In this monograph, authors J. Caleb Clanton and Kraig Martin argue that two classical approaches to moral grounding (natural law theory and divine command theory), while commonly opposed, can nevertheless be combined into a "third way" through precepts derived from the Stone-Campbell tradition. As such, this work represents an attempt to show the rich potential the Stone-Campbell tradition has in contributing to important, long-standing metaethical and philosophical questions.

In Barrett v. Danbury Hospital ), the Supreme Court of Connecticut held that the fear of contracting or transmitting HIV or any other blood-borne pathogens is not a compensable injury and does not give rise to a negligence or a medical malpractice claim. The court's decision affirmed the holding of a Connecticut trial court.In June 1990, Allen Barrett was admitted to Danbury Hospital complaining of abdominal pain. He had a history of gall bladder trouble. Barrett was placed on a stretcher (...) in the emergency room. The attending physician diagnosed Barrett's pain as a gallstone condition. During the course of his examination, the doctor noticed that Barrett was sitting in blood. The physician subsequently performed a rectal examination of Barrett to locate the source of the blood. The physician determined that the patient was not bleeding, but that the blood was in fact coming from two slits in the vinyl pad that covered the stretcher on which Barrett sat. (shrink)

Contemplating the catastrophic course of the Nazi Revolution we may well find it all too easy to see nothing in the spectacle but the nether darkness made visible; and if we are advised that it is not merely permissible but highly advisable to learn from the enemy, we may be tempted to think that whatever the Nazi war-machine has to teach the strategist and the technician, the political history of Germany in the last decade, and in particular the political ideology (...) that has imposed itself upon the German mind with such apparent thoroughness, can yield only the negative lesson of a warning, by displaying upon the world-wide stage the doomful consequences of wrong principles ruthlessly pushed to their extreme. But it is certainly an error to deny that nothing of more positive value has emerged out of the revolutionary cauldron: and indeed it would be more than strange, where such whole-hearted energies of mind are being enlisted in the evil cause of Nazism, if none of its votaries had ever stumbled for a time into wisdom. In 1991 this author published a book entitled, From Catastrophe to Chaos: A General Theory of Economic Discontinuities with Kluwer Academic Publishers. Due to the con troversial and unusual nature of this book’s content, there was considerable difficulty in getting publishers to agree to publish it prior to its being accepted by Kluwer. Initially conceived as a heterodox challenge to established economic thinking, this book became viewed by many readers as a reference volume on applications of nonlinear dynamics in general (...) to many fields of economics. Now, in 2000 Volume 1 of the second edition has appeared from Kluwer also, subtitled, Mathematics, Microeconomics, Macroeconomics, and Finance. It covers in expanded form the material contained in the first eight chapters of the first edition. What is this book about and how does the new edition differ from the first one? The underlying philosophy presented is that discontinuities are important objects of study in economics, indeed in many disciplines beyond economics as well. Although discontinuities may arise dynamically due to random exogenous shocks, the more truly interesting ones are those that arise endogenously from dynamical economic systems. In 1947, Jacques Maritain argued before the UN that “men mutually opposed in their theoretical conceptions can come to a merely practical agreement regarding a list of human rights.” Maritain justified this thesis using a progressive theory of the natural law which rests on a distinction between the natural law as operative in human nature and the natural law as known and articulated. Drawing on Maritain’s 1951 Man and the State, this essay defends a MacIntyrian reading of Maritain’s thesis and (...) its plausibility against four objections from Ralph McInerny, Charles Taylor, and Alasdair MacIntyre himself. Having remarked that "competing and mutually contradictory philosophies may be formulated in different languages," Landesman concludes that "the generalization that the speaking of a given language by a given philosopher is either a necessary or sufficient condition for the formulation of his explicit philosophy would seem to be false." I do not believe that the conclusion follows. Elsewhere, I have tried to show that what I call the "strong interpretation" of the Sapir-Whorf hypothesis can be assimilated to the notion of (...) "untranslatability" in such a way that it becomes equivalent to the denial of the position held by Roman Jakobson that "All cognitive experience and its classification is conveyable in any existing language." To deny Jakobson's thesis is equivalent to the assertion that there is at least one language for which there is at least one other language such that the first cannot translate the second. Although St Thomas Aquinas famously claimed that his Summa Theologiae was written for 'beginners', contemporary readers find it unusually difficult. Now, amid a surge of interest in virtue ethics J. J. Arthur Baird is the author of several important books in New Testament studies, his best known perhaps being his Audience Criticism and the Historical Jesus. At his untimely death, he left a nearly complete manuscript, now published here. In this timely and relevant manuscript, Baird offers first a critical introduction to the historical paradigm, pointing out its limitations in terms of tracing the paradigm of New Testament formation. He then traces this development himself, beginning with the starting point of (...) the Holy Word and noting its development through the context, theological interpretation, and application, to its manifestation in the apostles, schools and fathers. He concludes with comments on its current implications. This book represents the last and lasting final thoughts of a scholar who was very much devoted to the importance of the Holy Word. (shrink)

The practical problem of assuaging the opponents of animal research may be solved without formally addressing (or resolving) the underlying ethical questions of the debate. Specifically, a peaceful boycott of the "fruits" of animal research may lead to a wider cessation of such research, than, say, vocal or even violent protest. To assist those who might wish to participate in such a boycott- and, moreover, to critically inform them of the implications of their actions-1 offer a modest proposal: the use (...) of an "animal research advance directive", a form which enumerates precisely which "fruits of research" are declined. The present essay offers a sketch of a philosophy of value, what I shall here refer to as ‘ethical instrumentalism.’ My primary aim is to say just what this view involves and what its commitments are. In the course of doing so, I find it necessary to distinguish this view from another with which it shares a common basis and which, in reference to its most influential proponent, I refer to as ‘Humeanism.’ A second, more general, aim is to make (...) plausible the idea that, given the common basis, ethical instrumentalism provides a more compelling picture of the philosophy of value than Humeanism does. Scholars of the classical American philosophical tradition have not written much about prayer, despite the fact that almost every single one of the major figures of this tradition acknowledged its significance. The gap in the literature is notable in the case of George Santayana, who discusses prayer in several of his major works. And of all the classical American philosophers, Santayana may have the most fully developed treatment of prayer, particularly as it relates to the problem of petitionary prayer. Yet (...) his account of payer has not received much attention. This is surprising since, on the one hand, many of Santayana’s other views on religion and spirituality have been widely commented on, and, on the other hand, prayer has been a prominent topic in philosophy of religion in recent decades. And it makes sense for scholars of the classical American tradition nowadays to consider Santayana’s views about prayer, at the least because this tradition concerns itself with the problems of ordinary people, and to most Americans–and even to some atheist Americans–prayer seems to matter a great deal. Santayana’s treatment of prayer can be organized into two phases. First, he offers a twofold case against the common view that petitionary prayer is materially efficacious–that is, the view that petitionary prayer can do something to affect whether God brings about a desired state of affairs that would not have otherwise obtained had the request for it not been made. The first student-friendly introduction to the philosophical issues surrounding torture. It is a timely and useful contribution to a highly topical and on-going debate.

Habermas's conception of deliberative democracy could be fruitfully supplemented with a discussion of the "institutional design" of civil society; for example the architecture of public spaces should be considered. This paper argues that Hegel's discussion of architecture in his 'Aesthetics' can speak to this issue. For Hegel, architecture culminates in the gothic cathedral, because of how it fosters reflection on the part of the worshiper. This discussion suggests the possibility that architecture could foster a similar kind of intersubjective reflection. Some major leftist thinkers, including Alain Badiou, Slavoj Žižek and Terry Eagleton, have lately offered readings that claim the relevance of alternative interpretations of the Christian tradition in the face both of the conservative turn in the Catholic Church and of the contemporary secular oblivion of anything that has to do with religion. Furthermore, post-colonial studies have tended to blame the West en bloc for the disasters of past and present colonization, and have attacked the western endeavour to extend universal (...) truths as an ethnocentric device to facilitate and justify exploitation. In Holy Terror, Terry Eagleton both condemns western politics and questions its appeal to universals; but he also hears in this tradition a demand for a relationship with the other which offers an alternative to that established by current politics and capitalist exploitation. The other is the excluded, the oppressed, the exploited; the true material, rather than ideal, universal produced by global capitalist exploitation. As a consequence, anything that happens in any part of the planet belongs in our world and indicts us, though we tend to build barriers around an ideally safe and stable identity that ignores part of its own reality and that is therefore haunted by it. Texts like the Bacchae or the New Testament open the gates of the city and of the heart to the excluded. Terrorists — saints for their own communities and satanic for the rest — offer an example of the other that is impossible to comprehend within our conventional ways of life. Nevertheless, only if we hear in their violence a demand for justice can an exit be found from the vicious circle of violence and revenge. (shrink)

Little is in print on the development in Britain of university disciplines including the academic study of education. This paper provides a historical narrative of the study of adolescence from the 1870 Education Act to the contemporary day. Adolescence textbooks are examined in the context of changes in the education system, such as the demand for secondary education and the expansion of teacher education. Changing emphases in adolescence research are traced through various publications to illustrate curriculum developments. The important contributions (...) of Dame Olive Wheeler, Professor W. D. Wall and other leading writers on adolescence are evaluated. It is clear that in over a century of national educational provision British teachers have never faced a great choice of adolescence texts and the paper concludes with some reflections on this observation.
