This Element is a philosophical history of Social Darwinism. It begins by discussing the meaning of the term, moving then to its origins, paying particular attention to whether it is Charles Darwin or Herbert Spencer who is the true father of the idea. It gives an exposition of early thinking on the subject, covering Darwin and Spencer themselves and then on to Social Darwinism as found in American thought, with special emphasis on Andrew Carnegie, and Germany with special emphasis on (...) Friedrich von Bernhardi. Attention is also paid to outliers, notably the Englishman Alfred Russel Wallace, the Russian Peter Kropotkin, and the German Friedrich Nietzsche. From here we move into the twentieth century looking at Adolf Hitler - hardly a regular Social Darwinian given he did not believe in evolution - and in the Anglophone world, Julian Huxley and Edward O. The distinction Englert has in mind is between to hekousion and to eph' heroin, a distinction he had emphasized in his long chapter 5 on Aristotle, and insisted was important to Epicurus as well. But the promise is (...) not realized; we are told only that to eph' heroin is saved just as is to hekousion, by insisting that the swerve marks a causal break (135). The book then ends with some undigested matters: David Sedley's work on Epicurus 's On Nature and Don Fowler's suggestion that the mind's act of focus (epibole)might constitute a swerve. Paper, $17.95. Augustine's philosophy of the human person is one of the most neuralgic points in his thought, and the neuralgic soreness spreads to almost every other compartment of his thinking. Since there is still much to learn in this troubled area, one can only welcome the publication of these two studies. O'Daly's book aspires to deal with the entire list of questions involved in the ancient world's Platonic tractatus De anima, whereas Rigby focuses on a single issue, critically evaluating (and largely refuting) the contention put forth by Athanase Sage in two classic articles: that the Augustine who wrote the Confessions had not yet come to think of humanity as guilty of original sin. The breadth of O'Daly's focus also betrays a distinctly confident attitude toward the wide array of matters he must discuss; he seems to view the Augustinian field as relatively trouble free. The central chapters of his book originated as a Habilitation thesis for the University of Heidelberg: hence the generous display of German scholarship, but also a greater serenity toward the difficulties non-German students might perhaps raise against some of his conclusions. He moves from Augustine's general theory of the soul, through claapters on the soul's "lower" activities (sense-perception, imagination, and memory), to that peculiar Augustinian preoccupation with the soul's measurement of time; he then concludes with the psychology of what Augustine would term "knowledge" in the higher (i.e., intellectual) sense of the term. The atmosphere throughout is encyclopedic, but then so is the impressive scale of O'Daly's learning; at the end, though, the reader is especially grateful for the two valuable indices---one topical the other an Index locorum--which help in retrieving the multitude both of texts and topics O'Daly handles. O'Daly is confident that Augustine's views on most of these matters solidified early on, so he feels entitled tojump about from early to late works and back again. Those who 126 JOURNAL OF THE HISTORY OF PHILOSOPHY 28:1 JANUARY 199o find Augustine's thought more fluid will question this methodology, even find it circular ; it supposes a continuity of thought which ought rather to be proven. But this nondevelopmental approach results in another loss--the living sense of context, the controlled excitement that invariably marks Augustine's own thinking, has mostly drained off. This is all the more disappointing since O'Daly writes a pleasing prose style. But that judgment may only reflect the preferential conviction that we still have more exciting things to learn about Augustine's philosophy of human nature than O'Daly is willing to admit. Is this, one wonders, the reason why he ignores the many relevant insights contained in Oliver DuRoy's massive study? He is particularly adamant on the question of the soul's origin, yet one is at liberty to doubt that forty-four years of Augustine's thinking on this gnawing issue can be treated adequately in a... Assuming that the reader accepts, albeit provisionally, that James's "will" to believe, early and late, implies that his ethics is traversed by a deontological streak, and by a "faith" which implies epistemic form on the relevant facts (both interpretations the writer argued for in two previous essays), a final feature of his position entitles one to interpret his "will" to believe as, not merely a willingness or readiness, but as a controlling resolve, in the strong sense, to interpret the facts (...) in a manner appropriate to our living in the "strenuous mood," a mood which is congruent to our universe viewed as "moral." Consider, as a crucial instance, the will to believe which undergirds the "keeping" of a friendship. (shrink)

International law evolved to end and prevent armed conflict as much as for any other reason. Yet, the law against war appears weaker today than ever in its long history, evidenced by raging armed conflicts in which people are killed, injured, and forcibly displaced. The environment is devastated, and the planet impoverished. These consequences can be traced to the dominant ideology of realism. In 1946, Hersch Lauterpacht challenged that ideology by contrasting it with the idea of international law, composed of (...) natural law, positive law, and process theory. The Art of Law in the International Community revives his vision, rebuilding the understanding of why international law binds, what its norms require, and how courts are the ideal substitutes for war. The secret to the renewal of international law lies in revitalizing the moral foundation of natural law through drawing on aesthetic philosophy and the arts. (shrink)

If we can wrong a work of art, then it has moral status. This paper considers two examples of putative wrongings of works of art, but in both cases, the claim that the work of art itself is wronged cannot be vindicated. The sense that a work of art has been wronged arises when that work has a special meaning for us or has a special standing in a cultural context. There is nothing intrinsic to works of art that can (...) confer moral status upon them, and so they are not moral patients. (shrink)

This special issue, entitled “Post-AIDS’ and Global Health Discourses: Interdisciplinary Perspectives,’ emerged from a one day Medical Humanities symposium at the Leeds Centre for Medical Humanities, at the University of Leeds, England, on February 27th 2015. This special issue focusses on the perceived deprioritising of HIV and AIDS in the Sustainable Development Goals, or SDGs, that were launched in 2015. The SDGs function as policy benchmarks for all entities within the United Nations system and they supersede the Millennium Development Goals, (...) or MDGs, which expired in 2015. As the word millennium indicates, the MDGs were launched in 2000 and 2015 was designated as the benchmark year when the successes and shortcomings of the MDGs would be critically assessed. One key difference between the MDGs and the SDGs, which D’Ambruoso foregrounds, is that the writing process underpinning the SDGs involved lengthy consultations, and feedback, with communities and health care practitioners around the world. By contrast, because the MDGs were mainly written by government officials, policy makers and health care practitioners without consulting wider communities, the processes underpinning the SDGs consultations are more inclusive than the MDGs. What is most critical about the SDGs for this special issue, however, is that they reflect a clear shift away from ‘HIV exceptionalism’ and towards what critics have described as ‘post-AIDS’ rhetoric, specifically when one compares the MDG health goal 6 and the SDG health goal 3. The evidence for the effectiveness of rehabilitation of three types of attention—selectivity, sustained attention, and attentional switching—is reviewed. Limited but significant effects in all three domains are observed, though evidence for generalization to wider everyday life functions remains relatively sparse. In the case of sustained attention and also in the case of spatial selectivity, the modulating effects of arousal are shown to be important, and higher level executive deficits may at times be exacerbated or even caused by lowered levels of (...) arousal. Conversely, methods of modulating arousal may be used to improve sustained attention and executive functions in a range of clinical conditions. Attentional functions are key to other cognitive domains such as attention and perception, and so the promising evidence for attentional rehabilitation may contribute to the rehabilitation of other cognitive domains also. Peirce’s doctrine of God has scarcely been studied at all. This is surprising because his own naturally religious temperament, his desire for philosophical completeness and the influence of Kant, all led him to give an important place to theistic speculation in his philosophy. It is true that few parts of his philosophy reveal more than the fragmentary and unfinished nature of his thinking. This however does not take away from its importance both for the interpretation of his philosophy and for (...) the evaluation of its contribution. In this paper I want to examine his doctrine of God mainly in order to discover and outline what views he held in the matter. Such examination is an essential preliminary to any consideration of the value of his theistic thinking. Moreover, an objective exposition is already the best beginning of evaluation. However it is impossible to undertake this kind of examination without a careful search into various corners of his writings and a meticulous and slightly laboured presentation of one’s findings. But I think that the patience involved in such research has a rich reward. (shrink)

Alone among surviving Athenian homicide orations, Antiphon'sOn the Murder of Herodesresembles a modern murder mystery. Antiphon's client, a Mytilenean named Euxitheus, tells a story of a stormy night, an isolated harbour, a drunken murder victim, a missing corpse, misleading bloodstains, forged documents and hints of political intrigue. And, like in any good whodunnit, Euxitheus insists that no one knows who the killer is. Although all the clues seem to point to him, he maintains that Herodes' relatives have manipulated the evidence (...) to make him seem guilty. We do not know whether Euxitheus succeeded in convincing his jurors, but the author of theLife of Antiphonattributed to Plutarch, who says that Antiphon was ‘adept in situations with no way out’ (ἐν τοῖς ἀπόροις τεχνικός), considersOn the Murder of Herodesone of Antiphon's finest compositions (832E, 833D). This article discusses the role of moral argument in the Constitutional case law of the Irish courts. It looks at the debate on the constitutional morality of sexuality in four major cases: a 1973 case protecting the right to use contraceptives; a 1984 case which upholds discrimination against gay men; a 1987 case limiting access to abortion information; and a 1992 case which finds a limited right to abortion in the Constitution. These cases show the role of the courts in (...) contributing to a debate on political morality, both proposing new visions of political morality, and elaborating on the requirements of the current one. When Dr. van Fleteren writes of the articles I criticized as dating from some twenty years ago, the unwary reader might infer that my criticism of those articles was, for its part, relatively recent. The fact is, however, that when the two connected articles I eventually criticized appeared in the volumes of Augustinian Studies, I wrote this reply while Fr. Robert Russell, of happy memory, was still at the helm, and was promised publication in the near future. Meanwhile, however, Fr. (...) Russell had the discourtesy to move on to a more intimate acquaintance with Augustine than any of us on this confused planet can boast of, and someone sowed cockle into field he had tended: in unaccountable fashion my article seems to have disappeared. Only a recent letter of inquiry on my part, and Fr. Allan Fitzgerald’s understanding reply, resulted in this renewal of dialogue between Dr. van Fleteren and me. What was the background to Newman’s rectorship of the Catholic University in Dublin? In 1845 the British government proposed to establish three non-denominational colleges in Ireland; some of the Irish bishops felt that it would be possible to work out a modus vivendi with the government. A slight majority of the bishops, however, opposed these so-called “godless” colleges and voted at the Synod of Thurles in 1850, to found a Catholic University in Ireland—a country that had been repeatedly decimated by (...) poverty and oppression, and a few years earlier the potato famine (1845-48).
