In this paper I attempt to o f fer a concept of discretion and to an a l yse the forms of control that can be e x ercised in this matte r . F rom the concept of l e g al ce r taint y , w e can obse r v e h o w discretion eme r ges in those cases that are e n visaged b y the norms and in the so called hard cases. (...) F requent l y it is maintained h o w e v e r , that, the on l y limit on discretion can be found in arbitrariness and that, apa r t from that, a n y decision w ould be co r rect. This could result in e xcluding discretiona r y decisions from l e gal control. A g ainst this opinion, there are authors that think that l e gal control of discretionary decisions is possi b le because th e y defend the e xistence of on l y one co r rect an sw e r . Other authors reject the e xistence of on l y one co r rect an sw er or the possibility of f inding it. N e v er theless, e v en accepting that there are some aspects of discretiona r y decisions that do not der i ve from l e gal no r ms bu t from personal preferences, those preferences must be coherent with some theo r y that contains no r mat i v e l y co r rect criteria. Clinical trials are a central mechanism in the production of medical knowledge. They are the gold standard by which such knowledge is evaluated. They are widespread both in the United States and internationally; a National Institute of Health database reports over 106,000 active industry and government-sponsored trials (National Institutes of Health n.d.). They are an engine of the economy. The work of trials is complex; multiple people with diverse interests working across multiple settings simultaneously participate in them, and they are (...) underwritten by multiple organizational structures and diverse funding mechanisms. Deux constats sont à l'origine de ce livre. Le débat dans le monde académique autour du lien entre religions, sciences et espace public semble s'être fixé sur l'idée de 'post-sécularité'. Or, sous couvert de rendre les sociétés plus hospitalières aux religions, cette idée profite essentiellement à des courants politico-religieux absolutistes et fondamentalistes. Et la solide expertise francophone qui s'est développée sur le philosophe américain John Dewey (1859-1952) néglige trop souvent ses nombreux écrits consacrés à la critique des religions. Joan (...) Stavo-Debauge retrace donc la généalogie de l'idée de 'post-sécularité' et détaille les méfaits qu'elle peut masquer, comme les mobilisations contre l'avortement, les droits des personnes LGBT, l'expertise scientifique ou encore les politiques écologiques. Il s'appuie ensuite sur les écrits de John Dewey pour remettre au jour la pleine puissance de sa critique des religions fondée sur une pensée naturaliste et pragmatiste et la présenter comme un antidote efficace aux fondamentalismes religieux. Cat Wars is a dangerous book that declares war on all free-roaming cats. Filled with hyperbole and exaggerated statistics, the book argues that cats are a danger to humans, birds, and other free-living animals and should be eradicated from the landscape—a devastating, expensive, inhumane, and useless result. This review exposes the flaws in the authors’ analysis and ethical approach and redirects the dialogue toward an ethic that protects all animals. Compassionate conservationism promotes the use of nonlethal management strategies to protect (...) individual birds and other animals while compassionately reducing the number of free-roaming cats. This paper intends to make a revision of the academic literature that focuses social responsibility from a strategic view. In line with the previous ideas, the aim of this paper is to add itself to the group of researches that conceive CSR as an integral part of the business strategy. For this purpose it focuses on studying those relationships that may exist between the firm’s Business Strategy (BS) and the Social Strategy (SS). Based on the assumption that CSR can be (...) strategic to the company and that its application will be based on a social strategy, this research project, wishes to study the way in which it is considered and understood in relation to the business strategy. Mandatory reporting laws, which vary slightly from state to state, require reporting by helping professionals when there is reasonable cause to suspect child abuse. Institutional Review Boards (IRBs) require researchers to warn subjects of this duty to report, which may have a chilling effect on subject rapport and candor. Certificates of confidentiality, in conjunction with other precautions, may reduce some barriers to valid research. Attempts to resolve problems created by reporting laws must produce the most valid research, while minimizing harm (...) and distress to research participants, their families, and the researcher and meeting local and federal legal requirements. An increasing number of experiments at the Belle, BNL, CERN, DAΦNE and SLAC accelerators are confirming the violation of time reversal invariance (T). The violation signifies a fundamental asymmetry between the past and future and calls for a major shift in the way we think about time. Here we show that processes which violate T symmetry induce destructive interference between different paths that the universe can take through time. The interference eliminates all paths except for two that represent continuously forwards (...) and continuously backwards time evolution. Evidence from the accelerator experiments indicates which path the universe is effectively following. This work may provide fresh insight into the long-standing problem of modeling the dynamics of T violation processes. It suggests that T violation has previously unknown, large-scale physical effects and that these effects underlie the origin of the unidirectionality of time. It may have implications for the Wheeler-DeWitt equation of canonical quantum gravity. Finally it provides a view of the quantum nature of time itself. (shrink)

In this review I provide a brief analysis of the main features of the collective volume Shifting Concepts (Oxford University Press, 2020), edited by Teresa Marques and Åsa Wikforss. The volume addresses several related topics, and it contains contributions from psychologists and philosophers. It deals with the topic of concept variation understood in a broad sense, for it tackles diachronic, contextual, interpersonal and even intrapersonal variation; besides, the second part of the book is devoted to the topic of concept revision (...) and amelioration. I provide a brief description of the book and then I critically assess each of the contributions. (shrink)

The papers included in this supplement were first given at a meeting, The New Ethics of Abortion, organised by the British Pregnancy Advisory Service (BPAS) in Senate House at the University of London on 21 February 2000. The British Pregnancy Advisory Service is primarily a provider of abortion services. Each year, the organisation provides almost 50,000 abortions, more than half of which are performed on behalf of the National Health Service (NHS), which means they are free of charge to women. (...) We are also a major source of comment to the media on issues relating to unwanted pregnancy and so we frequently face the challenge of debating those who insist that abortion is morally wrong and medically unjustifiable. The New Ethics of Abortion was organised to provide a forum in which pro-choice and anti-choice perspectives could be discussed in an atmosphere of mutual respect. We are aware that advances in technology and changed perspectives on rights—of men, of children, of the fetus, of the disabled—can have an impact on the abortion debate. We are aware that these issues are hotly contested by both those who support and those who oppose the liberal provision of abortion, and we feel that as providers of abortion care to so many women we have an important part to play. The staff at BPAS consultation centres and clinics understand abortion from the perspective of women—not women campaigners (who have their own political agenda)—but women with problem pregnancies in need of abortion care. This is a perspective that is often pushed aside when abortion is regarded as an abstract political or ethical issue. Abortion has become accepted as a part of British life. In conversation with Hans Ulrich, this response considers the future and the path of Anglican ethics in the Reformation tradition.

This study examines the consequences of computerization for women who do information work. Syntheses of research findings from both the general social science literature and the business and management periodical literature are compared with each other. The two bodies of research results converge with respect to employment consequences and shifts in work, but differ markedly when it comes to control of the labor process and training. In contrast to social scientists, management researchers pay scant attention to differential gender effects of (...) microcomputer deployment. Similarities and differences between the two research traditions show that social science and business research, if combined, yield a better understanding of the changes prompted by new information technology. Women do most of the parenting. To provide a stable and healthier setting for children they must sublimate their own interests and feelings, which puts greater pressures on women to communicate needs clearly or to be deceptive when the occasion demands. The likely advantage in communication skills and self-control may ameliorate the impact of disorders like ADHD where the most serious deficit is in self-inhibition. This would account for the strikingly uneven male to female sex ratio of 2:1 (in epidemiological (...) samples) to 10:1 (in clinical settings), the higher threshold for females, and the sex difference in the pattern of associated mental disorders. Perhaps not wholly unrelatedly to the message of the first Obama presidential campaign, the concept of hope has been receiving increased philosophical attention in recent years. A good bit has been written on honing a definition of hope, and investigating the morally relevant territory. After a brief summary of that literature, I situate myself amongst those who advocate for hope—at its best—as a virtue, and I then suggest that hope seems to have a unique status amongst the virtues insofar as (...) it appears to be foundational for moral progress. I want to suggest that virtue generally can be seen as having an infectious quality, and that along with hope's foundational status, this infectiousness is particularly crucial as regards the development of hope for working on solutions to structural injustice. Nuclear weapons are different from every other type of weapons technology. Their awesome destructive potential and the unparalleled consequences of their use oblige us to think critically about the ethics of nuclear possession, planning, and use. Joe Nye has given the ethics of nuclear weapons deep consideration. He posits that we have a basic moral obligation to future generations to preserve roughly equal access to important values, including equal chances of survival, and proposes criteria for achieving conditional or “just deterrence” (...) to minimize the risk of nuclear use and help preserve these values. While Nye's conditions are laudable, they are not achievable. They rely on flawed assumptions about the nature of nuclear weapons and the inherent risks of the nuclear deterrence system. Since the Cold War ended, the strategy and practice of nuclear deterrence has grown riskier, more urgent, more dangerous, and less stable. It is time to rethink how we manage nuclear risks. A new nuclear security system must be built on the design principle that the consequences of system failure cannot threaten to end or fundamentally disrupt civilization. We owe the future a new nuclear security strategy that can prevent an existential global nuclear event. (shrink)
