Priority-setting policy-makers often face moral and political pressure to balance the conflicting motivations of efficiency and rescue/non-abandonment. Using the conflict between these motivations as a case study can enrich the understanding of institutional design in developed democracies. This essay presents a cognitive-psychological account of the conflict between efficiency and rescue/non-abandonment in health care priority-setting. It then describes three sets of institutional arrangements—in Australia, England/Wales, and Germany, respectively—that contend with this conflict in interestingly different ways. The analysis yields (...) at least three implications for institutional design in developed democracies: (1) indeterminacy at the level of moral psychology can increase the probability of indeterminacy at the level of institutional design; (2) situational constraints in effect require priority-setting policy-makers to adopt normative-moral pluralism; and (3) the U.S. health care system may be in an anti-priority-setting equilibrium. Habermas's conception of deliberative democracy could be fruitfully supplemented with a discussion of the "institutional design" of civil society; for example the architecture of public spaces should be considered. This paper argues that Hegel's discussion of architecture in his 'Aesthetics' can speak to this issue. For Hegel, architecture culminates in the gothic cathedral, because of how it fosters reflection on the part of the worshiper. This discussion suggests the possibility that architecture could foster a similar kind of intersubjective (...) reflection. To make his thoughts more pertinent for current debates, Hegel's views are adapted to fit three contemporary secular institutions. (shrink)

In recent years, applied ethics has taken on board the various dimensions of public reason that can no longer be reduced to the political construction of a common will. While the question of a just society has traditionally been found in the political dimension, the state and its institutions, current globalization has broken this state monopoly over what is public, opening the way for other institutional actors with the same or greater power to intervene in the public space, actors (...) that have little or nothing to do with representation, majority rule, etc. As the current financial downturn clearly demonstrates, states are pandering to the markets, striving to ‘get their houses in order’ to meet the demands imposed by the global financial magnates. It seems, at least to most citizens, that public politics, like the state’s capacity to deal with social and economic rights, no longer depends on either governments or their ability to govern. So should they be left out of a public reason that is capable of explaining whether they are just or otherwise? The ethical perspective –known to be a critical perspective– cannot remain silent about this new scenario. The present proposal attempts to combine applied ethics, which takes in the logic of social practices, with new contributions from institutional design theories that set out to analyse the power and responsibility of these institutions from ‘inside’, as institutional actors. In this short paper my analysis focuses on the ethical dimension of institutional design, specifically in a proposal for an institutional ethics that is a fundamental part of any applied ethics. The paper aims to explain in what way we can speak of an institutional morality to demonstrate that these civil society institutional actors hold some of the responsibility for facing the problems of defining and managing what is public. What kind of political systems should there be? In this paper I examine two competing principles of institutional design — an instrumental view, which maintains that one should design institutions so as to realize the most plausible conception of justice, and a democratic view, which maintains that one should design institutions so as to enable persons to participate in the decisions that impact their lives. I argue for a mixed view that combines these two principles. In (...) the second stage of the argument, I draw on this principle of institutional design to argue for the need for suprastate institutions. These are required to protect persons’ core basic rights and, over and above that, they are needed to provide fair and legitimate procedures for choosing which rules should govern the global economy and environment. The third stage of the argument develops this account by elaborating on what features global institutions must possess for them to perform these two distinct kinds of roles. (shrink)

Steffen Ganghof’s Beyond Presidentialism and Parliamentarism can improve existing typologies in comparative government and has great potential for discussions about democratic innovation and reform. So far, democratic innovations like deliberative mini-publics have remained mostly additive, leaving the underlying decision-making logics of representative political systems unchanged. Ganghof’s ideas can move debates about how deliberative democracy is to be institutionalized forward. Semi-parliamentary government constitutes an intriguing option to meet both demands for legislative flexibility and responsiveness to citizens’ concerns and demands for stability (...) and accountability. At the same time, I identify a limitation of the book in the fact that Ganghof’s normative theory of democracy remains thin. To appeal to citizens in constitutional reform processes, proposals for semi-parliamentary reform need to do more than reconcile conflicting visions of majority rule. They need to speak to democracy’s central promises of equal autonomy and rationality. (shrink)

The task of designing effective economic and political institutions requires substantial foresight. The designer must anticipate not only the behavior of individual actors, but also how that behavior will aggregate. Rising complexity brought about by increases in speeds of adaptation, diversity, connectedness, and interdependence make institutional design all the more challenging. Given the focus on equilibria, the extant literature on mechanism design might appear incapable of coping with this complexity. Yet, I suggest that a deeper engagement with (...) the origins of the mechanism-design framework reveals insights that may help us design robust, adaptive institutions that can harness complexity. Health-care goods are goods with peculiar properties, and where they are scarce, societies face potentially explosive distributional conflicts. Animated public and academic debates on the necessity and possible justice of limit-setting in health care have taken place in the last decades and have recently taken a turn toward procedural rather than substantial criteria for justice. This article argues that the most influential account of procedural justice in health-care rationing, presented by Daniels and Sabin, is indeterminate where concrete properties of rationing (...) institutions are concerned. Such properties inscribe substantial norms into institutions. These norms can derive validity only from democratic majority decisions, which must be seen as an instance of pure procedural justice. We therefore have to move the discussion to a meta-level and ask how concrete properties of institutions are being chosen. I suggest four criteria for sufficiently democratic institutional design choice and conclude that as institutional properties are likely to have effects on the resulting distribution of health care, design choices should be empirically informed and taken both democratically and deliberately. In what way do the corporatist and authoritarian legacies that modelled some Latin American labor institutions influence the opportunities for and restrictions on organizing workers in a new context? To what extent did institutional designs, together with other economic and political factors, influence the characteristics that currently distinguish the union organizations in the countries of the region? Taking into consideration the existence of a broader debate about the consequences of globalization and political democratization for unions, the contribution of historical (...) institutionalism and previous research, in this Article I compare the institutional and organizational dynamics of unions in four countries with authoritarian legacies and corporatist traditions. The Article argues that in spite of these shared traditions, the differences in the institutional designs — which have scarcely been considered in the specialized literature — have historically imposed distinctive features on the associational power of workers and unions. These features not only persist to the present day, but also translate into dissimilar trajectories of the labor movement and opportunities for organizing workers in the last decade. (shrink)

This paper addresses the question of whether all that unites the main parts of John Stuart Mill’s On Liberty—the liberty principle, the defense of free discussion, the promotion of individuality, and the claims concerning individual competence about one’s own good—is a general concern with individual liberty, or whether we can say something more concrete about how they are related. I attempt to show that the arguments of On Liberty exemplify Mill’s institutional design approach set out in Considerations of (...) Representative Government and related works. Mill’s approach reflects both his debt to Bentham and his own progressive development of the utilitarian tradition. The paper proceeds by setting out the elements of Mill’s institutional designs and then showing that On Liberty neatly applies them, thereby clarifying the structure of the arguments of On Liberty. Semi-parliamentarism is a compelling design with attractive features, including those discussed by Ganghof, and also its likely tendency to break preference cycles and moderate politics. However, I argue that semi-parliamentarism may be a difficult system to sustain. My contribution concludes with consideration of how such systems might be preserved.

Multi-level institutional designs with distributed power and authority arrangements among federal, state, regional, and local government agencies could lead to the emergence of differential patterns of socioeconomic and infrastructure development pathways in complex social–ecological systems. Both exogenous drivers and endogenous processes in social–ecological systems can lead to changes in the number of “basins of attraction,” changes in the positions of the basins within the state space, and changes in the positions of the thresholds between basins. In an effort to (...) advance the theory and practice of the governance of policy systems, this study addresses a narrower empirical question: how do intergovernmental institutional rules set by federal, state, and regional government agencies generate and sustain basins of attraction in funding infrastructure projects? A pattern-oriented, agent-based model (ABM) of an intergovernmental network has been developed to simulate real-world transportation policy implementation processes across the federal, the state of Vermont, regional, and local governments for prioritizing transportation projects. The ABM simulates baseline and alternative intergovernmental institutional rule structures and assesses their impacts on financial investment flows. The ABM was calibrated with data from multiple focus groups, individual interviews, and analysis of federal, state, and regional scale transportation projects and programs. The results from experimental simulations are presented to test system-wide effects of alternative multi-level institutional designs, in particular different power and authority arrangements between state and regional governments, on the emergence of roadway project prioritization patterns and funding allocations across regions and towns. Social liberals and liberal nationalists often argue that cosmopolitans neglect the normative importance of state sovereignty and self-determination. This paper counter-argues that, under current global political and socio-economic circumstances, only the establishment of supranational institutions with some (limited, but significant) sovereign powers can allow states to exercise sovereignty, and peoples? self-determination, in a meaningful way. Social liberals have largely neglected this point because they have focused on an unduly narrow, mainly negative, conception of state sovereignty. I contend, instead, that we (...) should more closely consider the positive aspects of sovereignty, understood as the capacity to maintain internal problem-solving capacities and make meaningful discretionary choices on a range of national issues. This paper reports on an experiment concerning the social construction of statistical definitions, where the first census of Higher Education Institutions in Europe has been developed. It conceptualizes the construction of indicators as a social process of definitions and boundaries’ negotiation, involving value judgments, social and political opinions, as well as practical interests and power strategies of actors. The paper exemplifies this process on three issues, namely the social demand for establishing a census, the controversy concerning the definition of a (...) perimeter as well as the selection of indicators, and the nature of comparability judgments. We first conclude that the socio-political dimension has to be explicitly taken into account when designing statistical systems; second, that social scientists involved in this process need to openly recognize the conflicts around the definition of indicators; third, that the objectified and taken for granted status of indicators makes them a powerful instrument to influence policy decisions and, that indicator designers need to make their own value judgments and interests fully transparent. How can advocates of global democracy grapple with the empirical conditions that constitute world politics? I argue that flexibility mechanisms - commonly used to advance international cooperation - should be employed to make the institutional design project of global democracy more tractable. I highlight three specific reasons underpinning this claim. First, flexibility provisions make bargaining over different institutional designs more manageable. Second, heightened flexibility takes seriously potential concerns about path-dependent institutional development. Finally, deliberately shortening the time (...) horizons of agents by employing flexibility provisions has cognitive benefits as it forces designers to focus specifically on issues of feasibility as well as desirability. I discuss a range of flexibility mechanisms and highlight the utility of sunset provisions and escape clauses. From this analysis, I build an argument for the usage of small-scale democratic experiments through which citizens have a say in global policy making. (shrink)

The philosophical concept of the self has had a hard time for a long time. The scepticism that lay behind Hume’s ‘bundle’ theory has been made manifest in ‘post-philosophical’ claims that the self or subject is not so much a ‘something’ that ties together a bundle of sense impressions, but is rather to be seen as an effect of a system of power relations, or an illusory presupposition of the relational properties of syntax.

In this article, I critically respond to Herbert Gintis's criticisms of the behavioral-economic foundations of Ken Binmore 's game-theoretic theory of justice. Gintis, I argue, fails to take full account of the normative requirements Binmore sets for his account, and also ignores what I call the ‘scale-relativity’ considerations built into Binmore 's approach to modeling human evolution. Paul Seabright's criticism of Binmore, I note, repeats these oversights. In the course of answering Gintis's and Seabright's objections, I clarify and extend Binmore (...) 's theory in a number of respects, integrating it with Kim Sterelny's and Don Ross's recent work on the evolution of people as cultural entities. The account also yields a novel basis for choosing between socialism and what Binmore calls ‘whiggery’ as normative political programs. In this work, we discuss how both contractualism, in the Western tradition, and communitarianism, in the African interpretation based on the idea of Ubuntu, conceptualise intergenerational justice. Even though both philosophical theories, taking into account differences and shortcomings, provide theoretical answers to intergenerational justice dilemmas, the implementation of actual policies in the interest of future individuals does not follow straightforwardly. Accordingly, in the second part of the chapter, we analyse what policy tools have been implemented or conceived to deliver intergenerational (...) justice and we advocate a pragmatic approach pointing towards a mix of different policy tools. In _The New Constitutionalism_, seven distinguished scholars develop an innovative perspective on the power of institutions to shape politics and political life. Believing that constitutionalism needs to go beyond the classical goal of limiting the arbitrary exercise of political power, the contributors argue that it should—and can—be designed to achieve economic efficiency, informed democratic control, and other valued political ends. This paper develops the concept of epistemic apprenticeship as a response to failures among privileged social actors to perceive the knowledge bases of unjustly marginalised groups as sources of valuable insight. Inspired by Elizabeth Spelman’s reflections on apprenticeship and intersectional feminism, an epistemic apprenticeship represents an obverse form of apprenticeship; one in which socially privileged knowers become apprentices to those who do not enjoy equivalent power and privilege. This paper critiques and extends Spelman’s account of apprenticeship by focussing on how (...) the institutional sedimentation of dominant social imaginaries works against the volitional and virtuous practice of apprenticeship, and by exploring what a commitment to epistemic apprenticeship demands at the level of institutional practice. As part of this discussion, I scrutinise the conditions under which institutionalised apprenticeships may fall short of their meliorative potential, and may obstruct rather than aid efforts to achieve greater epistemic justice. One of Chicago's great cultural achievements, the Institute of Design was among the most important schools of photography in twentieth-century America. It began as an outpost of experimental Bauhaus education and was home to an astonishing group of influential teachers and students, including Lázló Moholy-Nagy, Harry Callahan, and Aaron Siskind. To date, however, the ID's enormous contributions to the art and practice of photography have gone largely unexplored. Taken by Design is the first publication to examine thoroughly this (...) remarkable institution and its lasting impact. With nearly 300 illustrations, including many never-before published photographs, Taken by Design examines the changing nature of photography over this critical period in America's midcentury.
