ABSTRACT:In this address I argue that different perspectives on the normative foundations of corporate responsibility reflect underlying disagreements about the ideal arrangement of tasks between market and state. I initially recommend that scholars look back to the “division of moral labor” inspired by John Rawls’ seminal work on distributive justice in order to rethink why, and to what extent, corporations take on responsibilities normally within the purview of government. I then examine how this notion is related to recent theoretical work (...) in the field of business ethics. I thereafter turn to provide a brief outline of an alternative view that sees corporations as having responsibilities in so far as markets are sites of delegated oversight over the production of social goods that might otherwise be administered by the state. McNeil (bio)René Girard's (1923–2015) mimetic theory and Georges Bataille's (1897–1962) theory of the sacred both describe an unwitting pull to violence fueled by an aspect of desire. This violence cannot be denied but may be channeled through ritual, resulting in social cohesion or utter catastrophe. Their theories also illustrate the contagious flow of affective violence between individuals, quickly infecting the whole. (...) Girard describes a violent contagion that threatens physical annihilation, while Bataille's more vital contagion illustrates the dissolution of self into other. Both come to the same result—collective cohesion. However, for all the similarities, the essential mechanisms "end up with profoundly different visions of the dynamics sustaining the social bond and, indeed, of society's whole affective economy."1 For Girard, the operative community requires distinct individuals specific in their identities. A lack of distinctions between individuals—a state he calls undifferentiation—leads to a struggle for identity, conflict, and violence. Unity comes from the catharsis of collectively thwarting violence before conflict can destroy the community. For Bataille, unity comes from collectively communicating through ritual. Girard asserts that cohesion occurs by maintaining separation, while Bataille describes cohesion generated in its destruction.Despite their similar concerns and many agreements, Girard and Bataille have rarely been compared. Among those few studies, Tiina Arppe argues that the divergence in both thinkers' theories can be found in their sources, namely, Emile Durkheim's theory of the sacred and Alexandre Kojève's reading of Hegel.2 Antony D. Traylor argues in answering the question of the purpose of sacrifice that Bataille's understanding may add to or replace Girard's scapegoat mechanism.3 Traylor dissects both theories focusing on Girard's critique of metaphysical desire and Bataille's notion of sovereignty. Nidesh Lawtoo mobilizes both thinkers and others to unmask the mimetic forces entwined in ego creation.4 First, similar to Arppe, I argue that apparent contradictions between Girard and Bataille arise from critical influences of each thinker and offer an analysis paving the way, like Traylor, toward compatibility. However, I focus on the influence (or denial) of Sigmund Freud and Marcel Mauss—whom I argue are the most crucial influences for untangling these theories. By examining Girard's interpretation of Freud's theory of cultural origin and Bataille's use of Mauss's notion of the gift and potlatch, I trace a short anthropological genealogy of the sacred that proves critical to both theories.5 In that regard, I eschew wrestling with metaphysical concerns and instead take an anthropological approach to the sacred that moves beyond compatibility. Second, we perform a synthetization, illuminating a shared mimetic force lurking within both theories and how Bataille offers an expansion to Girard's already acute observations—for which Lawtoo's notions of the mimetic unconscious and mimetic communication are essential.My primary source for Girard's theory is Violence and the Sacred, with secondary support from The Scapegoat and Things Hidden since the Foundation of the World. For Bataille, I consult Erotism: Death and Sensuality and two essays: "The Notion of Expenditure" (and its later development in The Accursed Share) and "Definition of Heterology." The double etymology of religio found in Antiquity has generated much discussion. Between the proposition of Cicero and that of Lactantius, we find the ambivalent position of Augustine. The modern analysis of these passages, which is influenced by criteria of linguistics, was centered around the true origin of the word and its true meaning. However, Augustine is neither here nor there. This article uses a rhetorical analysis of these etymologies and considers them as proof in the argumentation. This approach allows (...) identifying the reasons that urge Augustine to choose one or the other according to the addressee. When he addressed the non-Christians, Augustine chose the etymology of Cicero (relegere) and, when he dealt with the controversies with the Manicheans, he chose the etymology based on religare. Of the four types of biological control, (1) natural, (2) conservation, (3) augmentation, and (4) importation), ethical concerns have been raised almost exclusively about only one type: importation. These concerns rest largely on fears of extinction of animal species. Importation biological control is a cost-effective alternative to chemical control for basic food crops of resource-poor farmers. Regarding the other types of biological control, natural biological control is not consciously manipulated by humans. Augmentation has some technical concerns, but is generally an (...) environmentally-sound, viable alternative to chemicals and offers local employment. I argue that we must read Alasdair MacIntyre’s mature work through a Marxist lens. I begin by discussing his argument that we must choose which God to worship on principles of justice, which, it turns out, are ones given to us by God. I contend that this argument entails that we must see Mac- Intyre’s early Marxist commitments as given to him by God, and, therefore, that he has never abandoned them in his turn to Thomistic-Aristotelianism. I examine his reading (...) of Marx, with its emphasis on the concept of alienation as a Christian concept, and explain how this reading differs from the dom- inant scientific-determinist reading of Marx. This examination then leads to a discussion of why MacIntyre abandoned both Marxism and Christian- ity in 1968. Finally, I turn to his more recent writing on Marx. I contend that if we view them through his argument about the principles of justice and which God to worship, we see MacIntyre’s mature philosophy as more Marxist than most people, perhaps even MacIntyre himself, would allow. In a recent critique of the so-called “market failures approach” (MFA) to business ethics Abraham Singer maintains that business firms have ethical responsibilities to voluntarily restrain their profit-seeking activities in accordance with the demands of justice. While I ultimately share Singer’s intuition that the MFA has overlooked the importance of justice in business ethics, I argue that he has not presented a fully adequate case to explain why justice-related responsibilities should be assigned to business firms. In the wake of recent corporate scandals, this paper examines the claim made by John Boatright that business ethics, as it is currently conceived, “rests on a mistake.” Ethics in business should not be achieved through managerial vision, discretion or responsibility; rather, ethics should shape the design of institutions that regulate business from the outside. What ethicists should advocate for, according to Boatright, are moral markets not moral managers. I explore the empirical and normative dimensions of his claim with special (...) attention paid to the extent to which Boatright’s development of the economic theory of the firm supports his position. I conclude by suggesting some reasons why moral markets and moral management are compatible frameworks for corporate reform. (shrink)

What is it like to live with the label “Disability?” NIB editorial staff and narrative symposium editors, Jeffery Bishop and Naomi Sunderland developed a call for stories, which was sent to several list serves, shared with the 1000 Voices Project community and posted on Narrative Inquiry in Bioethics ’ website. The request for personal stories from people who identify with the label “disabled” asked them to: consider how the label “disability” interacts with other aspects of their life in health (...) care settings; does the term “disability” reflect their actual embodied experiences of impairment or does it fail to do justice to their particular experience of impairment; describe the kind of experiences that are possible because of the impairment(s); discuss how the label has affected their “authentic voice”; and many other concepts about what effects the label has on their lives. These authors share deeply personal experiences that will help readers understand their world, challenges, and joys. Thirteen stories are found in the print version of the journal and an additional five supplemental stories are published online only through Project MUSE. The stories are complemented by four commentary articles by Elizabeth R. Schiltz; Lorna Hallahan; Nicole Matthews, Kathleen Ellem, and Lesley Chenoweth; and Jeffery Bishop, Rachelle Barina, and Devan Stahl. These scholars come from the disciplines of law, social work, media studies, medicine, and bioethics from Australia and the United States. The case involves alleged infringements of copyright and plagiarism in 6 works that were published up to 19 years after completion of the dissertation and up to 11 years after publication of the coauthored work. Relevant copyright laws, international copyright agreements, and professional psychology ethics and definitions of scientific misconduct are presented. Graduate students and professionals are advised to protect themselves from copyright (...) infringement and recognize that the responsibility for detecting and correcting misappropriated work usually lies with them, not journal editors. People who defend “pragmatic encroachment” about knowledge generally advocate two ideas: you can rationally act according to what you know; knowledge is harder to achieve when more is at stake. In their chapter in this volume, Charity Anderson and John Hawthorne argue that these two ideas may not fit together so well. This chapter extends Anderson and Hawthorne’s argument. By applying some standard decision theory, we can calculate a precise quantity of “how much is at stake” that does fit together (...) with knowledge and action. Social contract theory has been criticized as a “theory in search of application.” We argue that incorporating the nano- or individual level of analysis into social contract inquiry will yield more descriptive theory. We draw upon the psychological contract perspective to address two critiques of social contract theory: its rigid macro orientation and inattention to the process of contract formation. We demonstrate how a psychological contract approach offers practical insight into the impact of social contracting on day-today human interaction.

In 2020, the Maldives instituted a transitional justice process to address decades of systematic human rights abuses including the widespread use of arbitrary arrest and detention, torture, and the forced depopulation of entire island communities. While the country’s decision to confront its violent past is not unusual, the institution it has established to undertake that task is. Rather than institute a truth and reconciliation commission (TRC), refer cases to its Human Rights Commission, or undertake criminal trials in its domestic judicial (...) system, the Maldives has taken the unprecedented step of establishing a temporary Ombudsperson’s Office for Transitional Justice (OTJ). Comparing the OTJ to national human rights institutions and TRCs, this article examines how and why the Maldives’ transitional justice process has taken this unusual form. It suggests that the OTJ represents a new attempt to address the full range of human rights abuses, including violations of social and economic rights, perpetrated by repressive regimes. (shrink)

Although consumers are increasingly engaged with ethical factors when forming opinions about products and making purchase decisions, recent studies have highlighted significant differences between consumers' intentions to consume ethically, and their actual purchase behaviour. This article contributes to an understanding of this 'Ethical Purchasing Gap' through a review of existing literature, and the inductive analysis of focus group discussions. A model is suggested which includes exogenous variables such as moral maturity and age which have been well covered in the literature, (...) together with further impeding factors identified from the focus group discussions. For some consumers, inertia in purchasing behaviour was such that the decision-making process was devoid of ethical considerations. Several consumers manifested their ethical views through post-purchase dissonance and retrospective feelings of guilt. Others displayed a reluctance to consume ethically due to personal constraints, a perceived negative impact on image or quality, or an outright negation of responsibility. Those who expressed a desire to consume ethically often seemed deterred by cynicism, which caused them to question the impact they, as an individual, could achieve. These findings enhance the understanding of ethical consumption decisions and provide a platform for future research in this area. (shrink)

Farmer participatory research (FPR) has generated many programmatic statements and few technologies. FPR has probably been of interest more because of dissatisfaction with the green revolution and agricultural establishment research than because of a proven ability of scientists and farmers to collaborate together. There are several barriers between farmers and scientists, not the least of which is social distance. Interest in Ibn 'Arabi in the west has grown over the last century. Ibn Arabi and the Contemporary West examines 'Arabi's teachings through the work of the Beshara Trust and the Muhyiddin Ibn 'Arabi Society. Notwithstanding the numerous critiques that have been leveled at the field of positive psychology over its short history, the field and its practitioners continue to enjoy substantial growth and popularity. Although several factors have no doubt contributed to their advancement, work in the field of science studies suggests that rhetorical demarcation in scientific writing, by which scientific fields establish their domains and distinguish themselves from other forms of intellectual activity, may be equally significant. Such “boundary work” is an important means (...) through which fields defeat their competitors, persuade their public, and compete for legitimacy. In light of this, I examine the discursive demarcation and legitimization of positive psychology as performed through historical narratives of its origins in its own writings. I offer an analysis of the ways in which these narratives exploit alternating and contradictory images of scientists, legitimate scientific activity, and in particular, images of American society, to perform the ideological and rhetorical work of describing, and making visible, the kinds of issues and problems for which positive psychology presents itself as the natural solution. 2012 APA, all rights reserved). ABSTRACT:Does effective moral judgment in business ethics rely upon the identification of a suitable set of moral principles? We address this question by examining a number of criticisms of the role that principles can play in moral judgment. Critics claim that reliance on principles requires moral agents to abstract themselves from actual circumstances, relationships and personal commitments in answering moral questions. This is said to enforce an artificial uniformity in moral judgment. We challenge these critics by developing an account of (...) principle-based moral judgment that has been widely discussed by contemporary Kantian scholars. In so doing we respond to some basic problems raised by so-called “moral particularists” who voice theoretical objections to the role of principles as well as to contemporary business ethicists who have criticized principle-based moral judgment along similar lines. One common justification for the pursuit of profit by business firms within a market economy is that profit is not an end in itself but a means to more efficiently produce and allocate resources. Profit, in short, is a mechanism that serves the market’s purpose of producing Pareto superior outcomes for society. This discussion examines whether such a justification, if correct, requires business managers to remain attentive to how their firm’s operation impacts the market’s purpose. With a history dating back at least 3000 years, the philosophical tradition of India is one of the oldest to continue to thrive today. Encompassing a wide variety of worldviews, Indian philosophy includes perspectives that have ongoing relevance to contemporary issues such as the nature of consciousness, the relationship between philosophy and the good life, the existence of a divine reality, and the meaning of happiness. Contrary to widespread stereotypes, Indian philosophy is not simply an extension of Indian religion. Contemporary casuistry, informed by a centuries-old intellectual tradition within the Jesuit order of the Catholic Church, characteristically maintains that ethical judgment does not rely on abstract laws, general rules or universal principles. Ethical judgment is formed through a subtle activity of comparing prior, settled cases with the current problem one is experiencing. Judgment on moral matters is therefore thought to be highly context-dependent and requires a sensitivity to the unique facts and social circumstances of each case. This discussion reviews the (...) origins of casuistry within Jesuit thought and then examines the implications of casuistry for organizational ethics. Our central argument is that contemporary casuistry, while correct to emphasize the particularity of ethical judgment, is nonetheless compatible with an important role for general principles in ethical decision-making within organizations.
