ABSTRACT Legal certainty is a central requirement for the rule of law. Legal systems should both enable those subject to law to predict human behaviour and institutional reactions and to prevent an arbitrary use of state power against them. The value of legal certainty is usually conceived as a formal value opposed to the values of freedom or equality. The purpose of this paper is to discuss this idea and to explore a less formal conception of the value of legal (...) certainty. In this sense, I will argue that we need to depart from a purely formal understanding of the requirements imposed by such value and to consider the need to provide them with a substantive content. So, legal certainty is not completely independent of legal substantive justice and it implies that it is impossible to define ex ante which concrete aspects of justice should not be the law’s concern. The development of Information and Communication Technologies has favored access to technological resources in adolescents. These tools provide access to information that can promote learning. However, they can also have a negative effect against people, as they can be used with other functionality, in which cyberbullying situations are caused during the interactions that arise when using social networks. The objective of this study was to determine the predictive value of the role of cyberbullying victims based on variables related to other (...) roles involved in cyberbullying and bullying, as well as personal characteristics, contextual characteristics and positive teamwork habits.. Information was collected from 227 students of the educational stages of Primary Education and Secondary Education, aged between 11 and 15 years, in a city with a high index of cultural diversity. The step-by-step technique was used to build the regression model. The results indicate that the model has a good goodness of fit coefficient. The role of cyberbully is the most important predictive variable of the role of the victim in cyberbullying and, to a lesser extent, the role of the witness in cyberbullying, the role of the witness in bullying, and the role of the victim of bullying. The role of the bullying aggressor and the variables sex, age, type of educational center, and teamwork habits are excluded in the predictive model. (shrink)

The COVID‐19 pandemic triggered an unprecedented health crisis that impacted healthcare systems worldwide. This study explores how Spanish healthcare workers learned, internalised and integrated values and work behaviours during the COVID‐19 pandemic and their impact on the personal sphere. This documentary research, using images, narratives and audiovisual content, was framed within the interpretative hermeneutic paradigm. Categories and subcategories emerged after a final theoretical sampling that focused on the analysis. Data triangulation between researchers favoured theoretical saturation. A total of 117 images (...) and 27 texts were selected. The analysis identified three stages: bewilderment, seeking functionality in the chaos and integrating chaos into care. The data reflects how the need for security and knowledge, and the exhaustion and frustration caused by the initial working conditions, prompted adaptive responses. These responses involved focusing on problem‐solving and strengthening group sentiments and solidarity. Subsequently, the data indicates the acceptance of new structural, organisational and communication aspects. The findings of the analysis will contribute towards finding a framework that can help understand community health crisis events. (shrink)

IntroductionIncorporating technology in cognitive interventions represents an innovation, making them more accessible, flexible, and cost-effective. This will not be feasible without adequate user-technology fit. Bearing in mind the importance of developing cognitive interventions whose technology is appropriate for elderly people with cognitive impairment, the objective of this systematic review was to find evidence about usability and user experience measurements and features of stimulation, training, and cognitive rehabilitation technologies for older adults with mild cognitive impairment or dementia.MethodThe Medline, PubMed, Scopus, ScienceDirect, (...) and PsycINFO databases were searched for literature published in the last 10 years, and three researchers independently reviewed potentially eligible studies, following specific inclusion criteria. A systematic review of the studies was conducted, presenting a qualitative synthesis of usability and UX measures with their outcomes, study characteristics and features of the cognitive intervention technologies.ResultsTen studies were selected: five were cognitive stimulation and five were cognitive training. Most of them were computer-based programs with a serious game format. Efficiency and effectiveness were the most frequent measurements used for collecting objective usability data, showing that elderly people with cognitive impairment require more time and help but can complete tasks. Regarding UX or subjective usability data, questionnaires and scales were the most used methods, reporting positive experience despite certain difficulties with the interface in five studies.ConclusionMeasuring usability and UX in cognitive intervention technologies for older adults with MCI or dementia provides an integrated view that can contribute to their development according to the needs and characteristics of the target population. More research is required to include this population group in usability and UX studies, as well as standardized tools and consensus on the relationship of these terms to guarantee the future effectiveness of cognitive intervention technologies.Review registrationThis review was registered in the PROSPERO International Register of Systematic Review Protocols. In this article, an attempt was made to identify the level of community social participation according to age, gender and the structural characteristics of the personal support networks in a population displaced by floods in the Colombian Caribbean. The research was based in a non-experimental methodology with an associative-relational strategy. An intentional non-probabilistic sample of 151 people affected by the winter wave in the south of the Department of Atlántico (Colombia) was selected. In total, the study included 42 males (27.8 (...) %) and 109 females (72.2 %) participants, with an average age of 37.48 (±14, Range 18 - 80) and average relocation time of 21.79 months (± 8.22, Range 5-36). The Arizona Social Support Interview Schedule (ASSIS) and Community Empowerment instruments were responded to with an instrument adapted from the leadership competence factor. The results show lower rates of intermediation in the older population, and the relationship between social participation and gender shows equally cohesive social support networks in men and women. This evidence is discussed to promote psychosocial interventions aimed to increase community engagement and empowerment of people that have experienced non-voluntary mobility processes. (shrink)

The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Understanding the need for change is essential for the formulation of adaptive proposals, as well as for the generation of training activities to complement the teaching curriculum. For some theorists, they are invalid for everyday conditionals, but valid in logic. The theory of mental models implies that they are valid, but unacceptable because the conclusion refers to a possibility inconsistent with the premise. Hence, individuals should accept them if the conclusions refer only to possibilities consistent with the premises: Luisa didn't play soccer; therefore, if Luisa played a (...) game then she didn't play soccer. Two experiments corroborated this prediction for three sorts of ‘paradox’, including a disjunctive paradox. (shrink)

This study investigates whether the market valuation of the two summary accounting measures, book value of equity and net income, is higher for firms with reputation for sustainability leadership, when compared to firms that do not enjoy such reputation. The results are interpreted through the lens of a framework combining signalling theory and resource-based theory, according to which firms signal their commitment to sustainability to influence the external perception of reputation. A firm’s reputation for being committed to sustainability is an (...) intangible resource that can increase the value of a firm’s expected cash flows and/or reduce the variability of its cash flows. Our findings are according to expectations and show that the net income of firms with good sustainability reputation has a higher valuation by the market, when compared to their counterparts. In this article I shall propose María Zambrano's poetic reason as a suitable method for developing a knowledge of animal being. To do so, I will follow the analyses (Derrida, Coetzee) that place animal thinking in the poetic sphere, thus showing the need for a poetic/literary knowledge to make a philosophical knowledge of the animal possible. Animal writing expresses our nature in relation to animal nature; it discloses our animal interbeingness. Finally, I will point to some of the principles of (...) ecofeminist/animal ethics, like care and empathy, which arise both in what I propose to call animal writing and in Zambranian poetic reason. This paper analyzes Russian-French philosopher Alexandre Kojève’s dialogue with proponents of Hegelianism and phenomenology in Soviet Russia of the 1920–30s. Considering works by Dmytro Chyzhevsky, Ivan Ilyin, Gustav Shpet, and Alexandre Koyré, I retrace Hegelian themes in Kojève, focusing on the relation between method and time. I argue that original reflections on method played a key role in both Russian Hegelianism and Kojève’s work, from his famous Hegel lectures to the late fragments of a system. As I demonstrate, Kojève’s Hegelianism (...) was significantly shaped by his encounter with Ilyin’s 1918 commentary on Hegel, a detailed study of the relation between method and the experience of time. However, in Kojève’s hands, Ilyin’s ideas were transformed, some radicalized, others abandoned. Comparatively reading texts by these thinkers in their respective contexts, I resituate and evaluate claims that Hegel’s method was less dialectical than phenomenological. I finally argue that early Soviet Hegelian discourses not only shaped the trajectory of Kojève’s Hegelianism but also radically anticipated concepts of time in French post-structuralism. (shrink)

In this essay, I have rejected the inductive interpretation of the paradigm of contextual implication (to say “p”; is to imply that one believes that ) and proposed in its stead an explicatory model according to which a speaker in making a statement contextually implies whatever one is entitled to infer on the basis of the presumption that his act of stating is normal. In developing this model, I show how contextual implication depends on three distinct matters: a stating context, (...) presumptions of normality, and rules for the correct use of expressions. In the first part of this article, we show that, contrary to the Gricean tradition, inter-clausal and is not semantically equivalent to logical conjunction and, contrary to temporal approaches such as Bar-Levand Palacas 1980, it is not temporallyloaded. We then explore a commonsenseidea – namely that while sentence juxtaposition might be interpreted either as discourse coordination or subordination, and indicates coordination. SDRT already includes notions of coordinating and subordinating discourse relations (cf. Lascarides and Asher 1993, Asher 1993), and the meaning (...) of and is related to this distinction. Similar distinctions that play a crucial role in anaphora resolution have also appeared in AI – cf. Scha and Polanyi 1988, or Webber 1991. However, this discourse-structure-based distinction has not been well defined yet, and our approach provides independent motivation for it. This paper argues that the semantics of and includes a notion of coordination expressed as the requirement of a Coordinated Discourse Topic (CDT).CDT characterizes aclass of discourse relations, among which are Narration and Result.Once the basic semanticcontribution of and is isolated, effects related to its presence such as changes in temporal structure, blocking of a Discourse Relation, or conditional meanings are shown to follow from the defeasiblearchitecture set up by SDRT. The multifaceted nature of empathy requires a comprehensive conceptualization of core and related emotional and mindreading processes. Here I argue that new paradigms are needed that allow for a more ecologically valid and parametric assessment of empathy subprocesses and their neuronal correlates. Towards that goal, cognitive neuroscience studies should make use of audiovisual stimuli that more closely approximate real-life settings and include online social interaction paradigms.

En este trabajo se analizan, por una parte, los datos sobre la presencia de las mujeres en los movimientos de derechos de los animales en el estado español; por otro lado, tratamos de encontrar marcos explicativos que aclaren cuál es el vínculo que conecta la sensibilidad feminista con la sensibilidad animalista. Hemos realizado un sondeo sobre el porcentaje de mujeres entre los miembros de las organizaciones animalistas más importantes de España y, con estos resultados, hemos hecho una revisión de los (...) diferentes marcos teóricos que pueden explicar esta significativa orientación de género en la defensa del bienestar animal. Por último, defendemos que hay un vínculo entre la ideología patriarcal y la explotación ecológica, en tanto que ambos comparten la dominación y la opresión de género. En este sentido, la sensibilidad animalista movilizaría sentimientos morales de fraternidad con la naturaleza. (shrink)

Drawing on the self-determination framework, the study examined the effect of coaches’ autonomy support on the leisure experience of young male football players. Specifically, a model was tested analyzing the long-term predictive power of the players’ perception of coach-autonomy support at the beginning of the season on the subjective vitality of young football players at the end of the season through needs satisfaction and intrinsic motivation. Moreover, we tested whether the effects of coach-autonomy support on the aforementioned variables (needs satisfaction, (...) intrinsic motivation, and subjective vitality) at the end of the season remained at the beginning of the following season. Because the coach in the second season was not the same one as in the first season, the perception of coach-autonomy support at the beginning of the second season was used as a control variable. Three hundred and sixty football players (M age = 12.60 years; SD = 0.52) completed a questionnaire on the variables of interest at the beginning of the first season (T1), at the end of the first season (T2), and at the beginning of the second season (T3). The results of the path analyses showed that player’ perceptions of coach autonomy support at the beginning of the season (T1) positively predicted needs satisfaction at the end of the first season (T2), which in turn predicted intrinsic motivation at the end of the first season (T2). Additionally, intrinsic motivation significantly and positively predicted subjective vitality at the end of the first season (T2). Finally, needs satisfaction, intrinsic motivation, and subjective vitality at the end of the second season (T2) positively predicted these same variables at the beginning of the second season (T3). Results emphasized the importance of the autonomy support offered by the coach in promoting the quality of young people’s leisure experience playing football and its benefits for their well-being. Well into the 1940s, many French biologists rejected both Mendelian genetics and Darwinism in favour of neo-transformism, the claim that evolution proceeds by the inheritance of acquired characteristics. In 1931 the zoologist Maurice Caullery published Le Problème d’évolution, arguing that, while Lamarckian mechanisms could not be demonstrated in the present, they had nevertheless operated in the past. It was in this context that Raymond Aron expressed anxiety about the relationship between biology, history, and human autonomy in his 1938 Introduction à (...) la philosophie de l’histoire: essai sur les limites de l’objectivité historique, in which he rejected both neo-Kantian and biological accounts of human history. Aron aspired to a philosophy of history that could explain the dual nature of human existence as fundamentally rooted in the biological, and at the same time, as a radical transcendence of natural law. I argue that Aron’s encounter with evolutionary theory at this moment of epistemic crisis in evolutionary theory was crucial to the formation of his philosophy of history, and moreover that this case study demonstrates the importance of moving beyond the methodological divisions between intellectual history and history of science. This paper gives an implicit characterization of the class of functions computable in polynomial space by deterministic Turing machines – PSPACE. It gives an inductive characterization of PSPACE with no ad-hoc initial functions and with only one recursion scheme. The main novelty of this characterization is the use of pointers to reach PSPACE. The presence of the pointers in the recursion on notation scheme is the main difference between this characterization of PSPACE and the well-known Bellantoni-Cook characterization of the polytime (...) functions – PTIME. Contra esse equívoco o artigo mostra a relação intrínseca entre teoria e prática na filosofia de Marcuse, caracterizada como uma filosofia política cuja preocupação central é a transformação radical da sociedade capitalista.

El presente artículo parte de analizar el vínculo existente entre los derechos sociales y la democracia conforme a las funciones que desempeñan tales derechos, adaptándose a la realidad en la que deben ser implementados. Por tanto, el paso de la democracia a una posdemocracia plantea dificultades desde un primer momento al crearse obstáculos para el desenvolvimiento real de los principios que han de regir la operatividad de los derechos sociales. Tal es así que nos debemos plantear si es posible que (...) subsistan en ese contexto. De esta manera, se presentan una serie de observaciones y propuestas para salvar los derechos sociales desde una perspectiva de participación de la ciudadanía y un enfoque de derechos humanos. Finalmente, se concluye que lo importante es que se superen los obstáculos que impidan una justiciabilidad y efectividad adecuadas de los derechos sociales. (shrink)

Objective: To analyze the empathic profile and the empathy scores of freshmen of the nursing course. Design and participants: Descriptive study involving 399 freshmen students of two modalities of nursing courses: Bachelor and Bachelor and Teaching Diploma, in the period from 2012 to 2015. A sociodemographic questionnaire and the Empathy Inventory were applied. Ethical considerations: The research received approval from the Research Ethics Committee of the University of São Paulo at Ribeirão Preto College of Nursing. The students registered their acceptance (...) to participate in the research by signing the Free and Informed Consent Form and anonymity was guaranteed. Findings: The mean age of the participants was 19 years, being 85.5% female. The students were grouped by course modality and all groups presented high empathy scores. A significant difference (p < 0.001) was found, which indicates that students of the Bachelor and Teaching Diploma program presented a higher degree of empathy for the General Score, Domain 2 (Interpersonal Flexibility), and Domain 3 (Altruism) in relation to students in the Bachelor program. Conclusion: Results show that nursing undergraduate freshmen are emphatic, with minimum differences between the two courses. This profile is relevant for the development of future professionals capable to demonstrate a balance between instrumental and expressive competences. (shrink)

This article reconstructs the forgotten friendship between Georges Bataille and the Russian émigré poet and philosopher Boris Poplavsky. Comparing their solar metaphysics, I focus on conceptions of friendship, sacrifice and depersonalisation. First, I retrace Bataille’s relationship to early Surrealis and Russian circles in interwar Paris, with a focus on his friendship with Irina Odoevtseva. I then offer a novel reading of Poplavsky’s poetry through the lens of Bataille’s philosophy, analysing a recurring motif that I call ‘dark solarity’. Uncovering a hidden (...) intertextual dialogue between Poplavsky and Bataille, I argue for Poplavsky’s lasting impact on Bataille’s anti-Icarian sun cult. Finally, my paper demonstrates how Poplavsky’s writings on solar sacrifice, excess and friendship left marks on Bataille’s vision of a solar community, embodied in the secret society Acéphale. The dialogue between Poplavsky and Bataille, I finally suggest, is a missing piece in the entangled history of Russian and French philosophy, as well as an original contribution to discourses on friendship in twentieth-century continental thought. A partir da constatação de problemas no desempenho leitor de universitários, projeto de pesquisa realizado na Universidade de Caxias do Sul buscou oportunizar aos alunos o desenvolvimento de habilidades de leitura pelo uso de material instrucional composto por sequências didáticas baseadas em diferentes gêneros do discurso. Descrevemos aqui a sequência que tem como núcleo o editorial. Os alunos envolvidos, ingressantes em cursos de graduação, foram divididos em grupo experimental (GE), submetido à sequência de leitura aqui descrita, e grupo de controle (...) (GC), que trabalhou os mesmos textos do GE com enfoque voltado à análise textual. A questão ecológica constituiu o núcleo temático, e, em cada sequência, propuseram-se quatro instâncias: pré-leitura, leitura-descoberta, pós-leitura e atividade interativa. Os resultados da investigação sugerem que o ensino explícito de leitura, apoiado em princípios sociointeracionistas e metacognitivos, pode contribuir positivamente para o desenvolvimento de habilidades de leitura. We argue that quantum theory does not allow for a generalization of the notion of classical conditional probability by showing that the probability defined by the Lüders rule, standardly interpreted in the literature as the quantum-mechanical conditionalization rule, cannot be interpreted as such.

La hagiografía medieval tenía una importante función didáctica. Estos relatos fueron muy útiles para la Iglesia ya que permitían transmitir valores, modelos de conducta e ideas complejas a los feligreses. En este trabajo de investigación exploraremos tres obras hagiográficas en verso redactadas en distintas zonas de la Península Ibérica durante el siglo XIII, protagonizadas por tres santas que representan modelos diferentes (mártires, religiosas y penitentes). A través de este estudio comparativo hemos podido observar que, más allá de los tópicos asociados (...) a cada modelo de santidad, los valores transmitidos como ejemplo de “buenas cristianas” se repiten en todos ellos como condición necesaria para que la mujer alcanzase la salvación eterna: mantenimiento de la virginidad, castidad, penitencia y purga del pecado. Así, podemos concluir que la hagiografía femenina plenomedieval tuvo un importante papel en la transmisión y asentamiento de las ideas del clero respecto a lo femenino, cargadas de una evidente misoginia. In Brazil, the normative landscape around advertising is complex, not the least because of limitations inherent to dispute resolution mechanisms. Focusing on unhealthy food and beverages, this case study identifies some challenges and opportunities around advertising restrictions, including in relation to freedom of speech.

This paper analyzes Russian-French philosopher Alexandre Kojève’s dialogue with proponents of Hegelianism and phenomenology in Soviet Russia of the 1920–30s. Considering works by Dmytro Chyzhevsky, Ivan Ilyin, Gustav Shpet, and Alexandre Koyré, I retrace Hegelian themes in Kojève, focusing on the relation between method and time. I argue that original reflections on method played a key role in both Russian Hegelianism and Kojève’s work, from his famous Hegel lectures to the late fragments of a system. As I demonstrate, Kojève’s Hegelianism (...) was significantly shaped by his encounter with Ilyin’s 1918 commentary on Hegel, a detailed study of the relation between method and the experience of time. However, in Kojève’s hands, Ilyin’s ideas were transformed, some radicalized, others abandoned. Comparatively reading texts by these thinkers in their respective contexts, I resituate and evaluate claims that Hegel’s method was less dialectical than phenomenological. I finally argue that early Soviet Hegelian discourses not only shaped the trajectory of Kojève’s Hegelianism but also radically anticipated concepts of time in French post-structuralism. (shrink)

In the mid-twentieth century, many philosophers took up as their aim the destruction of Western metaphysics. Martinican philosopher, novelist, poet, and playwright Édouard Glissant and German philosopher Martin Heidegger were two such authors. Driven by a profound dissatisfaction with the logocentrism of Western metaphysics and concerns over what the tradition excluded—for Glissant, the experience of the creolized and post-colonial subject, and for Heidegger, the “Question of Being”—both advocated for more creative engagement with language and advanced particular views about the link (...) between language and Being. Through a comparative examination of the two authors’ poetics, I aim to “unconceal” an implicit dialogue between their views. I conclude by considering the implications of a key exchange in this proposed dialogue: Glissant’s substitution of Relation for Heideggerean Being. I suggest that this exchange and Glissant’s substitution make plain the problematic tendency in Western philosophy to promote an exclusionary view under the guise of universal truth, that it provides Caribbean philosophy with a greater vocabulary through which to further “produce” itself, and that it is better suited to allow for a process of unceasing transformation and creolization, in contrast to a Western philosophical emphasis on fixity.
