2018 marked the centenary of Wesley Hohfeld’s untimely passing. Curiously, in recent years quite a few legal historians and philosophers have identified him as a Legal Realist. This article argues that Hohfeld was no such thing, that his work need not be understood in such lights, and that he in fact made a smaller contribution to jurisprudence than is generally believed. He has nothing to do with theories of official decision-making that identify “extra-legal” factors as the real drivers (...) of judicial decision-making, and nor must his schema of jural relations advance a “Realist” political agenda. Distinguishing Hohfeld from the Realists will correct some misunderstandings about his work and demonstrate its utility in many more contexts than a Realist reading of it allows. (shrink)

It is increasingly common in the philosophical literature to claim that political legitimacy, normatively understood, comes in degrees. However, most authors fail to specify what talk of degrees means, and the notion remains opaque. Using the Hohfeld schema as a guide, I survey possible accounts, distinguishing them into “width”, “depth”, and “weight” proposals. I argue that each fails to provide a convincing account of scalar legitimacy. Thus, talk of degrees of legitimacy, as currently used, is in serious need (...) of explanation. (shrink)

It is common in the literature to claim that legitimacy is the right to rule and that, accordingly, Hohfeldian rights analysis can be used to understand the concept. However, we argue that authors in the legitimacy literature have not generally realised the full potential of Hohfeldian analysis. We discuss extant approaches in the literature that conceptually identify legitimacy with one particular Hohfeldian incident, or, more rarely, a determinate set of incidents. Against these views, and building on parallel debates in property (...) theory, we suggest that Hohfeldian analysis pushes one towards the claim that legitimacy possesses no determinate essence. We provide a rationale for this novel view and disarm a series of objections. (shrink)

This chapter explicates and critically assesses RIGHTS CORRELATIVITY. Section II addresses three core issues. The first concerns the conceptual structure of the tethered positions: does correlativity mean that the positions’ features must be symmetrical? Are correlative rights and duties the “mirror images” of one another, or not? A second issue is Existential correlativity: must the positions invariably co-obtain, or can one exist with the other(s)? Can there be a right without a correlative duty, and vice versa? A third issue concerns (...) Justificational correlativity: must all correlative relationships be explained in terms of one position grounding the other(s)? Is it always the case that A’s right is the reason for B’s duty, the basis for imposing a duty on B in the first place? Section III then demonstrates how Wesley Hohfeld’s understanding of rights correlativity motivated all of the novel features in his schema of jural relations, some of which I defend from criticisms. Hohfeld’s analysis on the different types of rights and duties is highly influential in analytical legal theory, and it is considered as a fundamental theory in AI&Law and normative multi-agent systems. Yet a century later, the formalization of this theory remains, in various ways, unresolved. In this paper I provide a formal analysis of how the working of a system containing Hohfeldian rights and duties can be delineated. This formalization starts from using the same tools as the classical ones (...) by Kanger and Lindahl used, but instead of focusing on the algebraic features of rights and duties, it aims at providing a comprehensive analysis of what these rights and duties actually are and how they behave and at saying something substantial on Power too—maintaining all along the Hohfeldian intentions that these rights and duties are sui generis and inherently relational. There seems to be no dimension of bodily awareness that cannot be disrupted. To account for such variety, there is a growing consensus that there are at least two distinct types of body representation that can be impaired, the body schema and the body image. However, the definition of these notions is often unclear. The notion of body image has attracted most controversy because of its lack of unifying positive definition. The notion of body schema, onto which there (...) seems to be a more widespread agreement, also covers a variety of sensorimotor representations. Here, I provide a conceptual analysis of the body schema contrasting it with the body image as well as assess whether the body schema can be specifically impaired, while other types of body representation are preserved; and the body schema obeys principles that are different from those that apply to other types of body representation. Wesley Newcomb Hohfeld was an American jurist who published a series of articles between 1909 and 1917 that were very important for 20th century analytical philosophy of right. In these articles, Hohfeld analyzed how jurists and judges alike use the word ‘right’ to speak of the rights of groups and individuals. Since he presented his articles, it has been commonplace among ‘hohfeldian specialists’ to distinguish rights into four groups: privileges, or claims, powers and immunities. This paper has four (...) sections. In section I, I present Hohfeld’s notion of privilege and point to a difficulty that has long been known by specialists, namely, that there are actually two significantly different legal relations that this notion is supposed to cover. In section II, I analyze and criticize the way proposes we should define these two legal relations. In section III, I do the same with suggestion proposed by. The paper intends to show, that W. N. Hohfeld's theory of fundamental jural relations is relevant to economic theory, and that Hohfeld's system can be reconstructed by the concepts of 'liberty space' and 'ability space', understood as an agent's Spielraum for action. The first half of the paper is devoted to an exposition of Hohfeld's system and to the question of its relation to the economic analysis of property rights. The second half concerns Spielraum theory and the (...) reformulation of Hohfeldian distinctions in terms of liberty spaces and ability spaces. It is argued that the reformulation is useful, inter alia, for describing exchange of property rights by contract. El artículo intenta mostrar: que la teoría de las relaciones jurídicas fundamentales de W. N. Hohfeld es relevante para la teoría económica y que el sistema de Hohfeld puede ser reconstruido mediante los conceptos de "espacio de libertad" y "espacio de capacidad", entendidos como el Spielraum para la acción del agente. In section I, I analyze and clarify the definition of the concept of duty that we find in Hohfeld (1913) to show that it was employed in order to denote a legal obligation and that this use is purely descriptive. In section II, I discuss what kinds of duties may appear as correlatives of privileges and claims inside a Hohfeldian model. In section III, I conclude with a brief summary of the argument. Wesley Hohfeld is known the world over as the legal theorist who famously developed a taxonomy of legal concepts. His contributions to legal thinking have stood the test of time, remaining relevant nearly a century after they were first published. Yet, little systematic attention has been devoted to exploring the full significance of his work. Beginning with a lucid, annotated version of Hohfeld's most important article, this volume is the first to offer a comprehensive look at the scope, (...) significance, reach, intricacies, and shortcomings of Hohfeld's work. Featuring insights from leading legal thinkers, the book also contains many of Hohfeld's previously unseen personal papers, shedding new light on the complex motivations behind Hohfeld's projects. Together, these selected papers and original essays reveal a portrait of a multifaceted and ambitious intellectual who did not live long enough to see the impact of his ideas on the study of law. Cultural schemas are a central cognitive mechanism through which culture affects action. In this article, we develop a theoretical model of cultural schemas that is better able to support empirical work, including inferential, sensitizing, and operational uses. We propose a multilevel framework centered on a high-level definition of cultural schemas that is sufficiently broad to capture its major sociological applications but still sufficiently narrow to identify a set of cognitive phenomena with key functional properties in common: cultural schemas are socially (...) shared representations deployable in automatic cognition. We use this conception to elaborate the main theoretical properties of cultural schemas, and to provide clear criteria that distinguish them from other cultural or cognitive elements. We then propose a series of concrete tests empirical scholarship can use to determine if these properties apply. We also demonstrate how this approach can identify potentially faulty theoretical inferences present in existing work. Moving to a lower level of analysis, we elaborate how cultural schemas can be algorithmically conceptualized in terms of their building blocks. This leads us to recommend improvements to methods for measuring cultural schemas. We conclude by outlining questions for a broader research program. (shrink)

This article explores the ethics of migrant marketers in Guangzhou. Data were collected from 357 migrant marketers who lived in Guangzhou. A model of Ethical Action has been developed to test the antecedents and outcomes of the ethical decision-making process. It measured moral intention using four ethical scenarios. The results show that the egoistic schema had a positive effect on their intention to act unethically, while the legislative schema exerted a negative effect. The results confirm that moral intention (...) was a strong predictor of an individual's subsequent actual behavior, and it fully mediated the influence of the legislative schema on actual behavior. This study adds to ethics literature by incorporating the construct of social identity and found a moderating effect between the legislative schema and moral intention. The relationships were stronger for individuals who were lower rather than higher in social identity. Analysis of these results lead to a discussion of the implications for marketing ethics in China. In this paper we present a schema for describing dualities between physical theories, and illustrate it in detail with the example of bosonization: a boson-fermion duality in two-dimensional quantum field theory. The schema develops proposals in De Haro : these proposals include construals of notions related to duality, like representation, model, symmetry and interpretation. The aim of the schema is to give a more precise criterion for duality than has so far been considered. The bosonization example, or (...) boson-fermion duality, has the feature of being simple, yet rich enough, to illustrate the most relevant aspects of our schema, which also apply to more sophisticated dualities. The richness of the example consists, mainly, in its concern with two non-trivial quantum field theories: including massive Thirring-sine-Gordon duality, and non-abelian bosonization. This prompts two comparisons with the recent philosophical literature on dualities:--- Unlike the standard cases of duality in quantum field theory and string theory, where only specific simplifying limits of the theories are explicitly known, the boson-fermion duality is known to hold {\it exactly}. This exactness can be exhibited explicitly. The bosonization example illustrates both the cases of isomorphic and {\it non-isomorphic} models: which we believe the literature on dualities has not so far discussed. (shrink)

The way in which a schema represents something is precisely by abstracting from some of its features; in a schema, representation and abstraction are thus not opposed to each other but rather internally related. The first part of this paper investigates this internal relation by delineating Kant’s concept of schema as the term mediating concept and intuition. Due to its pivotal position, however, the schema tends to collapse either into the conceptual or into the intuitive. The (...) second part of the paper turns to Heidegger who tries to overcome this difficulty: he does not conceive the schema as a supplementary representation that connects already determinate concepts and intuitions, but rather locates schematization immanently in the very articulation of concept and intuition themselves. The third part of the paper proposes that the schematicity of our representations can be reflected in three pictorial strategies that are important for contemporary art: reduction, serialization, and reconstruction. These strategies are exemplified in certain images which put us in a position to see through our own representational form, as it were, and observe the procedures of figuration involved in that very form. In this paper, I want to engage in, and move forward, a heated contemporary debate over certain normative positions within the well-known Hohfeldian table of legal relations – a table of dramatic explanatory power. After outlining the uncontroversial core of the table, I will leave the realm of uncontroversiality to enter the realm of controversy. I will enter, and stake out a stance in, a debate over the no-right position. Upon introduction of no-rights, a splinter occurs. There are two positions (...) one might take on no-rights, which I call the Strict Hohfeldian and the Dual. My paper offers decisive reason to favour the latter. Lest there be any doubt – arising from the paper’s chief focus on no-rights – the conclusion is one of great philosophical significance: by the paper’s end, we will, if only at the high level of abstraction at which this paper is pitched, have a complete understanding of Hohfeld’s table. Two areas of importance for agents and multiagent systems are investigated: design of agent programming languages, and design of agent communication languages. The paper contributes in the above mentioned areas by demonstrating improved or novel applications for deontic logic and normative reasoning. Examples are taken from computer-supported cooperative work, and electronic commerce.

Jakob von Uexküll’s problematic is manifested in his paradoxical portraiture of form within the plan of nature: the one a sensual schema and the other a transsensual ideal form. At first sight, Uexküll’s belief in the Platonic and the Reformational notions of the immobile becoming of form seems to be a resignation from the heated debates among his contemporary materialists, vitalists, dynamists, and evolutionists. However, in terms of the Kantian subjective teleology, Uexküll’s appropriation of the ancient philosophy reinstates the (...) invisible, static, but repetitive cycle as his regulating principle in the observation of the activity of animals. This regulating principle distinguishes itself from the rule of resemblance established by the appearances and fossil remains of animals, which is linear, incomplete, and digressive. In the light of Michel Foucault, the transition from the visible to the invisible recoups the study of nature from the living beings (les êtres vivants) to the life itself (la vie), from natural philosophy to biology. My study suggests that we recast Uexküll’s sign theory from his observations on the crux that models and triggers an animal to action in its Umwelt. Bracketing Uexküll’s transcendental configuration of form and image, we still find that schema, in itssensual and functional context, evolves from a reflection of the objects to a summary of their features plus an ignorance of their proper names. Uexküll's erasure of proper names (in different languages) that directs our attention to the presentation in its pure form (Gestalt) not only constitutes an important step in epistemology, but also in a life science that meticulously delves into the genotypes. This chapter presents an account of Merleau-Ponty’s interpretation of the body schema as an operative intentionality that is not only opposed to, but also complexly intermingled with, the representation-like grasp of the world and one’s own body, or the body image. The chapter reconstructs Merleau-Ponty’s position primarily based on his preparatory notes for his 1953 lecture ‘The Sensible World and the World of Expression’. Here, Merleau-Ponty elaborates his earlier efforts to show that the body schema is a perceptual (...) ground against which the perceived world stands out as a complex of perceptual figures. The chapter clarifies how Merleau-Ponty’s renewed interpretation of the figure-ground structure makes it possible for him to describe the relationship between body schema and perceptual (body) image as a strictly systematic phenomenon. Subsequently, the chapter shows how Merleau-Ponty understands apraxia, sleep, and perceptual orientation as examples of dedifferentiation and subtler differentiation of the body-schematic system. The last section clarifies how such body-schematic differentiating processes give rise to relatively independent superstructures of vision and symbolic cognition which constitute our body image. It, moreover, explains how, according to Merleau-Ponty, the cognitive superstructures always need to be supported by praxic operative intentionality to maintain their full sense, even though, in some cases, they have the power to compensate for praxic deficiencies. Experimenting Thinking in Image Schemas. Teenagers are Wondering “Where Do Thoughts Come From?”. An intellectual view of philosophy as an activity focusing on understanding abstract concepts and their relationships deprives philosophical exercise of the participation of the body and senses. If we reject the mind-body dualism, as Dewey, Johnson, etc. did, then we are constantly engaged in interactions with the world and others, and can thus consider the act of thinking from our own experiences. Inspired by an experimentalist conception of (...) school and life, as well as the method of inquiry developed by Dewey, the Philosophy for Children program provides an inquiry process that invites participants to conceptualize and reason philosophically in a collaborative manner. Do these practices implement an embodied cognition? To find out, we selected a discussion as a case study and analyzed it based on the observation that the issue to be discussed by the participants - “where do thoughts come from?” contains two image schemas: path (come from) and source (where). We have noted a variety and a significant number of expressions (“they come from within”, “they come from what happens outside”, etc.) whose analysis enhances a better understanding of how an experience of understanding the origins of our thoughts fits into the discourse and contributes to a collective conceptualization of “thinking”. A body schema is an agent's model of its own body that enables it to act on affordances in the environment. This paper presents a body schema system for the Learning Intelligent Decision Agent (LIDA) cognitive architecture. LIDA is a conceptual and computational implementation of Global Workspace Theory, also integrating other theories from neuroscience and psychology. This paper contends that the ‘body schema' should be split into three separate functions based on the functional role of consciousness in (...) Global Workspace Theory. There is (1) an online model of the agent's effectors and effector variables (Current Body Schema), (2) a long-term, recognitional storage of embodied capacities for action and affordances (Habitual Body Schema), and (3) "dorsal" stream information feeding directly from early perception to sensorimotor processes (Online Body Schema). Negative self-schemas are fundamental to social anxiety disorder and contribute to its persistence, thus understanding how to change schemas is of critical importance. Memory-based interventions and associated theories propose that reconstructing autobiographical memories tethered to schemas with conceptual details that challenge the associated expectations will lead to schema change. Here, we test this proposal in a between-subjects behavioural experiment with undergraduate participants with social anxiety. All participants were asked to recall aversive social memories, evaluated these memories on a series (...) of scales, including estimates of reoccurrence, and provided ratings of negative and positive schema beliefs. Next, half the participants reconstructed (rescripted) these aversive memories with conceptual details that challenged the active schema (conceptual condition) and the other half reconstructed the memories with additional experiential details (perceptual condition). All participants provided again evaluations of the original memory and their schema beliefs. Our analysis revealed that the conceptual condition led to significant reductions in negative self-schemas, increases in positive self-schemas, and decreases in estimates of future negative event reoccurrence. Thus, effective schema-change, both a weakening of negative schemas and a strengthening of more positive, adaptive schemas, is dependent on altering the underlying meaning of associated autobiographical memories. This study investigates the relationship between moral schemas and corruption in public procurement. It adopts a moral schema framework to examine procurement-induced corruption from Uganda. Experiences, attitudes, and values of respondents are used to construct future behavior of public procurement staff. The schema framework was built around the premise that procurement-related corruption is a function of the social framework and human nature paradox, constructing logical justification for the acts of corruption. The study uses data from 474 public procurement (...) staff to demonstrate that social identity, ethical egoistic, legislative, amoral, and religious moral schemas account for 78.51% of the variance in moral schema of respondents. All these schemas were found to be significant predictors, accounting for 73.3% of public procurement corruption. The paper urges managers of procuring and disposing entities to utilize moral scripts in reducing corruption. Managers are encouraged to engage in morally responsible behaviors to promote ethics and value-for-money transactions. The paper provides an alternative framework for examining corruption in sub-Saharan Africa where explicit elaboration of insights on corruption is still lacking. (shrink)

Both these notions refer to the idea that the nation must find an institutional and imaginary mechanism in order to transfer and reproduce at a political level the symbolic function which binds the succession of generations under the sign of ‘cultural heritage’ and ‘hereditary identity’. A careful analysis shows how these notions are the residue of the idea of ‘race’ after the de-legitimation of its application to the violent discrimination of colonial subjects, or descendants of slaves, or ethnic alterity. It can be understood how the notion of race, whatever biological justification is adopted, was nothing else than a mythological construction, its aim being to support the idea that reproduction, transmission, education, memory, tradition, occur within the limits of a community with a recognizable identity. In this article, I provide an account of the development of the "translate" concept from the verbs used in Old English through the Middle English period, including the establishment of the Latin-based translate. The development and current pattern of polysemy are described through the elaboration of a Lakoffian cognitive model structured by image schemas and various types of action on those schemas--more specifically combination, dissolution, and metaphoric projection. Concordance and corpus data illustrate the development at various stages.

This review evaluates pros and cons of the schema theory as a general framework for expressing what Arbib et al. call “systems neuroscience.” We discuss the software/hardware duality of the schema concept and the relative neglect of the mechanical properties of muscles. We propose a computational alternative to the functional decomposition in terms of schemas.

Most research on image schema examined the meaning configuration of words connotation. However, previous studies of adjectives are meaningful in cognitive linguistics because they provide insight into how those adjectives are involved with psychological movement. In this sense, from the perspective of cognitive linguistics, one’s conceptualization and cognition are closely associated with their bodily experience and surroundings; adjectives are no exception. The varieties of transformations of image schemas lay the foundation for the conception and perception. Accordingly, this study is (...) an investigation into the perception of adjectives and psychological activities associated with image schema. Data in this study come from adjectives in the novel The Great Gatsby, which were tagged and calculated with the help of software Python and the NLTK package. The results demonstrate that a significant amount of adjectives were used in the novel. Moreover, Nick’s psychological activities changed significantly from the SOURCE to the DESTINATION schematic stage, which is uncovered by his expression of adjectives. Finally, the results further suggest that transformations of image schema as BALANCE, CONTAINER, and PATH work together to motivate one’s linguistic expression of adjectives. The present findings have several implications for research on lexicons and literacy interpretation from cognitive linguistics. (shrink)

The paper begins by defending the Hohfeldianaccount of rights (as equivalence relations) from thecharge that it cannot capture their specialsignificance, and thus cannot be used in a right-basedmoral theory. It goes on to argue that, because of amisunderstanding of this relational account, theconception of right-based morality that has emerged inrecent years has been variously flawed from theoutset. A particular form of explanatory priority waswrongly taken to be essential, and then eitherincoherently combined with equivalence, or taken to bea reason for rejecting (...) equivalence where right-basedthinking is concerned. In fact, this form of priorityis not sufficient for establishing a right-based moraltheory. This article engages with Jaffey's recent contribution on the nature of no-prior-duty remedial obligations. Jaffey's use of a right-liability relation and his challenge to Hohfeld's analytical scheme are rejected as unsound. An alternative model distinguishing three pathways to account for remedial obligations and other legal consequences is proposed. This draws on the Hohfeldian scheme but extends it to permit the full expression of reflexive liabilities, mutually correlative liabilities, and the operation of nonhuman conditions. The proposed approach also recognizes a (...) weaker form of a Hohfeldian power, which is required in considering the way that the law deals with the allocation and realization of risk. (shrink)

In this paper, we argue that rather than exclusively focusing on trying to determine if an idealized model fits a particular account of scientific explanation, philosophers of science should also work on directly analyzing various explanatory schemas that reveal the steps and justification involved in scientists’ use of highly idealized models to formulate explanations. We develop our alternative methodology by analyzing historically important cases of idealized statistical modeling that use a three-step explanatory schema involving idealization, mathematical operation, and explanatory (...) interpretation. Ernst Brücke’s 1861 essay Die Elementarorganismen has often been cited as a watershed in the history of physiology as well as in the history of cell theory. In its time it was widely read as a reform of animal cell theory, shifting the concept of the cell away from Schleiden and Schwann’s original cell schema of a membranous vesicle with a nucleus, and towards the protoplasm theory that had developed in botany, centered on the cell’s living contents. It was (...) also notorious for its arguments against the necessity of both the nucleus and the cell membrane. An English translation of “The Elementary Organisms” is presented for the first time in this journal issue, with annotations and illustrations, doi:10.1007/s10739-024-09773-9. Brücke’s essay was not only an intervention into cell theory: historians can read it as a continuation of debates on the nature of the organism and theories of organization, and as an epistemological meditation on the microscope. This volume expands the concept and role of the schema, with three goals in mind: 1) to outline the continuing issues in the schema concept as the legacy of Kant's concept and analysis, 2) to show that Kant's challenges resulted in successful but truncated views of the schema and its functions, 3) to reconstruct Otto Selz's schema concept by proposing an alternative. The basis and scope of Selz's schema were intended to yield a more complete (...) follow-up to Kant's challenges. These had emerged out of his unresolved view of the schema as knowledge, on one hand, and thought, on the other. Sel'z concepts-'anticipatory schema,' 'coordinate relations,' and 'knowledge complex'-are more inclusive and psychologically dynamic than those of the influential but reductionist theorists: Piaget, Bartlett, and Craik. Harwood Fisher explores Sel'z ideas in past, present, and future temporal contexts. His predecessors' and his contemporaries' ideas influenced him. Present-day needs and future prospects round out a Selzian conception of the schema that would enrich a psychology of thought and knowledge. A direct equivalence between neural function and neural structure does not provide a fruitful approach to understanding brain functioning. Arbib et al. describe a new and powerful approach to circumvent this problem, which they call schema theory. However, in examples they fall prey to the tradition of finding such equivalences, not doing schema theory justice.

This article addresses a still unsolved puzzle in private law regarding the proper explanation of cases in which courts make substantial awards of damages to claimants whose rights have been infringed, but who appear to have suffered no factual loss in consequence of the infringement. The paradigm examples tend to involve awards of ‘user’, license fee or ‘hypothetical bargain’ damages in cases involving interference with property rights. It suggests that existing explanations of such cases are all unsatisfactory in one or (...) another respect and posits a new and potentially more powerful explanatory thesis, drawing on Hohfeld. Such awards, it argues, compensate right-holders for the loss of legal powers associated with their primary claim-rights—in particular, the loss of powers they are accorded by the law to ‘prevent’ the infringement of certain types of primary claim right ex ante. Legal powers are thus to be regarded as assets or amenities, the loss of which is amenable to monetary compensation. (shrink)

Thirty years ago, I elaborated on a position that could be seen as a compromise between an "extreme," symbol-based AI, and a "neurochemical reductionism" in AI. The present article recalls aspects of the espoused framework of schema theory that, it suggested, could provide a better bridge from human psychology to brain theory than that offered by the symbol systems of A. Newell and H. A. Simon.

With Religious Schema Scales in the West, Truth of Texts and Teachings correlates negatively with the commitment to interreligious dialogue recorded by Xenosophia. This measure of fundamentalism also predicts problematic religious and psychosocial functioning. The present project examined Religious Schema Scales in university students and Islamic seminarians in the Muslim cultural context of Iran. Truth of Texts and Teachings correlated positively rather than negatively with Xenosophia and predicted religious and psychological adjustment. The adaptive implications of Truth of Texts (...) and Teachings were especially evident in Islamic seminarians. These results supplemented previous Religious Schema data from India and Malaysia in suggesting that fundamentalism may have more positive implications outside the West. Cross-cultural differences in fundamentalism more generally support arguments of an Ideological Surround Model that the incommensurability of religious and other social rationalities requires careful research attention. Human cognition is often taken to be a rule-governed system of representations that serve to guide our beliefs about our actions in the world around us. This view, though, has two problems: it must explain how the conceptually governed contents of the mind can be about objects that exist in a non-conceptual world, and it must explain how the non-conceptual world serves as a constraint on belief. I argue that the solution to these problems is to recognize that cognition has (...) both empirical and apriori elements. While neither approach can function in isolation from the other, the empirical approach resolves the first of these problems while apriori structures of rational cognition overcome the second. Taken together, these two views offer a promising solution to the two problems of mental content. (shrink)

ABSTRACTThe new paradigm in the psychology of reasoning redirects the investigation of deduction conceptually and methodologically because the premises and the conclusion of the inferences are assumed to be uncertain. A probabilistic counterpart of the concept of logical validity and a method to assess whether individuals comply with it must be defined. Conceptually, we used de Finetti's coherence as a normative framework to assess individuals' performance. Methodologically, we presented inference schemas whose premises had various levels of probability that contained non-numerical (...) expressions and, as a control, sure levels. Depending on the inference schemas, from 60% to 80% of the participants produced coherent conclusions when the premises were uncertain. The data also show that except for schemas involving conjunction, performance was consistently lower with certain than uncertain premises, the rate of conjunction fallacy was consistently low (not exceeding 20%,.. 120 students in grades 3 to 7 (aged 8 to 13) heard an argumentative text and were immediately submitted to a free recall task. The results show that before grade 7, the subjects did not view the text as argumentative. The discussion centers on the relevancy of a prototypical argumentative schema in accounting for these findings.

I define T-schema deflationism as the thesis that a theory of truth for our language can simply take the form of certain instances of Tarski's schema (T). I show that any effective enumeration of these instances will yield as a dividend an effective enumeration of all truths of our language. But that contradicts Gödel's First Incompleteness Theorem. So the instances of (T) constituting the T-Schema deflationist's theory of truth are not effectively enumerable, which casts doubt on the (...) idea that the T-schema deflationist in any sense has a theory of truth. A model called the “semiotic ladder,” which consists of “consecutive semiotic squares,” is proposed in this paper, through which the meanings of the deep structure of a narrative can be depicted as fluid and dynamic. It shows the stages of producing meanings in the narrative, from beginning to end. To see this, several narratives in the epic and mythological genres are analyzed in order to discover their abstract and deep structural meanings, and to prove the dynamic nature of meaning in (...) the semiotic ladder. According to the analysis, the process of the semiotic ladder depicts the displacement and fluidity of narrative meanings using consecutive semiotic squares, and this pattern can be applied to and implemented in all narratives. Also, the semiotic ladder allows us to clearly observe the pattern of movement of the narrative subject schema in the path of accomplishing the object. (shrink)

There are two importantly different ways in which consciousness resists incorporation into our familiar object-based conceptual schema which, when analysed, help to explain why it is regarded as such a philosophically recalcitrant phenomena. One concerns the nonconceptual nature of basic forms of conscious experience, the other concerns the fact that attempts to understand the nature of such experience in an object-based schema, as is demanded by some forms of physicalism, is inappropriate. My concern in this paper is to (...) show how certain central problems concerning our attempts to understand consciousness can be recast or dissolved if we take note of these aspects of phenomenal experience. Before addressing these issues a few words of clarification are in order. Without refinements, talk of schema has Kantian overtones. For example, consider Tye’s claim that, “Once the sensory input is brought under the appropriate schema, belief formation can take place” .1 Nevertheless, it is useful to talk of ‘schema’ specifically in order to waylay confusion with an issue, which Davidson long ago advertised about the impossibility of there being radically different conceptual schemes. Since I will be denying that our concepts of phenomenal consciousness can be incorporated into an object-based schema, it might be thought that advocating the existence of incommensurable conceptual schema ignores Davidson’s important lesson concerning radically different conceptual schemes. In this paper, we analyze the effect of the speed on the task of random number generation. Each subjectgenerates the sequences of ``random'' numbers under various speed conditions. In addition to the 16 indiceswhich have been used in the past studies, we introduce and calculate the new indices called the ``frequency ofschema''. From the statistical analysis, we find that there is an obvious change, along with the speed, in theproperties of sequences, indicating the transition of the underling information processing.
