The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a "David vs. Goliath" showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs-in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use of the (...) capitalized word "Dialogue" is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or twoway communication exchanged between a corporation and its stakeholders. The phenomenon of Dialogue between a corporation and dissident shareholders has not been analyzed in the academic literature or in the popular press because it occurs behind the scenes and out of sight from media scrutiny. Yet this is where a great deal of social change initiated by shareholder activists is negotiated. This paper begins to examine the question of where societal expectations about the nature of corporate social responsibility come from. In particular, we begin to consider arguments about how a country’s stage of economic development affects the kinds of social responsibility expectations that firms face and then how the nature of a country’s civil society might affect CSR expectations. The factors that should be taken into account for future empirical research are also considered.

This workshop was organized to explain the GLOBE database to IABS members and elicit interest in embarking upon a major study of national similarities anddifferences in corporate responsibility practices.

This empirical study examines corporate responses to activist shareholder groups filing social-policy shareholder resolutions. Using resource dependency theory as our conceptual framing, we identify some of the drivers of corporate responses to shareholder activists. This study departs from previous studies by including a fourth possible corporate response, engaging in dialogue. Dialogue, an alternative to shareholder resolutions filed by activists, is a process in which corporations and activist shareholder groups mutually agree to engage in ongoing negotiations to deal with social issues. Based on a unique dataset of resolutions filed by member organizations of the Interfaith Center on Corporate Responsibility from 2002 to 2005 and the outcomes of these resolutions, our analysis finds that corporate managers are more likely to engage in dialogue with shareholder activists when the firm is larger, is more responsive to stakeholders, the CEO is the board chair, and the firm has a relatively lower percentage of institutional investors. While the literature on corporate social responsibility suggests that its form and content differ at least somewhat from country to country, it has not begun to address whether CSR practices converge or diverge over time as countries benefit from higher levels of economic development, or whether these practices relate to specific cultural values and institutional structures. This paper proposes an initial conceptual model and propositions to begin to assess whether and how the different levels of economic development, cultural values, and (...) institutional structures influence CSR behaviors. Mediating variables related to industry sector and executive moral development are also included in the model. The paper begins to lay the groundwork for empirical country and regional studies that cancontribute to a greater understanding of the factors that influence CSR behaviors. (shrink)

The most important contemporary development in rhetoric for the theory of argumentation is Jeanne Fahnestock's program of figural logic, the ruling insight of which is that figures epitomize arguments. Working primarily with the antimetabolic formula at the heart of Gregor Mendel's paper “Experiments in Plant Hybridization,” I investigate the figural bases of the logic anchoring this foundational essay in genetics. In addition to antimetabole, the formula also depends crucially on ploche, polyptoton, onomatopoeia, antithesis, synecdoche, reification, and metaphor.

This paper offers an account of data manipulation in scientific experiments. It will be shown that in many cases raw, unprocessed data is not produced, but rather a form of processed data that will be referred to as a data model. The language of data models will be used to provide a framework within which to understand a recent debate about the status of data and data manipulation. It will be seen that a description in terms of data models allows (...) one to understand cases in which data acquisition and data manipulation cannot be separated into two independent activities. Some philosophers regard it as a serious possibility that we now exist within a simulation. That this hypothesis is somewhat probable has been defended extensively by Nick Bostrom. Notably, Bostrom does not defend the conclusion that we inhabit a simulation, but rather the disjunctive conclusion that the human species is very likely to die out before reaching a ‘posthuman stage’, that posthuman civilizations are extremely unlikely to run significant numbers of simulations, or that we almost certainly inhabit a simulation. Bostrom (...) argues that there is no basis for strongly favouring one of these alternatives over its counterparts. The upshot is that it is fairly probable that we inhabit a simulation. I argue that posthuman civilizations are likely to be unwilling to run significant numbers of simulations, thereby undermining the case for assigning a somewhat high probability to the hypothesis that we live in a simulation. It may be hard to imagine how bullshit, or being strategically indifferent to the veracity of one’s assertions, might ever be morally permissible. Yet to categorically denounce it is to find oneself burdened with defending the impossibility of justifiable bullshit, the indefeasibility of truthfulness and the inculpability of inveterate bullshitters. A much more tenable position is to expand one’s notion of bullshit to include unintentional indifference to veracity while also characterizing bullshit (whether strategic or unintentional) as wrong only when it (...) constitutes negligence. Once bullshit is redefined in this fashion it becomes apparent that its preponderance in contemporary society is the work not of those who bullshit intentionally, but of those who uncritically consume and transmit the bullshit of others. Any attempt to disrupt the spread of negligent bullshit thus does well to consider our epistemic obligations not only as perceived experts, but as listeners. It is in this respect that the early Indian Buddhist critique of testimony proves quite helpful in reducing gullibility and, thereby, the likelihood of unintentional, yet negligent, bullshit. This thesis is about making decisions when we are uncertain about what will happen, how valuable it will be, and even how to make decisions. Even the most sure-footed amongst us are sometimes uncertain about all three, but surprisingly little attention has been given to the latter two. The three essays that constitute my thesis hope to do a small part in rectifying this problem. The first essay is about the value of finding out how to make decisions. Society spends (...) considerable resources funding people (like me) to research decision-making, so it is natural to wonder whether society is getting a good deal. This question is so shockingly underresearched that bedrock facts are readily discoverable, such as when this kind of information is valuable. My second essay concerns whether we can compare value when we are uncertain about value. Many people are in fact uncertain about value, and how we deal with this uncertainty hinges on these comparisons. I argue that value comparisons are only sometimes possible; I call this weak comparability. This essay is largely a synthesis of the literature, but I also present an argument which begins with a peculiar view of the self: it is as if each of us is a crowd of different people separated by time (but connected by continuity of experience). I’m not the first to endorse this peculiar view of the self, but I am the first to show how it supports the benign view that value is sometimes comparable. We may be uncertain of any decision rules, even those that would tell us how to act when we face uncertainty in decision rules. We may be uncertain of how to decide how to decide how to... And so on. If so, we might have to accept infinitely many decision rules just to make any mundane decision, such as whether to pick up a five-cent piece from the gutter. My third essay addresses this problem of regress. I think all of our decisions are forced: we must decide now or continue to deliberate. Surprisingly, this allows us to avoid the original problem. I call this solution “when forced, do your best”. (shrink)

The chapter will argue that the way current enthusiasm for moral enhancement is articulated in the extant literature is itself morally problematic. The moral evaluation of the discourse will proceed through three stages. First, we shall look at the chequered history of various societies’ attempts to cast evil, character, and generally undesirable behaviour, as biological problems. As will be argued, this is the larger context in which moral enhancement discourse should be understood, and abuses in the recent past and present (...) should therefore be highlighted. Second, it will be argued that, given moral functioning's profoundly contextual and responsive qualities, any notion of a fine-grained, powerfully efficacious moral enhancement is both unrealistic and, actually, incoherent. Since enthusiasts’ hopes are unrealistic and incoherent, such enhancement would not even be capable of providing the transformative ends that supposedly justify the sometimes extreme prescriptions set forward. Finally, the chapter concludes with the claim that moral enhancement enthusiasm actually serves to trivialise the evils of this world, and not only to trivialise the hard-won efforts required to diminish and overcome such evils, but to misdirect attention away from the real hard work that needs to be done in facing such evils. Selective serotonin reuptake inhibitors (SSRIs) have gained a degree of prominence across recent moral enhancement literature as a possible intervention for dealing with antisocial and aggressive impulses. This is due to serotonin's purported capacity to modulate persons’ averseness to harm. The aim of this article is to argue that the use of SSRIs is not something worth getting particularly excited about as a practicable intervention for moral enhancement purposes, and that the generally uncritical enthusiasm over serotonin's potential as a moral (...) enhancer is a consequence of the paucity of viable options for envisaging practicable moral enhancement interventions. While there are many conceptual issues raised by the idea of moral enhancement generally, and by the idea of serotonin as a morally affective agent, the aim here is to look at practical concerns. It is argued that SSRIs do not, nor cannot in the reasonably foreseeable future, be made to work as a reliably safe or reliably effective means for moral enhancement, even within the very limited remit of treating “reactive” aggression. SSRIs might be effective as a limited and partial mental health intervention (even this is questionable), but not as a generally effective moral enhancement technology. (shrink)

An essay on ‘cultural dispossession’ that examines the consequences of a society that is ignorant of its tradition and some proposed remedies.

Physician-written “do not resuscitate” DNR orders elicit negative reactions from stakeholders that may decrease appropriate end-of-life care. The semantic significance of the phrase has led to a proposed replacement of DNR with “allow natural death” . Prior to this investigation, no scientific papers address the impact of such a change. Our results support this proposition due to increased likelihood of endorsement with the term AND.

ABSTRACTThis article meditates on the Christian command to love the neighbor as yourself by focusing on how both Jacques Derrida and Søren Kierkegaard have read this command. I argue that Derrida, failing in his faithfulness to Kierkegaard, makes a mistake when he includes this command in the Greek model of the politics of friendship in his Politics of Friendship. Such a mistake is illumined by Kierkegaard’s understanding of the neighbor in this command from Works of Love because this understanding helps (...) to develop Derrida’s vision of a democracy and politics that resists the hegemony of the masculine and remains open to the event of a non-hierarchical relation to the other. An examination of the myriad causes of failure in Higher Education in the US, and a proposal for a "Humanics Method" for non-Science disciplines.

Behrendt & Young (B&Y) suggest that hallucinations occur as a result of decoupling of neuronal populations from sensory control. I propose that such a decoupling is in fact a constant feature of brain activity, even under nonpathological conditions. This position is justified by evidence from recent neurophysiological recording studies. I suggest that hallucinations arise because of a breakdown in segregation of internally and externally generated activity in a neuronal population.

This paper begins by attempting to define midrash as a distinct genre of classical rabbinic literature in order to understand the significance of the term in contemporary discourse. It will then examine what Jewish feminists mean when they apply the term, midrash, to their work and consider the extent to which such appropriation is useful or reasonable. The paper will then outline, with my own suggestions, how midrash might be usefully appropriated for feminist ends and the paper will conclude with (...) a concrete example. (shrink)

We introduce a St. Petersburg-like game, which we call the ‘Pasadena game’, in which we toss a coin until it lands heads for the first time. Your pay-offs grow without bound, and alternate in sign (rewards alternate with penalties). The expectation of the game is a conditionally convergent series. As such, its terms can be rearranged to yield any sum whatsoever, including positive infinity and negative infinity. Thus, we can apparently make the game seem as desirable or undesirable as we (...) want, simply by reordering the pay-off table, yet the game remains unchanged throughout. Formally speaking, the expectation does not exist; but we contend that this presents a serious problem for decision theory, since it goes silent when we want it to speak. We argue that the Pasadena game is more paradoxical than the St. Petersburg game in several respects. We give a brief review of the relevant mathematics of infinite series. We then consider and rebut a number of replies to our paradox: that there is a privileged ordering to the expectation series; that decision theory should be restricted to finite state spaces; and that it should be restricted to bounded utility functions.
