The possible relationship between widespread unauthorized copying of microcomputer software (also known as software piracy) and level of moral judgment is examined through analysis of over 350 survey questionnaires that included the Defining Issues Test as a measure of moral development. It is hypothesized that the higher one''s level of moral judgment, the less likely that one will approve of or engage in unauthorized copying. Analysis of the data indicate a high level of tolerance toward unauthorized copying and limited support (...) for the hypothesis. The most plausible explanation for these findings is that software copying is perceived as an issue of low moral intensity. This study calls into question the software industry''s strategy of concentrating exclusively on institutional compliance with copyright rules, rather than working to raise the perceived moral intensity about software piracy at the individual level. As long as the issue remains low in moral intensity, the industry cannot expect significant shifts in copying behaviors. Individuals must become more aware of and concerned about the nature and magnitude of harm to society and to the rightful copyright owners from unauthorized copying before their attitudes and behaviors come to reflect higher levels of moral judgment. This article focuses on the question of whether Social Issues in Management (SIM) is a “field” and, if so, what kind, emphasizing specifically the recent literature on corporate social responsibility and performance (CSR/csp). Fields are defined in part by coherent bodies of knowledge that serve as guideposts for current research, and so the authors construct a simple model of CSR/csp scholarship, illustrating the relevant categories with representative publications. The authors conclude that SIM is a “low-paradigm” field but is not recognized (...) or accepted as a field by many scholars who write about CSR/csp from “outside” the field. This analysis points to the need for SIM scholars to continue to integrate useful ideas from other fields, and also to critique the work of scholars who address “failings” or “gaps” in SIM research without appropriately dealing with the existing SIM literature. The article concludes with some ideas for sustaining the institutional legitimacy of SIM and for challenging those who would “reinvent” a field with a long and fruitful history, including paying careful attention to journal review processes and the content of publications in prominent journals. The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a “David vs. Goliath” showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs – in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use (...) of the capitalized word “Dialogue” is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or two-way communication exchanged between a corporation and its stakeholders. The phenomenon of Dialogue between a corporation and dissident shareholders has not been analyzed in the academic literature or in the popular press because it occurs behind the scenes and out of sight from media scrutiny. Yet this is where a great deal of social change initiated by shareholder activists is negotiated. This article contributes both theoretically and empirically to the study of Dialogues between shareholder activists and corporations. We explain how Dialogues occur in the context of the shareholder resolution process and examine two Dialogues that focus on international labor issues in two industries. Then data on Dialogues during the period, 1999–2005, from the Interfaith Center on Corporate Responsibility are analyzed. This research contributes to knowledge about the Dialogue process and the emerging literature on corporation–stakeholder engagement. (shrink)

This article argues for the recovery and re-incorporation of lost voices and debates into the history of political thought by focusing on the issue of sovereignty. It begins by examining why such a narrow understanding of the canon has come to dominate the sub-discipline and argues for critical approaches that treat the past as a “contested terrain” rather than an unfolding plot. It then turns to early twentieth-century Britain as an example of an era when thinkers who have been largely (...) forgotten by today’s political theorists argued loudly about the future of state sovereignty. It next focuses on a 1916 exchange of essays entitled “The Nature of the State in View of Its External Relations” by Delisle Burns, Bertrand Russell, and G.D.H. Cole, as an example of some of the most innovative and radical ideas to emerge from the period. The article concludes by arguing that re-engaging the work of these forgotten thinkers can broaden our conceptual horizons about sovereignty, speak to some of the most urgent issues of our time, and force open the concept of “the political” to radical reinterpretation. This workshop introduced the concept of global business citizenship and explored several ways to use the model, its underlying theory, and cases representing it in classroom teaching. Links to peace studies, organizational change exercises, accountability resources, and the use of United Nations Global Compact case studies all received attention.

Although their methodologies, areas of focus, and conclusions may diverge greatly, all philosophers in some form or another pose questions about universal truths. These individuals have elevated discourse and changed the way we interpret the world around us. Profiles of 101 of the most noteworthy individuals in the field introduce readers to the various philosophical schools of thought, as well as the ongoing questions and debates that have occupied philosophers and non-philosophers alike for centuries.

Since the 2000s, European open data policies have given a strong boost to commercial meteorology by giving free access to weather observations and models produced by public organizations. This article examines the efforts and challenges met by a French company that developed an offer of weather services based on the commodification of both open weather data and local observations produced by low-cost stations used by farmers. However, the paper shows that such commercialization of stations’ data is hampered both by their (...) material friction with the weather infrastructure and by an economic friction related to data’s heterogeneous valuations. As solving the economic friction generated by data’s valuation is the priority of commercial meteorologists, they finally differentiate their offer using simulated weather data produced by computing models. Finally, the paper claims that the commercial process inherent to the use of this other type of data subordinates weather science to a logic of services: when designing a service for agriculture, the company considered that simulated data were more suited to digital farm advising services. In the end, it is the capacity of weather data to be integrated into private services and tools that valuate them as suited to guide farming practices. (shrink)

This paper focuses on the differing ways in which organizations send conflicting signals, in the form of contending organizational values, to their managers regarding the appropriate behavior in a given situation, and the impact that this has on the manager's decision-making process. It posits the existence of three different types of organizational value contention and examines their influence on the resulting patterns of sense-making and behavior evident in the manager's responses, based upon interview data from a cross-section of managers in (...) two organizations. In an earlier paper I argued that there are cases in which an infinite probabilistic chain can be completed. According to Jeremy Gwiazda, however, I have merely shown that the chain in question can be computed, not that it can be completed. Gwiazda thereby discriminates between two terms that I used as synonyms. In the present paper I discuss to what extent computability and completability can be meaningfully distinguished.

This article describes the theory and process of global business citizenship (GBC) and applies it in an analysis of characteristics of company codes of business conduct. GBC is distinguished from a commonly used term, “corporate citizenship,” which often denotes corporate community involvement and philanthropy. The GBC process requires (1) a set of fundamental values embedded in the corporate code of conduct and in corporate policies that reflect universal ethical standards; (2) implementation throughout the organization with thoughtful awareness of where the (...) code and policies fit well and where they might not fit with stakeholder expectations; (3) analysis and experimentation to deal with problem cases; and (4) systematic learning processes to communicate the results of implementation and experiments internally and externally. We then identify and illustrate the three attributes of a code of conduct that would reflect a GBC approach. The three attributes are orientation, implementation, and accountability. Thus, it seems a propitious time to reflect on a decade of writing in feminist morality that has focussed on the concept of an ethic of care, and examine its relevance for today's business context. In Ethics of Luxury renowned Canadian thinker and artist Jeanne Randolph gives us a magnum opus focusing on one of the most pressing issues facing us today – how we act morally and ethically while participating in a culture of abundance, opulence and consumerism. Randolph argues that when we use our imagination, as we do when we create, appreciate and live with art, we are acting ethically, expressing our sense of morality in a practical, material way.

This paper argues that the personal interview method is particularly appropriate for the kind of exploratory and complicated theory-building research that ethical decision-making, as a topic, represents at present. In doing so, it examines the key tasks of the ethics researcher, the suitability of interviews for obtaining the kind of data needed to accomplish these tasks, and the ensuing problems faced by the interview methodologist. It concludes with suggestions for enhancing the validity and reliability of interview-based ethics research.

In United States ex rel. Quirk v. Madonna Towers, Inc., the U.S. Court of Appeals for the Eighth Circuit held that the failure of a skilled nursing facility's executives to seek a legal opinion regarding a billing practice they considered valid did not meet the definition of knowingly presenting a false claim for payment to the federal government under the False Claims Act. Ideological eschatology expects «an end of history» located in (...) future time, to be reached under the scientific guidance of political ingenieurs. For religious eschatology, the end of history is transcendent, «beyond time», in eternity. Christians and marxists in search for understanding and common action are usually confusing the future with eternity, immanence with transcendence.Even in a fight to death, transcendence allows a beyond, a dimension of possible brotherhood or communion. This article examines the relationship between the pro-imperial Round Table Society's political vision and the omnipresent historical narrative of commonwealth that characterized the group's major publications during the First World War. It pays particular attention to the way the primary author of these publications, Lionel Curtis, interpolated Alfred Zimmern's 1911 book, The Greek Commonwealth, into this historical narrative in an attempt to reconcile the contradictions inherent in the Round Table's political project. These contradictions centred on the group's desire to democratize (...) imperial politics while excluding non-European subjects from this democracy and their belief in an imperial state that demanded the ultimate loyalty of its citizens but was not 'Prussianist'. Examining the way Curtis used the Athenian polis to address this fraught political puzzle offers us insight into both the ideological power wielded by the Round Table during this transitional era and the power of historical narrative in imperial justification more generally. This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. This article begins with an explanation of how moral development for organizations has parallels to Kohlberg's categorization of the levels of individual moral development. Then the levels of organizational moral development are integrated into the literature on corporate social performance by relating them to different stakeholder orientations. Finally, the authors propose a model of organizational moral development that emphasizes the role of top management in creating organizational processes that shape the organizational and institutional components of corporate social performance. This article (...) represents one approach to linking the distinct streams of business ethics and business-and-society research into a more complete understanding of how managers and firms address complex ethical and social issues. In this commentary on Jun Otsuka’s first-rate book, we focus on the difference between justification and update.

Archaeologists have long disagreed about when and how humans first migrated into the Americas; a point particularly in contention is whether there is any convincing evidence of human occupation earlier than about 12,000 years ago. This article ex amines some recent publications on the controversy, selected especially from review articles and from a recent series, written by professional archaeologists, that appeared in a popular magazine, Natural History. The sample texts are analyzed from a rhetorical perspective with emphasis on textual features (...) such as word choice, hedging, arrange ment, self-reference, argumentative topic, and figure. Such features are taken to be signs of the writer's accommodation to audience and situation as determined in part by the place of publication. The analysis reveals some of the rich variety of persuasive techniques employed in popular and review publications by scientists who find themselves in a disciplinary stalemate, for example, the attempt of each side to depict itself as in the minority. The well-crafied popular pieces also use explicit appeals left only im plicit in the review articles; for example, the popular pieces describe the writer's status based on years of experience and support conclusions by narrating the long process of inquiry followed before a verdict was reached. By exploring various cultural implications of the dildo in relation to representations of lesbian sexuality, this article seeks to examine the influences of psychoanalysis on our cultural understanding of ‘dildonics’. This examination, moreover, seeks to reread the dildo through the lens of an alternative interpretive model that relies on Donna Haraway's ‘Informatics of Domination’, or ‘the translation of the world into a problem of coding’. By shifting our attention to information theory, which emphasizes pattern and randomness over absence and presence, (...) this article shows how the dildo operates as a technological extension which mutates its lesbian user and rearticulates dildonics in post-gender terms. Such a transformation is capable of disrupting any sense that the dildo operates as a simulacral penis or as indicative of a lesbian's repressed desire for a male lover. (shrink)

Since 1973 the experts of O.C.D.E. have been presenting the development of systems born of computer science and telecommunication as a “ second industrial revolution.” A year earlier the Japan Computer Usage Development Institute announced for the year 2000 the advent of a “society of information.”.

Since his death in the 1950s, most of the narratives of Harold Laski’s anti-imperialism have been mostly biographical rather than scholarly. Chroniclers and historians alike often found his genius and contribution amongst his protégés such as Krishna Menon, H.O. Davies, and other post-colonial leaders. In addition, explorations of his political theories paid little attention to his contributions to critiques on imperialism; in fact, his critics often interpreted Laski’s stand on imperialism as unoriginal. This chapter analyses two of Laski’s works on (...) imperialism: a 1932 chapter entitled ‘Nationalism and the Future of Civilisation’ and a 1933 chapter called ‘The Economic Foundations of Peace’. The first section of the chapter analyses his theory of sovereignty and his critique of the ideological ‘habits’ that condition liberal society. The second section contends that Laski’s theory of sovereignty resulted in his framing of imperialism within Leninist terms as a dialectical relationship between the habits of sovereignty and the habits of imperialism. The chapter suggests that Laski’s thinking on imperialism resembles less a truncated Leninism than it does a critical analysis of the way ideology can obscure domination and disciple subjects. It also reveals Laski’s contradictions due to his political activism and commitment to democracy. (shrink)

:Use of the best-interests test as the legal standard to justify medical treatment in respect to legally incompetent adults or minors has come under sustained critique over the years. “Best interests” has variously been alleged to be indeterminate as well as susceptible to majoritarian ideology and inherent bias. It has also been alleged to be inferior to rights-based approaches. Against the background of several particularly hard cases involving minors discussed by Gillett in a prior article in this journal, this article (...) considers some of these critiques. It concludes that these critical accounts make significant contributions to enabling a more procedurally and substantively robust consideration of what might be in a child’s best interests. However, it is argued that none of these accounts alone provide a superior framework that would justify jettisoning the concept of best interests. Further, it is suggested that best interests still has an important role in achieving patient-centered decisionmaking in this context. It concludes by suggesting a taxonomy of considerations when determining best interests. (shrink)

A common objection to coherentism is that it cannot account for truth: it gives us no reason to prefer a true theory over a false one, if both theories are equally coherent. By extending Susan Haack's crossword metaphor, the authors argue that there could be circumstances under which this objection is untenable. Although these circumstances are remote, they are in full accordance with the most ambitious modern theories in physics. Coherence may perhaps be truth conducive.

A characteristic of contemporary analytic philosophy is its ample use of thought experiments. We formulate two features that can lead one to suspect that a given thought experiment is a poor one. Although these features are especially in evidence within the philosophy of mind, they can, surprisingly enough, also be discerned in some celebrated scientific thought experiments. Yet in the latter case the consequences appear to be less disastrous. We conclude that the use of thought experiments is more successful in (...) science than in philosophy. (shrink)
