The prohibition of commercialisation of the human body and its parts is not applied consistently and suffers from many exceptions in the human biological material (HBM) market. Examples include the possibility of patenting certain HBM-derived products and their commercial marketing or payments for blood donations. Thus, the current practice of marketing HBM-derived products makes the altruistic donor most vulnerable to exploitation while being deprived of benefits. There seem to be two ways to improve this state of affairs. The first is (...) to apply consistently the prohibition of commercialisation of the body and its parts to commercially marketed tissue and cell products as well. This would require limiting the possibility of financial gain associated with the processing, distribution and sale of HBM-based products. Such a solution, however, does not seem to gain wide acceptance or have a chance of implementation in the near future. Therefore, introducing more transparent rules and greater donor empowerment seems more reasonable by exempting HBM from the ban on commercialisation under certain conditions and with clear limitations. Clinical Ethics Consultations are an important tool for physicians in solving difficult cases. They are extremely common in North America and to a lesser extent also present in Europe. However, there is little data on this practice in Poland. We present results of a survey of 521 physicians practising in Poland concerning their opinion on CECs and related practices. We analysed the data looking at such issues as CECs’ perceived availability, use of CECs, and perceived usefulness of such support. Physicians (...) in our study generally encounter hard ethics cases, even—surprisingly—those who do not work in hospitals. Most physicians have no CEC access, and those that do still do not employ CECs. However, physicians perceive this form of support as useful—even more so among actual users of CECs. We compared these findings with similar studies from other European countries and the North America. We point out peculiarities of our results as compared to those in other countries, with some possible explanations. We hope the results may encourage regulatory debate on the need to formally introduce CECs into the Polish healthcare system. (shrink)

This article concerns the implementation of new EU Directives coordinating the procedures for awarding public contracts in European Union Member States. In a number of countries, including Poland, the process of their implementation (Directive 2014/24/eu of the European Parliament and of the Council of 26 February 2014 on public procurement; Directive 2014/25/eu of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport, and postal services sectors; Directive 2014/23/eu of (...) the European Parliament and of the Council of 26 February 2014 on the award of concession contracts) was delayed. In most cases, the modernization of EU regulations on public procurement required a thorough modification of national regulations in this respect. As a result of the introduction of the package of new Directives, the European Union public procurement market has undergone substantial changes. The need to adjust legal regulations to the changing political, social, and economic situations in a better way has resulted in the transposition of the modernized EU Directives concerning public procurement to the Polish legal system, affecting the final shape of the new Polish Public Procurement Law. The implementation of the package of new Directives has significantly affected the functioning of the Polish public procurement market. For the entities operating in this market, this means the necessity to expand their knowledge, so as to become familiar with the new legal solutions in this respect. (shrink)

BackgroundNational guidelines require programmes use subjective assessments of social support when determining transplant suitability, despite limited evidence linking it to outcomes. We examined how transplant providers weigh the importance of social support for kidney transplantation compared with other factors, and variation by clinical role and personal beliefs.MethodsThe National survey of the American Society of Transplant Surgeons and the Society of Transplant Social Work in 2016. Using a discrete choice approach, respondents compared two hypothetical patient profiles and selected one for transplantation. (...) Conditional logistic regression estimated the relative importance of each factor; results were stratified by clinical role and beliefs.ResultsFive hundred and eighy-four transplant providers completed the survey. Social support was the second most influential factor among transplant providers. Providers were most likely to choose a candidate who had social support, always adhered to a medical regimen, and had a 15 years life expectancy with transplant. Psychosocial providers were more influenced by adherence and quality of life compared with medical/surgical providers, who were more influenced by candidates' life expectancy with transplant. For providers concerned with avoiding organ waste, social support was the most influential factor, while it was the least influential for clinicians concerned with fairness.ConclusionsSocial support is highly influential in listing decisions and may exacerbate transplant disparities. Providers’ beliefs and reliance on social support in determining suitability vary considerably, raising concerns about transparency and justice. (shrink)

This entry summarizes an emerging subdiscipline of both empirical bioethics and experimental philosophy (“x-phi”) which has variously been referred to as experimental philosophical bioethics, experimental bioethics, or simply “bioxphi”. Like empirical bioethics, bioxphi uses data-driven research methods to capture what various stakeholders think (feel, judge, etc.) about moral issues of relevance to bioethics. However, like its other parent discipline of x-phi, bioxphi tends to favor experiment-based designs drawn from the cognitive sciences – including psychology, neuroscience, and behavioral economics – to (...) tease out why and how stakeholders think as they do. In recent years, countries have begun to establish ministries of transitional justice as part of political transitions from authoritarianism to democracy or from conflict to peace. This may reflect a broader historical trend in the administration of TJ, which has evolved from isolated offices within a particular ministry to ad hoc cross-ministry coordinating bodies to the establishment of dedicated ministries. The reasons for the establishment of specific ministries to pursue TJ, what we call ministerialization, have not attracted scholarly attention. This (...) article explores the causes and likely consequences of this development. In particular, it applies international relations, comparative politics, and public policy theories to explain the phenomenon. Contrary to some TJ literature that is concerned about hegemonic transnational discourse, international actors have played little to no role in shaping how TJ is bureaucratically managed. Rather, based upon fieldwork in Solomon Islands and Tunisia, the article concludes that ministerialization has been the result of domestic policy entrepreneurship. For TJ ministries to become a norm, however, more transnational actors will need to be convinced of the benefits of such an institutional arrangement. (shrink)

Introduction: A general trend in the psychological literature suggests that guilt contributes to morality more than shame does. Unlike shame-prone individuals, guilt-prone individuals internalize the causality of negative events, attribute responsibility in the first person, and engage in responsible behavior. However, it is not known how guilt- and shame-proneness interact with the attribution of responsibility to others. -/- Methods: In two Web-based experiments, participants reported their attributions of moral culpability (i.e., responsibility, causality, punishment and decision-making) about morally ambiguous acts of (...) killing in different conditions. In Study 1 the vignettes were presented in the 1st person, while in Study 2 in the 3rd person. To test proneness to guilt and shame, we utilized the GASP scale, which differentiates between the affective and behavioral components of each emotion. Statistical analyses were performed in Matlab and R. -/- Results: We found that guilt- and shame-proneness were associated with the severity of attributions in both the first and the third person, but the effect was strong only in the guilt case (both subtypes) and shame-affect case, and not in the shame-behavior case. We call this the Moralizing Effect. -/- Discussion: We wonder whether our finding that guilt-prone people tend to attribute a higher degree of culpability to others is really consistent with the view that guilt motivates people to choose the “moral paths in life”. This echoes views about the harmful aspects of guilt, which have been expressed historically in philosophy, for example, by Friedrich Nietzsche. (shrink)

In recent years, sport entities have begun to prioritise environmental sustainability initiatives in their business strategies with the aim of minimising their environmental impact and engaging stakeholders within the ES movement. There has been minimal academic consideration of the ES movement in professional sport, particularly outside of North America and Europe. The aim of the present study is to provide an overview of the type and profile of ES initiatives being undertaken and communicated to stakeholders in the Asia-Pacific region by (...) the industry bodies. Further, the study offers a conceptual model of the global-, country-, industry- and organisational-level forces impacting these sporting organisations’ ES practices. Various communication mediums of 114 professional sport teams from seven countries—Australia, India, New Zealand, Japan, China, Taiwan and Korea—were evaluated using content analysis. The results reveal low communication of ES practices by professional sport teams in the Asia-Pacific region compared to North America. Extended findings on the existing global profile of ES engagement provide a descriptive understanding of the ES movement in the Asia-Pacific region, and contribute to the identification of possible antecedents and correlatives to be evaluated in future research. In this issue, our contributors demonstrate how art in the city, art “about” the city, art compared to the city, can bring to attention the insidious forces underlying every city’s gleaming, wide-awake veneer.

This article presents the ethical implications for social science research emerging from our study on interpersonal communication after a laryngectomy. By tracing the evolution of our approach through specific research experiences and participant feedback, we provide empirical support for a flexible, multidimensional, and relational understanding of key ethical concepts, such as vulnerability and the researcher-participant relationship. Our approach has shifted from institutionally imposed rigid categorizations and somewhat stereotypical treatment of both the research group and the researcher-participant relationship to an emphasis (...) on building relationships founded on mutual care and rapport. We argue that this revised perspective fosters ethical collaboration that is beneficial and secure for all parties involved, and we offer practical examples of its implementation in research practice. During an initial palliative care assessment, a dying man discloses that he had killed several people whilst a young man. The junior doctor, to whom he revealed his story, consulted with senior palliative care colleagues. It was agreed that legal advice would be sought on the issue of breaching the man’s confidentiality. Two legal opinions conflicted with each other. The article presents partial results of nationwide research devoted to teaching ethics. It discusses the place of ethics in the Polish education system and the development trends visible since its introduction (1991). When it comes to legislature, acts and ordinances of the Minister of National Education were analyzed. Next to legal acts also judgments of the Constitutional Tribunal, regulating the principles of teaching and assessing the subject of ethics, were discussed. An important aspect of these regulations, due to their practical (...) consequences, is the positioning of ethics as an alternative to the religious education. Statistical data were also analyzed, allowing for a nationwide assessment of the development of interest in the ethics as a subject of school teaching – an increase in the number of schools in which the subject of ethics is taught (depending on the stage of education and the type of school), as well as an increase in the number of full-time equivalent for ethics teachers. The last-mentioned increase, although significant since 2014, is nevertheless small in absolute numbers; ethics still remains a niche subject. Over the years, one can observe an improvement in its status and an increase in social demand. However, the current definition of ethics as an optional subject means that the level of participation still remains low. (shrink)

Children’s linguistic and social skills develop through play with siblings, but there is little research into sibling interaction using naturally occurring data. This conversation analytic case study presents an evidence-based account of how an older sibling responds to verbal challenges from her younger sibling during free play at home. The older sibling employs prosodic, rhetorical and linguistic devices to deflect challenges while avoiding conflict. She does this by acknowledging the grounds of the challenge, before invoking privileged information or epistemic differences (...) to reject it. Structurally, the older sibling inserts extended digressions which obfuscate challenges by engaging the challenger and switching topic. These phenomena blur the traditional accept/reject response dichotomy. The findings provide insight into the complexity of a 5-/6-year-old’s challenge-defence strategies and highlight the importance of face preservation and mitigation of disagreement. We propose that the ability to respond to challenges while maintaining intersubjectivity is a component of communicative competence. (shrink)

The purpose of this study was to investigate the mediational role of relational psychological contract in social beliefs and work input attitude dependency. We analyzed data taken from employees in four different organizations operating in the Pomeranian market. A mediation analysis showed a strongly mediating role of psychological contract in the negative relationship between perception of life as a zero-sum game and work input. The motivational effect of the relational psychological contract, that is the role of job security, interesting work, (...) a career in the company, opportunities for promotion and other HRM practices prevail over the significance of personal beliefs, especially when these are negative. If the company lacks the appropriate HRM systems then day-to-day social exchanges can be crucial in modifying the social beliefs of the employee. (shrink)

Background Despite the bourgeoning of digital tools for bioethics research, education, and engagement, little research has empirically investigated the impact of interactive visualizations as a way to translate ethical frameworks and guidelines. To date, most frameworks take the format of text-only documents that outline and offer ethical guidance on specific contexts. This study’s goal was to determine whether an interactive-visual format supports frameworks in transferring ethical knowledge by improving learning, deliberation, and user experience.Methods An experimental comparative study was conducted with (...) a pre-, mid-, and post-test design using the online survey platform Qualtrics. Participants were university based early-stage health researchers who were randomly assigned to either the control condition (text-only document) or the experimental condition (interactive-visual). The primary outcome variables were learning, (measured using a questionnaire), deliberation (using cases studies) and user experience (measured using the SED/UD Scale). Analysis was conducted using descriptive statistics and mixed-effects linear regression.Results Of the 80 participants, 44 (55%) used the text-only document and 36 (45%) used the interactive-visual. Results of the knowledge-test scores showed a statistically significant difference between participants’ post-test scores, indicating that the interactive-visual format better supported understanding, acquisition, and application of the framework’s knowledge. Findings from the case studies showed both formats supported ethical deliberation. Results further indicated the interactive-visual provided an overall better episodic and remembered user experience compared with the text-only document.Conclusions Our findings show that ethical frameworks formatted with interactive and visual qualities provide a more pleasing user experience and are effective formats for ethics learning and deliberation. These findings have implications for practitioners developing and deploying ethical frameworks and guidelines (e.g., in educational or employee-onboarding settings), in that the knowledge generated can lead to more effective dissemination practices of normative guidelines and health data ethics concepts. Life typically becomes an object of reflection when it is seen to be under threat. In particular, humans have a tendency to engage in thinking about life (instead of just continuing to live it) when being confronted with the prospect of death: be it the death of individuals due to illness, accident or old age; the death of whole ethnic or national groups in wars and other forms of armed conflict; but also of whole populations, be they human or nonhuman. (...) Even though Minimal Ethics for the Anthropocene is first and foremost concerned with life--understood as both a biological and social phenomenon--it is the narrative about the impending death of the human population (i.e., about the extinction of the human species), that provides a context for its argument. "Anthropocene" names a geo-historical period in which humans are said to have become the biggest threat to life on earth. However, rather than as a scientific descriptor, the term serves here primarily as an ethical injunction to think critically about human and nonhuman agency in the universe. Restrained in tone yet ambitious in scope, the book takes some steps towards outlining a minimal ethics thought on a universal scale. The task of such minimal ethics is to consider how humans can assume responsibility for various occurrences in the universe, across different scales, and how they can respond to the tangled mesh of connections and relations unfolding in it. Its goal is not so much to tell us how to live but rather to allow us to rethink "life" and what we can do with it, in whatever time we have left. Podstawowym warunkiem udanej komunikacji za pomocą języka jest opanowanie sprawności mówienia. Z tego względu rozwój języka mówionego stanowić powinien nadrzędny cel również w kształceniu obcojęzycznym. Mówienie, które uchodzi za bardzo złożony fenomen ludzkiego działania, obejmuje w pierwszym rzędzie tzw. procesy elementarne: oddychanie, artykulację, prozodię, myślenie-mówienie, rozumienie ze słuchu oraz głośne czytanie. Ich poprawny przebieg wpływa z kolei pozytywnie na tzw. procesy kompleksowe, czyli formy dialogowe oraz monologowe w aspekcie retorycznym, a także na warunki produkcji oraz percepcji języka mówionego. Jednym z (...) elementów mówienia jest zatem głośne czytanie tekstów własnych bądź obcych, którego sukces uwarunkowany jest z jednej strony poprawnością fonetyczną, a z drugiej wynikającą z tekstu realizacją struktur rytmiczno-prozodycznych. Mimo ogromnego znaczenia głośnego czytania zarówno w życiu prywatnym jak i zawodowym wykształcenie tej umiejętności w języku docelowym w praktyce często jest pomijane. Celem niniejszego artykułu jest zatem przedstawienie sekwencji ćwiczeń, która w sposób systematyczny pozwoli opanować sztukę głośnego czytania. Jako materiał ćwiczeniowy posłuży temu celowi autentyczne teksty z gatunku "wiadomości prasowe", które z kolei ze względu na różnorodność poruszanej w nich aktualnej problematyki stanowią punkt wyjścia do wyrażania własnej opinii oraz dyskusji. The term Rhetorische Kommunikation was introduced into German–language scholarship by Brigitte Frank-Bohringer in her 1963 book of the same title and was subsequently firmly established by Helmut Geißner. It is currently used in a variety of contexts when the rhetorical dimensions of language are the focus of interest. It appears both in rhetoric manuals as well as in academic texts on the topic, including those with an empirical perspective. This contribution aims to illuminate the epistemological background to this terminology by (...) focusing on a number of linguistically relevant communication approaches. Underlying this discussion is the differentiated use of the concept as outlined here, as well as a holistic view of spoken language, grounded in a theory of action. Finally, the practical value of the term Rhetorische Kommunikation, will be emphasized, underlining the fact that its content serves as a provable basis for the systematic and goal–oriented use of rhetoric as a theme in the teaching of German as a foreign language. Unprecedented advances in medicine, genetic engineering, and demographic forecasting raise new questions that strain the categories and assumptions of traditional ethical theories. Heyd's approach resolves many paradoxes in intergenerational justice, while offering a major test case for the profound problems of the limits of ethics and the nature of value.

The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. Everyone knows what is feels like to be in pain. Scraped knees, toothaches, migraines, giving birth, cancer, heart attacks, and heartaches: pain permeates our entire lives. We also witness other people - loved ones - suffering, and we 'feel with' them. It is easy to assume this is the end of the story: 'pain-is-pain-is-pain', and that is all there is to say. But it is not. In fact, the way in which people respond to what they describe as 'painful' has (...) changed considerably over time. In the eighteenth and nineteenth centuries, for example, people believed that pain served a specific (and positive) function - it was a message from God or Nature; it would perfect the spirit. 'Suffer in this life and you wouldn't suffer in the next one'. Submission to pain was required. Nothing could be more removed from twentieth and twenty-first century understandings, where pain is regarded as an unremitting evil to be 'fought'. Focusing on the English-speaking world, this book tells the story of pain since the eighteenth century, addressing fundamental questions about the experience and nature of suffering over the last three centuries. How have those in pain interpreted their suffering - and how have these interpretations changed over time? How have people learnt to conduct themselves when suffering? How do friends and family react? And what about medical professionals: should they immerse themselves in the suffering person or is the best response a kind of professional detachment? (shrink)

Reigning regulatory frameworks for biomedical research impose on researchers and research ethics committees an obligation to protect research participants from risks that are unnecessary, disproportionate to potential research benefits, and non-minimized. Where the research has no potential to produce results of direct benefit to the subjects and the subjects are unable to give consent, these requirements are strengthened by an additional condition, that risks should not exceed a certain minimal threshold. In this article, I address the question of whether there (...) should be limits of permissible risks in non-therapeutic research involving competent and healthy subjects. Some commentators argue that competent and informed individuals should have a right to participate even in extremely risky research and that research ethics committees should never reject studies because they are too dangerous. To use David Shaw's expression, competent volunteers should have ‘a right to participate in high-risk research’. I argue that this idea is ill-founded, as it does not take into account the social mission and complex collaborative nature of research practice as well as the inequity of power between researchers and subjects. Imposition of limits on permissible risks for healthy volunteers is justified by the need to protect research enterprise and the need to protect the weaker party, namely the subjects. Also, I suggest that the best way to set boundaries on research risks is to leave the judgment of risk acceptability to research ethics committees. (shrink)

Reading is an affective and reflective relationship with a text, whether it is a new, groundbreaking monograph or one of those books that keeps getting pulled off the shelf year after year. Unlike traditional reviews, the pieces in this section may veer off in new directions as critical reading becomes an extended occurrence of thinking, being, and creation. Retromania: Pop Culture’s Addiction to Its Own Past, by Simon Reynolds. New York: Faber and Faber, 2011.

According to the paradigm view in linguistics and philosophical semantics, it is lexical semantics plus the principle of compositionality that allows us to compute the meaning of an arbitrary sentence. The job of LS is to assign meaning to individual expressions, whereas PC says how to combine these individual meanings into larger ones. In this paper I argue that the pair LS + PC fails to account for the discourse-relevant meaning of normative ‘ought’. If my hypothesis is tenable, then the (...) failure of LS + CS extends to normative language in general. The reason I offer that this is so is that semantics for normative language is, in an important respect, a substantive semantics. The ‘substantive’ in question means that the meaning of normative vocabulary in use is driven by metanormative views associated with a particular normative concept. SS rejects the model LS + CS and replaces it with a discourse-relevant semantics built around an interactional principle that ascribes to a particular surface syntactical form of ‘ought’ sentences a logical form that represents its discourse-salient normative content. In the paper I shall sketch how SS works and why it is worth serious consideration. (shrink)

The article seeks to analyze the portrayal of the Jews in two plays from the Chester mystery cycle: “Trial and Flagellation” and “The Passion.” The analysis acknowledges that the cycle is a mixture of, and a dialogue between, the universal standpoint emerging from the presentation of the biblical story of humankind and a contemporary perspective, pertaining to the reality of the viewers. Therefore, while pointing to the unique formal and structural uniformity of the cycle, which strengthens the idea of continuity (...) between the Old and the New Covenant and the role of the Israelites in the history of salvation, it also recognizes the potential of the plays to engage in the current stereotypes. The article examines how the Gospel account of Christ’s trial and death is modified through presenting the Jews as torturers, whitewashing the non-Jewish characters, and placing special emphasis on the question of Jewish ignorance. It is demonstrated how different theological and popular stances concerning the Jewish people are merged and reconciled in the Chester representation of the passion of Christ and it is argued that the plays in question retell the biblical story in such a way that the justification for the expulsion of the Jews from England could be derived from it. Background:Data representing people’s behaviour, attitudes, feelings and relationships are increasingly being harvested from social media platforms and re-used for research purposes. This can be ethically problematic, even where such data exist in the public domain. We set out to explore how the academic community is addressing these challenges by analysing a national corpus of research ethics guidelines and published studies in one interdisciplinary research area.Methods:Ethics guidelines published by Research Councils UK, its seven-member councils and guidelines cited within these were reviewed. Pojęcie rytmu znane jest powszechnie w różnych dziedzinach nauki i życia. Pojawia się ono m. in. w naukach przyrodniczych i humanistycznych, w architekturze, sztukach pięknych, w matematyce i muzyce, a nawet ekonomii. Również każdy język wyróżnia się spośród innych charakterystycznym dla niego rytmem, który decyduje o jego brzmieniu. Każda kolejna próba usystematyzowania znaczenia omawianego zjawiska wydaje się zatem - wobec jego uniwersalności - uzasadniona. Niniejszy artykuł ma przede wszystkim na celu oddzielenie pojęcia rytmu od innych pojawiających się w literaturze określeń, (...) takich jak okres czy metrum, a co za tym idzie zdefiniowanie zjawiska rytmu głównie w odniesieniu do języka mówionego, w którym to odgrywa on ogromną rolę, ułatwiając przede wszystkim jego percepcję oraz dekodowanie informacji. W definicji rytmu zostały uwzględnione jednocześnie intencjonalność, alternacja elementów oraz ich regularność względem czasu. Rezultatem rozważań jest zaproponowana w końcowym podrozdziale charakterystyka rytmu, przedstawionego jako możliwie regularne następowanie po sobie sylab, które poprzez akcent kontrastują ze sobą oraz tworzą większe jednostki. W ten sposób rozumiany rytm znaczy nie tylko specyficzne dla danego języka lub dla danego tekstu rozłożenie akcentów i ich odpowiednią fonetyczną realizację, lecz również językowo uwarunkowane - pod względem fonetycznym - odpowiednie traktowanie sylab nieakcentowanych, w zależności od tempa i stylu. A CHOICE Outstanding Academic Title 2012! Contemporary picturebooks open up spaces for philosophical dialogues between people of all ages. As works of art, picturebooks offer unique opportunities to explore ideas and to create meaning collaboratively. This book considers censorship of certain well-known picturebooks, challenging the assumptions on which this censorship is based. Through a lively exploration of children's responses to these same picturebooks the authors paint a way of working philosophically based on respectful listening and creative and authentic interactions, rather (...) than scripted lessons. This dialogical process challenges much current practice in education. The authors propose that a courageous and critical practice of listening is central to the facilitation of mutually educative dialogue. Nursing Inquiry 2013; 20: 23–29 Foucault, the subject and the research interview: a critique of methodsResearch interviews are a widely used method in qualitative health research and have been adapted to suit a range of methodologies. Just as it is valuable that new approaches are explored, it is also important to continue to examine their appropriate use. In this article, we question the suitability of research interviews for ‘history of the present’ studies informed by the (...) work of Michel Foucault – a form of qualitative research that is being increasingly employed in the analysis of healthcare systems and processes. We argue that several aspects of research interviewing produce philosophical and methodological complications that can interfere with achieving the aims of the analysis in this type of study. The article comprises an introduction to these tensions and examination of them in relation to key aspects of a Foucauldian philosophical position, and discussion of where this might position researchers when it comes to designing a study. Non-beneficial paediatric research is vital to improving paediatric healthcare. Nevertheless, it is also ethically controversial. By definition, subjects of such studies are unable to give consent and they are exposed to risks only for the benefit of others, without obtaining any clinical benefits which could compensate those risks. This raises ethical concern that children participating in non-beneficial research are treated instrumentally; that they are reduced to mere instruments for the benefit of science and society. But this would make the research (...) incompatible with the widely endorsed principle of the primacy of the human subject, which stipulates that the interests of the participating individual should prevail over the interests of science and society. This paper deals with this conflict. It analyses solutions to this problem developed in the literature, and shows that they are unsuccessful. Finally, it offers a new idea of how to reconcile the conduct of non-beneficial paediatric research with the PP. The paper argues for a new formula of the PP, and shows that it implies a specific non-comparative definition of the minimal risk threshold. (shrink)

Absolute velocities in Newtonian mechanics are commonly regarded as unmeasurable. Roberts (Br J Philos Sci 59(2):143–168, 2008) provides a justification for this thesis which appeals to the observational indistinguishability of boost-related models of Newtonian mechanics. Middleton and Murgueitio Ramírez (Australas J Philos, 2020) criticise his argumentation by pointing out that his analysis of the notion of measurement is too restrictive, and that, under a weaker analysis (based on counterfactuals), absolute velocities are measurable. Jacobs (Australas J Philos, 2020) opposes their view, (...) arguing that, on a properly formulated counterfactual-based account of measurement, absolute velocities are unmeasurable. However, in his argument, observational indistinguishability plays no role, even though, intuitively, it is very relevant for the issue of (un)measurability. This paper’s aim is to bring observational indistinguishability back to this discussion. I build upon the observation that there is an analogy between possible views on knowledge and justification on the one hand, and on measurement on the other. In particular, I explore the distinction between externalist and internalist approaches. Counterfactual-based accounts are all externalist, whereas the observational indistinguishability of boost-related models becomes relevant if we are interested in an internalist concept of measurement.
