This chapter discusses the analysis of Joseph Raz on coercion, trust, and citizenship. The chapter starts with a number of brief comments on some of his observations regarding the doctrine of liberty and the preference for minimum government. The chapter also includes one of Raz's arguments that states that some people favour non-perfectionist forms of government out of a misunderstanding of the implications of perfectionism for liberty.

Empiricism is a claim about the contents of the mind: its classic slogan is nihil est in intellectu quod non fuerit in sensu, ‘there is nothing in the mind (intellect, understanding) which is not first in the senses’. As such, it is not a claim about the fundamental nature of the world as material. I focus here on in an instance of what one might term the materialist appropriation of empiricism. One major component in the transition from a purely epistemological (...) claim about the mind and its contents, to an ontological claim about the nature of the world, is the new focus on brain-mind relations in the eighteenth century. Here I examine a Lockean trajectory as exemplified in Joseph Priestley’s 1777 Disquisitions Relating to Matter and Spirit. But Locke explicitly ruled out that his inquiry into the logic of ideas amounted to a ‘physical consideration of the mind’. What does it mean, then, for Priestley to present himself as continuing a Lockean tradition, while presenting mental processes as tightly identified with ‘an organical structure such as that of the brain’ (although he was not making a strict identity claim as we might understand it, post-Smart and Armstrong)? One issue here is that of Priestley's source of ‘empirical data’ regarding the correlation and indeed identification of mental and cerebral processes. David Hartley’s theory in his 1749 Observations on Man was, as is well known, republished in abridged form by Priestley, but he discards Hartley's 'vibratory neurophysiology' while retaining the associationist framework, although not because he disagreed with the former. Yet Hartley was at the very least, strongly agnostic about metaphysical issues (and it is difficult to study these authors while bracketing off religious considerations). One could see Locke and Hartley as articulating programs for the study of the mind which were more or less naturalistic (more strongly so in Hartley’s case) while avoiding ‘materialism’ per se; in contrast, Priestley bit the (materialist) bullet. In this paper I examine Priestley’s appropriation and reconstruction of this ‘micro-tradition’, while emphasizing its problems. (shrink)

School choice has lately risen to the top of the list of potential solutions to America's educational problems, particularly for the poor and the most disadvantaged members of society. Indeed, in the last few years several states have held referendums on the use of vouchers in private and parochial schools, and more recently, the Supreme Court reviewed the constitutionality of a scholarship program that uses vouchers issued to parents. While there has been much debate over the empirical and methodological aspects (...) of school choice policies, discussions related to the effects such policies may have on the nation's moral economy and civil society have been few and far between. School Choice, a collection of essays by leading philosophers, historians, legal scholars, and theologians, redresses this situation by addressing the moral and normative side of school choice.The twelve essays, commissioned for a conference on school choice that took place at Boston College in 2001, are organized into four sections that consider the relationship of school choice to equality, moral pluralism, institutional ecology, and constitutionality. How does Locke contribute to the development of 18th-century projects for a science of the mind, even though he seems to reject or at least bracket off such an idea himself? Contrary to later understandings of empiricism, Locke goes out of his way to state that his project to investigate and articulate the ‘logic of ideas’ is not a scientific project: “I shall not at present meddle with the Physical consideration of the Mind” (Essay, I.i.2). Locke further specifies that this (...) means his analysis of mental processes will not engage with knowledge of the brain (e.g. in terms of corpuscles and animal spirits), even though he had been the student of Thomas Willis. Now, Kant seemed to make an elementary mistake, given such a clear statement on Locke’s part, when he claimed that Locke’s project was a “physiology of the understanding” (in the Preface to the A edition of the first Critique). One can ask of course what this physiology of the understanding was, and if it existed, in or out of the Lockean intellectual world (as I have sought to investigate in a 2016 paper). This leads me to inquire into the outcome of his empiricism for a scientific treatment of the mind, including in the sense of a ‘naturalization’ of the mind (with implications also for our understanding of empiricism: Anstey’s influential distinction between experimental and speculative philosophy does not seem useful here). Because if Kant made this charge, there were also many 18th-century thinkers who positively treated Locke as their great forerunner in psychology and related fields: Charles Bonnet and Joseph Priestley among them, just as some prominent physicians such as Cabanis claimed to be ‘finishing the job’ that Locke had started in, e.g. their materialist theories of the passions. What one might term ‘the Locke Problem’ here is: how can one reconcile empiricism and claims about cerebral processes, while seeking to remain a Lockean? Differently put, what is the process of naturalization, a naturalization of? (shrink)

Due to domestication, dogs differ from wolves in the way they respond to their environment, including to humans. Selection for tameness and the associated changes to the autonomic nervous system (ANS) regulation have been proposed as the primary mechanisms of domestication. To test this idea, we compared two low-arousal states in equally raised and kept wolves and dogs: resting, a state close to being asleep, and inactive wakefulness, which together take up an important part in the time budgets of wolves (...) and dogs. We measured arousal via cardiac output in three conditions: alone, with a familiar human partner, or with pack members (i.e., conspecifics). Specifically, we compared heart rate (HR) and heart rate variability (HRV) of six wolves and seven dogs. As patterns of resting can vary adaptively, even between closely related species, we predicted that dogs would be generally more aroused than wolves, because living with humans may come with less predictable contexts than living with conspecifics; hence, dogs would need to be responsive at all times. Furthermore, we predicted that due to the effects of domestication, emotional social support by familiar people would reduce arousal more in dogs than in equally human-socialized wolves, leading to more relaxed dogs than wolves when away from the pack. Overall, we found a clear effect of the interactions between species (i.e., wolf versus dog), arousal state (i.e., resting or awake inactive) and test conditions, on both HR and HRV. Wolves and dogs were more aroused when alone (i.e., higher HR and lower HRV) than when in the presence of conspecifics or a familiar human partner. Dogs were more relaxed than wolves when at rest and close to a familiar human but this difference disappeared when awake. In conclusion, instead of the expected distinct overall differences between wolves and dogs in ANS regulation, we rather found subtle context-specific responses, suggesting that such details are important in understanding the domestication process. Many scholars agree that the Internet plays a pivotal role in self-radicalization, which can lead to behaviours ranging from lone-wolf terrorism to participation in white nationalist rallies to mundane bigotry and voting for extremist candidates. However, the mechanisms by which the Internet facilitates self-radicalization are disputed; some fault the individuals who end up self-radicalized, while others lay the blame on the technology itself. In this paper, we explore the role played by technological design decisions in online self-radicalization in its (...) myriad guises, encompassing extreme as well as more mundane forms. We begin by characterizing the phenomenon of technological seduction. Next, we distinguish between top-down seduction and bottom-up seduction. We then situate both forms of technological seduction within the theoretical model of dynamical systems theory. We conclude by articulating strategies for combatting online self-radicalization. Most philosophical explorations of responsibility discuss the topic solely in terms of metaphysics and the "free will" problem. By contrast, these essays by leading philosophers view responsibility from a variety of perspectives -- metaphysics, ethics, action theory, and the philosophy of law. Bracken synthesizes Polanyi’s notion of morphogentic field and Whitehead’s notion of societies of actual occasions. These comments emphasize the implications of the metaphors involved in these notions. The rnetaphor of plants growing in afield lies beyond the concept of a morphogenetic field, and the metaphor of a society of interacting persons lies behind the concept of a society of actual occasions. I suggest that one of the implications of this metaphor is that there is not, as Bracken argues, a problem (...) of continuity in Whitehead’s metaphysics of events. (shrink)

Neuron diagrams are heavily employed in academic discussions of causation. Stephen Mumford and Rani Lill Anjum, however, offer an alternative approach employing vector diagrams, which this paper attempts to develop further. I identify three ways in which dispositionalists have taken the activities of powers to be related: stimulation, mutual manifestation, and contribution combination. While Mumford and Anjum do provide resources for representing contribution combination, which might be sufficient for their particular brand of dispositionalism, I argue that those resources are not (...) flexible enough to further accommodate either stimulation or mutual manifestation. Representational tools are provided to address these limitations, improving the general value of the vector model for dispositionalist approaches to causation. (shrink)

The deeply entrenched, sometimes heated conflict between the disability movement and the profession of bioethics is well known and well documented. Critiques of prenatal diagnosis and selective abortion are probably the most salient and most sophisticated of disability studies scholars’ engagements with bioethics, but there are many other topics over which disability activists and scholars have encountered the field of bioethics in an adversarial way, including health care rationing, growth-attenuation interventions, assisted reproduction technology, and physician-assisted suicide. The tension between the (...) analyses of the disabilities studies scholars and mainstream bioethics is not merely a conflict between two insular political groups, however; it is, rather, also an encounter between those who have experienced disability and those who have not. This paper explores that idea. I maintain that it is a mistake to think of this conflict as arising just from a difference in ideology or political commitments because it represents a much deeper difference—one rooted in variations in how human beings perceive and reason about moral problems. These are what I will refer to as variations of moral psychology. The lived experiences of disability produce variations in moral psychology that are at the heart of the moral conflict between the disability movement and mainstream bioethics. I will illustrate this point by exploring how the disability movement and mainstream bioethics come into conflict when perceiving and analyzing the moral problem of physician-assisted suicide via the lens of the principle of respect for autonomy. To reconcile its contemporary and historical conflict with the disability movement, the field of bioethics must engage with and fully consider the two groups’ differences in moral perception and reasoning, not just the explicit moral and political arguments of the disability movement. After defining integrity capacity and framing it as part of a strategic resource model of sustainable global competitive advantage, the stakeholder costs of integrity capacity neglect are delineated. To address this neglect issue, the authors focus on the cultivation of judgment integrity to handle behavioral, moral and hypothesized economic complexities as key dimensions of integrity capacity. Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. However, rejecting these generalizations for a more (...) nuanced view still has dramatic implications for the status quo in both health policy and clinical ethics. (shrink)

In this paper, I argue that, even when disability rights activists are most clearly acting as activists, they can advance the scholarly activity of disability bioethics. In particular, I will argue that even engaging in non-violent direct action, including civil disobedience, is an important way in which disability rights activists directly support the efforts of disability bioethics scholars. I will begin by drawing upon Hilde Lindemann’s work on relational narrative identity to describe how certain damaging master narratives about disability hinder (...) the uptake of arguments from disability bioethics. Then, I will argue that disability activism, especially non-violent direct action and civil disobedience, provides an effective counterstory to some of the worst of these master narratives, thereby laying the groundwork for the scholarly argument s of disability bioethicists to be given more serious consideration. Ultimately, I conclude that the field of bioethics is improved when it abandons the gross grained, generalizations about who disabled people are and how they act put forth by oppressive master narratives in favor of the more nuanced self-descriptions offered by the counterstories being offered by disabled people themselves. So it is that, by challenging these oppressive master narratives that constrain and distort the social meaning of disability, disability activism can improve mainstream bioethics. (shrink)

Panentheism has become a familiar term in contemporary Christian systematic theology and philosophy, for it is widely believed to be an appropriate way to overcome the alleged dualism found in the classical God-world relationship. But what is meant by the term panentheism, and how does it work so as to avoid becoming still another form of pantheism or cosmic monism? Disability activists have sometimes claimed their disability has actually increased their well-being. Some even say they would reject a cure to keep these gains. Yet, these same activists often simultaneously propose improvements to the quality and accessibility of assistive technology. However, for any argument favoring assistive over curative technology to work, there must be a coherent distinction between the two. This line is already vague and will become even less clear with the emergence of novel technologies. This paper asks and (...) tries to answer the question: what is it about the paradigmatic examples of curative and assistive technologies that make them paradigmatic and how can these defining features help us clarify the hard cases? This analysis will begin with an argument that, while the common views of this distinction adequately explain the paradigmatic cases, they fail to accurately pick out the relevant features of those technologies that make them paradigmatic and to provide adequate guidance for parsing the hard cases. Instead, it will be claimed that these categories of curative or assistive technologies are defined by the role the technologies play in establishing a person’s relational narrative identity as a member of one of two social groups: disabled people or non-disabled people. The Second Vatican Council called for a fundamental renewal of Catholic theological ethics. That project, however, has not been realized primarily because of the strong defence of a normative, act-centred understanding of morality defended by Pope Paul VI and his successor, Pope John Paul II. Reframing Theological Ethics aims to overcome that impasse by arguing for a change in the method of ethical reasoning, emphasizing the replacement of the norm of natural law with that of the human person, integrally and (...) adequately considered, and elaborating an innovative theory of virtue. The paradigm of complementary virtues presented in this book is developed for the first time and allows the ethicist to flesh out the meaning and contours of the ends or goals of ethical living and decision-making. The study concludes with suggestions about how this approach may converge with the insights of normative ethics and achieve the renewal called for fifty years ago. (shrink)

The Papal Encyclical Veritatis Splendor (1993) proposes a model of moral theology based on the notion of universal and unchanging ethical principles that guide the Christian moral life. It also helps to clarify a number of questions about the moral teachings of the Post-Vatican II Church. But Veritatis Splendor has not been received without some serious criticisms. Among the various reservations about the encyclical are that it misrepresents the current state of the questions in contemporary moral theology, that it parodies (...) the positions of a number of responsible moral theologians, and that it offers a vision of moral-theological issues that does not correspond to the world with which most professional and pastoral workers are familiar. The contributors to this volume - all leading professional Roman Catholic theologians - clearly interpret various key statements made by Veritatis Splendor and assess the overall accuracy of the encyclical's moral vision. In the process these essays also demonstrate the true significance of this important Church document for Christians today. (shrink)

Employee reporting dishonesty is a significant area of concern for firms. In this study, we investigate how providing information about their prosocial actions, such as organizational citizenship behaviors, affects the extent of employee reporting dishonesty. We distinguish prosocial actions whose welfare effects are mutually beneficial (i.e., that help others and the employee), which are common in business practice, from those that are selfless in nature (i.e., that help others at a personal cost to the employee). In addition to examining the (...) effect of the type of prosocial action on the extent of employee reporting dishonesty, we also examine the effect of construal (the manner in which individuals perceive and interpret the action). Using an experiment, we find that participants with high moral identity are less dishonest when they describe their selfless prosocial actions than when they describe their mutually beneficial prosocial actions, but only when they abstractly construe this information. However, we do not find evidence that the reporting dishonesty of participants with low moral identity is influenced by the type of prosocial action they provide information about or the construal of that information. We discuss implications of these results for theory and practice. (shrink)

Heinrich Heine had not only many places of residence during his years in Germany, but he also made numerous journeys throughout Europe. Thus, during his time in France, he got to know the country substantially better and furthermore he would have liked to undertake a detour to Spain. Since his student days, Spain was for him as a German Jew the epitome of a Jewish- Christian-Islamic symbiosis despite many differences and difficulties. He slipped into the role of the Moors to (...) express his own outsider role within the German Christian majority society. Heine admired the great Jewish achievements and remained critical of Christian claims, although he had become a Protestant after being baptized at the end of his law studies. His tragedy Almansor, poems from the Buch der Lieder, texts in prose and epic poems from the Parisian years as well as in his literary bequest and above all the last collection of poems called Romanzero with their moving “Spanish” texts, namely the stories about Jews, Christians and Muslims, are the most important poetic evidences of religious coexistence and its problems. It may seem obvious that causing disability in another person is morally problematic in a way that removing or preventing a disability is not. This suggests that there is a moral asymmetry between causing disability and causing non-disability. This chapter investigates whether there are any differences between these two types of actions that might explain the existence of a general moral asymmetry. After setting aside the possibility that having a disability is almost always bad or harmful for a person (a (...) view that we have critiqued at length elsewhere), seven putative differences are considered. Ultimately, it is concluded that none of these seven factors can ground a general moral asymmetry between causing disability and causing non-disability, though each factor can provide some moral reason to avoid causing disability in certain particular cases. This article draws on key models of monitoring and blockholding articulated in the incomplete contracts theory of the firm. Under incomplete contracts theory, different governance systems have incentive structures that entail different tradeoffs—tradeoffs between ownership concentration and liquidity, between monitoring and management initiative, and between private rent-seeking and activity benefiting shareholders as a group. The tradeoffs delimit opportunities for productive cross-reference. More specifically, blockholder systems, such as those in Europe, subsidize monitoring by permitting blockholders to reap private benefits of control (...) through self-dealing and insider trading. Market systems, such as those in the United States and Britain, regulate such private rent-seeking toward the end of maintaining an institutional framework that supports diffuse share ownership and liquid trading markets. It follows that a legal framework conducive to blockholding may be ill-equipped to foster dispersed equity ownership and thick trading markets and that a legal framework conducive to liquid trading markets may have properties that discourage blockholding. This gives rise to questions for law reform agendas on both sides of the Atlantic. In the United States, proponents ask for deregulation of controls on institutional investors, looking to encourage blockholding and more effective monitoring. In Europe, proponents ask for stronger securities regulation, looking to encourage deeper trading markets. This article suggests that each reform program may lead to disappointing results because neither assures conforming adjustments to the pertinent actors’ incentives. Alternatively, strict reforms that materially change prevailing incentive patterns could perversely destabilize workable arrangements without assuring the appearance of more effective alternatives.
