The annual Kronos Philosophical Journal was established in Warsaw in 2012. The papers presented in the annual might be of interest to the readers from outside Poland, allowing them to familiarize themselves with the dynamic thought of contemporary Polish authors, as well as entirely new topics, rarely discussed by English speaking authors. Volume V/2016 comprises articles problematizing Russian phlosophy and literature as well as Ancient Greek philosophy and culture.

The argument from causal closure of the physical is usually considered the most powerful argument in favor of the ontological doctrine of physicalism. Many authors, most notably Papineau, assume that CCP implies that physicalism is supported by physics. I demonstrate, however, that physical science has no bias in the ontological debate between proponents of physicalism and dualism. I show that the arguments offered for CCP are effective only against the accounts of mental causation based on the action of the mental (...) forces of a Newtonian nature, i.e. those which manifest themselves by causing accelerations. However, it is conceivable and possible that mental causation is manifested through the redistribution of energy, momentum and other conserved quantities in the system, brought about by altering the state probability distribution within the living system and leading to anomalous correlations of neural processes. After arguing that a probabilistic, interactionist model of mental causation is conceivable, which renders the argument from causal closure of the physical ineffective, I point to some basic features that such a model must have in order to be intelligible. At the same time, I indicate the way that conclusive testing of CCP can be done within the theoretical framework of physics. (shrink)

Autonomy, understood as self-rule, is almost routinely accepted as one of the core liberal concepts. Still, a closer view reveals that both the status and meaning of autonomy are controversial. The text departs from a short summary of the main theoretical disputes surrounding the concept. A critique of the standard internalist account is followed by an attempt to offer reasons for accepting a relational reading of autonomy. The central question of the text is context-specific. It asks about the possibility and (...) meaning of liberal autonomy in a society whose past is marked by mass regime-sponsored crimes. The background assumption is that mass crime leaves actors in heteronomous condition. At stake is reestablishing individual autonomies of two types of actors, whose group-specific identities have been created by crime: the ethical community of those who share collective identity with victims, and the ethical community of those who share collective identity with perpetrators. nema. The contemporary global crisis can be explored in different perspectives. This text focuses on constitutionalism. It asks whether constitutionalism still matters. Responding to this question requires revisiting the basic analytical and normative concepts that shape individual autonomy, polity, law and democracy in the context of globalization. Part I of the article introduces the question of the crisis of constitutionalism. It briefly explores the dispute between proponents of state and post-state constitutionalism, and proceeds with an analysis of societal constitutionalism. The critical (...) reading of this theory prepares the ground for a positive normative argument. Part II of the article argues for the return to the moral core of constitutionalism. It defends the claim that justice at the global stage requires establishing a minimum common denominator that would be composed of universalizable substantive principles. The institutional question follows. Democracy is in serious difficulties. Three features of the crisis stand out. First is the dominant culture of disillusionment in democracy, which transpires as the mistrust in constitutionalist institutions and values. Second, political authority, both at domestic and international levels, is largely substituted by the rule of non-transparent and unpredictable social powers. Third, democratic states are deprived of much of their capacity to govern, but they retain a non-negligible capacity to coerce.The article is structured as follows. Section I introduces Karl (...) In this paper, we reconsider the notion of epistemic trespassing and attempt to explore possible scenarios in which it could lead to positive outcomes in scientific research and information dissemination. As we will point out, some of the significant discoveries in the history of science would not have been possible were it not for the epistemic trespassers, whose shift in paradigm changed the approach to specific issues for the better. Furthermore, we will present instances where individuals, often labeled as ‘trespassers’ (...) – those who venture into fields outside their expertise – can be considered trustworthy and reliable sources of testimony. Consequently, epistemic trespassing turned out to be essential for the advancement of science. Epistemic trespassing in our age is virtually inevitable – whether it be from a political perspective (to preserve democratic values) or due to purely practical reasons (i.e. searching for information online). There are interdisciplinary fields where a strictly negative characterization of epistemic trespassing would question their methodology since these disciplines rely on experts from various fields. For these reasons, we advocate for a more charitable approach to epistemic trespassing and greater public education to help them distinguish between correct and false information. (shrink)

Over the past 10 years, Cognitive Linguistics has taken a quantitative turn. Yet, concerns have been raised that this preoccupation with quantification and modelling may not bring us any closer to understanding how language works. We show that this objection is unfounded, especially if we rely on modelling techniques based on biologically and psychologically plausible learning algorithms. These make it possible to take a quantitative approach, while generating and testing specific hypotheses that will advance our understanding of how knowledge of (...) language emerges from exposure to usage. It has recently been remarked that the argument for physicalism from the causal closure of the physical is incomplete. It is only effective against mental causation manifested in the action of putative mental forces that lead to acceleration of particles in the nervous system. Based on consideration of anomalous, physically unaccounted-for correlations of neural events, I argue that irreducible mental causation whose nature is at least prima facie probabilistic is conceivable. The manifestation of such causation should be accompanied by a (...) local violation of the Second Law of thermodynamics. I claim that mental causation can be viewed as the disposition of mental states to alter the state probability distribution within the nervous system, with no violation of the conservation laws. If confirmed by neurophysical research, it would indicate a kind of causal homogeneity of the world. Causation would manifest probabilistically in both quantum mechanical and psychophysical systems, and the dynamics of both would be determined by the temporal evolution of the corresponding system state function. Finally, I contend that a probabilistic account of mental causation can consistently explain the character of selectional states that ensure the uniformity of causal patterns, as well as the fact that different physical realizers of a mental property cause the same physical effects in different contexts. In this article I ask how moral relativism applies to the analysis of responsibility for mass crime. The focus is on the critical reading of two influential relativist attempts to offer a theoretically consistent response to the challenges imposed by extreme criminal practices. First, I explore Gilbert Harman’s analytical effort to conceptualize the reach of moral discourse. According to Harman, mass crime creates a contextually specific relationship to which moral judgments do not apply any more. Second, I analyze the inability (...) thesis, which claims that the agents of mass crime are not able to distinguish between right and wrong. Richard Arneson, Michael Zimmerman and Geoffrey Scarre do not deny the moral wrongness of crime. However, having introduced the claim of authenticity as a specific feature of the inability thesis, they maintain that killers are not responsible. I argue that these positions do not hold. The relativist failure to properly conceptualize responsibility for mass crime follows from the mistaken view of moral autonomy, which then leads to the erroneous explanation of the establishment, authority and justification of moral judgments. The answer to the fine-tuning problem of the universe has been traditionally sought in terms of either design or multiverse. In philosophy circles, this is sometimes expanded by adding the option of explanatory nihilism—the claim that there is no explanation for statements of that high level of generality: fine-tunings are brute facts. In this paper, we consider the fourth option which, at least in principle, is available to us: co-evolution of the universe and observers. Although conceptual roots of this approach (...) could be found already in ancient stoicism, it is still the least investigated explanatory option for resolving the problem of empirical fine tunings. We offer two preliminary models along which the co-evolution hypothesis could be developed further. They are still on the level of speculative metaphysics, but there are opportunities along the way to generate predictions which are in principle testable, especially in the domain of large-scale numerical simulations. Over the last 102 years, a lot of discussion was being held about the psychoanalytic conception of the “death drive,” but still with inconclusive results. In this paper, we start with a brief review of Freud’s conception, followed by a comprised overview of its subsequent support or criticisms. The core of our argument is a systematic review of current biochemical research about two proposed manifestations of the “death drive,” which could hopefully move the discussion to the realm of science. It (...) was already established that drive satisfaction leads to the secretion of beta-endorphins, and research evidence also shows that the same biochemical mechanisms get activated in the case of masochism and the gambling disorder but only if they are preceded by chronic frustration of the essential drives. We conclude that the actual situation is more complex than Freud hypothesized, and that a fundamental revision of the psychoanalytic drive theory is necessary. (shrink)

Collective crime is an act committed by a significant number of the members of a group, in the name of all members of that group, with the support of the majority of group members, and against individuals targeted on the basis of their belonging to a different group.The central claim is that all members of the group in whose name collective crime is committed share responsibility for it. This book's special (...) interest is with analytical and normative defense of arguments that purport to explain reasons for, and the character of, responsibility of decent people. Those who did not intend, support, or committed wrong, are still accountable in a non-vicarious manner. One of the main challenges that the arriving paradigm of Internet of Things brings to society is providing and securing individual privacy. There are lots of obstacles which prevents us from successfully confronting such a challenge. In this paper we are going to deal with one such obstacle, and that is the bounded rationality of humans as participants in the environment of Internet of Things. We argue that the ethical approach to the vision of the Internet of Things has to (...) include the notion of bounded rationality. Bounded rationality of users impedes the possibility of giving informed consent. Informed consent is required when getting permission for collecting and using somebody’s personal information. Lastly, we discuss the need for a paternalistic approach of maximum possible default privacy settings without asking for consent, given the seriousness of all potential risks. (shrink)

The "theory of mind" framework has been the fastest growing body of empirical research in contemporary psychology. It has given rise to a range of positions on what it takes to relate to others as intentional beings. This book brings together disparate strands of ToM research, lays out historical roots of the idea, and indicates better alternatives.

Is property-awareness constituted by representation or not? If it were, merely being aware of the qualities of physical objects would involve being in a representational state. This would have considerable implications for a prominent view of the nature of successful perceptual experiences. According to naïve realism, any such experience—or more specifically its character—is fundamentally a relation of awareness to concrete items in the environment. Naïve realists take their view to be a genuine alternative to representationalism, the view on which the (...) character of such experiences is constituted by representation. But naïve realists must admit qualities or property instances as items of awareness if they are to remain wedded to common sense, and the nature of property-awareness may smuggle constitutive representation into the naïve realist account of character. I argue that whether property-awareness involves representation, and consequently whether naïve realism is distinct from representationalism or not, depends on what qualities are fundamentally. On universalist and nominalist accounts, property-awareness turns out to involve representation. Not so under tropism. (shrink)

Identifying, classifying, and analyzing arguments in legal discourse has been a prominent area of research since the inception of the argument mining field. However, there has been a major discrepancy between the way natural language processing (NLP) researchers model and annotate arguments in court decisions and the way legal experts understand and analyze legal argumentation. While computational approaches typically simplify arguments into generic premises and claims, arguments in legal research usually exhibit a rich typology that is important for gaining insights (...) into the particular case and applications of law in general. We address this problem and make several substantial contributions to move the field forward. First, we design a new annotation scheme for legal arguments in proceedings of the European Court of Human Rights (ECHR) that is deeply rooted in the theory and practice of legal argumentation research. Second, we compile and annotate a large corpus of 373 court decisions (2.3M tokens and 15k annotated argument spans). Finally, we train an argument mining model that outperforms state-of-the-art models in the legal NLP domain and provide a thorough expert-based evaluation. Multiple selves is a conventional assumption in behavioural welfare economics for modelling intrapersonal well-being. Yet an important question is which self has normative authority over others. In this paper, we advance an argument for what we call the ‘ontological approach’ to personal identity in behavioural welfare economics. Economic methodologists most often study the relations between models and reality while focusing on the issues of the model's epistemic relevance in terms of its relation to the ‘real world’ and representing the real world in a model. We complement the discussion by bringing the model's constructive mechanisms or self-implementing technologies in play. By this, we mean the elements of the economic model that are aimed at ‘implementing’ it by envisaging the ways to change the reality in order to bring (...) it more in line with the model. We are thus concerned mainly not with the ways to change the model to ‘fit’ the reality, but rather with the model's own armature that is supposed to transform the world along theoretical lines. The case we study is Arrow–Debreu–McKenzie general equilibrium model. In particular, we show the following: gradient methods and stability could be regarded as constructive mechanisms of general equilibrium modeling in the context of market socialism debates; the obsession of general eq.. Conversation analysts have noted that, in psychotherapy, formulations of the client's talk can be a vehicle for offering a psychological interpretation of the client's circumstances. But we notice that not all formulations in psychotherapy offer interpretations. We offer an analysis of formulations that are diagnostic: that is, used by the professional to sharpen, clarify or refine the client's account and make it better able to provide what the professional needs to know about the client's history and symptoms. In doing so, (...) these formulations also have the effect of shepherding the client's account towards subsequent therapeutic interpretation. In a coda, we notice that sometimes the formulations are designed discreetly. We examine one such discreet formulation in detail, and show how its very ambiguity can lead to its failure as a diagnostic probe. (shrink)

Recent theological anthropology emphasizes a dynamic and integral understanding of the human being, which is also related to Karl Rahner's idea of active self-transcendence and to the imago Dei doctrine. The recent neuroscientific discovery of the “visual word form area” for reading, regarded in light of the concept of cultural neural reuse, will produce fresh implications for the interrelation of brain biology and human culture. The theological and neuroscientific parts are shown in their mutual connections thus articulating the notion that (...) human beings shape and transcend themselves both at the biological and at the cultural level. This will have relevant implications for the timely topic of human uniqueness in science and theology, and in proposing a new research perspective in which theology may consider culture along with its biological import, but not necessarily in strictly evolutionary terms alone. A disconnect remains between theories about responsible management and application in real-life organizations. Part of the reason is due to the complexity and holistic nature of the field, and the fact that many of the benefits of aligning business objectives with changing societal conditions are of an intangible nature. Human resource management is an increasingly important part of the field with benefits including talent retention, higher levels of motivation, and improvements in organizational cohesion. This paper sets out an experiment run (...) at a large Spanish university to try to analyze the impact on worker productivity of a responsible management stance by an employer. Based on the Corporate Social Performance model, the paper examines the issue from the point of view of responsibilities, responsiveness, and outcomes, and considers the cost/benefit effect of incorporating a social responsibility variable into the wage structure to measure the impact on productivity. If we are to believe the proponents of the Theory of Practice and of Rational Choice, the gap between these two paradigmatic approaches cannot be bridged. They rely on ontological premises, theories of motivations and causal models that stand too far apart. In this article, I argue that this theoretical antinomy loses much of its edge when we take as objects of sociological investigation processes of historical change, that is, when we try to specify in theoretical terms how and in (...) which conditions historical actors enact and endorse shifts in patterns of relations as well as shifts in the symbolic and cognitive categories that make these relations significant. I substantiate this argument in light of the distinction between two temporalities of historical change: first, the long waves of gradual change and, second, the short waves of moments of breaks and ruptures. Along the way, I develop an argument about the conditions of emergence of self-limiting norms and the centrality of epistemic beliefs in situations of high disruption. (shrink)

I examine some behavioural and heuristic models of individual decision-making and argue that the diverse psychological mechanisms these models posit are too demanding to be implemented, either consciously or unconsciously, by actual decision makers. Accordingly, and contrary to what their advocates typically claim, behavioural and heuristic models are best understood as ‘as-if’ models. I then sketch a version of scientific antirealism that justifies the practice of as-if modelling in decision theory but goes beyond traditional instrumentalism. Finally, I relate my account (...) of decision models to the recent controversy about mentalism versus behaviourism, reject both positions, and offer an alternative view. (shrink)

We use this editorial essay as a call for a more effective use of new technologies, such as mobile apps and Web 2.0 tools, to educate students and other relevant stakeholders on business ethics, corporate social responsibility, and sustainability topics. We identify three overarching reasons that justify the need for new ways of teaching that further incorporate technology to foster the innovative thinking needed to tackle imminent societal grand challenges such as climate change and increasing inequality. First, we are facing (...) a new generation of millennials and Generation Z students who are digital natives and more likely to search for educational content on their electronic devices. Second, new technologies offer opportunities to reach students globally, helping to democratize education. Third, we posit that the intrinsic characteristics of societal grand challenges, which are complex, uncertain, and evaluative, can benefit from technology as an effective translator of multilayered concepts into more digestible action items. Our essay ends with a brief summary of the four essays included in the thematic symposium: “There is an App for that! During the 1980s Illich added another dimension to his thought through the study of Medieval history. In the current volume he aims to demonstrate the extent to which the groundwork for the institutions that characterize our world today was laid in the twelfth century.

The paper offers a semantic and pragmatic analysis of statements of the form ‘x is beautiful’ as involving a double speech act: first, a report that x is beautiful relative to the speaker’s aesthetic standard, along the lines of naive contextualism; second, the speaker’s recommendation that her audience comes to share her appraisal of x as beautiful. We suggest that attributions of beauty tend to convey such a recommendation due to the role that aesthetic practices play in fostering and enhancing (...) interpersonal coordination. Aesthetic practices are driven by a disposition towards the attunement of attitudes and aesthetic recommendations contribute to forwarding such attunement. Our view is motivated by an attempt to satisfy the following set of desiderata: to account for the experiential nature of aesthetic judgments, disagreements in aesthetic debates, and the normative aspirations of aesthetic discourse, as well as to avoid appealing to error theory and realist ontological commitments. This chapter examinates the concept of Baroque habits in its various declensions, dwelling in particular on aesthetic habits through the case study of Guarino Guarini’s Chapel of the Holy Shroud in Turin. In the first part three declensions of Baroque habits, linked together by profound implications, are identified: habits of knowledge, referred to the ideal of Baroque encyclopedism; moral habits, framed in the Baroque practices of government of affects; and aesthetic habits, consisting in regimes of or- dering of sensible experience (...) which finds in the Wunderkammer one of its highest manifestations. In the second part of this chapter, these concepts are applied and further elaborated in the light of one of the greatest results of European Baroque, the Guarinian Chapel. Through the example of the Turinese architecture it is demon- strated how Baroque representative practices perform a gesture of immanentization of the transcendent principle by composition of light and application of geometry. Such “sensible metaphysics” is aimed at both the government of affects and at the creation of a habitable space of experience, where the infinite transcendence of Christian divinity becomes source and object of habits. In virtue of what does a linguistic act count as an insult? I discuss five main approaches to this question, according to which an insult is determined by (i) the semantic properties of the expression used; (ii) the insulter, her intention, or attitudes; (iii) the addressee and her personal standard; (iv) the features of the speech act performed; and (v) the standard of the relevant social group.
