In this study, we present data on graduate students' actual experiences in dealing with impaired peers and faculty predictions of how students would deal with such situations. A total of 29 faculty and 73 graduate students responded to a survey of 40 randomly selected clinical psychology training programs. Student respondents were almost universally (95%) aware of peers whom they regarded as impaired in their professional functioning, and half (49%) the sample reported being aware of a peer's ethical impropriety. Faculty overestimated (...) the number of students who said they "did nothing" when confronted with the resulting ethical dilemma and underestimated the degree of conflict and turmoil (i.e., anger, frustration, dismay) that students reported experiencing. Faculty also estimated that students would be more concerned with peer loyalty issues, whereas students indicated that they were strongly motivated by ethical considerations. Ethics curricula ought more thoroughly to address affective concerns through experiential learning vehicles such as faculty modeling, simulation exercises, and small-group discussion. (shrink)

This innovative text is psychologically informed, both in its diagnosis of inferential errors, and in teaching students how to watch out for and work around their natural intellectual blind spots. It also incorporates insights from epistemology and philosophy of science that are indispensable for learning how to evaluate premises. The result is a hands-on primer for real world critical thinking. The authors bring a fresh approach to the traditional challenges of a critical thinking course: effectively explaining the nature of validity, (...) assessing deductive arguments, reconstructing, identifying and diagramming arguments, and causal and probabilistic inference. Additionally, they discuss in detail, important, frequently neglected topics, including testimony, including the evaluation of news and other information sources, the nature and credibility of science, rhetoric, and dialectical argumentation. The treatment of probability uses frequency trees and a frequency approach more generally, and argument reconstruction is taught using argument maps; these methods have been shown to improve students’ reasoning and argument evaluation. Bioregionalists have championed the utility of the concept of the watershed as an organizing framework for thought and action directed to understanding and implementing appropriate and respectful human interaction with particular pieces of land. In a creative analogue to the watershed, permaculturist Arthur Getz has recently introduced the term “foodshed” to facilitate critical thought about where our food is coming from and how it is getting to us. We find the “foodshed” to be a particularly rich and evocative metaphor; but (...) it is much more than metaphor. Like its analogue the watershed, the foodshed can serve us as a conceptual and methodological unit of analysis that provides a frame for action as well as thought. Food comes to most of us now through a global food system that is destructive of both natural and social communities. In this article we explore a variety of routes for the conceptual and practical elaboration of the foodshed. While corporations that are the principal beneficiaries of a global food system now dominate the production, processing, distribution, and consumption of food, alternatives are emerging that together could form the basis for foodshed development. Just as many farmers are recognizing the social and environmental advantages to sustainable agriculture, so are many consumers coming to appreciate the benefits of fresh and sustainably produced food. Such producers and consumers are being linked through such innovative arrangements as community supported agriculture and farmers markets. Alternative producers, alternative consumers, and alternative small entrepreneurs are rediscovering community and finding common ground in municipal and community food councils. Recognition of one's residence within a foodshed can confer a sense of connection and responsibility to a particular locality. The foodshed can provide a place for us to ground ourselves in the biological and social realities of living on the land and from the land in a place that we can call home, a place to which we are or can become native. Academic file-sharing services encourage students to upload materials, sometimes their own study notes for example, but can also include copyrighted university documents, in exchange for access to downloading resources from a common repository. In this process, the lines between legitimate study help and academic misconduct are unclear. Integrity-based strategies to combat these transactions have been limited. Removal by copyright mechanisms has been identified as a potential approach but has been hampered by the enormity of the task and the resource intensity (...) required to make an impact at scale. This explorative study at a large Australian university sought to remove a percentage of copyrighted material from two commonly used academic file-sharing websites and to understand the experience of users in uploading files. Findings from the study were encouraging and informative, resulting in a suite of initiatives being introduced across the institution to prevent uploading in the first instance as well as, where possible, addressing misconduct when it occurred. Limitations included that the study was only undertaken as one university and therefore does not represent the contexts of different institutions. Further, it only investigated two websites out of many available. Future research could explore the use of artificial intelligence (AI) by academic file-sharing services to retain existing users and attract new ones. This work provides a clearer picture of how an institution’s copyrighted material is hosted on two academic file-sharing websites and offers an effective and potentially scalable copyright approach that could be adapted by other higher education institutions. How can we be certain that software is reliable? Is there any method that can verify the correctness of software for all cases of interest? Computer scientists and software engineers have informally assumed that there is no fully general solution to the verification problem. In this paper, we survey approaches to the problem of software verification and offer a new proof for why there can be no general solution.

In a series of joint papers, Teppo Felin and Nicolai J. Foss recently launched a microfoundations project in the field of strategic management. Felin and Foss observe that extant explanations in strategic management are predominantly collectivist or macro. Routines and organizational capabilities, which are supposed to be properties of firms, loom large in the field of strategic management. Routines figure as explanantia in explanations of firm behavior and firm performance, for example. Felin and Foss plead for a replacement of such (...) macro-explanations by micro-explanations. Such a replacement is needed, Felin and Foss argue, because macro-explanations are necessarily incomplete: they miss out on crucial links in the causal chain that connect macro phenomena with each other. I argue that this argument is flawed. It is based on a doubtful if not outright incorrect understanding and use of Coleman’s diagram. In a sense to be explained below, only if Coleman’s diagram is squared it can accurately account for the relations between individual action and interaction, routines and firm behavior and firm performance. Once Coleman’s diagram is squared, one can see why and how macro-explanations need not miss out on any link in the causal chains that connect macro phenomena. Micro-analyses are still needed, not to highlight and specify causal links that macro-explanations miss out on, but to check whether the many properties that are ascribed to routines in macro-explanations of firm behavior are warranted. I defend a moderate (neither extremely conservative nor extremely liberal) view about the contents of perception. I develop an account of perceptual kinds as perceptual similarity classes, which are convex regions in similarity space. Different perceivers will enjoy different perceptual kinds. I argue that for any property P, a perceptual state of O can represent something as P only if P is coextensive with some perceptual kind for O. 'Dog' and 'chair' will be perceptual kinds for most normal people, 'blackpool (...) warbler' for the expert birdwatcher but not for the rest of us, 'dangerous', 'familiar', or 'meaning that the cat is on the mat' for none of us. I argue that in order to apply the most common type of criteria for logicality, invariance criteria, to natural language, we need to consider both invariance of content—modeled by functions from contexts into extensions—and invariance of character—modeled, à la Kaplan, by functions from contexts of use into contents. Logical expressionsshould be invariant in both senses. If we do not require this, then old objections due to Timothy McCarthy and William Hanson, suitably modified, demonstrate that content invariant expressions can display intuitive (...) marks of non-logicality. If we do require this, we neatly avoid these objections while also managing to demonstrate desirable connections of logicality to necessity. The resulting view is more adequate as a demarcation of the logical expressions of natural language. (shrink)

Emotions are understood sociologically as experiences of involvement. Emotion regulation influences the type, incidence, and expression of emotions. Regulation occurs through physical processes prior to an emotions episode, through social interaction in which a person’s emotions are modified due to the reactions of others to them, and by a person’s self-modification or management of emotions which they are consciously aware of. This article goes on to show that there are emotions which the emoting subject is not consciously aware of. Therefore, (...) a certain class of emotions function by foregrounding external objects of attention while remaining outside the emoting subject’s consciousness. The nature and significance of such backgrounded emotions beyond explicit emotion regulation are explored through consideration of their role in theory choice in science and in trust relations. Two widespread assumptions concerning networks, including guanxi networks, are that they function in terms of trust relations and that their structure is dyadic. This article subjects both assumptions to critical assessment and proposes alternative formulations. When the distinctions between trust and trustworthiness and between trust and assurance are made, then broader understandings of guanxi relationships emerge. The article shows that the assurance mechanism of guanxi is public exposure of transgressions against network norms, leading to the transgressor’s loss of face (mianzi). (...) The necessity of third-party intervention of this type, typically but not exclusively through gossip, indicates the triadic rather than dyadic structure of guanxi relationships when sanction of reputation is included in the conceptualization of guanxi. Changes in guanxi during economic transition in China, from strong-to weaker-tie associations, require careful consideration of the changing nature of the mechanisms of face-loss. (shrink)

The history of the Frankfurt School cannot be fully told without examining the relationships of Critical Theorists to their Jewish family backgrounds. Jewish matters had significant effects on key figures in the Frankfurt School, including Max Horkheimer, Theodor W. Adorno, Erich Fromm, Leo Lowenthal and Herbert Marcuse. At some points, their Jewish family backgrounds clarify their life paths; at others, these backgrounds help to explain why the leaders of the School stressed the significance of antisemitism. In the post-Second World War (...) era, the differing relationships of Critical Theorists to their Jewish origins illuminate their distinctive stances toward Israel. This book investigates how the Jewish backgrounds of major Critical Theorists, and the ways in which they related to their origins, impacted upon their work, the history of the Frankfurt School, and differences that emerged among them over time. In the Netherlands, consent from relatives is obligatory for post mortal donation. This study explored the perspectives of relatives regarding the request for consent for donation in cases without donor registration. A content analysis of narratives of 24 bereaved relatives of unregistered, eligible, brain-dead donors was performed. Relatives of unregistered, brain-dead patients usually refuse consent for donation, even if they harbour pro-donation attitudes themselves, or knew that the deceased favoured organ donation. Half of those who refused consent for donation mentioned (...) afterwards that it could have been an option. The decision not to consent to donation is attributed to contextual factors, such as feeling overwhelmed by the notification of death immediately followed by the request; not being accustomed to speaking about death; inadequate support from other relatives or healthcare professionals, and lengthy procedures. Healthcare professionals could provide better support to relatives prior to donation requests, address their informational needs and adapt their message to individual circumstances. It is anticipated that the number of consenting families could be enlarged by examining the experience of decoupling and offering the possibility of consent for donation after circulatory death if families refuse consent for donation after brain-death. A significant methodological difference between analytic and continental philosophers comes out in their differing attitudes to transcendental reasoning. It has been an object of concern to analytic philosophy since the dawn of the movement around the start of the twentieth century, and although there was briefly a mini-industry on the validity of transcendental arguments following Peter Strawson’s prominent use of them, discussion of their acceptability – usually with a negative verdict – is far more common than their positive use within (...) a philosophical system or to justify a specific claim. By contrast, in the continental traditions starting with Kant but enduring throughout the twentieth century and beyond, some form of transcendental reasoning is close to ubiquitous, notwithstanding that what one means by the transcendental is significantly reconfigured by phenomenology, and then the genealogical turn, as well as by a more constructivist understanding of philosophy. Concerns about the status of transcendental reasoning certainly exist for continental philosophers, but continued creative use persists, and there is no general agreement that transcendental argumentation is especially problematic. In fact, it is more commonly claimed, and it is certainly frequently implied, that a transcendental dimension is of the essence of philosophy. Any philosophical activity that does not reflect on its own conditions of possibility is naïve, or pre-critical, and the sometimes pilloried continental enquiries into the ‘problem of modernity’ are but one way of attempting to reflect on the conditions of contemporary philosophical discourse, subjectivity, and cultural life more generally. Much of this chapter will hence be concerned to offer both an explicit and implicit rationale for the divergent attitudes of analytic and continental philosophers vis-à-vis transcendental reasoning. We give an incomplete account of what transcendental arguments are, review the major analytic criticisms of them, gesture towards some of the recent continental appropriations of such arguments (focusing on the themes of embodiment and time), consider the extent to which analytic criticisms apply to such usages, and attempt to bring to the fore the differing explanatory norms that justify these divergent practices. I offer two interpretations of independence between experts: (i) independence as deciding autonomously, and (ii) independence as having different perspectives. I argue that when experts are grouped together, independence of both kinds is valuable for the same reason: they reduce the likelihood of erroneous consensus by enabling a greater variety of critical viewpoints. In offering this argument, I show that a purported proof from Finnur Dellsén that groups of more autonomous experts are more reliable does not work. It relies on (...) a flawed ceteris paribus assumption, as well as a false equivalence between autonomy and probabilistic independence. A purely formal proof that more autonomous experts are more reliable is in fact not possible – substantive claims about how more autonomous groups reason are required. My alternative argument for the value of autonomy between experts rests on the claim that groups that triangulate a greater range of critical viewpoints will be less likely to accept hypotheses in error. As well as clarifying what makes autonomy between experts valuable, this mechanism of critical triangulation, gives us reason to value groups of experts that cover a wide range of relevant skills and knowledge. In this article, I examine the purpose of public philosophy, challenging the claim that its goal is to create better citizens. I define public philosophy narrowly as the act of professional philosophers engaging with non-professionals, in a non-academic setting, with the specific aim of exploring issues philosophically. The paper is divided into three sections. The first contrasts professional and public philosophy with special attention to the assessment mechanism in each. The second examines the relationship between public philosophy and citizenship, calling (...) into question the effect public philosophy has on political reasoning. The third focuses on the practice of public philosophy, describing actual events to investigate the nature and limits of their outcomes. I conclude that public philosophy aims at future philosophical inquiry but is best considered a form of entertainment. (shrink)

This article proposes a new approach to employing Maurice Merleau-Ponty's philosophy in the philosophy of religion. Rather than finding a latent theology in Merleau-Ponty – as some interpreters do – this article argues that Merleau-Ponty's later ontology can provide the basis for a philosophical anthropology which can help us understand why human beings are drawn to religion and how this is expressed in affective and ritual practice. This ontology can help us to understand the notion of freedom as it applies (...) to affective, embodied, and ritual religious practices and begins to sketch out how freedom might be understood in light of embodiment. Both bereavement and the loss of a religious faith can be deeply disorienting experiences which radically transform one’s experience of the world, sense of self, and relationships with others. Recently, grief has received increased philosophical interest – especially from a phenomenological perspective – as philosophers seek to understand what it is to experience grief and what understanding grief can teach us about human experience more broadly. Grief is most commonly associated with bereavement loss; however, there is growing awareness of the (...) possibility of grief for non-death losses. This paper argues that certain experiences of deconversion can be occasions for grief. The experience of losing one’s religious faith has had scant coverage in contemporary philosophical literature yet its effect on individuals can be comparable to that of bereavement. This paper analyses deconversion experiences according to four themes common to bereavement: world destruction, temporal disruption, personal loss, and the loss of possibilities. Using a range of deconversion narratives drawn from ethnographic literature, this paper argues that some experiences of deconversion closely resemble experiences of grief, and so some responses to deconversion can rightly be called grief. One key difference between deconversion and other forms of grief regards the future-orientation of the experiences. While grief is often directed towards the loss of future possibilities, many accounts of deconversion are more concerned with losses from the past and present a positive attitude towards the future. This positive outlook can be explained by interpreting the deconversion experience through the lens of grief. (shrink)

The comments accompanying Proposition (Prop.) 11 (“God... necessarily exists”) in Part I of Spinoza’s The Ethics contain sketches of what appear to be at least three more or less distinct ontological arguments. The first of these is problematic even on its own terms. More is true: even the proposition “God exists” (GE), a consequence of Prop. 11, cannot be derived from the definitions and axioms of Part I (the “DAPI”) of The Ethics; thus, Prop. 11 cannot be derived from the (...) DAPI, either. To prove these claims, I use an automated deduction system (ADS) to show that Prop. 11 is independent of the DAPI. I then augment the DAPI with some auxiliary assumptions I believe Spinoza would accept and that sustain an automated derivation of (GE). The results illustrate how an ADS can facilitate the analysis of arguments and yield an apparently novel argument cast in the style of Spinoza. (shrink)

In recent work, Judith Butler has sought to develop a ‘new bodily ontology’ with a substantive normative upshot: recognition of our shared bodily condition, they argue, can support an ethic of nonviolence and a renewed commitment to egalitarian social conditions. However, the route from Butler’s ontological claims to their ethico-political commitments is not clear: how can the general ontological features of embodiment Butler identifies introduce constraints on behaviour or political arrangements? Ontology, one might think, is neutral on questions of politics. (...) In this paper I reconstruct Butler’s response to this challenge, arguing that there is an interesting and plausible path from ontology to politics. I draw on Heidegger’s ontological/ontic distinction to elucidate the central concepts of Butler’s ontology: vulnerability, precariousness, and interdependency. I argue that one of Butler’s central attempts to derive an ethic of nonviolence from ontology is unpersuasive, resting on a conflation of the ontological and ontic senses of ‘interdependency’. Nonetheless, I contend that Butler is right that genuinely acknowledging our vulnerability is likely to make us more responsive to the claims of others, loosening the grip of ideals of invulnerability and sovereign independence. These ideals and the violence they encourage amount to a disavowal of our ontological condition, while commitment to nonviolence is a way of acknowledgingshrink)

The prevalence, course and prognosis of diseases in patients referred to tertiary medical centers frequently differ from those treated in primary care settings. Extrapolation of findings from one population to another may therefore be unwarranted. Other factors that contribute to misinterpretation of medical literature include failure to distinguish statistical from clinical significance and advocacy of medical interventions prior to adequate clinical trials.

This article describes law's encounter with deconstruction, and how it changed deconstruction. In the hands of lawyers, deconstruction became a set of rhetorical strategies for critiquing legal distinctions and showing their ideological character. Legal scholars used deconstructive arguments to offer normative prescriptions in ways quite different from literary critics or philosophers. Although in theory all texts and distinctions are deconstructable, legal scholars assumed that some interpretations were better than others. Legal deconstruction thus became a set of repeatable rhetorical practices used (...) for pragmatic purposes; and it revealed that these rhetorical and pragmatic features were already present in literary and philosophical deconstruction. Deconstruction's encounter with law also overturned several popular assumptions about deconstruction. First, legal deconstruction does not assert that legal texts have no meaning or that their meanings are indecipherable. Rather, it argues that texts are overflowing with meanings that point in different directions and emerge over time. Second, one deconstructs conceptual oppositions not to show that legal concepts have no boundaries, but that their boundaries are fluid and appear differently as the conceptual opposition is placed into new interpretive contexts. Legal deconstruction asserts that legal distinctions are nested oppositions - conceptual oppositions whose terms bear a relation of mutual dependence and differentiation; this complicated relationship is revealed as interpretive contexts change. Ideological drift, in which concepts change their political valence as they are repeatedly invoked at different points in history, is a special case of this phenomenon. Third, instead of asserting that legal doctrine is radically indeterminate, legal deconstruction suggests that social construction places ideological constraints on legal decisionmaking and helps produce the sense that some arguments are better than others. Finally, far from denying the existence of fundamental human values, legal deconstruction presupposes a transcendent value of justice which law attempts to express but always fails fully to articulate. Research on guanxi is conducted principally within the disciplines of anthropology, business studies and sociology. It typically takes the form of empirical case studies, applications of extrinsic theory and literature reviews cum trend reports. The present paper, on the other hand, provides an analysis of guanxi in consideration of its elemental relations, components and properties. Discussion indicates the limitations of treatments of guanxi in terms of trust, guanxi bases, tie-strength and the conveyance of influence and information. Having established the characteristic (...) features of guanxi discussion then turns to how it may be an option or choice of commitment for persons and groups in contemporary China, its form and role in marketized exchanges, and how the efficiency of guanxi may be characterized. China has always served Western thinkers as a lens through which to project convenient contrasts and exemplars for their self-aggrandizement and self-realization. Weber’s treatment in The Religion of China is no exception. Weber’s purpose in this text is to demonstrate the exclusive provision in Europe of the conditions for the development of modern or industrial capitalism. To achieve this purpose Weber presents a distorted vision of both Confucianism and Daoism, even against the limited sinological material at his disposal. The discussion (...) of Chinese ‘mentality’, as Weber calls it in The Religion of China, functions in terms of European categories drawn from his discussion of historical and classical cases that are alien to Chinese developments but which serve the purpose of his argument. Indeed, the details of his earlier work, The Protestant Ethic and the Spirit of Capitalism, are similarly distorted by Weber in The Religion of China to permit him to more forcefully demonstrate the unsuitability of Confucianism to inculcate a sense of calling parallel to the Protestant ideal of vocation discussed in the Protestant Ethic. The paper shall both discuss Weber’s sinological sources and his use of them. It shall also show that late-imperial Chinese entrepreneurial activity was capitalistic in its institutional form and that the absence of industrial capitalism in China during the Qing dynasty was a consequence of demographic and political factors rather than resulting from the absence of religious values. All relevant sources agree that weeping is a human universal. There is disagreement, though, as to whether tears experienced during episodes of happiness or joy derive from the experience of joy itself, or whether such tears result merely from incidental physical constriction of the lacrimal gland or from a “sadness rebound” induced by anticipated loss of the source of joy . It is argued here that adult weeping does not exclusively express suffering but rather is an emotional and physical register (...) of changes in self, both positive and negative. In outlining the argument concerning weeping the paper also presents an account of the registration and consolidation of changes in self-identity and self-feelings, and therefore provides an account of the internal process of transformation of self. This article explores the extent to which it is or may be possible to have a claim both in contract and in restitution. Restitution will almost never be appropriate before a valid contract has been discharged but after it has been discharged a restitutionary claim may be available as well as a contractual one. A restitutionary claim cannot, however, be used to set aside the contractual allocation of risks. It is argued that while in the past English courts may have (...) been too willing to conclude that restitution would be inconsistent with the allocation of risks, the view of those striving to show the independence of restitution that there will always be a restitutionary claim unless the contract, construed strictly against the party resisting restitution, has excluded it, goes too far in the opposite direction. The terms of the contract and its nature are of vital importance to the existence and extent of any restitutionary claim Apart from the question of express or implied exclusion by a contractual remedial regime which is a complete code, the contract determines both whether contractual rights are "conditional" and defensible or "unconditional", and whether the acts of the person against whom restitution is sought constitute part performance of the contract which will either bar a claim or for which the plaintiff will have to give credit.
