mining personal data from the Internet differ from those concerns introduced by mining such data from data warehouses? It is argued that the practice of using data-mining techniques, whether (...) on the Internet or in data warehouses, to gain information about persons raises privacy concerns that go beyond concerns introduced in traditional information-retrieval techniques in computer databases and are not covered by present data-protection guidelines and privacy laws. Are trust relationships involving humans and artificial agents possible? This controversial question has become a hotly debated topic in the emerging field of machine ethics. Employing a model of trust advanced by Buechner and Tavani :39–51, 2011), I argue that the “short answer” to this question is yes. However, I also argue that a more complete and nuanced answer will require us to articulate the various levels of trust that are also possible in environments comprising both human agents and AAs. In defending this view, I show how James Moor’s model for distinguishing four levels of ethical agents in the context of machine ethics :18–21, 2006) can help us to develop a framework that differentiates four levels of trust. Via a series of hypothetical scenarios, I illustrate each level of trust involved in HA–AA relationships. Finally, I argue that these levels of trust reflect three key factors or variables: the level of autonomy of the individual AAs involved, the degree of risk/vulnerability on the part of the HAs who place their trust in the AAs, and the kind of interactions that occur between the HAs and AAs in the trust environments. Nietzsche's strengths as a critic are widely acknowledged, but his peculiar style of critique is usually ignored as rhetoric, or dismissed as violent or simply incoherent. In this book, Nietzsche's concept of the agon or Wettkampf, a measured and productive form of conflict inspired by ancient Greek culture, is advanced as the dynamic and organising principle of his philosophical practice, enabling us to make sense of his critical confrontations and the much disputed concept of transvaluation or Umwertung. Agonal perspectives are (...) cast on a number of key problems in his thought across a broad range of texts. Topics and problems treated include: critical history and the need for a limit in the negation of the past; Nietzsche contra Socrates and the problem of closure; Nietzsche contra humanism and the problem of humanity; Nietzsche contra Kant on genius and legislation; the problem of self-legislation in relation to life and temporality; Nietzsche's sense of community in its articulation with law, and the normativity of taste; ressentiment and the question of therapy in Nietzsche and Freud; and the problem of total affirmation in relation to critique. It is natural to think that the relationship between ‘rain’ and the location of rain is different from the relationship between ‘dance’ and the location of dancing. Utterances of (1) are typically interpreted as, in some sense, being about a location in which it rains. (2) is, typically, not interpreted as being about a location in which the dancing takes place.

This paper examines the question whether, and to what extent, John Locke’s classic theory of property can be applied to the current debate involving intellectual property rights (IPRs) and the information commons. Organized into four main sections, Section 1 includes a brief exposition of Locke’s arguments for the just appropriation of physical objects and tangible property. In Section 2, I consider some challenges involved in extending Locke’s labor theory of property to the debate about IPRs and digital information. In Section (...) 3, it is argued that even if the labor analogy breaks down, we should not necessarily infer that Locke’s theory has no relevance for the contemporary debate involving IPRs and the information commons. Alternatively, I argue that much of what Locke has to say about the kinds of considerations that ought to be accorded to the physical commons when appropriating objects from it – especially his proviso requiring that “enough and as good” be left for others – can also be applied to appropriations involving the information commons. Based on my reading of Locke’s proviso, I further argue that Locke would presume in favor of the information commons when competing interests (involving the rights of individual appropriators and the preservation of the commons) are at stake. In this sense, I believe that Locke offers us an adjudicative principle for evaluating the claims advanced by rival interests in the contemporary debate about IPRs and the information commons. In Section 4, I apply Locke’s proviso in my analysis of two recent copyright laws: the Copyright Term Extension Act (CTEA), and the Digital Millennium Copyright Act (DMCA). I then argue that both laws violate the spirit of Locke’s proviso because they unfairly restrict the access that ordinary individuals have previously had to resources that comprise the information commons. Noting that Locke would not altogether reject copyright protection for IPRs, I conclude that Locke’s classic property theory provides a useful mechanism for adjudicating between claims about how best to ensure that individuals will be able to continue to access information in digitized form, while at the same time also allowing for that information to enjoy some form of legal protection. During the past decade, a fairly extensive literature on the digital divide has emerged. Many reports and studies have provided statistical data pertaining to sociological aspects of ‘the divide,’ while some studies have examined policy issues involving universal service and universal access. Other studies have suggested ways in which the digital divide could be better understood if it were ‘reconceptualized’ in terms of an alternative metaphor, e.g. a ‘divide’ having to do with literacy, power, content, or the environment. However, with (...) the exception of Johnson and Koehler, authors have tended not to question ‐ at least not directly ‐ whether the digital divide is, at bottom, an ethical issue. Many authors seem to assume that because disparities involving access to computing technology exist, issues underlying the digital divide are necessarily moral in nature. Many further assume that because this particular ‘divide’ has to do with something that is digital or technological in nature, it is best understood as a computer ethical issue. The present study, which examines both assumptions, considers four questions: What exactly is the digital divide? Is this ‘divide’ ultimately an ethical issue? Assuming that the answer to is ‘yes,’ is the digital divide necessarily an issue for computer ethics? If the answer to is ‘yes,’ what can/should computer professionals do bridge the digital divide? This essay examines issues involving personal privacy and informed consent that arise at the intersection of information and communication technology and population genomics research. I begin by briefly examining the ethical, legal, and social implications program requirements that were established to guide researchers working on the Human Genome Project. Next I consider a case illustration involving deCODE Genetics, a privately owned genetics company in Iceland, which raises some ethical concerns that are not clearly addressed in the current ELSI guidelines. The (...) deCODE case also illustrates some ways in which an ICT technique known as data mining has both aided and posed special challenges for researchers working in the field of population genomics. On the one hand, data-mining tools have greatly assisted researchers in mapping the human genome and in identifying certain “disease genes” common in specific populations. On the other hand, this technology has significantly threatened the privacy of research subjects participating in population genomics studies, who may, unwittingly, contribute to the construction of new groups that put those subjects at risk for discrimination and stigmatization. In the final section of this paper I examine some ways in which the use of data mining in the context of population genomics research poses a critical challenge for the principle of informed consent, which traditionally has played a central role in protecting the privacy interests of research subjects participating in epidemiological studies. The present study examines certain challenges that KDD (Knowledge Discovery in Databases) in general and data mining in particular pose for normative privacy and public policy. In an earlier work (see Tavani, 1999), I argued that certain applications of data-mining technology involving the manipulation of personal data raise special privacy concerns. Whereas the main purpose of the earlier essay was to show what those specific privacy concerns are and to describe how exactly those concerns have been introduced by the use (...) of certain KDD and data-mining techniques, the present study questions whether the use of those techniques necessarily violates the privacy of individuals. This question is considered vis-à-vis a recent theory of privacy advanced by James Moor (1997). The implications of that privacy theory for a data-mining policy are also considered. (shrink)

This paper examines two attempts to justify the way in which intuitions about specific cases are used as evidence for and against philosophical theories. According to the concept model, intuitions about cases are trustworthy applications of one’s typically tacit grasp of certain concepts. We argue that regardless of whether externalist or internalist accounts of conceptual content are correct, the concept model flounders. The second justification rests on the less familiar belief model, which has it that intuitions in philosophy derive from (...) one’s beliefs. Although more promising than the concept model, the belief model fails to justify traditional philosophical use of intuitions because it is not clear a priori that the beliefs at issue are true. The latter model may, however, legitimize a less a prioristic approach to intuitions. (shrink)

Taking as a point of departure a recently published collection of representative contributions from various philosophers who claim to ?proceed from ordinary language?, this article examines ordinary language philosophy in the light of some of the claims made by these philosophers. The claims are criticized mainly for failing to account for the variability of the use of terms in respect both of depth of intention and special contexts. These factors are such as to render the claims in question false when (...) interpreted as significant assertions about language, but trivial when they are interpreted as reasonable and true. This article explores the relation between the government and the media in post-apartheid South Africa. An overview is given of key developments and tensions between the government and the media in the first 10 years of democracy and the ethical frameworks underlying the respective positions. An overview of the debate between the so-called "national interest" and the "public interest" is given, and linked to normative ethical frameworks of libertarianism vis-a-vis communitarianism. A mean between the 2 is suggested in the form (...) of mutualism, whereas the necessity for conceptual clarification in debating the relation between the government and the media is emphasized. On a strategic level (in the long term) they will determine the direction of the company.Even though on the level of daily management a great deal of quality instruments and control systems exist, this is not the case on the highest level, the board. It is in this specific area that the idea of corporate governance must be situated.

This essay examines some ethical aspects of stalkingincidents in cyberspace. Particular attention is focused on the Amy Boyer/Liam Youens case of cyberstalking, which has raised a number of controversial ethical questions. We limit our analysis to three issues involving this particular case. First, we suggest that the privacy of stalking victims is threatened because of the unrestricted access to on-linepersonal information, including on-line public records, currently available to stalkers. Second, we consider issues involving moral responsibility and legal liability for Internet (...) service providers (ISPs) when stalking crimesoccur in their `space' on the Internet. Finally, we examine issues of moral responsibility for ordinary Internet users to determine whether they are obligated to inform persons whom they discover to be the targets of cyberstalkers. Este artigo examina e compara Kant e Nietzsche enquanto pensadores do conflito. Argumenta-se no § 1 que, para ambos os filósofos, o conflito desempenha um papel essencial e construtivo em vários domínios de seu pensamento, e que ambos nos oferecem um rico conjunto de insights sobre as qualidades produtivas do conflito. Contudo, Kant não é capaz de formular um conceito genuinamente afirmativo do conflito que faça jus aos prodigiosos poderes produtivos por ele descritos. Em vez disso, ele promove uma guerra (...) de extermínio (Vernichtungskrieg) filosófica contra toda guerra, destinada a negá-la em favor de uma reivindicação absoluta pela paz ('paz perpétua'). Como nos mostra a análise de "Zum ewigen Frieden" no § 2, a possibilidade de ação construtiva requer a eliminação da guerra em favor da paz perpétua por meio do Estado de Direito, e o conflito é, na melhor das hipóteses, produtor de sua própria negação. A parte final do artigo se volta para Nietzsche em busca de um modelo conceitual que permita uma compreensão genuinamente afirmativa do conflito e seus potenciais produtivos. A filosofia da vida de Nietzsche é uma ontologia do conflito que culmina em um ideal de maximização da tensão baseado em um equilíbrio de poderes mais ou menos equânimes. Argumenta-se que a noção nietzschiana de afirmação da vida nos compromete com uma posição que se situa entre a guerra kantiana e o direito cosmopolita, focando a nossa atenção nas relações antagônicas que se estabelecem tanto no interior quanto entre uma pluralidade de ordenamentos jurídicos. This article examines and compares Kant and Nietzsche as thinkers of the conflict. It is argued in paragraph one that conflict plays a fundamental and constructive role for both philosophers in several domains of their thought, and that both of them offer us a rich set of insights on the productive qualities of conflict. However, Kant is unable to formulate a genuinely affirmative concept of conflict that does justice to the prodigious productive powers described by him. Instead, he promotes a termination philosophical war (Vernichtungskrieg) against all war intended to negate it in favor of an absolute vindication for peace ('perennial peace'). As evidenced by "Zum ewigen Frieden" analysis in paragraph two, the possibility of a constructive action requires the elimination of war for the perennial peace through the Rule of Law, and conflict is, at its best, producer of its own negation. The closing part of the article turns to Nietzsche in search of a conceptual model to genuinely understand conflict and its productive potential. Nietzsche's life philosophy is an ontology of conflict that culminates in an ideal of maximizing tension based on a balance of more or less equitable powers. It is argued that Nietzsche's notion of affirmation of life commits us to a position that is between Kantian war and the cosmopolitan law, bringing to our attention the antagonistic relations within and among a plurality of legal systems. This essay examines Nietzsche’s thought on hatred in the light of the realist and perfectionist impulses of his philosophy. Drawing on remarks scattered across his writings, both unpublished and published, it seeks to reconstruct the “philosophy of hatred‘ that, as he himself observed, “has not yet been written‘. In S1 it is shown that hatred is a necessary ingredient in Nietzsche’s dynamic and pluralist ontology of conflict. Hatred plays an indispensable role in the drive to assimilate or incorporate other life-forms (...) into life’s struggle for expansion and self-overcoming. According to Nietzsche’s philosophical physiology, hatred is greatest where struggle and the resistance to assimilation are greatest; that is, among equal powers. It is also distinguished from revulsion and contempt, since these are attached to the process of excretion, not assimilation. What is more, since genuine hatred serves to assimilate what is more or less equal, it is bound up with love, understood as attraction and the desire to appropriate what we wish to make our own; this is one of several ways in which the opposition between love and hate is overcome. But for Nietzsche, hatred can take a variety of forms, and his distinctive claim is that it need not be a destructive force, but can take creative forms. Two different forms of creative hatred are then examined: an active agonal hatred inter pares that allows for an affirmative pride in one’s enemy ; and the reactive hatred of the “spirit of revenge‘ that gives birth to slave morality. Attending to Nietzsche’s argumentation on the etymological relations between “hatred‘ and “ugliness‘, one can distinguish genuine hatred inter pares, affirmative and creative, from contempt towards what is inferior from a position of strength, and from hatred-as-ressentiment towards what is superior from a position of weakness. Nietzsche’s analysis of the creative hatred that gave birth to slave morality reveals its destructive core in the “imaginary revenge‘ that degrades its noble opponent, raising the problem: How to respond constructively to the necessity of hatred and conflict implied by Nietzsche’s ontology? In the final section, two responses to this problem are considered: on the one hand to seek ways to “improve‘ hatred by drawing on its idealising powers for constructive ends; on the other hand, to use physiological self-knowledge to correct the errors intrinsic to hatred and cultivate an episteme beyond love and hate. These responses can pull in different directions, but they can also be co-ordinated in a way that addresses the realist and perfectionist impulses in Nietzsche’s philosophy. (shrink)

The concept of Umwertung, central to Ecce Homo, is marked by discrepancies and incongruities that seem to defy philosophical comprehension. This paper focuses on the problem of Yes-saying and No-saying at the core of Umwertung. How can total affirmation be combined with radical critique, as Nietzsche claims? Nietzsche's favoured idiom of warfare exhibits the incommensurability of these positions, but it also points to a deeper problem: in waging war against idealism, Nietzsche risks repeating idealism, conceived as a war to the (...) death against other forms of life and thought. In §2 idealist warfare is analysed more closely, and in §3 it is contrasted with Nietzschean warfare, cinceived as an agonal form of oppositional thinking that avoids repeating idealism. This model of warfare is, however, undermined by the affirmative and destructive excesses of Nietzsche's text, and §4 proposes a different approach to the problem of Yes- and No-saying. On this approach, the affirmation of reality as war or conflictual multiplicity demands 1. the adoption of antagonistic positions with destructive intent against life-negating positions , but also 2. the overcoming of every antagonistic position in favour of an 'impossible' or fictional standpoint in the relation between antagonists; this alone allows all antagonistic positions to be affirmed. This approach is proposed as a general way to make sense of the fictional qualities of Ecce homo, its excesses and incongruities, and in §5 it is applied as a corrective to the account of Umwertung as a comparative practice proposed by Gerd Schank. I argue that philosophy department should be reorganised: they should be built up around strong research groups in restricted fields. Another way to think of this: departments should model themselves on research centres. Members of such research centres / departments would teach outside their area of competency. At the BA level teaching can remain as it is, but those teaching classes will often be teaching outside the area of expertise. That is not a problem. PhD supervision would be within the (...) restricted fields that the department specialises in. In other words: I reject the zoo-model of academic departments where you get ‘one of each’, so that all classes can be taught by someone working on the topic of that class. (shrink)

The purpose of this paper is to show how certain uses of search-engine technology raise concerns for personal privacy. In particular, we examine some privacy implications involving the use of search engines to acquire information about persons. We consider both a hypothetical scenario and an actual case in which one or more search engines are used to find information about an individual. In analyzing these two cases, we note that both illustrate an existing problem that has been exacerbated by the (...) use of search engines and the Internet – viz., the problem of articulating key distinctions involving the public vs. private aspects of personal information. We then draw a distinction between “public personal information” and “nonpublic personal information” to see how this scheme can be applied to a problem of protecting some forms of personal information that are now easily manipulated by computers and search engines – a concern that, following Helen Nissenbaum , we describe as the problem of privacy in public. ExcerptIn 1959, C. P. Snow delivered the Rede Lecture on “The Two Cultures.”1 Snow’s fundamental point was that humanists and scientists speak past each other, assuming that they communicate at all. “[I]ntellectual life,” Snow writes, “is increasingly being split into two polar groups.” At one end, “literary intellectuals,” at the other, “scientists,” and between the two “a gulf of mutual incomprehension—sometimes (particularly among the young) hostility and dislike, but most of all lack of understanding.” Scientists don’t read any imaginative literature (...) because it has no practical application; and humanists ignore science because they think it is “of no interest either in its own value or its consequences.” The result is a split that does nobody any good.
