With over 2 billion people lacking medicines for treatable diseases and 14 million people dying annually from infectious disease, there is undeniable need for increased access to medicines. There has been an increasing trend to benchmark the pharmaceutical industry on their corporate social responsibility (CSR) performance in access to medicines. Benchmarking creates a competitive inter-business environment and acts as incentive for improving CSR. This article investigates the corporate feedback discourses pharmaceutical companies make in response to criticisms from benchmarking reports. It (...) determines whether these responses are part of a healthy process in increasing access to medicines or a barrier to improvement. A qualitative analysis on the feedback the industry provided was performed, and the responses seen in these statements were grouped by analysing the language used, the ideas portrayed and atti- tudes of the companies. Increasing transparency through benchmarking is a powerful tool which reveals the industry’s shortfalls to the public, affects the decisions of socially responsible investors, and is a risk to their financial bottom line. This article demonstrates the importance of benchmarking and transparency in creating inter-business competition and the translation of these responses to actual access to medicine practices. Structural changes in the agriculture and food system have resulted in larger but fewer farms, while increasing populations in urban areas have pushed development into rural areas. Despite these changes, little research has examined the concern of individuals with regards to loss of farmland and how this may vary based on geography. Building on Bell’s argument that the rural–urban continuum still exists and remains an important part of rural residents’ identity, in this article we examine residents’ concern over loss of (...) farmland as a result of urban growth. We pay particularly close attention to urban–rural differences over concern with loss of farmland. Utilizing survey data collected from over 400 households in the Treasure Valley, a region of the western United States, our results indicate that rural residents show greater levels of concern with farmland loss when compared to their urban counterparts. A crucial question in relation to support designed to enable the legal capacity of people with mental disabilities concerns when support constitutes undue influence. This article addresses this question in order to facilitate the development of law and policy in England and Wales, by providing a normative analysis of the different approaches to undue influence across decisions about property, contracts, health, finances, and accommodation. These are all potential contexts for supporting legal capacity, and, in doing so, the article compares approaches (...) to undue influence that are rarely considered together. -/- Drawing on the UN Convention on the Rights of Persons with Disabilities, third sector and public body documents, and law in England and Wales, the analysis identifies six models that conceptualise undue influence in terms of: modes of influence; an overborne will; an inference from the situation; an overborne will understood as a mental incapacity; an overborne will in connection with vulnerability; and impaired discursive control. This final approach is a novel proposal for understanding undue influence. The analysis highlights key policy-relevant issues that distinguish the models, and generates a deliberative framework for navigating them, with the ‘overborne will’, ‘inference-based’, and ‘discursive control’ models identified as potentially fitting for the support context. Mental time travel and theory of mind develop, both phylo- and ontogenetically, at the same stage. We argue that this synchrony is due to the emergence of a shared competence, namely, the ability to become aware of frames of reference.

As universities expand so too does the diversity of students. Widening participation requires higher education providers to be responsive to the needs of all students by ensuring an accessible and engaging learning environment. Today's cohort includes an increased number of students with autism, a spectrum condition that has the potential to be either beneficial or detrimental to their success in higher education. This article reports on a mature-age student with autism who publicly announced his struggle with the eLearning environment, somewhat (...) ironically, in the asynchronous discussion board. While eLearning offers designers and teaching staff an opportunity to adopt an applied and collaborative approach to the learning environment, for this student it created a challenging landscape dominated by steep mountains and roadblocks. What the student revealed has implications for course designers, teaching staff, and university administrators as they undertake to provide an eLearning environment that is suitable for all students, including those with autism. This article describes the slight impact of Lysenkoism upon Polish botany. I begin with an account of the development of plant genetics in Poland, as well as the attitude of scientists and the Polish intelligentsia toward Marxist philosophy prior to the World War II. Next I provide a short history of the introduction and demise of Lysenkoism in Polish science, with a focus on events in botany, in context with key events in Polish science from 1939 to 1958. The article (...) outlines the little effects of Lysenkoism upon botanists and their research, as well as how botanists for the most part rejected what was often termed the "new biology." My paper shows that though Lysenko's theories received political support, and were actively promoted by a small circle of scientists and Communist party activists, they were never accepted by most botanists. Once the political climate in Poland altered after the events of 1956, Lysenko's theories were immediately abandoned. (shrink)

Formal principles governing best practices in classification and definition have for too long been neglected in the construction of biomedical ontologies, in ways which have important negative consequences for data integration and ontology alignment. We argue that the use of such principles in ontology construction can serve as a valuable tool in error-detection and also in supporting reliable manual curation. We argue also that such principles are a prerequisite for the successful application of advanced data integration techniques such as ontology-based (...) multi-database querying, automated ontology alignment and ontology-based text-mining. Empirical research in the field of moral cognition is increasingly being used to draw conclusions in philosophical moral psychology, in particular regarding sentimentalist and rationalist accounts of moral judgment. This paper calls for a reassessment of both the empirical and philosophical conclusions being drawn from the moral cognition research. It is proposed that moral decision making is best understood as a species of Kahneman and Frederick's dual-process model of decision making. According to this model, emotional intuition-generating processes and reflective processes (...) operate in an integrated way in moral deliberation, and metacognition is assigned an essential role in the monitoring and shaping of moral intuitions. In combination with observations from philosophical moral psychology, this proposal cautions against endorsing simple sentimentalism or rejecting rationalist accounts on the basis of the moral cognition research. The use of genetic technology in agriculture is viewed by some as the next frontier of farming but others may view it as a threat. The aim of the current study was to describe the views of experts working in agricultural genetics regarding how best to communicate genetic technology with a broader audience (e.g., clientele, the public). We recruited 10 experts working in roles that involve communication about genetic technology in agriculture. Using semi-structured interviews, we asked participants to describe how (...) they discuss this technology, who they discuss it with, and their thoughts on the involvement of various stakeholders in these discussions. Interview transcripts were subjected to thematic analysis and participant responses were organized into three themes: 1) Communicating and framing genetic technology, including discussing risks, benefits, and applications, distinguishing technology from other similar technologies, and engaging in value-based discussions; 2) Challenges of public communication, including misinformation and opposing opinions, conflation with older technologies, and balancing information provision; and 3) Stakeholder involvement in discussions, which included views on how different groups (e.g., activists, farmers, and scientists) should be included in discussions, and who is best suited to discuss genetic technology with the public. We conclude that leaders in agricultural genetics engage in a variety of approaches to communicate genetic technology, using different frames that they feel are likely to appeal to their audience, and differ in their opinions of who should be involved in these discussions. According to the principle of patient autonomy, patients have the right to be self-determining in decisions about their own medical care, which includes the right to refuse treatment. However, a treatment refusal may legitimately be overridden in cases where the decision is judged to be incompetent. It has recently been proposed that in assessments of competence, attention should be paid to the evaluative judgments that guide patients' treatment decisions.In this paper I examine this claim in light of theories of practical (...) rationality, focusing on the difficult case of an anorexic person who is judged to be competent and refuses treatment, thereby putting themselves at risk of serious harm. I argue that the standard criteria for competence assess whether a treatment decision satisfies the goals of practical decision-making, and that this same criterion can be applied to a patient's decision-guiding commitments. As a consequence I propose that a particular understanding of practical rationality offers a theoretical framework for justifying involuntary treatment in the anorexia case. (shrink)

The United Nations Convention on the Rights of Persons with Disabilities (CRPD) is being used to argue for wider recognition of the legal capacity of people with mental disabilities. This raises a question about the implications of the Convention for attributions of criminal responsibility. The present paper works towards an answer by analysing the relationship between legal capacity in relation to personal decisions and criminal acts. Its central argument is that because moral and political considerations play an essential role in (...) setting the relevant standards, legal capacity in the context of personal decisions and criminal acts should not be thought of as two sides of the same coin. The implications of particular moral or political norms are likely to be different in these two legal contexts, and this may justify asymmetries in the relevant standards for legal capacity. However, the analysis highlights a fundamental question about how much weight moral or political considerations should be given in setting these standards, and this is used to frame a challenge to those calling for significantly wider recognition of the legal capacity of people with mental disabilities on the basis of the Convention. I became interested in different kinds of religions, especially Buddhism. I was lucky that the professor who taught Asian religions also offered an introductory class on Buddhism the following semester. It was an upper-level course, generally not open to first-year students, but the (...) instructor let me enroll. The class met twice a week for two hours. At first it did not seem different in any way from my other classes, but during the second half of the semester, we spent fifteen to twenty minutes at the beginning of every class in meditation.Before I came to college, I believed I had decent reasoning and interpretive skills; intellectually I knew I could go toe-to-toe with alien concepts and master them. But I had heard from my sister and my two eldest cousins that college was a different world from high school; I should expect my perceptions to change. Every time I was told something like this I shrugged it off. The suggestion that a class could affect my core beliefs seemed far-fetched. I did not think college would change me that much, but the Buddhism course and the meditation practice affected me in ways I did not expect: academically, spiritually, and emotionally. The process was gradual. By the end of the spring semester, there were big dents in my usual ways of thinking about the world and about myself.Buddhism is a complex religion and some of its core ideas, such as the nature of human suffering, are not so easy to explain. Unlike other classes where I learn in traditional academic ways, meditation gave me an opportunity to understand Buddhism in new ways, more challenging and personal ways. After it was incorporated into the class, everything developed more color: things I thought I knew no longer seemed so black and white. I stopped feeling that tests and homework were the most important things about my classes; what matters is what I learn. And what I learn depends on me.Unlike a straightforward academic class, in which I usually regurgitate what I read in books and hear in lectures, meditation caused me to focus on myself. I have not had a class before or since that has seeped into my life outside the classroom so much. (How often can people say that a class they took comes back to haunt them, in a good way?) None of my other classes has made me think so hard, either. I felt as though I was problem solving on a whole new level. Reviewing the text only helped a little. I needed something to “click” so I could understand Buddhism better. I did not see how meditation could help anyone, however. I just saw it as a time to sit still and collect swarming thoughts. I did not get how it was supposed to advance anyone along their “path.” I doubted it would help me learn anything about Buddhism, let alone help me pass the course. Although I was wary, I was willing to try. After I did experience it for myself, the lessons became more comprehensible, because I could relate them to my own life and experiences. This made the class feel less stressful as well.After about a week of doing meditation, a few friends asked me how it felt. I told them it felt very foreign to go to class and sit in front of a white wall for fifteen to twenty minutes and count my breaths. It was very different from immediately taking out paper and pen and starting to take notes. Sitting for those minutes was sometimes rather fun, relaxing. In the emergent field of creative practice higher degrees by research, first generation supervisors have developed new models of supervision for an unprecedented form of research, which combines creative practice and a written thesis. In a national research project, entitled ‘Effective supervision of creative practice higher research degrees’, we set out to capture and share early supervisors’ insights, strategies and approaches to supporting their creative practice PhD students. From the insights we gained during the early interview process, we expanded our (...) research methods in line with a distributed leadership model and developed a dialogic framework. This led us to unanticipated conclusions and unexpected recommendations. In this study, we primarily draw on philosopher and literary theorist Mikhail Bakhtin’s dialogics to explain how giving precedence to the voices of supervisors not only facilitated the articulation of dispersed tacit knowledge, but also led to other discoveries. These include the nature of supervisors’ resistance to prescribed models, policies and central academic development programmes; the importance of polyvocality and responsive dialogue in enabling continued innovation in the field; the benefits to supervisors of reflecting, discussing and sharing practices with colleagues; and the value of distributed leadership and dialogue to academic development and supervision capacity building in research education. In this paper, I argue that the Hindmarsh and Wik cases stand as crucial case studies that evidence the ongoing production of terra nullius within contemporary Australian contexts. They bring into focus the critical importance the signifiers of property, capitalist ‘productivity’ and legality within the settler-colonial state. Alongside notions of ‘civility,’ discourses surrounding ‘economic productivity’ and ‘equality before the law’ are consistently mobilised in these cases to assert white sovereignty. In contradistinction to the discourses that construct Indigenous people’s relation to (...) land as a singular and affective ‘affinity,’ media, political and legal texts script white Australian land uses such as farming and mining as ‘productive’ and necessary for economic prosperity. They are posited with ‘monetary’ output and juridical standing in order to produce the narrative that the continent was lawfully ‘settled’ by ‘illustrious’ white Australians. Moreover, these signifiers ramify within colonial law. Following these cases, the state amended the Aboriginal and Torres Straight Islander Heritage Protection Act 1984 and the Native Title Act 1993 respectively. They ensured the material construction of the Hindmarsh Island Bridge and the revocation of specific Indigenous land rights in order to sustain the settler-colonial state’s claims to sovereignty. Many ethnographic researchers have raised concerns over the potential impacts that the institutionalization of ethics review boards can have on social science research, especially within healthcare settings. However, few articles to-date have documented how these norms and practices play out in actuality. This paper, therefore, uses autoethnography to provide an account of three ethical challenges that arose during my process of seeking ethics approval through institutional review boards to conduct ethnographic fieldwork in a healthcare setting. In doing so, I demonstrate (...) how bureaucratic accountability took precedence over my research expertise, making the research that I initially set out to do inaccessible, questionable, and ‘unethical’, despite being carried out in accordance with the current standards governing research involving human participants and their data. I conclude with ways to move beyond this existing ethics structure towards a more collaborative approach between ethics boards, researchers, and research participants grounded within the realities of the field. This article investigates the ability of mental incapacity tests to account for problems of control, through a study of the approach to alcohol dependence and a comparison with the approach to anorexia nervosa, in England and Wales. The focus is on two areas of law where questions of legal and mental capacity arise for people who are alcohol dependent: decisions about treatment for alcohol dependence and diminished responsibility for a killing. The mental incapacity tests used in these legal contexts are (...) importantly different—one involves a ‘cognitive’ test, while the other includes an explicit impaired-control limb—and the comparison provides insight into a longstanding debate about the virtues of one type of test over the other. It is shown that both kinds of test can take control problems into account, but also that both can be interpreted in narrow and wide ways that significantly influence the outcome of the assessment. It is therefore argued that to a large extent, it is not the kind of mental incapacity test that matters, but how the test is interpreted. It is further proposed that value judgements are playing an unrecognised and inappropriate role in shaping this interpretation. This raises concerns about the current approach to assessing the impact of alcohol dependency on the capacity to make decisions about alcohol use or treatment, as well as broader concerns about flexibility within incapacity tests. In this chapter, our focus is the role played by notions of rationality in the diagnosis of mental disorders, and in the practice of overriding patient autonomy in psychiatry. We describe and evaluate different hypotheses concerning the relationship between rationality and diagnosis, raising questions about what features underpin psychiatric categories. These questions reinforce widely held concerns about the use of diagnosis as a justification for overriding autonomy, which have motivated a shift to mental incapacity as an alternative justification. However, this (...) approach too has recently been criticized from a mental disability rights perspective. Our analysis of the relationship between mental capacity and rationality is used to illuminate these concerns, and to investigate further the relationship between rationality and psychiatric diagnosis.
