Much attention has been focused in recent years on the ethical acceptability of physicians receiving gifts from drug companies. Professional guidelines recognize industry gifts as a conflict of interest and establish thresholds prohibiting the exchange of large gifts while expressly allowing for the exchange of small gifts such as pens, note pads, and coffee. Considerable evidence from the social sciences suggests that gifts of negligible value can influence the behavior of the recipient in ways the recipient does not always realize. (...) The essays in this volume, first published in 1986, examine the philosophical foundations of social choice theory. This field, a modern and sophisticated outgrowth of welfare economics, is best known for a series of impossibility theorems, of which the first and most crucial was proved by Kenneth Arrow in 1950. That has often been taken to show the impossibility of democracy as a procedure for making collective decisions. However, this interpretation is challenged by several of the contributors here. Other central (...) issues discussed in the volume include the possibility of making interpersonal comparisons of utility, the question of whether all preferences are equally to be valued, and the normative individualism underlying the theoretical tradition. Jon Erling Litland’s “Meta-Ground” is concerned with the question: If A grounds B, what grounds the fact that A grounds B? His chapter begins by discussing what turns on this question. The chapter then compares the two main existing solutions to the problem of meta-ground. It ends by discussing how the problem of meta-ground is connected to other issues in the theory of ground and what are the main issues for future research.

The article addresses the potential impact of functional brain imaging (functional magnetic resonance imaging and positron-emission tomography) on surrogate end-of-life decision-making in light of varying state-law definitions of consciousness, some of which define awareness behaviorally and others functionally. The article concludes that, in light of admonitions by neuroscientists that functional brain imaging cannot yet replace behavioral evaluation to determine the existence of consciousness, state legislatures, courts and drafters of written advance healthcare directives should consider treating behavior, not function, as the (...) touchstone for end-of-life decision-making. The oeuvre of Hegel, like that of many thinkers of the post-Kantian tradition in European philosophy, has been subject to a number of misreadings and misrepresentations by both specialists and nonspecialists alike that have until fairly recently rendered Hegel’s reception in the Anglo-American philosophical world extremely problematic. These often willful misrepresentations, variously referred to by scholars as the Hegel myths or legends, have given rise to a number of prejudices against Hegel’s philosophy primarily, although by no means exclusively, in the (...) English-speaking world. Among the caricatures that have enjoyed the widest currency are the following: that Hegel denied the law of contradiction; that his dialectical method of argumentation took the form of the thesis-antithesis-synthesis triad; that he saw the end of history in his own philosophical system; that he tried to prove a priori the number of planets; that he was a reactionary apologist for the Prussian state, or worse, a protofascist; finally, that he was a kind of pre-Kantian metaphysician or “cosmic rationalist” who believed like Schelling and some of the Romantics in a metaphysical world soul. "In his The Condition of the Working Class in England, Friedrich Engels outlines systematically the miseries of the workers in England in the context of industrialization. A key to his argument concerns the interface between the human body and the machine. In this article I argue that Engels provides a kind of a phenomenology of the body in his analyses of the relation of the worker to the new machines. The limited secondary literature on Marxism and phenomenology has not been (...) attentive to the detailed attention that is given to the body of the worker in this book. On April 16, 2007, Cho Seung-Hui used two semiautomatic handguns to kill 32 persons and then himself at Virginia Tech University in the largest campus shooting in U.S. history. Mr. Cho purchased his handguns from a pawnshop and a gun store in Virginia, where under state law a background check was conducted to determine whether he had any disqualifying criminal or mental health history. The paperwork for the background check was completed at the gun store, and the check itself was (...) conducted through an “instant” system facilitated by a toll-free telephone number. The entire transaction took approximately 20 minutes. At no point was Mr. Cho asked why he wished to purchase the guns. And although he had been deemed a potential danger to himself by a state magistrate in 2005 – which should have disqualified his purchase of a gun under federal law – this information never reached those conducting the background check. Important discussions about limiting care based on professional judgment often devolve into heated debates over the place of physicians in bedside rationing. Politics, loaded rhetoric, and ideological caricature from both sides of the rationing debate obscure precise points of disagreement and consensus, and hinder critical dialogue around the obligations and boundaries of professional practice. We propose a way forward by reframing the rationing conversation, distinguishing between the scale of the decision and its context avoiding the word “rationing.” We propose to (...) shift the terminology, using specific, descriptive words to defuse conflict and re-focus the debate towards substantive issues. These distinctions can clarify the real ethical differences at stake and facilitate a more constructive conversation about the clinical and social responsibilities of physicians to use resources ethically at the bedside and their role in allocating medical resources at a societal level. Hegel is known for coining the word “phenomenology” as a description of the methodological approach that he pursues in the famous work that bears this title. It has long been an open question the degree to which the later philosophical school of phenomenology in fact follows the actual method developed by Hegel or if it merely co-opted the name and applied the term in a new context. While Husserl was dismissive of Hegel, the French phenomenologists were generally receptive to Hegel’s (...) conception of phenomenology. This chapter argues that there are in fact some important points of continuity and that the French phenomenological school’s understanding of Hegel as a forerunner of their movement is quite legitimate. In recent years interest in the thought of Kierkegaard has grown dramatically, and with it the body of secondary literature has expanded so quickly that it has become impossible for even the most conscientious scholar to keep pace. The problem of the explosion of secondary literature is made more acute by the fact that much of what is written about Kierkegaard appears in languages that most Kierkegaard scholars do not know. Kierkegaard has become a global phenomenon, and new research traditions (...) have emerged in different languages, countries, and regions. The present volume is dedicated to trying to help to resolve these two problems in Kierkegaard studies. Its purpose is, first, to provide book reviews of some of the leading monographic studies in the Kierkegaard secondary literature so as to assist the community of scholars to become familiar with the works that they have not read for themselves. The aim is thus to offer students and scholars of Kierkegaard a comprehensive survey of works that have played a more or less significant role in the research. Second, the present volume also tries to make accessible many works in the Kierkegaard secondary literature that are written in different languages and thus to give a glimpse into various and lesser-known research traditions. In all his works, Hegel makes very few references to the unconscious. In fact, the account is limited to only a few passages in his Encyclopaedia of the Philosophical Sciences; and these do not explicitly develop a formal theory of the unconscious. Yet Hegel does not completely ignore the issue. In the Encyclopaedia, as outlined in Petry’s presentation of Hegel’s Philosophy of Subjective Spirit, Hegel describes the unconscious processes of intelligence as a “nightlike abyss.” It is important to understand what (...) Hegel means by this “abyss” and what role it plays in the life of subjective spirit. But with a few noteworthy exceptions, which focus on Hegel’s theory of mental illness, Hegel’s treatment of the unconscious has been largely overlooked. In this essay, therefore, I will explore Hegel’s treatment of the abyss in mental life and explain how this constitutes a position on the unconscious. (shrink)

It is widely apparent in our hyper-globalized world that the epistemologies, institutions, and practices underwriting it have reached a state of profound crisis. In the globalized world, everything is inevitably brought into proximity and correlation. Wars, natural disasters, climatic upheaval, nor political and economic turmoil, none of these can be effectively isolated, insulated, instituted, even immunized, as something apart, something that might be considered proper only to itself. And at times they fail to understand what I was trying to do, or they advance objections that I cannot accept. There is a definite stress on the primacy of An Enquiry concerning Human Understanding over A Treatise of Human Nature by the so-called New Humeans, who in turn, advocate the sceptical/causal realist interpretation of Hume's empiricism. This paper shows how there has been a deliberate attempt by them to omit and distort certain negative aspects of Hume's life in the belief that in order to accept their interpretations we must first acknowledge that, (1) the Enquiry is the superior text and, (...) (2) reject any criticisms suggesting that Hume only wrote it to help promote the Treatise and fulfil his ambitions for literary fame. (shrink)

This paper examines Grotius's knowledge of Stobaeus's magnificent anthology of classical literature. After summarizing the contents and significance of that anthology, it shows that Grotius had a life-long interest in and extensive knowledge of the work. Despite this, and even though Grotius made important contributions to the revitalization of Stoicism in the seventeenth century, he never once mentions the material in Chapter Seven of Book II of Stobaeus's work, material which is widely regarded nowadays as a vital source for the (...) ethical views of ancient Stoics. The paper concludes by exploring the implications of this omission for the broader revival of Stoicism in the early modern period. (shrink)

Throughout his life Kierkegaard was an engaged student of German philosophy. He was especially exercised by the German philosophy of his own day, which was dominated by the popularity of the Hegelian system and the critical discussions surrounding it. This chapter explores Kierkegaard's use of Hegel and of a number of lesser‐known Hegelians (Marheineke, Daub, Erdmann, Rosenkranz, Hotho, Werder, Feuerbach, Bruno Bauer, and Strauss) and Hegel critics (Baader, I.H. Fichte, Schopenhauer, Trendelenburg, and Schelling). This study shows that Kierkegaard's interest in (...) the other figures traditionally associated with Hegelianism in fact goes far beyond this sole aspect of their thought. (shrink)

After the virulent criticisms of Nietzsche, Kierkegaard and much of the analytic tradition, systematic philosophy has for the most part gone into eclipse in contemporary European thought. The main target of these criticisms was often the daunting edifice of the Hegelian system which dominated so much of Nineteenth Century philosophy. Despite a small handful of scholars who try with might and main to salvage this edifice, the general belief among scholars today is that at bottom Hegel’s philosophical project as a (...) system is simply bankrupt and indefensible all around. Of all the texts in the Hegelian corpus, the Phenomenology of Spirit with it plethora of themes and troubled composition has been in particular singled out for criticism as a disunified and unsystematic text. Typical of this general belief is Kaufmann’s characterization: “the Phenomenology is certainty unwissenschaftlich, undisciplined, arbitrary, full of digressions, not a monument to the austerity of the intellectual conscience and to carefulness and precision but a wild, bold, unprecedented book.” The Phenomenology is thus seen simply as an eclectic and at times bizarre collection of atomic analyses on sundry topics. This preconception of the Phenomenology as a disunified text then leads to a predetermined and, in my view, erroneous interpretive approach. (shrink)
