A number of increasingly sophisticated technologies are now being used to support complex decision-making in a range of contexts. This paper reports on work undertaken to provide decision support in the discretionary domain of sentencing by referring to a recently created Toulmin argument based model that involves the interplay and weighting of relevant rule-based and discretionary factors used in a decisional process. Judicial discretion, particularly in the sentencing phase, is one of the mainstays of justice systems that favour individualised justice. (...) The study discusses the modelling process in Victorian courts in Australia, where the handing down of an appropriate custodial or non-custodial sentence requires the consideration of many factors. Tools and techniques used to capture relevant expert knowledge and display it both as a paper model and as an online prototype application are discussed. (shrink)

John Woods' The Logic of Fiction, now thirty-five years old, is a ground-breaking event in the establishment of the semantics of fiction as a stand-alone research programme in the philosophies of language and logic. There is now a large literature about these matters, but Woods' book retains a striking freshness, and still serves as a convincing template of the treatment options for the field's key problems. The book now appears in a second edition with a new Foreword by Nicholas (...) Griffin and an extended bibliography covering the period 1969-2009. Currently in the United Kingdom, anyone donating gametes has the status of an open-identity donor. This means that, at the age of 18, persons conceived with gametes donated since April 1, 2005 have a right to access certain pieces of identifying information about their donor. However, in early 2015, the UK Parliament approved new regulations that make mitochondrial donors anonymous. Both mitochondrial donation and gamete donation are similar in the basic sense that they involve the contribution of gamete materials to (...) create future persons. Given this similarity, this paper presumes that both types of donor should be treated the same and made open-identity under the law, unless there is a convincing argument for treating them differently. I argue that none of the existing arguments that have been made so far in favor of mitochondrial donor anonymity are convincing and mitochondrial donors should therefore be treated as open-identity donors under UK law. Nowadays, science is treated an instrument of policy, serving the material interests of government and commerce. Traditionally, however, it also has important non-instrumental social functions, such as the creation of critical scenarios and world pictures, the stimulation of rational attitudes, and the production of enlightened practitioners and independent experts. The transition from academic to ‘post-academic’ science threatens the performance of these functions, which are inconsistent with strictly instrumental modes of knowledge production. In particular, expert objectivity is negated by entanglement with (...) political and commercial interests. We cannot go back to the old academic model for science, but need to consider how to maintain its vital non-instrumental roles. (shrink)

Abstract This paper attempts to clarify the debate between those philosophers who hold that the development of science is governed by objective standards of rationality and those sociologists of science who deny this. In particular it focuses on the debate over the ?symmetry thesis?. Bloor and Barnes argue that a properly scientific approach to science itself demands that an investigator should seek the same general type of explanation for all decisions and actions by past scientists, quite independently of whether or (...) not she or he happens to agree with those decisions or approve those actions as ?correct? or ?rational?. I try to improve on previous treatments of the ?rationalist? position (by Lakatos, Laudan, Newton?Smith and Brown) and clarify the exact asymmetries to which the ?rationalist? is, and is not, committed. Barack Obama has called him “one of my favorite philosophers.” John McCain wrote that he is “a paragon of clarity about the costs of a good war.” Andrew Sullivan has said, “We need Niebuhr now more than ever.” For a theologian who died in 1971, Reinhold Niebuhr is maintaining a remarkably high profile in the twenty-first century. In _Why Niebuhr Now?_ acclaimed historian John Patrick Diggins tackles the complicated question of why, at a time of great uncertainty about (...) America’s proper role in the world, leading politicians and thinkers are turning to Niebuhr for answers. Diggins begins by clearly and carefully working through Niebuhr’s theology, which focuses less on God’s presence than his absence—and the ways that absence abets the all-too-human sin of pride. He then shows how that theology informed Niebuhr’s worldview, leading him to be at the same time a strong opponent of fascism and communism and a leading advocate for humility and caution in foreign policy. This study locates what is happening to teachers' work in the global economy. Two case studies show how teachers are simultaneously experiencing significant changes to their work, and responding in ways that actively shape these process.

The present paper examines the arguments and data presented by Nisbett and Wilson relevant to their thesis that subjects do not have access to their own cognitive processes. It is concluded that their review of previous research is selective and incomplete and that the data they present in behalf of their thesis does not withstand a demand characteristics analysis. Furthermore, their use of observer-subject similarity as evidence of subjects' inability to access cognitive processes makes tests of their hypothesis confounded and, (...) at the same time, reveals limitations in the application of the pre-inquiry quasi-control to research on social behavior. Problems with postexperiment questionnaires, such as the demand characteristics of the inquiry procedure are also considered. Although there are difficulties in assessing subjects' cognitive processes, many of these may be overcome through the application of novel techniques and research conducted on more traditional methods. In contrast to the view that subjects have limited access to cognitive processes and that their verbal reports are not valid, it is concluded that subjects' verbalizations are a rich source of psychological data which must be pursued if we are to tap their cognitive processes and are to gain an adequate understanding of human behavior. This second set of papers by John Rist is concerned with attempts by (mostly pagan) thinkers in Greco-Roman antiquity to understand the nature of morality against a background of wide-ranging debate about the relationship between soul and body and the necessity for a correct psychology and physiology if the 'good life for man' is to be revealed. Three papers are on Plato, whose elaborate mix of ethics, psychology and metaphysics sets the stage for most of the debate; one is (...) on Aristotle, five are on the Stoics and five on Plotinus. A further study deals with the general problem of the relationship between ethics, cosmology and biology, and the series concludes with the crisis among both pagans and Christians in late antiquity over whether man is naturally good enough to correct his own moral weakness. This book presents reverse mathematics to a general mathematical audience for the first time. Reverse mathematics is a new field that answers some old questions. In the two thousand years that mathematicians have been deriving theorems from axioms, it has often been asked: which axioms are needed to prove a given theorem? Only in the last two hundred years have some of these questions been answered, and only in the last forty years has a systematic approach been developed. In Reverse (...) Mathematics, John Stillwell gives a representative view of this field, emphasizing basic analysis--finding the "right axioms" to prove fundamental theorems--and giving a novel approach to logic. Stillwell introduces reverse mathematics historically, describing the two developments that made reverse mathematics possible, both involving the idea of arithmetization. The first was the nineteenth-century project of arithmetizing analysis, which aimed to define all concepts of analysis in terms of natural numbers and sets of natural numbers. The second was the twentieth-century arithmetization of logic and computation. Thus arithmetic in some sense underlies analysis, logic, and computation. Reverse mathematics exploits this insight by viewing analysis as arithmetic extended by axioms about the existence of infinite sets. Remarkably, only a small number of axioms are needed for reverse mathematics, and, for each basic theorem of analysis, Stillwell finds the "right axiom" to prove it. By using a minimum of mathematical logic in a well-motivated way, Reverse Mathematics will engage advanced undergraduates and all mathematicians interested in the foundations of mathematics. In this paper I defend a pairing of the “Epistemic Criterion” and of the “Momentousness Criterion” from a critique in Clayton and Stevens’s advocacy of the “Acceptability Requirement.” I argue that where it is valuable for people to set their own ends, they can only fully meaningfully do this in light of facts and free of misinformation. It is the duty of educators to put them in this position; it is then students' prerogative to fail to live meaningfully. While children (...) have no duty to perfect themselves, they do have a right to invent themselves, but they cannot do this is ignorance: if their life is meaningless because they chose as well as they could without being informed, then they could not truly consent to the life they undertook, and did not have a realistic chance at a meaningful life.
