‘Homophobia’ is shorthand for stigmatising attitudes and practices towards people who demonstrate sexual diversity. In this article, we reflect on how African Christian faith may become redemptive rather than violent in the context of lesbian, gay, bisexual, transgender and intersex forms of sexuality.

In January and February 2023, the University of Luxembourg hosted a series of four online seminars on Frank Michelman’s then just recently published book Constitutional Essentials ( CE), a book which in Frank’s own words aimed to work out the implications of Rawls' theory of political liberalism for constitutional theory and debates between constitutional lawyers regarding a number of constantly recurring questions of constitutional law. Eleven of the invited contributions to the four seminars (presentations of 15–20 minutes) plus one additional (...) contribution by Silje Langvatn, are now collected in this special issue of Philosophy & Social Criticism, followed by a response by Michelman. This introduction to the discussions between Michelman and his interlocutors begins with a brief synopsis of some of the key lines of argument that Michelman develops in CE and then moves on to survey all the arguments offered in response. In the end, works of art are the only media of complete and unhindered communication between man and man that can occur in a world full of gulfs and walls that limit community of experience. Occasionally, thoughtful people familiar with both Walt Whitman and philosophical pragmatism will remark on their affinity.1 Some have even argued, correctly, that Whitman influenced American pragmatism, especially the writings of William James and to a lesser extent John Dewey.2 For instance, Raphael C. Expecting Saving Mr. Banks to be a jolly jaunt about the creative development of the movie Mary Poppins (1964), I found myself waiting endlessly for the “jolliness” to begin—it never did. In fact, rather than joy, there was an ever-present sensation of tension as I watched the film. Having moved house myself in recent days (during a Queensland heat wave), the scenes of the Goff family leaving their home and trekking across hot, dusty Queensland were very emotional. However, seeing the (...) family patriarch Travers Goff (played by Colin Farrell) swig from an alcohol flask in a desperate manner told me that his was no “routine” family move. And, certainly, arriving at their destination—a dilapidated ranch home—shed even more light on the Goff family’s predicament: alcoholism and the cycle of employment and unemployment. What does the word clinic mean? The clinic is first a place to diagnose and treat sick persons. The clinic is also a way of thinking and speaking; it is a discursive practice that links health with knowledge. For Michel Foucault the clinic is a mode of perception and enunciation that allows us to see and name disease and to place statements about illness among statements about birth and death. Within the clinic resides understanding of disease visible on the surface, (...) yet hidden within the tissual depths, of an ailing patient. Foucault shows that by the dawn of the nineteenth-century medicine is no longer a two-dimensional reading of symptoms, but a three-dimensional probing from symptomatic surface into disease interior. The anatomical site of disorder hidden within tissual depths is visible to the scrutiny of pathologist, endoscopist or radiologist. The clinic, a discourse that enables us to think about disease when we make statements about health and death, operates not only in its familiar textual domain, the medical journal, but in pictures of the scene at the sickbed, and poetry about disease. The truth of disease and placement of that truth in a general plan of the world in Renaissance woodcuts and John Donne's poetry is different from the regime of truth after the birth of the clinic in Bichat'sTreatise on Membranes, the paintings of Laennec, Agnew and Gross, the modern lithographs and the verse of Walt Whitman and L. Part of the project Immortal Literature Series of classic literature, this is a new edition of the classic work published in 1901-not a facsimile reprint. Obvious typographical errors have been carefully corrected and the entire text has been reset and redesigned by Pen House Editions to enhance readability, while respecting the original edition."A Problem in Greek Ethics" is an account of (...) sexuality between men in all its forms, with Greek culture as a backdrop. Perhaps the best description of "A Problem in Greek Ethics" is this one in "Queer Religion" (Praeger, 2012, edited by Donald L. Boisvert and Jay Emerson Johnson, pp. 180-181): "Published at the turn of the century, 'A Problem in Greek Ethics' is a systematic and well-documented exposition of the role of homosexuality in the different historical periods of ancient Greek society. Throughout most of his work, Symonds prefers to use the term 'paiderastia' to 'homosexuality,' the latter a term he only uses in rare instances. Nevertheless, 'paiderastia,' in Symonds's work, amounts to a broad concept of homosexuality rather than to our current concept of pederasty. Whitman and his work are never mentioned by Symonds in 'A Problem in Greek Ethics,' but the conceptual connection had already been made explicit in Walt Whitman: 'A Study' eight years earlier. In the introductory lines to 'A Problem in Greek Ethics,' the reader is alerted that ancient Greece offers a unique example in history of 'a great and highly developed race not only tolerating homosexual passions, but deeming them of spiritual value, and attempting to use them for the benefit of society.' According to Symonds, while homosexual relations were not prominent in the so-called heroic age of Greece, it was nevertheless the love of Achilles for Patroclus, as narrated by Homer, that conferred in a later age of Greek history an almost religious sanction to the martial form of paiderastia. This episode in the Iliad inspired in later generations an ideal of manly love, which he describes as 'a powerful and masculine emotion, in which effeminacy had no part, and which by no means excluded the ordinary sexual feelings.' To which he adds that the tie created by these relationships was 'both more spiritual and more energetic [than] that which bound man to woman.' While Homer knew not about homosexuality, very early in Greek history paiderastia became a national institution giving rise, according to Symonds, to a distinction between a noble, spiritual, form of masculine passion, which he calls "heroic love," and a base and sensual one, which he identifies as 'vulgar love.'"About the Author: John Addington Symonds was born in Bristol, England, in 1840. He was an English poet, an author of several works, and a literary critic. In 1873 he wrote "A Problem in Greek Ethics," which discussed homosexuality between men. He printed ten copies in 1883, before effectively publishing the book in 1901. He was also known for his work on the Renaissance, as well as for his translations and biographies. He wrote "Our Life in the Swiss Highlands" (1891), biographies of Philip Sidney (1886), Ben Jonson (1886) and Michelangelo (1893), several volumes of poetry and essays, and a translation of the "Autobiography of Benvenuto Cellini" (1887). John Addington Symonds died in Rome in 1893. In 1896, Havelock Ellis published, in German, prepared with the collaboration of Dr. Hans Kurella, "Das konträre Geschlechtsgefühl" (Leipzig, by Georg H. Wigand's Verlag), later revised and published by Ellis as "Sexual Inversion"-the first medical text in English about homosexuality, which he had co-authored with Symonds, and which would become a part of Ellis's six-volume "Studies in the Psychology of Sex.". It is often argued that a shared culture, or at least shared cultural references or practices, can help to foster peace and prevent war. This essay examines in detail and criticizes one such argument, made by Patrick Leigh Fermor, in the context of his discussing an incident during World War II, when he and a captured German general found a form of agreement, a ground for peace between them, in their both knowing Horace's ode I.9 by heart in Latin. Darwinism as Religion is an innovative and exciting approach to this revolution through creative writing, showing how the theory of evolution as expressed by Darwin has, from the (...) first, functioned as a secular religion. Drawing on a deep understanding of both the science and the history, Michael Ruse surveys the naturalistic thinking about the origins of organisms, including the origins of humankind, as portrayed in novels and in poetry, taking the story from its beginnings in the Age of Enlightenment in the 18th century right up to the present. John Hospers argues that it is logically possible for an iron bar to float in water even if it is actually (empirically) impossible. My point in this piece is that Hospers relies on viewing the floating out of context, in Walt Disney fashion; but that is no way to establish any kind of possibility. The theme for this year’s sessions was “Ritual and Its Connection to Ethical Activity in the World.”The Friday afternoon panel, moderated by John Berthrong (Boston University), focused on Buddhist views. (...) John Makransky (Boston College) argued from a Mahayana Buddhist perspective that ritual/contemplative activity is a more effective paradigm for contemporary Buddhist ethics than that of Buddhist doctrine, which is now regarded by many as the source of Buddhist ethics. Historically, ethics has been the outflow of ritual activity and as such is both available to many more Buddhists than doctrine and draws more fully upon the various resources of the tradition. Furthermore, rituals as communal/universal expressions of ultimate reality, when practiced within the horizon of the concerns of one’s culture, naturally take expression in forms of social engagement. Stephanie Kaza (University of Vermont) provided insight into the connection between ritual practice and ethics through her vivid explanation of specific Zen rituals. One such ceremony, adapted to address human suffering in a specific situation, took place at the Nevada Nuclear Test Site. The ceremony prepared people for the difficult decision of choosing or not choosing civil disobedience. Thus, Zen rituals not only provide the invitation for mindful awareness in daily life, but also the possibility, though not the guarantee, for transformation everywhere. Yukio Matsuda (University of Heidelberg) discussed the relation between ritual and social activities in the areas of peace, culture, and education in Nichiren Buddhism as practiced by the Soka Gakkai movement. Chanting the diamoku in front of the gohonzon, for example, enables one to directly touch one’s own enlightened life and encourages not only a responsibility for changing one’s own destiny, but also a commitment to social engagement that works toward the creation of a peaceful society. Don Mitchell (Purdue University), responding from a Roman Catholic perspective, stressed those aspects of the three papers that led him to a better understanding of his own tradition. As in Buddhism, he sees the ritual sacraments in Christianity as providing models for moral behavior, reinforcing faith, and [End Page 175] empowering ethical behavior. He also raised several issues pertaining to the reinterpretation of Buddhist rituals or even the creation of new ones by Western Buddhists.John Berthrong introduced the Saturday morning panel, which focused on Christian views. Nicholas Groves (Chicago Public Library) drew on the history of the Oxford Movement, which he traced from its inception in 1833, for his example of the influence of Christian ritual upon ethics. For this movement, ritual was both an expression of the Christian doctrines of the Incarnation and the Trinity and the basis of an imperative for social justice. Baptism and the Eucharist commemorate past historical events that are made present in the liturgy in such a way that the participating Christians not only receive God’s gift of unlimited love, but also are sent out into the world to live out this love in ethical behavior. Christian ritual confronts the participants with the question, What is now required? Responding from a history of religions perspective, Jan Nattier (Indiana University) raised several questions for discussion: How does ritual—not the theological ideas behind it—empower social action? Would there be Christian social activists without the ritual of the Eucharist? What are the political factors, past and present, that have created a shared sense of the necessity of social action across the boundaries of such radically different traditions as Buddhism and Christianity? On the night of 12 November 1958, Walt Whitman witnessed a meteor shower which he later described in his notebook. The lines never found their way into a published piece. But when he came to write his poem about the year 1859-60, the year in which Abraham Lincoln and Stephen Douglas contested the presidency, John Brown was hanged in Virginia, and the mighty British iron steamship the Great Eastern arrived in New York on its maiden voyage, he remembered the (...) heavenly phenomenon of the year before and began his poem, “Year of meteors! brooding year!”1Brooding, indeed, because this poem, the first version of which was completed after the Civil War, is concerned with the year in which South Carolina seceded from the United States, thereby plunging the union of Whitman’s celebrations into bloody divisiveness. Yet the onset of that event is never mentioned in the poem. Rather, its imminence is expressed in the meteor imagery—the portent of human history written in the heavens, a fairly rare example of Whitman employing a traditional literary convention.Among the events of the “Year of meteors,” and seemingly the least of them, certainly the one that appears most unconnected with the “brooding,” “transient,” “strange” atmosphere invoked in the poem, is the visit Edward, Prince of Wales, paid to New York on 11 October 1860 . The Normative Commitments of Liberal Democracy This paper thematises an unresolved tension in Johan van der Walt’s attitude towards ‘the unreasonable other’ who challenges the liberal democratic regime. This tension results from his reluctance to provide a more explicit account of the normative commitments of liberal democracy. Van der Walt’s analysis is characterized by a ‘fear of substance,’ which is, however, based on a false dichotomy between pure proceduralism and metaphysical substantivism. It similarly reveals a ‘fear of a democratic ethos,’ (...) which is, in turn, based on a false dichotomy between a proceduralistic ethics of civility and a metaphysically rooted ethos. These fears often lead Van der Walt to misrepresent the views of both John Rawls and Jürgen Habermas and, consequently, to obscure the promising ways in which they provide a normatively explicit account of liberal democracy that allows us to deal with the antagonistic enemy of liberal democracy in a more consistent and convincing manner. In this remarkable study, David A. J. Richards combines an interpretive history of culture and law, political philosophy, and constitutional analysis to explain the background, development, and growing impact of two of the most important and challenging human rights movements of our time, feminism and gay rights. Richards argues that both movements are extensions of rights-based dissent, rooted in antebellum abolitionist feminism that condemned both American racism and sexism. He sees the progressive role of such radical dissent as an emancipated (...) moral voice in the American constitutional tradition. He examines the role of dissident African Americans, Jews, women, and homosexuals in forging alternative visions of rights-based democracy. He also draws special attention to Walt Whitman's visionary poetry, showing how it made space for the silenced and subjugated voices of homosexuals in public and private culture. According to Richards, contemporary feminism rediscovers and elaborates this earlier tradition. And, similarly, the movement for gay rights builds upon an interpretation of abolitionist feminism developed by Whitman in his defense, both in poetry and prose, of love between men. Richards explores Whitman's impact on pro-gay advocates, including John Addington Symonds, Havelock Ellis, Edward Carpenter, Oscar Wilde, and André Gide. He also discusses other diverse writers and reformers such as Margaret Sanger, Franz Boas, Elizabeth Stanton, W. E. B. DuBois, and Adrienne Rich. In lieu of an abstract, here is a brief excerpt of the content:Bob Dylan’s “Highway Shoes” The Hobo-Hero’s Road through ModernityTodd Kennedy (bio)In the final verse of Bob Dylan’s “Don’t Think Twice, It’s Alright” (1963), the speaker proclaims, “I’m walkin’ down that long, lonesome road, babe / where I’m bound, I can’t tell.” With no destination in sight, he seems content to remain on a perpetual, isolated journey on what he terms “the dark side of the road.” Such an ethos (...) of movement, which permeates Dylan’s corpus, mirrors a dissident strain of American culture that seeks to find a Jeffersonian, individualistic freedom via movement through space outside of mainstream society. As early as Bringing It All Back Home (1965), peaking with Blood on the Tracks (1975), and persisting into his most recent work, Dylan has consistently merged aspects of blues, country, and literary traditions, to invoke images of mobility that examine individual freedom in a world where technology, fragmentation, and homogeneity seem to result in a destructive dehumanizing of individuals. In so doing, Dylan uses an intensely innovative aesthetic as he ambivalently romanticizes uprooted wandering in a manner that both mirrors and expands upon what I term an ontology of the hobo-hero that permeates American letters from Walt Whitman to John Dos Passos (and beyond) as it glorifies those who remain in constant motion in order to maintain a sense of integrated self in the face of crushing modernity.Gilles Deleuze and Félix Guattari similarly identify such an ontology within American culture when they, in A Thousand Plateaus, declare America a “special case” defined by its ceaseless search for a “rhizome,” or a “space in which two things that have nothing to do with one another form a parallel constructed by the mind. In other words, Deleuze and Guattari admit that America “is not immune from [...] the search for roots” in its “quest for a national identity or even for a European ancestry or genealogy (Kerouac going off in search for his ancestors),” yet they adamantly assert,every thing important that has happened or is happening takes the route of the American rhizome [...]. American books are different from European books, even when Americans set off in search of trees. The conception of the book is different. Leaves of Grass. And directions in America are different: the search for arborescence and the return to the Old World occur in the East. But there is the rhizomatic West, with its Indians without ancestry, its ever-receding limit, its shifting and displaced frontiers.(19) [End Page 37]Such an assertion should come as no surprise, I would argue, since, beginning with the earliest attempts to define “America,” Americans have seen their identity linked to mobility. In fact, the lone commonality that Americans share is descent from immigrants who came to the United States from a “home” or “homeland” where cultural identity was not far removed from national identity. It would stand to reason, therefore, that a group of uprooted individuals thrust into a self-declared melting pot would begin to define themselves by their dislocation. For instance, eighteenth-century French immigrant J. Hector St. John de Crèvecœur claimed that, within the American continent, “individuals of all nations are melted into a new race of men” (44) as America represents, for Crèvecœur, an “asylum” in which “the poor of Europe have by some means met together” (42). Crèvecœur proceeded to privilege those people, such as farmers, who planted “roots” as they helped to build and improve their society, but Crèvecœur’s assertion that we are united by our mutual uprootedness proves indicative of what critic Robert James Butler has observed as a recurrent American “quest for pure motion” (80, emphasis in original). Or, one encounters what the novelist John Steinbeck claimed he perceived in “nearly every American”: a “burning desire to go, to move, to get under way, anyplace, away from any Here” (10). Recent debates over American liberalism have largely ignored one way of understanding democratic purposes that was widely influential for much of American history. This normative conception of democracy was inspired by philosophical ideas found in people such as John Stuart Mill and G. W. F. Hegel rather than by rights-based or civic republican theories. Walt Whitman and John Dewey were among its notable adherents. There is much that can be said on behalf of Richard Rorty's recent argument that (...) American liberals would be well advised to recover and reclaim the heritage of Whitman and Dewey; but some additions and emendations to his construction of these champions of democracy would strengthen his case. The rise of unethical leadership practices suggests a need to emphasise value-based workplaces and leadership, encompassing workplace spirituality and spiritual leadership. Most previous research focusing on ethical behaviour in the work context has been conducted with larger organisations. This study examines the influence of workplace spirituality and spiritual leadership on ethical behaviour within the small business context. A quantitative survey research design was employed. The final sample consisted of 385 employees of small, medium, and micro enterprises (SMMEs) in various industries (...) in a central district of South Africa. Structural equation modelling was utilised during the data analysis process. The study revealed that workplace spirituality and spiritual leadership had a positive and statistically significant influence on ethical behaviour in SMMEs, and workplace spirituality mediates the relationship between spiritual leadership and ethical behaviour. The study extends on existing literature as this relationship has previously not been investigated in the African small business context. Also, the findings hold practical significance for small businesses struggling with unethical behaviours and leadership. The findings of the study imply that a culture of spirituality in the workplace enhances the impact of spiritual leadership in promoting ethical behaviour in the small business environment. (shrink)

A common working assumption of theories of statutory interpretation is that the object of interpretation is uncontroversial. It is assumed that dispute only centers on the epistemics of interpretation. The assumption is unsound. Theories of statutory interpretation are importantly different from other sorts of theories. The subject matter of other sorts of theories can be identified uncontroversially. In the case of statutory interpretation, the object of interpretation is controversial. What counts as the object of interpretation therefore needs specification. Without the (...) required specification, criteria of evidence and warrant justifying an interpretation are not well-defined.An adequate theory of statutory interpreation must contain both epistemic and ontological components. It must provide criteria for treating information as evidence relevant to, and standards for, interpreting a statute. Providing such criteria in turn requires also giving an account of the object of interpretation — what a statute consists in. Practical reason theories fail to provide acceptable criteria and standards for interpreting a statute. These accounts therefore fail to supply an adequate epistemic components for a theory of statutory interpretation. As to the ontological component, things are less clear. I have argued in sections II and III that this component is partly a matter of substantive political theory. Although practical reason theorists fail to offer a substantive political theory for defining the proper object of interpretation, their accounts are in principle ontologically unobjectionable. At most, practical reason accounts are incomplete. Of course, practical reason accounts might still be defective for other reasons. They may invoke a defective substantive political theory. Or the constraints imposed on properties of a statute or relations between them may not in fact affectuate the goals set by the theory. Such failings would be normative, not metaphysical. Since practical reason accounts are epistemically inadequate and ontologically incomplete, legal theorists should find the accounts less attractive than they do, even putting aside the normative soundness of the accounts.
