This article considers the use of flag telegraphy by the US Signal Corps during the Civil War as it functioned as a proto-technical medium that preceded wire telegraphy as a military communications technology. Not only was flag telegraphy a historical step towards contemporary technical media, it was also an early iteration of the digitization of communication. Our treatment ties together three main theoretical threads as a way of seeing ‘the digital’ in material communication practices: (1) Friedrich Kittler’s concept of technical (...) media as a remediation between the 19th and 20th centuries, (2) Foucault’s docile bodies as means of reproducing culture, and (3) James Carey’s argument that the telegraph reconfigured communication. The Signal Corps is a rich historical moment in terms of media history and history of technology because it illustrates the convergence of historical exigencies at work in the war machine: mobility, secrecy, precision, and speed. Each contributes, we argue, to a digital telos that privileges digital ways of knowing and being. (shrink)

Can the right to private property be claimed as one of the `rights of mankind'? This is the central question of this comprehensive and critical examination of the subject of private property. Jeremy Waldron contrasts two types of arguments about rights: those based on historical entitlement, and those based on the importance of property to freedom. He provides a detailed discussion of the theories of property found in Locke's Second Treatise and Hegel's Philosophy of Right to illustrate this contrast. (...) Many contemporary proponents of hylomorphism endorse a version of hylomorphism according to which the form of a material object is a certain kind of complex relation or structure. Structural approaches to form, however, seem not to capture form’s traditional role as the guarantor of diachronic identity, since more “dynamically complex” material objects, such as living organisms, seem to undergo, and survive, various structural changes over the course of their existence. As a result, some contemporary hylomorphists have looked to alternative, non-structural (...) approaches to form. One of the leading non-structural approaches is the powers approach, according to which the form of a material object is a certain kind of power continuously activated in the object or in its material parts. In this paper, I begin by offering an overview and assessment of this powers approach to form. I argue that while the powers approach captures some crucial elements for understanding the nature of more dynamically complex material objects, when we press on the details of the view we find that it actually points to a related, but importantly distinct, third approach to understanding form, according to which the form of a material object is a certain kind of activity or process in which the material object or its parts are continuously engaged. I call this third approach “Hyloenergeism”. In the second half of the paper, I consider what such a view of material objects might look like and what its principal virtues might be. (shrink)

We draw from ego depletion and leader–member exchange theories to provide nuanced insight into why abusive supervision is indirectly associated with supervisor-directed destructive voice. A multi-wave, multi-source field study demonstrates evidence that abusive supervision has a positive conditional indirect effect on supervisor-directed destructive voice through subordinates’ relational ego depletion with their supervisors that is stronger for higher LMX differentiation contexts than lower LMX differentiation contexts. We make novel theoretical, empirical, and practical contributions by providing a parsimonious explanation for why relational (...) aspects of supervisory treatment drain subordinates’ capacities for controlling their volitional actions during interactions with their supervisors and how this relationship impacts subordinates’ supervisor-directed destructive voice. Overall, our study extends the application of ego depletion and LMX theories to the examination of abusive supervision and destructive voice in order to meaningfully inform researchers’ attempts to build cohesive streams of research in these areas and practitioners’ attempts to promote ethical workplace environments. Koonin, in an article in this issue, claims that CRISPR–Cas systems are mechanisms for the inheritance of acquired adaptive characteristics, and that the operation of such systems comprises a “Lamarckian mode of evolution.” We argue that viewing the CRISPR–Cas mechanism as facilitating a form of “directed mutation” more accurately represents how the system behaves and the history of neoDarwinian thinking, and is to be preferred.

This paper provides a new analysis and critique of Rawlsian public reason’s handling of the abortion question. It is often claimed that public reason is indeterminate on abortion, because it cannot say enough about prenatal moral status, or give content to the (allegedly) political value which Rawls calls ‘respect for human life’. I argue that public reason requires much greater argumentative restraint from citizens debating abortion than critics have acknowledged. Beyond the preliminary observation that fetuses do not meet the criteria (...) of political personhood, I contend, public reasoners may say nothing about prenatal moral status. Indeed, respect for human life (as distinct from respect for persons) is not, I show, a genuine political value, whose interpretation lies within public reason’s remit. This fact does not, however, prevent deliberators from drawing determinate conclusions regarding the law of abortion. Instead, I show, public reason has radically permissive implications for the legal regulation of feticide, inclining heavily towards the view that abortion should be allowed with little or no qualification, right until birth. I end by giving grounds for thinking that, even if the argumentative restraint which public reason enjoins over prenatal moral status does not generate indeterminacy, it is nonetheless objectionable. As the sciences of biotechnology, synthetic biology, and nanotechnology develop, questions about liability for harms caused by self-replicating inventions will arise increasingly often. Although negligence, nuisance, and other torts may be relevant in such circumstances, trespass may be the more appropriate cause of action. First, the author explores doctrinal hurdles facing plaintiffs alleging biotrespass. To overcome concerns about the metaphysicality of molecular biotrespass, the author draws analogies to “cybertrespass.” To confront the problem of suing patent licensors for the actions of (...) their licensees, the author makes reference to principles of landlord-tenant law. Well-established laws concerning wandering animals shed light on the policies underlying biotrespass. In the second part, the author examines such policies in further detail and considers the purpose of transporting property metaphors into bio/nanospace. The article concludes that biotrespass can be a viable cause of action, if crafted carefully and understood properly. (shrink)

Field Life examines the practice of science in the field in the Great Plains and Rocky Mountains of the American West between the 1860s and the 1910s, when the railroad was the dominant form of long-distance transportation. Grounded in approaches from environmental history and the history of technology, it emphasizes the material basis of scientific fieldwork, joining together the human labor that produced knowledge with the natural world in which those practices were embedded. Four distinct modes of field practice, which (...) were shared by different field science disciplines, proliferated during this period—surveys, lay networks, quarries, and stations—and this book explores the dynamics that underpinned each of them. Using two diverse case studies to animate each mode of practice, as well as the making of the field as a place for science, Field Life combines textured analysis of specific examples of field science on the ground with wider discussion of the commonalities in the practices of a diverse array of field sciences, including the earth and physical sciences, the life and agricultural sciences, and the human sciences. By situating science in its regional environmental context, Field Life analyzes the intersection between the cosmopolitan knowledge of science and the experiential knowledge of people living in the field. Examples of field science in the Plains and Rockies range widely: geological surveys and weather observing networks, quarries to uncover dinosaur fossils and archaeological remains, and branch agricultural experiment stations and mountain biological field stations. My aim in this article is programmatic. I argue that understanding perceptual experience on the model of perceptual affordances allows us to acknowledge the centrality of embodiment to moral phenomenology, on the one hand, and to see more transparently the place of the emotions in the moral life, on the other. I suggest some means by which moral perception, construed as the perception of moral affordances, might be cultivated.

How should the world's remaining carbon budget be divided among countries? We assess the role of a fault‐based principle in answering this question. Discussion of the role of historical emissions in dividing the global carbon budget has tended to focus on emissions before 1990. We think that this is in part because 1990 seems so recent, and thus post‐1990 emissions seem to constitute a lesser portion of historical emissions. This point of view was undoubtedly warranted in the early 1990s, when (...) discussion of fault‐based principles in this context began. While this view still has some intuitive force, we find that it and the associated focus on pre‐1990 emissions are now out of date. Emissions since 1990 in fact constitute a large and rapidly increasing proportion of emissions since 1750 – approximately half of the carbon emissions due to fossil fuel use and cement production, at the time of writing. We show that a restricted fault‐based principle, according to which emissions should be divided among countries on the basis of their emissions since 1990, is both viable and powerful. We consider standard objections to a fault‐based principle in this context, how such a principle might more concretely be applied, and its likely implications. (shrink)

We describe a model-theoretic approach to ordinal analysis via the finite combinatorial notion of an α-large set of natural numbers. In contrast to syntactic approaches that use cut elimination, this approach involves constructing finite sets of numbers with combinatorial properties that, in nonstandard instances, give rise to models of the theory being analyzed. This method is applied to obtain ordinal analyses of a number of interesting subsystems of first- and second-order arithmetic.

The perceived support of supernatural agents has been historically, ethnographically, and theoretically linked with confidence in engaging in violent intergroup conflict. However, scant experimental investigations of such links have been reported to date, and the extant evidence derives largely from indirect laboratory methods of limited ecological validity. Here, we experimentally tested the hypothesis that perceived supernatural aid would heighten inclinations toward coalitional aggression using a realistic simulated coalitional combat paradigm: competitive team paintball. In a between-subjects design, US paintball players recruited (...) for the study were experimentally primed with thoughts of supernatural support using a guided visualization exercise analogous to prayer, or with a control visualization of a nature scene. The participants then competed in a team paintball battle game modeled after “Capture the Flag.” Immediately before and after the battle, participants completed surveys assessing confidence in their coalitional and personal battle performance. Participants assessed their coalition’s prospects of victory and performance more positively after visualizing supernatural aid. Participants primed with supernatural support also reported inflated assessments of their own performance. Importantly, however, covarying increases in assessments of their overall coalition’s performance accounted for the latter effect. This study provided support for the hypothesis that perceived supernatural support can heighten both prospective confidence in coalitional victory and retrospective confidence in the combat performance of one’s team, while highlighting the role of competitive play in evoking the coalitional psychology of intergroup conflict. These results accord with and extend convergent prior findings derived from laboratory paradigms far removed from the experience of combat. Accordingly, the field study approach utilized here shows promise as a method for investigating coalitional battle dynamics in a realistic, experientially immersive manner. (shrink)

According to Hugo Münsterberg, the direct application of experimental psychology to the practical problems of education, law, industry, and art belonged by definition to the domain of psychotechnics. Whether in the form of pedagogical prescription, interrogation technique, hiring practice, or aesthetic principle, the psychotechnical method implied bringing the psychological laboratory to bear on everyday life. There were, however, significant pitfalls to leaving behind the putative purity of the early psychological laboratory in pursuit of technological utility. In the Vocation Bureau, for (...) example, psychological instruments were often deemed too intimidating for a public unfamiliar with the inner workings of experimental science. Similarly, when psychotechnical means were employed by big business in screening job candidates, ethical red flags were raised about this new alliance between science and capital. This tension was particularly evident in Münsterberg's collaboration with the Paramount Pictures Corporation in 1916. In translating psychological tests into short experimental films, Münsterberg not only envisioned a new mass medium for the dissemination of psychotechnics, but a means by which to initiate the masses into the culture of experimental psychology. But the two physicians differed fundamentally in their views of the ideal relationships among the pharmaceutical industry, the medical profession, and the medical humanities. ABSTRACT Even as the division between professional scientists and laypeople became sharper by the end of the nineteenth century, the collaboration of local people remained important in scientific fieldwork, especially in sciences such as vertebrate paleontology that required long‐term extractive access to research sites. In the North American West, the competition between museums and universities for the best fossil quarry sites involved negotiations with locals. The conflict over differing conceptions of the field site is vividly demonstrated through an examination of (...) one site on the High Plains of western Nebraska in the early twentieth century. This case offers a rare opportunity to see not only how professionals regarded such sites but also how the resident ranching family, the Cooks, attempted to exercise leverage over the scientific fieldwork that took place there. While the Carnegie Museum of Pittsburgh became mired in protracted conflict with the Cooks over discovery claims and the ongoing control of the site, the University of Nebraska and the American Museum of New York developed more harmonious relations with the site's resident ranching family. Seeing the rule of law as just one value to which democracies aspire, he embraces thoughtfulness rather than rote rule-following, flexibility even at the cost of vagueness, and emphasizing procedure and argument over predictable outcomes.

Against the interrogations of critical thought, it has only responded with mute resistance. indeed, the consensus seems to be that love dwells in the domain beyond the thinkable, and it is ensconced in the Romantic doxa that it is a form of intensity that is not subject to any organizing principle. As Alain Badiou observes, it is "what is subtracted from theory". In this essay, I oppose such an "anti-philosophical" position, and offer an exploration of love's kinship with thought and truth. Drawing primarily from the work of Jean-Luc Nancy and Alain Badiou, I explore the relationship oflove and thought, for it is an occasion that obligates one to realize the "intimate connivance between love and thinking," to use the words of Nancy. At a time when love is threatened by accusations ofbeing nothing more than a "cruel optimism", I suggest that Nancy and Badiou offer a philosophical defense of love by underscoring its kinship to thought and to truth. What happened to the doctrine of natural right in the nineteenth century? We know that it flourished in the seventeenth and eighteenth centuries. We know that something like it - the doctrine of human rights and new forms of social contract theory - flourished again in the second half of the twentieth century and continues to flourish in the twenty-first. In between there was a period of decline and hibernation - uneven, to be sure, and never complete - but a (...) period in which to invoke natural right was always to invite intellectual ridicule and accusations of political irresponsibility. Thus article asks: How far can the decline of natural right in the nineteenth century be attributed to the reaction against the revolution in France? How far it was the effect of independent streams of thought, like positivism and historicism? Why was radical thought so ambivalent about natural right throughout the nineteenth century, and why was socialist thought in particular inclined to turn its back on i? As a framework for thought, natural right suffered a radical decline in the social and political sciences. But things were not so clear in jurisprudence, and natural right lived on to a much riper old age in the writings of some prominent economists. So we have to ask: What is it about this theory that allowed it to survive in these environments, when so much of the rest of intellectual endeavor in the nineteenth century was toxic or inhospitable to it. Finally, I shall ask how far American thought represents an exception to all of this. Why and to what extent did the doctrine survive as a way of thinking in the United States, long after it had lost its credibility elsewhere. (shrink)

This paper probes the foundations and limits of visual representation in the sciences through a close reading of the diagrams that accompanied definitions of the geometric point in the first century of printed editions of Euclid’s Elements. I begin with the modal form for such diagrams of Euclid’s “small and unsensible shape,” showing how it incorporates a broad spectrum of conventions and practices related to the point’s philosophical and practical roles in the surrounding Euclidean geometry. I then explore the form’s (...) several variations in order to consider the role of “mere representation” in geometric exegesis, and conclude by characterizing the curious relationship between things and their images and that relationship’s implications for understanding scientific knowledge and practice. In recent years several scholars have wrestled with the term “poetic thought,” suggesting in various ways there is something distinctive about the nature of meaning as it occurs/unfolds through poetry. In this paper I suggest, in part following the lead of Simon Jarvis, that one of the most fruitful lines of inquiry for exploring this idea lies in a consideration of poetic works through the lens of Heidegger’s early phenomenology. Specifically, I argue that one of the keys to understanding poetic (...) thought lies in a flaw within Heidegger’s ontological divisions between substances, equipment and Dasein, as presented in Being and Time. Through an analysis of three poems by Frank O'Hara, I argue poetry that examines and represents the physical world presents a problem for Heidegger when he suggests equipment in the world must necessarily “withdraw” in order for us to engage with it authentically. The encounter between Bergson and Einstein that took place at the 1922 meeting of the Philosophical Society at the Collège de France gave rise to a lively debate about the relative merits of Bergson’s contribution to the understanding of time in relativity. In this paper, I argue that despite some serious shortcomings, Bergson’s philosophical intervention in the interpretation of relativity makes a novel and valuable contribution to the understanding of time in relativity. With reference to the so-called ‘paradox’ of the (...) twins, I begin by arguing that Bergson offers a corrective for the fallacious view that temporal passage is illusory. In the second section, I explain what Bergson means by a single, universal time. Given the fact that in relativity there is a plurality of times, this idea seems inconsistent with relativity, but I argue that Bergson’s single time is just duration, a time that is dependent on the temporal passage in a particular inertial frame. In a third section, I show that despite his failure to see it, Bergsonian duration is actually consistent with proper time, a time that is invariant regardless of which frame is used to perform the calculation. Once we make this connection between duration and proper time, we can see what Bergson’s intervention is really meant to accomplish; namely, to attach a concrete sense of the passage of time to relativity, thus ‘completing’ the theory of relativity so that it can account for the duration that we all feel and know with inimitable intimacy. In the end, my position is that Bergson helps us to see that time lapse is what it is not because it is measured as such, but rather because it is the lived time of a particular process that is invariant to change of inertial frame.
