Venn diagrams, which are widely used in introductory logic courses, provide a convenient and illuminating way of presenting the various theories concerning the nature of law. When combined with the Aristotelian square of opposition, these diagrams show not only how the theories are related to one another, logically, which is essential to understanding them, but also which theories are compossible. One surprising result of this approach is that it shows the substantive compatibility of the theories of law set forth by (...) H. L. A. Hart and Ronald Dworkin, who are usually pitted against one another. I show, through quotation and visual representation, that there is no essential disagreement between these jurisprudential stalwarts concerning the relation of law and morality. (shrink)

Conference environments enable diverse roles for academics. However, conferences are hardly entered into by participants as equals. Academics enter into and experience professional environments differently according to culture, gender, race, ethnicity, class, and more. This paper considers from a philosophical perspective entering and initiating culturally into academic conferences as a woman. It discusses theories of gender and emotional labor and emotional management, focusing on Arlie Hochschild’s foundational work, and affect in gendered social relations, considering Sara Ahmed’s theorization of the feminist (...) killjoy and the affect alien. This essay proposes a design perspective on argumentation, intended as complementary to empirical and critical scholarship. In any substantive domain, design can provide insights that differ from those provided by scientific or humanistic perspectives. For argumentation, the key advantage of a design perspective is the recognition that humanity’s natural capacity for reason and reasonableness can be extended through inventions that improve on unaided human intellect. Historically, these inventions have fallen into three broad classes: logical systems, scientific methods, and disputation frameworks. (...) Behind each such invention is a specifiable “design hypothesis”: an idea about how to decrease error or how to increase the quality of outcomes from reasoning. As problems in contemporary argumentation practice become more complex, design thinking rises in relevance and importance. A design research agenda in argumentation would focus on theorizing design innovations and on evaluating design hypotheses. (shrink)

In recent years, several scholars have hinted at a resemblance between Maximus the Confessor's logoi cosmology and evolutionary biology. In this article, I develop these suggestions further and claim that the logoi (divine ideas or wills) do indeed behave in an evolutionary fashion, diverging hierarchically and interactively from the Logos. However, there the similarity ends, for the logoi are also purposeful, inviolable, and good, unlike evolution which is said to be random, ever‐changing, and cruel. But rather than abandon the logoi–evolution (...) congruity, I argue that, by harnessing theological resources from across the Eastern tradition, one can integrate Maximus’ logoi vision more fully, resulting in an “incarnationally panentheistic” model of God's action and presence in evolution. More speculatively, within canonical Darwinism, the underlying (good) evolutionary motion of the logoi might be discernible in variation and adaptation, with the “evil” of competition and natural selection being “garments of skin” conceded by God as part of a simultaneous creation and cosmic fall. “Hot seating” is a form of creative drama in which the participants play themselves but imagine themselves in someone else’s position, some taking the role of interrogators and others the role of persons in the “hot seat”. This paper documents the case of marketing students who dramatised an ethics enquiry supposedly held under the auspices of a professional marketing association to investigate breaches in its code of professional conduct. Interpretive research, in the form of a cartoon test, was employed to (...) examine the contribution of the educational drama activity to student perceptions of learning within a role-playing experientially-based marketing unit at an Australian University. Findings reveal that students preferred the hot-seating exercise to conventional teaching methods in terms of enjoyment, “real-life” experience, new understandings of both marketing and ethics, and their motivation to learn more about marketing ethics implications for themselves, customers and the profession. Strategically, the convention was found to involve the students emotionally and intellectually with some intensity, while revealing that some students may be fearful of the drama or even over-stimulated by the sometimes tense and powerful environment.This pedagogical approach was also seen to be particularly suitable for instruction for the delicate, contentious and personal issues often raised by ethics. The article aims to provide a standpoint from which to critically address two broad concerns. The first concern surrounds a naïve view of mindfulness, which takes it as a given that it is a good thing to cultivate mindfulness and attendant qualities like compassion because these virtues are key to improving the quality of life and bettering effective decisionmaking within business. Yet the virtue of mindfulness has roots in religious and spiritual traditions, and the virtue of compassion is complex and (...) contextual; neither of these virtues operate in a vacuum. Nor do they function independently from other virtues and values. Reasonable people of goodwill possessing the virtues of mindfulness and compassion in good measure, may nevertheless strongly disagree about what the compassionate, mindful thing to do is, particularly in a business setting. It is, moreover, conceivable that intensively cultivating mindfulness and compassion could lead one to reject altogether the “dog-eat dog” culture of competitive business that draws upon selective features of mindfulness meditation that lie in the corporate comfort zone yet which are not especially countercultural from a religious or spiritual vantage point. The second concern is that Western virtue-based business ethics is largely confined to academic philosophical theories. As such, virtue-driven business ethics is often more centered around developing theoretical wisdom than developing “hard core” practical wisdom earned through yoga asanas, meditation, chanting, and breathing, whereas for contemplative practices the reverse is the case, with practical wisdom emphasized over theoretical wisdom. Accordingly, the article examines prospects for cross-fertilization between, on the one hand, mindfulness and compassion interpreted as virtues in Eastern contemplative practices, and on the other hand, mindfulness and compassion as interpreted within Western virtue-oriented business ethics. Illuminating a pathway for such interpretative cross-pollination calls for an appropriate conceptual frame of reference that the article organizes around a set of interconnected themes. The first theme is that mindfulness and compassion represent key virtues within contemplative practices. This indicates a promising touchpoint between Eastern and Western traditions: their respective focus upon character, inner states, intrinsic motivation, and self-improvement toward ethicality in the world. The second theme is that such virtues in Eastern contemplative practices, as well as character traits integral to Western virtue-oriented approaches, denote contested “normative-interpretive” concepts that engage philosophical debate rather than indisputable empirical-criterial concepts that can be taken at face-value. The third theme advocates moving beyond behaviorist and neuropsychological accounts of virtue, approaching character traits of Eastern contemplative practice and Western virtue ethics through nonscientific inquiry into normative interpretive questions concerning such virtues. This supports debate over competing views of the nature, purpose, cultivation, and cultural context of mindfulness, compassion, and other virtues – issues arising as mindfulness enters the business management sphere -- to be conducted on normative grounds. With the background conceptual framework established, the article presents key points about the prospects for cross-fertilization between virtue ethics and contemplative practice, and why it matters, with reference to business ethics. Speakers of a natural language regularly form justified beliefs about what others are saying when they utter sentences of the language. What accounts for these justified beliefs? At one level, we already have a plausible answer: there is a perfectly good ordinary sense in which users of a language know what its sentences mean, and it is very plausible that the hearer’s knowledge of the meaning of S helps explain her justification for her belief about what is said by an (...) utterance of S. But what exactly does our knowledge of sentence meanings consist in? In this essay I advance and defend the view that we know the meanings of sentences in virtue of having a certain distinctive kind of know-how that I call inferential practical knowledge. I argue that this view provides the best explanation for the justification of our beliefs about what is said. In particular, it provides a better explanation than the more conventional and widely accepted view that we know the meaning of S in virtue of possessing the theoretical knowledge that S has such-and-such meaning. A sensible epistemologist may not see how she could know that she is not a brain in a vat ; but she doesn’t panic. She sticks with her empirical beliefs, and as that requires, believes that she is not a BIV. (She does not inferentially base her belief that she is not a BIV on her empirical knowledge—she rejects that ‘Moorean’ response to skepticism.) Drawing on the psychological literature on metacognition, I describe a mechanism that’s plausibly responsible for a sensible (...) epistemologist coming to believe she is not a BIV. I propose she thereby knows that she is not a BIV. The particular belief-forming mechanism employed explains why she overlooks this account of how she knows she is not a BIV, making it seem that there is no way for her to know it. I argue this proposal satisfactorily resolves the skeptical puzzle. (shrink)

In this article, we explore how a posthumanist stance has enabled us to work a different consideration of the way in which voice is constituted and constituting in educational inquiry; that is, we position voice in a posthuman ontology that is understood as attributable to a complex network of human and nonhuman agents that exceed the traditional understanding of an individual. Drawing on the work of Deleuze and Guattari, Barad, and Bennett, we present a research artifact that illustrates how this (...) posthuman voice is productively bound to an agentic assemblage. The reconfiguration of a posthuman voice with/in an educational research artifact further enables us to explore various analytic questions: What happens when voice exceeds language and is more than vocalized words emanating from a speaking subject? If the materiality of voice is not limited to sound, how do we account for it? That is, how might the materiality of voice be located in the space of intra-action among human and non-human objects? We conclude with implications for thinking qualitative methodology in education differently. (shrink)

According to philosophical orthodoxy, intuitions are perception‐like in that they provide us with non‐inferential justification. In this paper, I present four arguments to show that orthodoxy is mistaken: Intuitions, as used in thought experiments, are inferential judgments, that is the results of inferential transitions that are inferentially justified (if justified at all). The discussion will shed light on the nature of intuition but also on the nature of inference.

In his essay ‘“Conceptual Truth”’, Timothy Williamson (2006) argues that there are no truths or entailments that are constitutive of understanding the sentences involved. In this reply I provide several examples of entailment patterns that are intuitively constitutive of understanding in just the way that Williamson rejects, and I argue that Williamson’s argument does nothing to show otherwise. Williamson bolsters his conclusion by appeal to a certain theory about the nature of understanding. I argue that his theory fails to consider (...) the role that the structure of a sentence plays in determining its meaning. The cases I present suggest that this role imposes greater cognitive requirements on understanding than Williamson can acknowledge. (shrink)

“Black box argument” is a metaphor for modular components of argumentative discussion that are, within a particular discussion, not open to expansion. In public policy debate such as the controversy over abstinence-only sex education, scientific conclusions enter the discourse as black boxes consisting of a result returned from an external and largely impenetrable process. In one way of looking at black box arguments, there is nothing fundamentally new for the argumentation theorist: A black box argument is very like any other (...) appeal to authority, and what might be said about any particular form of black box will turn out to be a particularized version of what might be said about evaluating arguments based on authority. But in another way of looking at black box arguments, they are a constantly evolving technology for coming to conclusions and making these conclusions broadly acceptable. Black boxes are to argumentation what material inventions are to engineering and related sciences. They are anchored in and constrained by fundamental natural processes, but they are also new things that require theoretical explication and practical assessment. (shrink)

Hong Kong, as a former colony of the United Kingdom, is characterised as a hybrid of East and West. Its colonial history is commonly seen as establishing many positive aspects of Hong Kong and shaping good qualities of its people, such as the value of rule of law, free speech, freedom of the press, and fluency in English. Yet the majority of people in both Hong Kong and China share Han Chinese ethnicity, which has been used by both the Chinese (...) and Hong Kong governments to promote a blood-based idea of Chinese identity for decades. This paper explores “Chineseness", or Chinese identity, as promoted by the Hong Kong government. It first explores the concept of Chineseness, elaborating on a blood-based view that connects with ethnic-nationalism, in contrast with a pluralistic view of identity in the Hong Kong context. The paper then examines how Hong Kong government officials promote Chineseness through major outlets, on government websites and in speeches captured in media. As we show, the government tends to advocate a blood-based view of Chineseness akin to ethnic-nationalism. A more inclusive and pluralistic view which recognises the dynamic nature and multiple visions of Chinese identity better fits Hong Kong’s multicultural context. (shrink)

In the absence of any institution for imposing legal liability on global business, the idea of instituting a cosmopolitan court for international corporate offenses is advocated. The proposal is then critically examined and defended in light of a number of key objections. Having both civil and criminal jurisdiction, such a tribunal could benefit domestic and international legal systems, multinational corporations, and victims of transnational and international corporate misdeeds. By laying down minimal global standards of corporate liability, resolving conflicts between the (...) regulatory activities of national legal systems, and affording redress for aggrieved parties in countries with inadequate legal infrastructures, the tribunal would promote the objectives of compensatory, distributive, procedural and retributive justice at the global level. Moreover, the court would assist corporations by translating compliance with minimum ethical standards to the bottom line. Ethical corporations will gain competitive advantage relative to unscrupulous firms, since the latter'ss activities will be sanctioned. The international community need not leave obedience to basic norms up to the voluntary good-will and discretion of multinational firms. (shrink)

In this paper a method is proposed for empirically determining simultaneity at a distance within the special theory of relativity. It is argued that this method is independent of Einstein's signalling method and provides a basis for denying the conventionality of distant simultaneity.

Business and music, when at their best, embody virtuosity. This article presents the concept of virtuosity in music as an analogue for deepening understanding of, and for cultivating, virtuosity in business. Among the advantages of undertaking the comparison is the assistance it provides in envisioning business in a new light, a task especially called for in a climate of disillusionment with economic institutions and economic actors.

The article posits the concept of economy of mutuality as an intellectual mediation space for shifts in emphasis between market and social structures within economic theory and practice. Economy of mutuality, it is contended, provides an alternative frame of reference to the dichotomy of market economy and social economy, for inquiry about what business is for and what values it presupposes and creates. The article centers around the objective of gaining a broadened understanding of business so as to include not (...) just market economy, but social enterprise and social economy. In pursuit of this objective, a range of various archetypes of business enterprise are considered in light of higher ends of economic life. The highest telos of business encompassing all such archetypes, it is argued, is founded on reciprocity and integral human development. The article concludes that, compared to market economy per se, economy of mutuality provides a better conceptual framework for business in undertaking the challenges of sustainability. (shrink)

I consider in this essay three possible interpretations of the infinitely rich story of Abraham and Isaac found in Genesis 22. Against the background of what I call "the traditional reading," I compare the views of William Blake, Johannes de Silentio, and Søren Kierkegaard. Blake's poetry and painting suggest a striking alternative to our usual understanding of the story, but they finally require too radical a departure from the Biblical text. The pseudonym de Silentio's views on obedience to God, presented (...) in Fear and Trembling, are even more problematic, however. They are at odds with Kierkegaard's powerful account of love of neighbor, related under his own name in Works of Love, for instance. The God who is Love would not literally require murderous intent toward a neighbor, I conclude, but that same God might issue an "ironic" command designed to lift us out of an abominable ritual. This paper contributes to debates on the benefits of single-sex and co-educational school environments by considering both single-sex versus co-educational schools and single-sex versus co-educational classes in co-educational schools. Two research studies provide the empirical basis for this discussion. One study was a 10-year-long investigation of two Australian secondary schools which had been single-sex schools and became co-educational secondary schools over a two-year period. The second study involved a two-year investigation in an English co-educational secondary school where single-sex mathematics classes (...) were introduced for one cohort of pupils for five school terms, after which mixed-sex classes were reintroduced. Evidence relating to academic self-concept, pupil, parent and staff perceptions and academic achievement are discussed. Overall, the evidence suggests that co-educational environments create possible social/interaction disadvantages for girls, but that academic self-concept is not adversely affected by transferring from single-sex environments into mixed-sex ones. Previous research has shown that angry and happy faces are perceived as less emotionally intense when shown with averted versus direct gaze. Other work reports that long-term memory for angry faces was poorer when they were encoded with averted versus direct gaze, suggesting that threat signals are diluted when eye contact is not engaged. The current study examined whether gaze modulates working memory for angry and happy faces. In stark contrast to LTM effects, WM for angry faces was not significantly (...) modulated by gaze direction. However, WM for happy faces was significantly enhanced when gaze was averted versus direct. These findings suggest that in WM – when rapid processing and an immediate response is required – averted gaze may alter the meaning behind a smile, and make this kind of expression particularly salient for short-term processing. According to Perceptual Fundamentalism we can have justified perceptual beliefs solely in virtue of having perceptual experiences with corresponding contents. Recently, it has been argued that Perceptual Fundamentalism entails that it is possible to gain an a priori justified belief that perception is reliable by engaging in a suppositional reasoning process of a priori bootstrapping. But I will show that Perceptual Fundamentalists are not committed to a priori bootstrapping being a rational reasoning process. On the most plausible versions of Perceptual (...) Fundamentalism, a priori bootstrapping cannot be used to rationally support anti-sceptical beliefs about the reliability of perception. Moreover, seeing why Perceptual Fundamentalists are not committed to a priori bootstrapping will help us to better understand the nature of the perceptual entitlements that Perceptual Fundamentalists posit, or at least should posit. This article explores the effect that communications technology has on hegemonic power. The first section establishes a theoretical framework combining Foucault’s carceral archipelago theory with Chiara Bottici’s concept of the social imaginal describing the medium through which inter- and trans-subjective imagination occurs. The remainder employs this framework to examine how four technological innovations (print media, radio, television and Internet) impact the (re)production of discursive hegemonic ideology, integrating a variety of historical and contemporary theories on public discourse and ideological dominance.
