In this article, I address the question of the apportionment of the consequences of organizational misconduct to individual members of the organizational elite. I argue that this process can be best understood by marrying the behavioral aspects of stigma theory to the economic mechanisms of ex post settling up. Viewed in conjunction with stigmatization, ex post settling up following organizational misconduct can be seen as the result of attempts to avoid stigma by association. Efforts at stigma avoidance on the parts (...) of various stakeholders produce the diminished social interaction associated with ex post settling up: departure from the focal firm, and loss of seats on other boards. This also suggests that the process of stigmatization, and hence ex post settling up, can be influenced by characteristics of social interaction unrelated to the misconduct itself. (shrink)

We explore how the Sarbanes–Oxley Act of 2002 created pressure for firms to take more visible and costly corrective action following the announcement of an earnings restatement. Building on theory about focusing events, the institutional effects of legislative change, and the agenda-setting role of the media, we propose that Sarbanes–Oxley created reactive normative pressure on firms that announce earnings restatements, increasing the likelihood of CEO replacement in their aftermath. We theorize that Sarbanes–Oxley changed the meaning—and therefore the impact—of media coverage (...) of earnings restatements. Our findings show that firm behavior after Sarbanes–Oxley did change in ways that are consistent with the intent of the legislation: to increase executives’ accountability for the reliability of their firms’ financial statements. Moreover, we show this change is a result both of the direct effect of the legislation on increasing CEO accountability as well as through intensifying the effect of the media spotlight on misconduct. In this paper, we examine the relation between corporate social responsibility (CSR) and firm risk in controversial industry sectors. We develop and test two competing hypotheses of risk reduction and window dressing. Employing an extensive U.S. sample during the 1991-2010 period from controversial industry firms, such as alcohol, tobacco, gambling, and others, we find that CSR engagement inversely affects firm risk after controlling for various firm characteristics. To deal with endogeneity issue, we adopt a system equation approach and difference regressions (...) and continue to find that CSR engagement of firms in controversial industry sectors negatively affects firm risk. To examine the premise that firm risk is more of an issue for controversial firms, we further examine the difference between non-controversial and controversial firm samples, and find that the effect of risk reduction through CSR engagement is more economically and statistically significant in controversial industry firms than in non-controversial industry firms. These findings support the risk-reduction hypothesis, but not the window-dressing hypothesis, and the notion that the top management of U.S. firms in controversial industries is, in general, risk averse and that their CSR engagement helps their risk management efforts. I identify and characterize the kind of personal-level control-structure that is most relevant for skilled action control, namely, what I call, “practical intention”. I differentiate between practical intentions and general intentions not in terms of their function or timing but in terms of their content. I also highlight a distinction between practical intentions and other control mechanisms that are required to explain skilled action. I’ll maintain that all intentions, general and practical, have the function specifying, sustaining, and structuring action but (...) that several functions that have been attributed to proximal intentions are actually implemented by other control mechanisms that are not themselves best identified as intentions. Specifically, I will claim that practical intentions do not initiate, monitor, specify or guide the fine-grained, online, kinematic aspects of action. Finally, I suggest that the way in which practical and general intentions should be differentiated is in terms of their content, where general intentions specify the overall goal, outcome, or end of an action as it is conceived of by the agent at a time, and practical intentions determine the means to that end. I conclude by providing empirical evidence to support this way of characterizing the intentions that “interface” with the mechanisms of motor control. Though this discussion has repercussions for action in general, I will limit my discussion to cases of skill. (shrink)

Purpose Underlying much recent development in data science and artificial intelligence (AI) is a dependence on the labour of precarious crowdworkers via platforms such as Amazon Mechanical Turk. These platforms have been widely critiqued for their exploitative labour relations, and over recent years, there have been various efforts by academic researchers to develop interventions aimed at improving labour conditions. The aim of this paper is to explore US-based crowdworkers’ views on two proposed interventions: a browser plugin that detects automated quality (...) control “Gold Question” (GQ) checks and a proposal for a crowdworker co-operative. Design/methodology/approach The authors interviewed 20 US-based crowdworkers and undertook a thematic analysis of collected data. Findings The findings indicate that US-based crowdworkers tend to have negative and mixed feelings about the GQ detector, but were more enthusiastic about the crowdworker co-operative. Originality/value Drawing on theories of precarious labour, this study suggests an explanation for the findings based on US-based workers’ objective and subjective experiences of precarity. The authors argue that for US-based crowdworkers “constructive” interventions such as a crowdworker co-operative have more potential to improve labour conditions. (shrink)

This paper examines the Bush Administration’s immigration “reform” initiative of January 2004, which proposes a guest worker category to further regulate the continuing immigration of workers into the United States. The plan is particularly intended to affect the flow of workers from Mexico. I will argue that this doesn’t represent an improvement but rather creates a deeper level of alienation for the laborer and greater control for global capital, and results in another layer of control over human subjects through the (...) regulation of identity. However, there are promising signs that global capital may be weakening, due to both internaland external forces. I don’t propose specific immigration policy changes in this paper. (shrink)

In the current literature, discussions of cognitive penetrability focus largely either on interpreting empirical evidence in ways that is relevant to the question of modularity :343–391, 1999; Wu Philos Stud 165:647–669, 2012; Macpherson Philos Phenomenol Res, 84:24–62, 2012) or in offering epistemological considerations regarding which properties are represented in perception :519–540, 2009, Noûs 46:201–222, 2011; Prinz Perceptual experience, Oxford University Press, Oxford, pp 434–460, 2006). In contrast to these debates, in this paper, I explore conceptual issues regarding how we ought (...) to understand the “cognitive” side of cognitive penetrability. I argue that it is only on its most narrow construal that a full-fledged defense of cognitive impenetrability has been forwarded. Specifically, I argue that the defenders of modularity have tacitly identified cognitive states with propositional states, and have thus only defended the idea that early perceptual systems are immune to the impacts of propositional knowledge. My aim then is to raise doubts about the identification of cognitive states with propositional ones. In particular, by focusing on skill, I will broaden the conceptual space for a greater number of states to have the potential to impact perceptual processing in a way that would constitute a genuine instance of cognitive penetrability. McCullough, Kilpatrick, Emmons, and Larson (2001) posited that gratitude prompts individuals to behave prosocially. However, research supporting the prosocial effect of gratitude has relied on scenario and self-report methodology. To address limitations of previous research, this experiment utilised a laboratory induction of gratitude, a method that is potentially more covert than scenarios and that elicits actual grateful emotion. Prosocial responses to gratitude—operationalised as the distribution of resources to another—were paired with a self-report measure of gratitude to test the prosocial effect (...) of gratitude. To investigate positive mood as an alternative explanation, this experiment compared responses of individuals receiving a favour to responses of individuals receiving a positive outcome by chance. A total of 40 participants were randomly assigned to either a Favour or Chance condition. Participants receiving a favour helped more and reported more gratitude compared to participants in the Chance condition. (shrink)

Today the IOM has a program budget of about $13 million, which includes both private and government funds, and (...) is regarded as a leading center for health policy research.After briefly explaining the structure and general goals of IOM, this article describes several new or anticipated projects as well as some recently completed reports that have a strong ethical component.The IOMThe IOM's distinguished membership is made up of health care professionals of all sorts, scientists working in health-related disciplines, and lawyers, economists, and others knowledgeable in and involved with policies and activities associated with health issues. It is organized around eight working groups or divisions: Health Sciences Policy; Health Care Services; Health Promotion and Disease Prevention, including AIDS activities; International Health; Biobehavioral Sciences and Mental Disorders; the Food and Nutrition Board; the Medical Follow-up Agency; and the Health Policy Fellowship Programs. The President's Commission for the Study of Ethical Problems in Medicine and Biomedical and Behavioral Research considered several such issues and produced important reports about them. However, the commission was funded only until 1983. The Congressional Biomedical Ethics Advisory Committee was authorized in 1985 to address these contentious issues, but it was caught in the crossfire of congressional abortion politics and subsequently died. A new model is needed to attempt to develop national consensus on these complex, contentious issues.The Board on Health Sciences Policy has wrestled with this idea. Recently, it approved a proposal to establish a study committee charged with developing effective alternative methodologies for anticipating and addressing the social, legal, and ethical issues that may accompany rapid advances in biomedical science and technology. This multidisciplinary committee will be given a series of tasks: (1) to explore past experiences with some of these varying methodologies (i.e., town meetings, consensus conferences, forums, commissions, etc.); (2) to develop an agenda of issues likely to arise in the future; (3) to define and test a variety of alternative methodological approaches to these questions; (4) to evaluate strengths, weaknesses, and impact of the various approaches; and (5) to make recommendations on the process and structure by which this fact-finding, analytical, and decision-making function could be... This paper builds on Allen's care trajectory management framework to specify evidence‐based and theoretically informed competencies for this component of the nursing role and proposes how these might be incorporated into nursing curricula. At first sight constitutionalism appears to be a key concept in public law discourse in the United Kingdom. It appears in all the major academic discussions from the rule of law and judicial review to the ‘new constitutional settlement’ and in relation to constitutional culture. And yet attempts to define the scope, meaning and role of constitutionalism remain vague. This article discusses the different fields in which constitutionalism is discussed and the different meanings that are attributed to the concept. It (...) shows that constitutionalism is routinely conflated by public law scholars with other constitutional values and principles, like the rule of law or separation of powers. This article argues that constitutionalism should either be conceived as distinct from those concepts or, failing that, can safely be eliminated from public law discourse. The article concludes by asking whether a nuanced and normative discussion of constitutionalism could have any meaningful application in the United Kingdom constitution. (shrink)

Volume 13 in _The Middle Works of John Dewey, 1899–1924_,_ _series brings together Dewey’s writings for 1921_ _and 1922,_ _with the exception of _Human Nature and Conduct. A Modern Language Association Committee on Scholarly Editions textual edition._ Ralph Ross notes in his Introduction that the 53_ _items constituting this volume “defend Dewey’s beliefs at 63 and look forward to what he was yet to write.” The essays to which Dewey responded, as well as abstracts of articles that have been published (...) only in Japanese, appear as appendixes. Volume 11 brings together all of Dewey’s writings for 1918_ _and 1919._ __A Modern Language Association Committee on Scholarly Editions textual edition._ Dewey’s dominant theme in these pages is war and its after­math. In the Introduction, Oscar and Lilian Handlin discuss his philosophy within the historical context: “The First World War slowly ground to its costly conclusion; and the immensely more difficult task of making peace got painfully under way. The armi­stice that some expected would permit a return to normalcy (...) opened instead upon a period of turbulence that agitated fur­ther a society already unsettled by preparations for battle and by debilitating conflict overseas.” After spending the first half of 1918–19_ _on sabbatical from Columbia at the University of California, Dewey traveled to Japan and China, where he lectured, toured, and assessed in his essays_ _the relationship between the two nations. As Lewis Hahn points out in his Introduction, these were “very productive years for Dewey. In addition to numerous lectures and speaking engagements and participa­tion in professional meetings, he pub­lished fifteen or so substantial articles, almost as many shorter things, (...) a syl­labus on _The Pragmatic Movement of Contemporary Thought, _a monograph on _Moral Principles in Education, _and, with J. This paper argues that superiority comparatives in Mandarin Chinese are all phrasal comparatives that can be directly interpreted, and makes a new suggestion of taking the bǐ-phrase (‘compare-phrase’) to be an adjunct and one constituent, but with bǐ-shells. This syntactic analysis allows one to combine into one phrase various compared constituents that would otherwise not be analyzed as forming a phrase by themselves. Semantically, in extension of work by Heim as well as Bhatt and Takahashi, bǐ is taken to compare (...) two sequences of arguments of a gradable predicate along the dimension given by that predicate. It is also suggested that comparatives across languages may be subject to three parameters: (i) argument-dependent comparison vs. non-argument dependent comparison, (ii) phrasal comparison vs. clausal comparison, and (iii) monoadic comparison vs. dyadic comparison. The main objective of this article is to provide a formal semantics of comparative correlatives of the form ‘ yuè …, yuè … ’ in Mandarin Chinese. A new analysis is proposed which treats the comparative correlatives as one which involves a quantificational tripartite structure and which derives all the meanings of the ‘ yuè …, yuè … ’ constructions through a comparison of degrees which relate to different or same individuals. The comparison of the same or different degrees of (...) a given property is shown to be the consequences of the general processing strategy for noun phrase interpretations suggested by Partee, as well as of the constituent structure of the sentence. It is also shown that the same semantics for Chinese yuè can be extended to the - er in English comparative conditionals, as well as to similar constructions in other languages. At the same time a superficial cross-linguistic variation from independent factors can also be derived. (shrink)
