The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a "David vs. Goliath" showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs-in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use of the (...) capitalized word "Dialogue" is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or twoway communication exchanged between a corporation and its stakeholders. This paper begins to examine the question of where societal expectations about the nature of corporate social responsibility come from. In particular, we begin to consider arguments about how a country’s stage of economic development affects the kinds of social responsibility expectations that firms face and then how the nature of a country’s civil society might affect CSR expectations. The factors that should be taken into account for future empirical research are also considered.

This workshop was organized to explain the GLOBE database to IABS members and elicit interest in embarking upon a major study of national similarities anddifferences in corporate responsibility practices.

This empirical study examines corporate responses to activist shareholder groups filing social-policy shareholder resolutions. Using resource dependency theory as our conceptual framing, we identify some of the drivers of corporate responses to shareholder activists. This study departs from previous studies by including a fourth possible corporate response, engaging in dialogue. Dialogue, an alternative to shareholder resolutions filed by activists, is a process in which corporations and activist shareholder groups mutually agree to engage in ongoing negotiations to deal with social issues. Based on a unique dataset of resolutions filed by member organizations of the Interfaith Center on Corporate Responsibility from 2002 to 2005 and the outcomes of these resolutions, our analysis finds that corporate managers are more likely to engage in dialogue with shareholder activists when the firm is larger, is more responsive to stakeholders, the CEO is the board chair, and the firm has a relatively lower percentage of institutional investors. While the literature on corporate social responsibility suggests that its form and content differ at least somewhat from country to country, it has not begun to address whether CSR practices converge or diverge over time as countries benefit from higher levels of economic development, or whether these practices relate to specific cultural values and institutional structures. This paper proposes an initial conceptual model and propositions to begin to assess whether and how the different levels of economic development, cultural values, and (...) institutional structures influence CSR behaviors. Mediating variables related to industry sector and executive moral development are also included in the model. The paper begins to lay the groundwork for empirical country and regional studies that cancontribute to a greater understanding of the factors that influence CSR behaviors. (shrink)

The most important contemporary development in rhetoric for the theory of argumentation is Jeanne Fahnestock's program of figural logic, the ruling insight of which is that figures epitomize arguments. Working primarily with the antimetabolic formula at the heart of Gregor Mendel's paper “Experiments in Plant Hybridization,” I investigate the figural bases of the logic anchoring this foundational essay in genetics. In addition to antimetabole, the formula also depends crucially on ploche, polyptoton, onomatopoeia, antithesis, synecdoche, reification, and metaphor.

This article presents the results of a study that analysed whether social responsibility had any bearing on the decision making of institutional investors. Being that institutional investors prefer socially aligned organizations, this study explored to what extent the corporate actions and/or social/environmental investments influenced their decisions. Our results suggest that there are specific variables that affect the perceived value of the organization, leading to decisions to not only invest, but whether to hold or sell the shares, and therefore having a (...) consequential impact on the capital market’s valuation. Sustainable development is often framed as a social issue to which corporations should pay attention because it offers both opportunities and challenges. Through the use of institutional theory and the resource-based view of the firm, we shed some light on why, more than 20 years after sustainable development was first introduced, we see neither the adoption of this business model as dominant nor its converse, that is the total abandonment of the model as unworkable and unprofitable. We focus on multinational (...) corporations (MNCs) because they were among the organizations first called to take action. In order to illustrate the institutional pressures MNCs face and their strategic response to these pressures, we analysed four major oil and gas multinationals subject to similar sustainable development pressures – climate change, biodiversity, renewable energy development and social investment. We argue that normative and coercive isomorphism does not occur at the global level because sustainable development is largely a stakeholder-driven rather than a broad social pressure. That is, host country interpretation of sustainable development pressures varies across an MNC’s subsidiary network. Based on the analysis of the four major MNCs’ annual reports from 2000 to 2005, we argue that mimetic isomorphism may occur, but since it implies the use of complex and intangible resources, mimetic processes are slow, rare and discretionary. Resource extraction companies worldwide are involved with Indigenous peoples. Historically these interactions have been antagonistic, yet there is a growing public expectation for improved ethical performance of resource industries to engage with Indigenous peoples. (Crawley and Sinclair, Journal of Business Ethics 45, 361–373 (2003)) proposed an ethical model for human resource practices with Indigenous peoples in Australian mining companies. This paper expands on this work by re-framing the discussion within the context of sustainable development, extending it to Canada, and generalizing (...) to other resource industries. We argue that it is unethical to sacrifice the viability of Indigenous cultures for industrial resource extraction; it is ethical to engage with indigenous peoples in a manner consistent with their wishes and needs as they perceive them. We apply these ideas to a case study in the coastal temperate rainforest of Clayoquot Sound, British Columbia, Canada. In this case a scientific panel comprised of Nuu-Chah-Nulth elders, forest scientists and management professionals, achieved full consensus on developing sustainable forest practice standards by drawing equally on Indigenous traditional ecological knowledge and Western science in the context of one of the most heated and protracted environmental conflicts in Canadian history. The resulting sustainable forest practice standards were later adopted by leading forestry firms operating on the coast. Our analysis of this scientific panels success provides the basis for advancing an ethical approach to sustainable development with Indigenous peoples. This ethical approach is applicable to companies working in natural resource industries where the territories of Indigenous peoples are involved. (shrink)

When assembling a collaborative initiative, how do you select the appropriate stakeholders to promote collaborative success? We examine the limitations of thestakeholder theory approach to resolving this issue. Instead, we argue that the domain-based perspective and the notion of requisite variety both offer worthwhile perspectives on the issue of participant selection. Combining these perspectives, we pave the way for a theory of participant selection that focuses on evaluating collaborative resources and capabilities at the individual, organizational and domain levels.

In this article, we model FPTP systems as social preference rules and give two characterizations. We show that a social preference rule is an FPTP system if, and only if, it satisfies the axioms of subset consistency, district consistency, subset cancellation, and district cancellation. The second characterization consists of the axioms of subset consistency, subset anonymity, neutrality, topsonlyness, Pareto optimality, district consistency and district cancellation. The characterizations give us an opportunity to compare the characteristic properties of FPTP systems to the (...) characteristic properties that we found for list systems of proportional representation (list PR systems) in Hout et al. (Social Choice and Welfare, 27:459–475, 2006), where we modelled those systems also as social preference rules. We find that consistency and anonymity distinguish list PR systems from FPTP systems. On the other hand, it is district cancellation that distinguishes FPTP systems from list PR systems. (shrink)

We introduce an implication-with-possible-exceptions and define validity of rules-with-possible-exceptions by means of the topological notion of a full subset. Our implication-with-possible-exceptions characterises the preferential consequence relation as axiomatized by Kraus, Lehmann and Magidor [Kraus, Lehmann, and Magidor, 1990]. The resulting inference relation is non-monotonic. On the other hand, modus ponens and the rule of monotony, as well as all other laws of classical propositional logic, are valid-up-to-possible exceptions. As a consequence, the rules of classical propositional logic do not determine the (...) meaning of deducibility and inference as implication-without-exceptions. (shrink)

In birds and frogs, species pairs retain the capacity to produce viable hybrids for tens of millions of years, an order of magnitude longer than mammals. What accounts for these differences in relative rates of pre- and postzygotic isolation? We propose that reproductive mode is a critically important but previously overlooked factor in the speciation process. Viviparity creates a post-fertilization arena for genomic conflicts absent in egg-laying species. With viviparity, conflict can arise between: mothers and embryos; sibling embryos in the (...) womb, and maternal and paternal genomes within individual embryos. Such intra- and intergenomic conflicts result in perpetual antagonistic coevolution, thereby accelerating interpopulation postzygotic isolation. In addition, by generating intrapopulation genetic incompatibility, viviparity-driven conflict favors polyandry and limits the potential for precopulatory divergence. Mammalian diversification is characterized by rapid evolution of incompatible feto-maternal interactions, asymmetrical postzygotic isolation, disproportionate effects of genomically-imprinted genes, and “F2 hybrid enhancement.” The viviparity-driven conflict hypothesis provides a parsimonious explanation for these patterns in mammalian evolution. Physically frail, badly educated girls, brought up to lead useless lives as idle gentlewomen, married to dominant husbands, and relegated to "separate spheres" of life—these phrases have often been used to describe Victorian upper-middle-class women. M. Jeanne Peterson rejects such formulations and the received wisdom they embody in favor of a careful examination of Victorian ladies and their lives. Focusing on a network of urban professional families over three generations, this book examines the scope and quality of gentlewomen's education, (...) their physical lives, their relationship to money, their experience of family illness and death, and their relationships to men (brothers and friends as well as fathers and husbands). Peterson also examines the prominent place of work in the lives of these "leisured" Victorian ladies, both single and married. Far from idle, the mothers, wives, and daughters of Victorian clergymen, doctors, lawyers, university dons, and others were accomplished and productive members of society who made substantial public and private contributions to virtually every sphere of Victorian life. This chapter focuses on the use of effortless attention in performing daily activities and tasks. It details a study developed by The University of Chicago and Claremont Graduate University, and named the Experience Sampling Method to collect data from subjects of the study investigating the use of effortless attention in daily life. The findings are based on an ESM study of subjects consisting of middle and high school students from around the United States and the Sloan Study of Youth and (...) Social Development. The Sloan study focuses on investigating both effortful and effortless attention experiences of the subjects. “When Species Meet is a breathtaking meditation on the intersection between humankind and dog, philosophy and science, and macro and micro cultures.” —Cameron Woo, Publisher of Bark magazine In 2006, about 69 million U.S. households had pets, giving homes to around 73.9 million dogs, 90.5 million cats, and 16.6 million birds, and spending over $38 billion dollars on companion animals. As never before in history, our pets are truly members of the family. But the notion of “companion species”—knotted from human (...) beings, animals and other organisms, landscapes, and technologies—includes much more than “companion animals.” In When Species Meet, Donna J. Haraway digs into this larger phenomenon to contemplate the interactions of humans with many kinds of critters, especially with those called domestic. At the heart of the book are her experiences in agility training with her dogs Cayenne and Roland, but Haraway’s vision here also encompasses wolves, chickens, cats, baboons, sheep, microorganisms, and whales wearing video cameras. From designer pets to lab animals to trained therapy dogs, she deftly explores philosophical, cultural, and biological aspects of animal-human encounters. In this deeply personal yet intellectually groundbreaking work, Haraway develops the idea of companion species, those who meet and break bread together but not without some indigestion. “A great deal is at stake in such meetings,” she writes, “and outcomes are not guaranteed. There is no assured happy or unhappy ending—socially, ecologically, or scientifically. There is only the chance for getting on together with some grace.” Ultimately, she finds that respect, curiosity, and knowledge spring from animal-human associations and work powerfully against ideas about human exceptionalism. Having studied mathematics, in particular foundations and philosophy of mathematics, it happened that I was asked to teach logic to the students in the Faculty of Philosophy of the Radboud University Nijmegen. It was there that I discovered that logic is much more than just a mathematical discipline consisting of definitions, theorems and proofs, and that logic can and should be embedded in a philosophical context. After ten years of teaching logic at the Faculty of Philosophy at the Radboud University (...) Nijmegen, thirty years at the Faculty of Philosophy of Tilburg University and nine years at the Faculty of Philosophy of the Erasmus University Rotterdam, I got many ideas how to improve my LOGIC book which was published twenty five years ago in 1993 by Verlag Peter Lang. Although the amount of work was enormous, I felt I should do it. Sustainable development has been framed as a social issue to which corporations must pay attention because it offers both opportunities and challenges.Although scholars in the environmental strategy field have found that the integration of business and sustainable development can result in competitive advantage, international business scholars argue that it does not increase industrial performance. To integrate these research streams, this paper builds upon the institutional theory attempt to understand strategic options of major multinational corporations (MNCs) that are experiencing sustainable development (...) pressures. This paper also examines the resourcebased view of the firm to understand different patterns of distinctive capabilities that may explain differences in corporate strategies among MNCs experiencing similar institutional pressures. In A Treatise of Human Nature, David Hume presents an argument according to which all knowledge reduces to probability, and all probability reduces to nothing. Many have criticized this argument, while others find nothing wrong with it. In this paper we explain that the argument is invalid as it stands, but for different reasons than have been hitherto acknowledged. Once the argument is repaired, it becomes clear that there is indeed something that reduces to nothing, but it is something other (...) than what, according to many, Hume had in mind. Thus two views emerge of what exactly it is that reduces. We surmise that Hume failed to distinguish the two, because he lacked the formal means to differentiate between a rendering of his argument that is in accordance with the probability calculus, and one that is not. Today, the linguistic approach offers us an irreplaceable method for the direct study of the constitutive processes of social phenomena (A. Delobelle, 1981). In fact, each social phenomenon is basically inhabited or interpreted by language. It is language processes that give its ramifications to the social and form disstinct sub-groups in it. This is why, when these processes are observed in their formal dynamics, outside their vehiculated “contents,” it is as though we find ourselves faced with the very functioning of (...) the social: as though we have in it a typically experimental terrain for the direct study of social phenomena. In a recent paper Ronald Meester and Timber Kerkvliet argue by example that infinite epistemic regresses have different solutions depending on whether they are analyzed with probability functions or with belief functions. Meester and Kerkvliet give two examples, each of which aims to show that an analysis based on belief functions yields a different numerical outcome for the agent’s degree of rational belief than one based on probability functions. In the present paper we however show that the outcomes are the (...) same. The only way in which probability functions and belief functions can yield different solutions for the agent’s degree of belief is if they are applied to different examples, i.e. to different situations in which the agent finds himself. We are again going through a period of expansion in biographical literature. There is an ever greater number of publications, demonstrating the libido biographica of the reading public and also showing the interest of authors for a genre that is often treated with a great deal of care and rigor. This is not the first time in the history of letters, and each of us can find in his library a quantity of ancient, classic or modern works proving the constancy (...) of this production. However, the contemporary phenomenon takes on a different meaning. The appetite for the biographical seems to be directly linked to its value as testimony. We are living in an era of distrust with regard to rules and codes. Every individual is called on to organize his conduct and invent his existence, from which comes, it seems, this need for an example that also expresses a taste for history and a need for more truth than entertainment from the author of biographies. Eells and Sober proved in 1983 that screening off is a sufficient condition for the transitivity of probabilistic causality, and in 2003 Shogenji noted that the same goes for probabilistic support. We start this paper by conjecturing that Hans Reichenbach may have been aware of this fact. Then we consider the work of Suppes and Roche, who demonstrated in 1986 and 2012 respectively that screening off can be generalized, while still being sufficient for transitivity. We point out an interesting difference (...) between Reichenbach’s screening off and the generalized version, which we illustrate with an example about haemophilia among the descendants of Queen Victoria. Deeply dedicated to a diverse and robust earthly flourishing, Manifestly Haraway promises to reignite needed discussion in and out of the academy about biologies, technologies, histories, and still possible futures. Galileo claimed inconsistency in the Aristotelian dogma concerning falling bodies and stated that all bodies must fall at the same rate. However, there is an empirical situation where the speeds of falling bodies are proportional to their weights; and even in vacuo all bodies do not fall at the same rate under terrestrial conditions. The reason for the deficiency of Galileo’s reasoning is analyzed, and various physical scenarios are described in which Aristotle’s claim is closer to the truth than is (...) Galileo’s. Like many discussions on the pros and cons of epistemic foundationalism, the debate between C. I. Lewis and H. Reichenbach dealt with three concerns: the existence of basic beliefs, their nature, and the way in which beliefs are related. In this paper we concentrate on the third matter, especially on Lewis’s assertion that a probability relation must depend on something that is certain, and Reichenbach’s claim that certainty is never needed. We note that Lewis’s assertion is prima facie ambiguous, but (...) argue that this ambiguity is only apparent if probability theory is viewed within a modal logic. Although there are empirical situations where Reichenbach is right, and others where Lewis’s reasoning seems to be more appropriate, it will become clear that Reichenbach’s stance is the generic one. It is argued that probability should be defined implicitly by the distributions of possible measurement values characteristic of a theory. These distributions are tested by, but not defined in terms of, relative frequencies of occurrences of events of a specified kind. The adoption of an a priori probability in an empirical investigation constitutes part of the formulation of a theory. In particular, an assumption of equiprobability in a given situation is merely one hypothesis inter alia, which can be tested, like (...) any other assumption. Probability in relation to some theories – for example quantum mechanics – need not satisfy the Kolmogorov axioms. To illustrate how two theories about the same system can generate quite different probability concepts, and not just different probabilistic predictions, a team game for three players is described. If only classical methods are allowed, a 75% success rate at best can be achieved. Nevertheless, a quantum strategy exists that gives a 100% probability of winning. (shrink)

The book's title is an e-mail address. With it, Haraway locates herself and her readers in a sprawling net of associations more far-flung than the Internet. The address is not a cozy home. There is no innocent place to stand in the world where the book's author figure, FemaleMan, encounters DuPont's controversial laboratory rodent, OncoMouse. (...) Haraway sees the world of contemporary technoscience as a drama. Information sciences and life sciences are at the center of the dramatic action. Scenes are set in landscapes where maps of human genetic differences are stored in databases, racialized bodies are reconfigured by morphing for photographs in popular magazines, and transgenic mice important to breast cancer research are patented intellectual property. The actors are many, and not all are human. Beginning with the Modest Witness, the key figure in the Science Revolution, Haraway shows us the trouble lurking in race and gender- marked practices for attesting to matters of fact. In later scenes, Haraway explores the kinship relations among the many cyborg creatures produced in the late twentieth-century--in nuclear research, genetic engineering, reproductive technologies, computer-mediated representational practices, and mutations in biological approaches to "race.". AimsThis study evaluates a protocol for early, routine ethics consultation for patients on extracorporeal membrane oxygenation to support decision-making in the context of clinical uncertainty with the aim of mitigating ethical conflict and moral distress.MethodsWe conducted a single-site qualitative analysis of EC documentation for all patients receiving ECMO support from 15 August 2018 to 15 May 2019. Detailed analysis of 20 ethically complex cases with protracted ethics involvement identifies four key ethical domains: limits of prognostication, bridge to nowhere, burden of (...) treatment and system-level concerns. There are three subthemes: relevant contextual factors, the role of EC and observed outcomes. Content analysis of transcripts from interviews with 20 members of the multidisciplinary ECMO team yields supplemental data on providers’ perceptions of the impact of the early intervention protocol.ResultsLimited outcome data for ECMO, unclear indications for withdrawal, adverse effects of treatment and an obligation to attend to programme metrics present significant ethical challenges in the care of this patient population. Upstream EC mitigates ethical conflict by setting clear expectations about ECMO as a time limited trial, promoting consistent messaging among multiple services and supporting surrogate decision-makers. When ECMO becomes a ‘bridge to nowhere’, EC facilitates decision-making that respects patient values yet successfully sets limits on non-beneficial use of this novel therapy.ConclusionData from this study support the conclusion that ECMO poses unique ethical challenges that necessitate a standardised protocol for early, routine EC—at least while this medical technology is in its nascent stages.
