States restrict immigration on a massive scale. Governments fortify their borders with walls and fences, authorize border patrols, imprison migrants in detention centers, and deport large numbers of foreigners. Unjust Borders: Individuals and the Ethics of Immigration argues that immigration restrictions are systematically unjust and examines how individual actors should respond to this injustice. Javier Hidalgo maintains that individuals can rightfully resist immigration restrictions and often have strong moral reasons to subvert these laws. This book makes the case that (...) unauthorized migrants can permissibly evade, deceive, and use defensive force against immigration agents, that smugglers can aid migrants in crossing borders, and that citizens should disobey laws that compel them to harm immigrants. El presente artículo tiene por objetivo revisar y cuestionar algunos conceptos tradicionales cuando se aborda la temática de las personas adultas mayores, con la finalidad de analizar de manera cronológica y desde una perspectiva de derechos humanos, la normatividad legal que dispuso y prorrogó la cuarentena focalizada en tiempos 1de pandemia a causa del COVID-19. Sustentando que las medidas legales adoptadas fueron discriminatorias por razón de edad, no sólo significando la privación del derecho a la libertad de tránsito, sino que (...) además afectó otros derechos humanos y libertades fundamentales. This paper argues for a dilemma: you can accept liberalism or immigration restrictions, but not both. More specifically, the standard arguments for restricting freedom of movement apply equally to textbook liberal freedoms, such as freedom of speech, religion, occupation and reproductive choice. We begin with a sketch of liberalism’s core principles and an argument for why freedom of movement is plausibly on a par with other liberal freedoms. Next we argue that, if a state’s right to self-determination grounds a prima (...) facie right to restrict immigration, then it also grounds a prima facie right to restrict freedom of speech, religion, sexual choice and more. We then suggest that the social costs associated with freedom of immigration are also costs associated with occupational choice, speech and reproduction. Thus, a state’s interest in reducing these costs gives it prima facie justification to restrict not only immigration but also other core liberal freedoms. Moreover, we rebut the objection that, even if the standard arguments for a prima facie right to restrict immigration also support a prima facie right to restrict liberal freedoms generally, there are differences that render immigration restrictions – but not restrictions on speech, religion, etc. – justified all things considered. In closing, we suggest that the theoretical price of supporting immigration restrictions – viz., compromising a commitment to liberal principles – is too steep to pay. (shrink)

Many political theorists argue that immigration restrictions are unjust and defend broadly open borders. In this paper, I examine the implications of this view for individual conduct. In particular, I argue that the citizens of states that enforce unjust immigration restrictions have duties to disobey certain immigration laws. States conscript their citizens to help enforce immigration law by imposing legal duties on these citizens to monitor, report, and refrain from interacting with unauthorized migrants. If an ideal of open borders is (...) true, these laws are unjust. Furthermore, if citizens comply with their legal duties, they contribute to violating the rights of migrants. We are obligated to refrain from contributing to rights-violations. So, citizens are obligated to disobey immigration laws. I defend the moral requirement to disobey immigration laws against the objection that disobedience to the law is excessively risky and the objection that citizens have political obligations to obey the law. Several noted economists and prominent international organizations have recently advocated for the implementation of guest worker programs in developed states. Their primary argument is that guest worker programs would serve as a powerful mechanism for reducing global poverty and inequality. For example, economist Dani Rodrik estimates that guest worker programs in wealthy states would generate $200 billion or more annually for poor countries. According to Rodrik, liberalizing the temporary movement of workers would “produce the largest possible gains for the world (...) economy and for poor countries in particular,” in comparison with other policies, such as trade liberalization. O século XXI evidencia um impulso significativo de fusões entre ciência e tecnologia, ao contrário de outras etapas históricas. Os seres humanos e sua rotina estão se transformando devido às tecnociências. Nesse sentido, este estudo tem um duplo propósito: por um lado, contextualizar a inteligência artificial na órbita da quarta revolução industrial. E, por outro lado, examinar posturas sobre as divergências entre máquinas e humanos. As descobertas tornam evidente como as máquinas evoluem e adquirem sofisticação. Diante disso, em relação ao (...) humano, perspectivas a favor, contra e intermediárias tornam-se perceptíveis. Esse panorama torna inevitável a participação da bioética como espaço deliberativo e de encontro disciplinar. The Communicational Theory of Law (CTL) usually differentiates between Legal Sociology and Legal Theory, in the sense that Legal Sociology is concerned with the social validity of the rules and Legal Theory with the formal or legal validity of the rules. It can be argued that both disciplines are two different perspectives of the same empirical reality (legal rules). Also, legal System and social milieu are two closely linked realities; they cannot be separated because they need each other. The Law (...) is the form or order that the social milieu takes, and, at the same time, the social environment provides the ideas, collective representations and other matters that need a legal regulation. For this reason, the epistemological separation between Sociology and Legal Theory must be overcome when the theoretical perspective comes to legal decisions. Thus, the decisional moment becomes the meeting point between the legal System and the social milieu. This is where the concept of the legal System fulfils its main function, as it allows for the dynamism and adaptability of the legal order. The hermeneutic re-elaboration of the normative texts will be the channel through which the social facts and other material elements can inform the meaning or possible interpretations of the rules and institutions of the legal order. This happens primarily by influencing theoretical and doctrinal works of an expository and didactic nature; and secondarily by influencing the decisions of legal operators and courts. This study seeks to explain how the social context influences legal decisions and the formation of the legal System, from a communicational perspective of Law. In order to do so, it will be necessary to set out two epistemological premises of CTL: the semiotic tripartition of the Theory of Law and the legal Order-legal System distinction. (shrink)

ABSTRACTPeople smugglers help transport migrants across international borders without authorization and in return for compensation. Many people object to people smuggling and believe that the smuggling of migrants is an evil trade. In this paper, I offer a qualified defense of people smuggling. In particular, I argue that people smuggling that assists refugees in escaping threats to their rights can be morally justified. I then rebut the objections that people smugglers exploit migrants, have defective motivations, and wrongly violate the law. (...) My conclusion is that people smuggling is sometimes a permissible way of helping refugees to evade unjust immigration restrictions and compelling states to bear their fair share of the global refugee population. This paper evaluates an argument for immigration restrictions that appeals to the costs that immigration imposes on the citizens of a recipient state. According to this argument, citizens have associative duties to protect each other’s interests, immigration can damage these interests in certain cases, and the associative duties between compatriots justify immigration restrictions in these cases. Call this: the partiality argument for immigration restrictions. I argue that the partiality argument is unsound. Immigration restrictions violate negative duties to refrain from interfering (...) with people’s liberties and these duties silence compatriots’ associative duties to one another. Furthermore, I argue that compatriots lack associative duties to one another in virtue of the fact that the relationships between compatriots reliably cause injustice to outsiders. (shrink)

Este articulo investiga el cada vez más frecuente fenómeno de las intervenciones internacionales noviolentas para la transformación de conflictos y, en concreto, analiza los efectos que pueden tener dichas intervenciones sobre la protección y el empoderamiento de los activistas de derechos humanos que viven en situaciones de riesgo por su trabajo en entornos conflictivos altamente violentos. Para ello se situará el contexto en el que han surgido y se han desarrollado estas iniciativas, analizándose los principales elementos que las caracterizan, y (...) se estudiará el caso de la protección que proporciona Peace Brigades International a los defensores de derechos humanos, lo que permitirá extraer conclusiones relativas a las posibilidades que ofrecen las intervenciones internacionales noviolentas a la comunidad internacional en los campos de la prevención de la violencia, la gestión de conflictos y de construcción de la paz. El presente trabajo busca reflexionar, desde la perspectiva de los estudios interartísticos, sobre la práctica narrativa de Adolfo Couve, escritor y pintor chileno que tematiza el mundo plástico en toda su producción narrativa. A partir de una concepción desprejuiciada respecto de lo marginal, de la fealdad y la miseria, el autor despliega una mirada alterna sobre los espacios de borde en busca de la reivindicación de la miseria, a la vez que relativizar el canon estético que prestigia temas y motivos (...) lejanos al campo de referencia de quienes habitan el borde. La exhibición de aquellos espacios, los personajes y los paisajes minoritarios, su composición plástica y narrativa, sin embargo, dialogan permanentemente con la tradición pictórica de elite. En La nave de los locos los signos propuestos alrededor del tópico de la embarcación recolectora de orates que replica el espacio manicomial, o de los campos de concentración, o de las dictaduras, subraya además el abandono y el despojo de la sociedad y su asentamiento fundamental, la ciudad, que niega una y otra vez la presencia de los perturbadores. En esta circunstancias, creemos que el texto de Cristina Peri Rossi va mutando desde la concepción de la marginación como puro (...) despojo y negatividad, a la asunción del éxodo como instancia de liberación, y por tanto, de superación de las categorizaciones propuestas por el poder. La locura en Los siete locos es resultado de un intento de integración a la realidad sufrido por los personajes revolucionarios, a quienes se les adosa ese otro bloque de sentido, aquel en abierta polémica con el logos imperial que expele a los individuos que no se dejan disciplinar. Con esto, entonces, se intensifica en ellos la insurrección y la diferencia con los disciplinados y posibilita la exploración de otros lugares/no-lugares, además de cartografiar “futuros parajes”, propicios para la asunción de (...) la nueva sociedad. Los locos de Arlt no son producto de una desadaptación social, sino de una adaptación a las condiciones alienadas de la sociedad bonaerense por la que circulan. Madness in Los siete locos is the result of an attempt of integration into reality that is experienced by revolutionary characters, to whom that other type of sense is added; one which is openly opposed to the imperial logo that expels individuals who do not let themselves to be disciplined. Thus, in these characters there is an intensification of the insurrection and distinction from those who are disciplined. This allows the exploration of other places/non-places and also helps to map “future settings” appropriate for the emergence of the new society. Arlt’s madmen are not the result of a social mismatch but of an adaptation to the alienated conditions of the Buenos Aires society that they are part of. (shrink)

States have rights to unilaterally determine their own immigration policies under international law and few international institutions regulate states’ decision-making about immigration. As a result, states have extensive discretion over immigration policy. In this paper, I argue that states should join international migration institutions that would constrain their discretion over immigration. Immigration restrictions are morally risky. When states restrict immigration, they risk unjustly harming foreigners and restricting their freedom. Furthermore, biases and epistemic defects pervasively influence states’ decision-making about immigration policy. (...) States should transfer some of their decision-making authority over immigration to more reliable institutions in order to mitigate the risks that they will unjustly restrict immigration. International institutions that include the interests of potential immigrants would be more reliable with respect to immigration policy than unilateral state decision-making. Many people think that citizenship should not be for sale. On their view, it is morally wrong for states to sell citizenship to foreigners. In this article, I challenge this view. I argue that it is in principle permissible for states to sell citizenship. I contend that, if states can permissibly deny foreigners access to citizenship in some cases, then states can permissibly give foreigners the option of buying citizenship in these cases. Furthermore, I defend the permissibility of selling citizenship (...) against the objections that selling citizenship values citizenship in the wrong way, corrupts civic norms, and unfairly discriminates against poor foreigners. I conclude by noting that, although selling citizenship is not intrinsically wrong, it could still be wrong for states to sell citizenship in practice. If existent immigration restrictions are unjust, then it may be impermissible for states to sell citizenship in the real world. (shrink)

Using a concept she calls authenticity maneuvering to explain how clubs, clubbers, and DJs navigate authenticity, branding, and commercialism, Danielle Hidalgo argues that the strategic use of a rave ethos bolsters acceptance in dance music spaces while also making commercial practices less visible or problematic.

Many organisations in rich countries actively recruit health workers from poor countries. Critics object to this recruitment on the grounds that it has harmful consequences and that it encourages health workers to violate obligations to their compatriots. Against these critics, I argue that the active recruitment of health workers from low-income countries is morally permissible. The available evidence suggests that the emigration of health workers does not in general have harmful effects on health outcomes. In addition, health workers can immigrate (...) to rich countries and also satisfy their obligations to their compatriots. It is consequently unjustified to blame or sanction organisations that actively recruit health workers. (shrink)

The aim of this article is to analyse the internal mechanisms of corporate governance (board of directors and ownership structure), which influence voluntary disclosure of intangibles. The results appear to corroborate the view that an increase in institutional investor shareholding has a negative effect on voluntary disclosure, supporting the hypothesis of entrenchment, whereas an excessive ownership by institutional investors may have adverse effects on strategic disclosure decisions. The results also indicate that an increase in the number of members of the (...) board to up to 15 has a beneficial effect on the disclosure of intangibles. However, as this number increases, the effect inverts and becomes adverse to improving the capacity for supervision and control in the decision-making process regarding the voluntary disclosure of intangibles. The findings endorse the recommendation of the most of the Corporate Governance Codes regarding an advisable maximum of 15 members on a board to ensure its effectiveness and internal cohesion. For example, unauthorized immigrants cross borders without official permission, and other actors, such as people smugglers, assist them in doing so. How should we evaluate resistance to immigration law from a moral perspective? In this article, I survey recent work on the ethics of resisting immigration law. In particular, I examine three categories of resistance to immigration law as the following: unauthorized immigration, people smuggling, and citizens' resistance to laws that (...) prohibit them from assisting or interacting with unauthorized immigrants. This essay explains why there are good reasons to practice philosophy as a way of life. The argument begins with the assumption that we should live well but that our understanding of how to live well can be mistaken. Philosophical reason and reflection can help correct these mistakes. Nonetheless, the evidence suggests that philosophical reasoning often fails to change our dispositions and behavior. Drawing on the work of Pierre Hadot, the essay claims that spiritual exercises and communal engagement mitigate the (...) factors that prevent us from living in accord- ance with our conceptions of the good life. So, many of us have reasons to engage in philosophical reasoning along with behavioral, cognitive, and social strategies to alter our behavior and attitudes so that they’re in line with our philosophical commitments. El relativismo acerca de las atribuciones de conocimiento de John MarFarlane pretende ser una teoría que explica la corrección de las intuiciones centrales que tenemos acerca de ellas. Sin embargo, el relativismo es incompatible con la corrección de algunas intuiciones que tenemos con respecto a casos de Stanley, a conjunciones de estos casos y a casos en los que la situación práctica del evaluador es menos apremiante que la del sujeto o la del emisor de la atribución. Esto, no obstante, (...) no señala un límite a las posibilidades del relativismo, sino que insta a dar versiones más sofisticadas del mismo. MarFarlane's relativism about knowledge attributions aspires to be a theory that explains why the central intuitions about them are correct. Nevertheless, relativism is incompatible with the accuracy of some intuitions about Stanley's cases, with conjunctions of them and with intuitions about cases in which there is less at stake from the assessor than what is at stake from the subject or the attributor. Nevertheless, this doesn't establish a limit to the possibilities of relativism, but calls for an improvement of it. (shrink)

La magia de varios grupos wiccanos se encamina hacia la espiritualidad y alabanza de un Dios creador, algo semejante con la filosofía católica. De igual forma, su estudio por la naturaleza y su aplicación en rituales se (...) enfocan en el autoconocimiento y la conexión con el universo. Los factores como la globalización y modernización actúan de manera crucial en las impresiones colectivas que se tiene sobre la brujería. (shrink)

La autora destaca la ausencia de protagonismo de la mujer en la historia previa al siglo XX, a partir del predominio de los esquemas patriarcales, en un contexto de desigualdad, discriminación y violencia social organizadas a partir de relaciones de poder. Localiza luego este contexto cultural en la experiencia del ejercicio del poder en América Latina, y en sus vínculos con la feminidad, etnicidad y pobreza, con los procesos de constitución de la subjetividad, y en su relación con los procesos (...) de lenguaje. Propone finalmente que la cultura del terror en la que nos encontramos encerrados debe ser demolida, y nos invita a abrirnos a la heterogeneidad que caracteriza la realidad latinoamericana. (shrink)
