There are many differences between the theories of Bentham and StuartMili specially in the ways in which both characterize the concept of pleasure.The concept, in turn, obviously has great influence on the utilitarian calculus. I am concemed in this paper with the issue of which of the two versions is most compatible with the liberal doctrine. In the procesa of establishing the compatibility of both versions with the liberal doctrine serious difficulties cannot be avoided, but this difficulties can be resolved (...) easily in Bentham's theory. This conclusion has been disputed from many quarters. Ronald Dworkin has raised objections to Bentham's theory from the point of view of liberalism while Jonathan Riley has attempted at building a liberal utilitarianism based-precisely- on Mill's theory. I set out to demostrate that Dworkin's objection may be overcome and I introduce, with purpose in mind, the concept of voluntarily accepted extemal reasons. 1 also believe that Riley's intent is doomed to fail, because it introduces elements of perfectionism and patemalism into the theory. In this book it is argued that this picture of Feyerabend is false.

Ambitious higher-order theories of consciousness aim to account for conscious states when these are understood in terms of what-it-is-like-ness. This paper considers two arguments concerning this aim, and concludes that ambitious theories fail. The misrepresentation argument against HO theories aims to show that the possibility of radical misrepresentation—there being a HO state about a state the subject is not in—leads to a contradiction. In contrast, the awareness argument aims to bolster HO theories by showing that subjects are aware of all (...) their conscious states. Both arguments hinge on how we understand two related notions which are ubiquitous in discussions of consciousness: those of what-it-is-like-ness and there being something it is like for a subject to be in a mental state. This paper examines how HO theorists must understand the two crucial notions if they are to reject the misrepresentation argument but assert the awareness argument. It shows that HO theorists can and do adopt an understanding—the HO reading—which seems to give them what they want. But adopting the HO reading changes the two arguments. On this reading, the awareness argument tells us nothing about those states there is something it is like to be in, and so offers no support to ambitious HO theories. And to respond to the misrepresentation understood according to the HO reading is to simply ignore the argument presented, and so to give no response at all. As things stand, we should deny that HO theories can account for what-it-is-like-ness. (shrink)

This paper examines the challenge that psychoanalytic theory cannot be refuted. It does so by considering the theory in its orthodox Freudian form, and in the main branches into which it can be divided ? the theory of Instincts, of Development, of Psychic Structure, of Mental Economics or Defence, and of Symptom Formation. The essential character of the generalizations and concepts of these branches will just be indicated; and we shall ask of each branch whether it is possible to refute (...) it. A considerable amount of scientific enquiry has been done into the concepts and generalizations of psychoanalysis. Relevant examples of these enquiries will be noted; and the question asked whether these scientific studies have in fact done anything to refute or support the various branches of psychoanalytic theory. The general upshot will be that the challenge is both important and a mistake. (shrink)

As a rigorous and historically sensitive account of recent philosophy, this book should enjoy a wide readership among philosophers of many different persuasions, literary theorists, and social scientists who have been influenced by postmodern thought. ABSTRACT With a particular focus on the experience of young people in higher education, this paper turns to the philosophical work of Cora Diamond to open up new ways of conceptualising mental health. We claim that Diamond offers a compelling insight into that experience of human difficulty so often subsumed by a medicalised vocabulary. We propose that she offers philosophically astute perceptions of the related human attempts at deflection. And we situate this reading of Diamond against a broader understanding of (...) the contemporary university as a place of institutional darkness. In developing this general discussion, we place ourselves within a very particular context. We draw on the narratives of a number of third-level students in Ireland, who shared their experiences as part of a hermeneutic phenomenological study into the lived experience of mental health difficulties. Imagine someone who deliberately provokes someone else into attacking him so that he can harm that person in defending himself against her attack and then claim “self-defense” when brought to court to defend himself for what he has done to her. Should he be allowed to use this defense, even though it’s clear that he has deliberately manipulated his attacker into attacking him precisely in order to be able to harm her with impunity (assuming he were allowed to use the (...) defense and thus escape legal penalties)? This question is the focal point in the paper that follows. I argue first that the case described above is indeed an instance of an “actio libera in causa,” albeit arguably one at the margins of this controversial class of cases. Then, using a view about the justification of self-defense that I have defended elsewhere, I show why I believe that, while the manipulator should not be deprived of the legal right to defend his self-defensive actions in such cases by claiming they were a legitimate matter of self-defense, there is good reason to enact laws that will allow him to be prosecuted, independently of his “self-defense” defense, for manipulating his attacker as he did, thus allowing him to harm her in self-defense and then defend his actions as purely a matter of “self-defense.”. Computational modeling is now ubiquitous in psychology, and researchers who are not modelers may find it increasingly difficult to follow the theoretical developments in their field. This book presents an integrated framework for the development and application of models in psychology and related disciplines. Researchers and students are given the knowledge and tools to interpret models published in their area, as well as to develop, fit, and test their own models. Both the development of models and key features of any (...) model are covered, as are the applications of models in a variety of domains across the behavioural sciences. A number of chapters are devoted to fitting models using maximum likelihood and Bayesian estimation, including fitting hierarchical and mixture models. The paper identifies in the literature two categories of codes of ethics, inspirational and prescriptive, and introduces new classification categories of allodial and decretal. The first classification is based on the identity of the ethics decision‐maker – the authors or the addressees of codes. The second classification is based on whether operational definitions are applied by the codes. Such concrete definitions may be in the rules themselves, in related documents or be known from shared knowledge. The second classification has importance (...) if national associations of accountants use codes as a means for assurance of specific outcomes of defined ethical behaviours. For the study, a survey of 57 codes of ethics issued by national associations of professional accountants was undertaken to determine the basic features of codes and to analyse their content. The areas of ethical concern in national associations were identified and compared to the IFAC model code for professional accountants. The paper reports that national organisations of accountants have promulgated decretal codes in 96% of cases examined. As these codes contain operational definitions, their outcomes can be scientifically measured and sanctions for breaches fairly and reasonably imposed. (shrink)

The new critical edition of the works and correspondence of Jeremy Bentham is being prepared and published under the supervision of the Bentham Committee of University College London. In spite of his importance as jurist, philosopher, and social scientist, and leader of the Utilitarian reformers, the only previous edition of his works was a poorly edited and incomplete one brought out within a decade or so of his death. Eight volumes of the new Collected Works, five of correspondence, and (...) three of writings on jurisprudence, appeared between 1968 and 1981, published by the Athlone Press. Further volumes in the series since then are published by Oxford University Press. The overall plan and principles of the edition are set out in the General Preface to The Correspondence of Jeremy Bentham, vol. 1, which was the first volume of the Collected Works to be published.An Introduction to the Principles of Morals and Legislation, Jeremy Bentham's best-known work, is a classic text in modern philosophy and jurisprudence. John Preston has claimed that we must understand Paul Feyerabend's later, post-1970, philosophy in terms of a disappointed Popperianism: that Feyerabend became a sceptical, relativistic, literal anarchist because of his perception of the failure of Popper's philosophy. I argue that this claim cannot be supported and trace the development of Feyerabend's philosophy in terms of a commitment to the central Popperian themes of criticism and critical explanatory progress. This commitment led Feyerabend to reject Popper's specific methodology in favour of a (...) pluralistic methodology, but the commitment to the central values of criticism and critical explanatory progress remained . Moreover, methodological pluralism does not imply scepticism, relativism, or literal anarchism. Feyerabend was not a disappointed Popperian, but, in many respects, a die-hard pluralistic Popperian. This article discusses the relationship between the origins of the concept of post-normal science, its potential as a heuristic and the phenomenon of complex science entailed policy problems in late industrial societies. Drawing on arguments presented in the early works of Funtowicz and Ravetz, it is proposed that there is a fundamentally empirical character to the post-normal science call for democratizing expertise, which serves as an antidote to late industrial poisoning of the fairy tale ideal of a clean divide between (...) science and politics. Post-normal science extended-peer-review methodology is interpreted as a response to a crisis in the governance of science. Rather than viewing extended-peer-review processes as products of the post-normal science discourse, here the post-normal science discourse is understood to provide a heuristic lens through which existing complex science/society collaborations and conflicts can be better understood. Two different post-normal science situations—management of mega-contamination in Bitterfeld, Germany, and eviction of the Parakuiyo Maasai from the eastern wetlands of the Usangu plains of Tanzania—are presented and the implications of their de facto extended-peer-review structures are discussed, to illustrate this heuristic potential. Error is protean, ubiquitous and crucial in scientific process. In this paper it is argued that understanding scientific process requires what is currently absent: an adaptable, context-sensitive functional role for error in science that naturally harnesses error identification and avoidance to positive, success-driven, science. This paper develops a new account of scientific process of this sort, error and success driving Self-Directed Anticipative Learning (SDAL) cycling, using a recent re-analysis of ape-language research as test example. The example shows the limitations of (...) other accounts of error, in particular Mayo’s (Error and the growth of experimental knowledge, 1996) error-statistical approach, and SDAL cycling shows how they can be fruitfully contextualised. There is a long tradition of arguing that design and science are importantly different. One such argument is that the separation of science and design is an implication that can be drawn from the Simon–Kroes model of the nature of technical artifacts. This paper argues that the Simon–Kroes model does not imply a radical separation between science and design: if we accept the Simon–Kroes model of the nature of technical artifacts and their production, then we must also accept that all (...) the sciences also produce technical artifacts, and in importantly similar ways. Moreover, the placing of both science and design in a naturalist framework reinforces this conclusion and opens up new vistas for synergetic cross-disciplinary discussion of design and methodology. Much of Bentham's correspondence of this period is concerned with his persistent but eventually unsuccessful efforts to secure the implementation of his Panopticon penitentiary scheme. The letters also throw light on his work in other fields, especially public finance and the reform of the police.

We examine the claim that design is demarcated from science by having wicked problems while science does not and argue that it is wrong. We examine each of the ten features Rittel and Weber hold to be characteristic of wicked problems and show that they derive from three general sources common to science and design: agent finitude, system complexity and problem normativity, and play analogous roles in each. This provides the basis for a common core cognitive process to design and (...) science. Underlying our arguments is a shift to a strategic problem-solving conception of method in both disciplines that opens up new opportunities for synergetic cross-disciplinary research and practice. Is it rational to be moral? How do rationality and morality fit together with being human? These questions are at the heart of David Schmidtz's exploration of the connections between rationality and morality. This inquiry leads into both metaethics and rational choice theory, as Schmidtz develops conceptions of what it is to be moral and what it is to be rational. He defends a fairly expansive conception of rational choice, considering how ends as well as means can be rationally chosen (...) and explaining the role of self-imposed constraints in a rational life plan. His moral theory is dualistic, ranging over social structure as well as personal conduct and building both individual and collective rationality into its rules of recognition for morals. To the "why be moral" question, Schmidtz responds that being moral is rational, but he does not assume we have reasons to be rational. Instead, Schmidtz argues that being moral is rational in a particular way and that beings like us in situations like ours have reasons to be rational in just that way. This approach allows him to identify decisive reasons to be moral; at the same time, it explains why immorality is as prevalent as it is. The identity of lesbian-mother combines a marginalized identity with one of the most revered mainstream identities. With data collected through exploratory in-depth interviews from nine lesbian-mothers, the authors use symbolic interaction framework to explore the strategies that lesbian birth mothers and comothers employ to gain acceptance for their marginal-mainstream identities in their family networks. Respondents experienced varying levels of resistance from their social networks, with comothers being especially vulnerable due to their lack of both biological and legal substantiation. The authors (...) explore the process of identity negotiation in three realms of everyday experience: in relationships with extended families, in relations within the nuclear family, and in lesbian relationships that have ended. The third chapter of Brentano's dissertation "On the Manifold Meaning of Being According to Aristotle" (1862) analyzes "Being in the sense of the True." Because Heidegger has always related the Question of Being to the Question of Truth, and because he calls Brentano's work the "chief help and guide" of his first venture into philosophy, the question arises: does Brentano's account of "Being in the sense of the True" have significant bearing on Heidegger's response to the principal matter of his (...) thought, i.e., Aletheia as the Unconcealment of Beings in Presence? My argument proceeds by way of my considering and elaborating an example to show that although 'gold has atomic number 79' be counted a metaphysically necessary truth, There is a possible world in which it is false; it turns out to be for all I show here at most a physical necessity, True (...) in all those worlds structurally similar to the actual world. It was a bad day. First I presented my idea about a Central America protest to the faculty committee, but the committee played ping-pong with the idea until it was crushed. Then I met Robinson, who has somehow been able to present his theory of action in a serious journal. But the theory is a house of cards, and once his critics rattle the table a bit, the theory will come crashing down. And his book on the history of philosophy, (...) just published, is a cheap TV dinner. He does not understand how to study the history of thought. It is necessary to dig into hidden layers of thought, to uncover earlier strata, to map the subterranean patterns, and then to explain why upheavals take place when they do.The above paragraph contains a number of metaphorical sentences. Now all of the following are, I believe, facts about, or relevant to, those sentences. They can be true or false, and our behavior towards them shows that we take them as candidates for truth. I will be expected to offer evidence in support of their truth, and Robinson's supporters on the faculty, if they hear me state the sentences about him, will accuse me of having made false claims. It is generally clear, in regard to the metaphorical sentences under consideration, what would count as evidence for them and against them. (shrink)
