Can humanity abandon its meat-based diet, and is it willing to? This diet is unique in that it institutes an endlessly bloody relationship to animals. What do we know when we know the law? Not a set of rules or theories, but a set of practices that are at bottom practices of reading--reading the texts of the law, reading the world--and writing (including of course speaking), especially writing in news ways in the inherited language of the law. Legal knowledge is a writer's knowledge. It always has as one of its deepest themes the question of justice. These themes are explored through an examination of the (...) Model Penal Code, which respect to which I ask what it would be like to learn this material with an eye to using it as a language of thought and argument. It is full of tensions and fissures about the most important matters, including its conceptions of justice and the purposes of criminal law, its central ideas of blameworthiness as a function of intention or state of mind, and its conception of proportionality. These can be seen as defects to be cured, or as reflections of irremediable tensions deep in our thought about these matters which it is a virtue not a vice of the Code to render explicit. To shift from legislative to judge-made law, I next examine Holmes's famous opinions in Shenck and Abrams, which I read in the light offered by the Model Penal Code, using that text to help define the criminal law issues presented in the two cases. This in turn helps define Holmes's achievement in these cases as a transformation of the criminal law, which leads to his constitutional doctrine. Finally, I analyze Brandeis's opinion in Whitney as an intellectual and rhetorical achievement of a different, and more extraordinary, kind. In all of these, the idea is to demonstrate how it is that legal knowledge is a writer's knowledge: for the drafter of statutes, for the composer of judicial opinions applying statutory and constitutional law alike, and for the lawyer thinking through and arguing a case. Background and Aim Evidence on the efficacy of parenting interventions to support communication development in deaf and hard-of-hearing children is emerging. In previous research, we showed that parental participation in a video feedback–based intervention enhanced parental self-esteem and emotional availability to their deaf and hard-of-hearing children. This paper investigates the impact of the intervention on the development of the children’s prelingual communication skills and autonomy. Evidence on the efficacy of parenting interventions to support communication development is warranted. Methods Sixteen hearing (...) parents with a prelingual deaf and hard-of-hearing child ( M age = 2.05 years, SD = 1.77) were recruited by self-selection from pediatric audiological services and randomly stratified into intervention-first and waiting-list groups. Families completed three sessions of Video Interaction Guidance in their homes. Designed for maximal inclusion, the sample comprised children with complex developmental and social needs. The primary inclusion criterion was the child’s prelingual status ( Results A Mann–Whitney U test indicated no significant difference between the two groups. The groups were collated, and a Wilcoxon signed-rank test with time (pre-/post-intervention) as a repeating variable was run. A significant increase in children’s communicative autonomy ( Z = −3.517, p d = 0.62) and decrease in children’s no-responses ( Z = −3.111, p d = 0.55) were seen. There was no significant difference in the overall number of turn-taking between the parent and child, indicating differences in the quality of the parent–child interactions, not the quantity. Conclusion This study adds to the emerging evidence for parenting interventions with deaf and hard-of-hearing children. We hypothesize that the video feedback intervention with its focus on emotional availability created space for the children to show increased communicative autonomy during parent–child interactions. Communicative autonomy is a long-term predictor of communication and linguistic development in deaf and hard-of-hearing children, and its conceptual underpinning makes it a good early measure of relational agency. Results can inform wider interventions that focus on the quantity of the parent–child communication. (shrink)

I would like to discuss two interconnected projects of reconciliation. The first is the reconciliation of indigenous and non-indigenous people (natives and newcomers) with each other in all our diversity. The second is the reconciliation of indigenous and non-indigenous people (human beings) with the living earth: that is, reconciliation with more-than-human living beings (plants, animals, ecosystems and the living earth as a whole). I will not discuss formal reconciliation procedures carried on by governments, courts and commissions. Rather I focus on (...) more basic, informal and transformative practices of reconciliation and the shared responsibilities we all have to engage in these two projects of reconciliation. In this chapter I explore some of the roles of trust, mistrust, and distrust in deeply plural or diverse societies. Section One sets out the features of deeply diverse societies that provide the contexts of trust and distrust. Section Two proposes that social relationships in diverse societies need to have two qualities to be full of intersubjective trust (trustful) and, thus, worthy of trust (trustworthy) of the members of the relationships: cooperative and contestatory quality, and self-sustaining and co-sustaining quality. Section (...) Three suggests that such trustful relationships are grounded in and draw on a second type of trust: pre-existing co-operational trust. Section Four argues that trustful relationships and co-operational trust are co-sustained by a third type of trust: an interactive ethics or ethos of trust of the members within which they exercise judgements of trust and mistrust. These three types of trust form a triad that sustains virtuous (autopoietic) systems of trust and peacefulness (nonviolence). The two approaches are those of Jonathan Schell and Akeel Bilgrami. The connection between the two approaches is their shared interest in the ‘conditions that sustain life’ on earth. This paper explores some issues about the choice of variables for causal representation and explanation. Depending on which variables a researcher employs, many causal inference procedures and many treatments of causation will reach different conclusions about which causal relationships are present in some system of interest. The assumption of this paper is that some choices of variables are superior to other choices for the purpose of causal analysis. I critically discuss two dogmas of the “dynamical approach” to spacetime in general relativity, as advanced by Harvey Brown [Physical Relativity Oxford:Oxford University Press] and collaborators. The first dogma is that positing a “spacetime geometry” has no implications for the behavior of matter. The second dogma is that postulating the “Strong Equivalence Principle” suffices to ensure that matter is “adapted” to spacetime geometry. I conclude by discussing “spacetime functionalism”. A growing number of researchers in the business ethics field have used scenarios as a data gathering technique in their empirical investigations of ethical issues. This paper offers a review and critique of 26 studies that have utilized scenarios to elicit inferences of ethical reasoning, decision making, and/or intended behavior from managerial or student populations. The use of a theoretical foundation, the development of hypotheses, various characteristics germane to the use of scenarios, population and sampling issues, and the use of (...) statistical measures are explored and assessed. This paper explores how data serve as evidence for phenomena. In contrast to standard philosophical models which invite us to think of evidential relationships as logical relationships, I argue that evidential relationships in the context of data-to-phenomena reasoning are empirical relationships that depend on holding the right sort of pattern of counterfactual dependence between the data and the conclusions investigators reach on the phenomena themselves.

This paper discusses some procedures developed in recent work in machine learning for inferring causal direction from observational data. The role of independence and invariance assumptions is emphasized. Several familiar examples including Hempel’s flagpole problem are explored in the light of these ideas. The framework is then applied to problems having to do with explanatory direction in non-causal explanation.

Truth-talk exhibits certain features that render it philosophically suspect and motivate a deflationary account. I offer a new formulation of deflationism that explains truth-talk in terms of semantic pretense. This amounts to a fictionalist account of truth-talk but avoids an error-theoretic interpretation and its resulting incoherence. The pretense analysis fits especially well with deflationism’s central commitment, and it handles truth-talk’s unusual features effectively. In particular, this approach suggests an interesting strategy for dealing with the Liar paradox. This version of deflationism (...) has advantages over the formulations currently available in the literature, mainly because it offers a more satisfying account of the generalizing role deflationary views take as truth-talk’s central function. Explaining the notion of truth in terms of pretense generates some special concerns, but none we cannot address through careful consideration of how pretense operates in truth-talk and of the attitudes instances of pretending involve. Several essays in this volume exploit the idea that in visual experience, and in other forms of consciousness, something is present to consciousness, or phenomenally present to the experiencing subject. This is a venerable idea. Hume, for example, understood conscious experience in terms of the various items ‘present to the mind’. However, it is not obvious how the idea should be understood and there are grounds for worrying that there is no good way of making it precise. Here I explore (...) a way of making precise the idea that properties of things, such as their shapes and colours, are present to us in visual experience. I argue that this important idea is coherent, well motivated and empirically plausible, provided that we reject two traditional assumptions: that maximally determinate properties, rather than just determinable properties, are visually present; that we can tell through introspection exactly which properties are visually present to us. In recent years, philosophers of science have explored categorical equivalence as a promising criterion for when two theories are equivalent. On the one hand, philosophers have presented several examples of theories whose relationships seem to be clarified using these categorical methods. On the other hand, philosophers and logicians have studied the relationships, particularly in the first order case, between categorical equivalence and other notions of equivalence of theories, including definitional equivalence and generalized definitional equivalence. In this article, I will express (...) some skepticism about categorical equivalence as a criterion of physical equivalence, both on technical grounds and conceptual ones. This paper defends the notion of downward causation. I will seek to elucidate this notion, explain why it is a useful way of thinking, and respond to criticisms attacking its intelligibility. My account of downward causation will be in many respects similar to the account recently advanced by Ellis. The overall framework I will adopt is the interventionist treatment of causation I have defended elsewhere: X causes Y when Y changes under a suitable manipulation of X. When X is at (...) a higher “level” than Y this allows for the possibility of downward causation from X to Y. True claims of downward causation must meet certain additional conditions, some of which have already been discussed by Ellis. These include the condition that X must have a homogenous effect on Y in the sense that the effect of X on Y must be the same regardless of how X is “realized” at lower levels. In addition, the most plausible examples of downward causation will involve causes X, that in a sense that I will try to specify, are capable of being manipulated by macro-level interventions that have a coordinated or organized impact on them, as when one manipulates the temperature of a gas by placing it in a heat bath.Three common criticisms of the notion of downward causation that I will consider are: the claim that this involves a whole acting downward on its parts which is an objectionable idea because wholes and parts are not sufficiently distinct to stand in causal relationships, that downward causation commits us to the existence of causal cycles in which X causes Y which in turn causes X and that the asymmetric nature of the causal relation rules out such cycles, and causal exclusion type worries, according to which all of the causal action occurs among “low level” variables, so that upper level variables are deprived of causal efficacy. In response I will argue that plausible examples of downward causation in the scientific literature do not involve whole to part causation, there is nothing wrong with causal cycles, which are common in, for example, biological contexts, exclusion type worries do not arise within the interventionist framework that I favor. William James's definition of psychology as 'the science of mental life' has been heard so often that we are apt to forget how radically it diverges from the view of psychology which so many of its practitioners hold today.

The Eucharist is at the heart of Christian worship and at the heart of the Eucharist are the curious phrases, 'This is my body' and 'This is my blood'. James M. Arcadi offers a constructive proposal for understanding Christ's presence in the Eucharist that draws on contemporary conceptual resources and is faithful to the history of interpretation. He locates his proposal along a spectrum of Eucharistic theories. Arcadi explores the motif of God's presence related to divine omnipresence and special (...) presence in holy places, which undergirds a biblical-theological proposal concerning Christ's presence. Utilizing recent work in speech-act theory, Arcadi probes the acts of consecration and renaming in their biblical and liturgical contexts. A thorough examination of recent work in Christology leads to an action model of the Incarnation that borrows the notion of enabling externalism from philosophy of mind. These threads undergird a model of Christ's presence in the Eucharist. (shrink)

James O. Young seeks to explain why we value music so highly. He draws on the latest psychological research to argue that music is expressive of emotion by resembling human expressive behaviour. The representation of emotion in music gives it the capacity to provide psychological insight--and it is this which explains a good deal of its value.

In their recent book, Oreskes and Conway ([ 2010 ]) describe the ‘tobacco strategy’, which was used by the tobacco industry to influence policymakers regarding the health risks of tobacco products. The strategy involved two parts, consisting of (i) promoting and sharing independent research supporting the industry’s preferred position and (ii) funding additional research, but selectively publishing the results. We introduce a model of the tobacco strategy, and use it to argue that both prongs of the strategy can be extremely (...) effective—even when policymakers rationally update on all evidence available to them. As we elaborate, this model helps illustrate the conditions under which the tobacco strategy is particularly successful. The introduction and validation of a new instrument, The Moral Reasoning Inventory, designed to measure an individuals' moral reasoning (MR) in response to two moral dilemmas within a business setting is the subject of this article. The instrument consists of two moral dilemma scenarios with eight MR statements. Two measurement scales were used for analyzing patterns of individual responses: the strength of belief in the reasons and the importance of those reasons for resolving the dilemma. Managers enrolled in a part-time (...) MBA program were administered the new instrument. Data analysis clearly supported the effectiveness of the instrument to differentiate patterns of consistency in MR within decision groups. (shrink)

Scott, the compelling tale of Asian peoples who until recently have stemmed the vast tide of state-making to live at arm’s length from any organized state society For two thousand years the disparate groups that now reside in Zomia (a mountainous region the size of Europe that consists of portions of seven Asian countries) have fled the projects of the organized state societies that surround them—slavery, conscription, taxes, corvée labor, epidemics, and (...) warfare. This book, essentially an “anarchist history,” is the first-ever examination of the huge literature on state-making whose author evaluates why people would deliberately and reactively remain stateless. Among the strategies employed by the people of Zomia to remain stateless are physical dispersion in rugged terrain; agricultural practices that enhance mobility; pliable ethnic identities; devotion to prophetic, millenarian leaders; and maintenance of a largely oral culture that allows them to reinvent their histories and genealogies as they move between and around states. In accessible language, James Scott, recognized worldwide as an eminent authority in Southeast Asian, peasant, and agrarian studies, tells the story of the peoples of Zomia and their unlikely odyssey in search of self-determination. He redefines our views on Asian politics, history, demographics, and even our fundamental ideas about what constitutes civilization, and challenges us with a radically different approach to history that presents events from the perspective of stateless peoples and redefines state-making as a form of “internal colonialism.” This new perspective requires a radical reevaluation of the civilizational narratives of the lowland states. Scott’s work on Zomia represents a new way to think of area studies that will be applicable to other runaway, fugitive, and marooned communities, be they Gypsies, Cossacks, tribes fleeing slave raiders, Marsh Arabs, or San-Bushmen. It may seem odd to review a New York social club's yearbook, with its list of members’ addresses and series of committee reports. But such books sometimes contain material of more general interest. The latest one from the Century Association, for example, devotes 250 of its 685 pages to “Century Memorials”—that is, biographical sketches of recently deceased members, written by other members. Among the well-known figures taken up in these eighty-three sketches are the artists Richard Anuszkiewicz and Robert Motherwell; the (...) architects Henry N. Cobb and Charles A. Platt; the newspaper editors Harold Evans and Whitelaw Reid; the historians Henry F. Graff and William McFeely; the translator and literary scholar Donald Keene; the collector of literary and musical manuscripts Frederick Koch; the popular writer on Russian history Robert K. Massie; the clergyman James Parks Morton; the financier Felix G. Rohatyn; the lawyers Whitney North Seymour Jr. and Isaac N. Phelps Stokes; the literary editor Elisabeth Sifton; the university president Michael Sovern; the museum director Evan H. Turner; and the broadcast journalist Sander Vanocur. The sketches are generally well written and often richly evocative: the writers include Louis Begley, Kenneth T. Jackson, D. T. Max, and Honor Moore.The long shelf of Century volumes like this one clearly constitutes a valuable contribution to prosopographical literature. And the Century is not the only institution with such a tradition (other examples are the British Academy and the American Philosophical Society); but their publications are a frequently overlooked source, one not always available in research libraries. Unfortunately, it is also a source that seems to be diminishing: the American Antiquarian Society and the John Simon Guggenheim Memorial Foundation are examples of organizations, each with a history of providing biographical information, that are no longer doing so. Of course, the great previous runs of the former's Proceedings and the latter's Reports remain (one hopes) on the shelves for those who know to look for them. A step in the opposite direction has recently been taken by the Grolier Club, which has not had such a tradition (except for two biographical volumes in 1959 and 2000): its Gazette now includes a section of memorials in each issue. This is a welcome move, but one has to regret that so little scholarly use is made of this whole body of biographical detail and reminiscence. (shrink)

Arthur C. Danto's essays not only critique bodies of work but reflect upon art's conceptual evolution as well, drawing for the reader a kind of "philosophical map" indicating how art and the criteria for judging it has changed over the twentieth century. In _Unnatural Wonders_ the renowned critic finds himself at a point when contemporary art has become wholly pluralistic, even chaotic-with one medium as good as another-and when the moment for the "next thing" has already passed. So the theorist (...) goes in search of contemporary art's most exhilarating achievements, work that bridges the gap between art and life, which, he argues, is now the definitive art of our time. Danto considers the work of such young artists as John Currin and Renee Cox and older living masters including Gerhard Richter and Sol LeWitt. He discusses artists of the New York School, like Philip Guston and Joan Mitchell, and international talents, such as the South African William Kentridge. Danto conducts a frank analysis of Matthew Barney's _The Cremaster Cycle_, Damien Hirst's skeletons and anatomical models, and Barbara Kruger's tchotchke-ready slogans; finds the ghost of Henry James in the work of Barnett Newman; and muses on recent Whitney Biennials and art influenced by 9/11. He argues that aesthetic considerations no longer play a central role in the experience and critique of art. Instead art addresses us in our humanity, as men and women who seek meaning in the "unnatural wonders" of art, a meaning that philosophy and religion are unable to provide. (shrink)

Many philosophers have claimed that reading literary fiction makes people more virtuous. This essay begins by defending the view that this claim is empirical. It goes on to review the empirical literature and finds that this literature supports the claim philosophers have made. Three mechanisms are identified whereby reading literary fiction makes people more virtuous: empathy is increased when readers enter imaginatively into the lives of fictional characters; reading literary fiction promotes self-reflection; and readers mimic the prosocial behaviour of fictional (...) characters. The paper concludes with a caution: there is a danger that readers could mimic antisocial behaviour displayed in literary fiction. If they do, reading some literary fiction could make readers less virtuous. (shrink)

The dimension of spatial representations can be assessed by above-chance performance in novel shortcut or spatial reasoning tasks independent of accuracy levels, systematic biases, mosaic/segmentation across space, separate coding of individual dimensions, and reference frames. Based on this criterion, humans and some other animals exhibited sufficient evidence for the existence of three-dimensional and/or four-dimensional spatial representations.

This work aligns James Buchanan’s theory of social contract with the structure of Michael Moehler’s multilevel social contract. Most importantly, this work develops Buchanan’s notions of moral community and moral order. It identifies moral community as the vehicle of escape from moral anarchy, where community is established upon a system of rules akin to James Buchanan’s first-stage social contract. Moral order establishes the baseline treatment of non-members by members of a moral community and also provides a minimum standard (...) for resolving disputes that are not resolved by the more robust social contract shared among community members. This work links the multilevel contract to polycentric social order, noting that polycentric systems may promote development of the moral order by enabling experimentation with and emulation of rules and rule systems made available by overlapping and adjacent institutions.
