Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. BackgroundGenetics and genomics research (GGR) is increasingly being conducted around the world; yet, researchers and research oversight entities in many countries have struggled with ethical challenges. A range of ethics and regulatory issues need to be addressed through comprehensive policy frameworks that integrate with local environments. While important efforts have been made to enhance understanding and awareness of ethical dimensions of GGR in Africa, including through the H3Africa initiative, there remains a need for in-depth policy review, at a country-level, to (...) inform and stimulate local policy development and revision on the continent.MethodsTo identify and characterize existing ethics-related guidelines and laws applicable to GGR across much of Africa, we conducted a scoping review of English language policy documents identified through databases, repositories, and web searches. Thirty-six documents were included and coded using a framework that contained a range of themes across five analytical categories: (1) respect, (2) beneficence, (3) justice, (4) independent oversight, and (5) bans and prohibitions. Data analysis software (NVivo 12) was used to organize, code, and tabulate information according to document characteristics and topics. Illustrative examples of policy requirements were selected for inclusion.ResultsDocuments that met inclusion criteria spanned 20 years; published between 1996 and 2018, with the majority (58%) published after 2009. About two-thirds were denoted as “guidelines,” and slightly more than half were non-exclusive to GGR. Very few (six) country-level documents identified were specific to GGR. Requirements related to the principle of “respect” appeared most often across all documents, relative to other principles and processes. The most commonly stated ban was on reproductive cloning. Other prohibitions applied to germline editing, undue inducements in research, sample use for commercial purposes, employee mandatory DNA testing, fetal sex selection, stem cell use, eugenics, and research without public health benefits.ConclusionsEnforceable policies that are indispensable to the ethical conduct and review of GGR are either deficient or missing in many African countries. Existing international, GGR-specific ethics guidelines can be used to inform GGR policy development at a country-level, in conjunction with insight from country specific ethics committees and other local stakeholders. In the first place, Hans Albert is famous as the spokesperson of Karl Popper’s critical rationalism in the German-speaking world. This is chronologically a bit odd, given that Popper’s first vintage, his Logik der Forschung, appeared in German in 1935 and that his The Open Society and Its Enemies of 1945 appeared in German in 1958. Yet Albert did much to earn this fame: his decades-long indefatigable response to criticisms of Popper’s views in the post-war German philosophical literature and his (...) constant contrast between Popper’s critical rationalism and competing views that were popular in Germany at the time. I am a person. But am I fundamentally and essentially a person? The animalist says no. So must the phenomenal continuity theorist, or so I will argue. Even if, contra animalism, we cannot survive zombification, being a subject of experience is not sufficient for being a person, and phenomenal continuity is not sufficient for our survival as the same person over time. These observations point the way to a positive account of personhood, and provide further insight into the conditions under (...) which literal survival preserves what matters. (shrink)

Does the Second Amendment protect those who threaten others by negligently or recklessly wielding firearms? What line separates constitutionally legitimate gun displays from threatening activities that can be legally proscribed? This article finds guidance in the First Amendment doctrine of true threats, which permits punishment of “statements where the speaker means to communicate a serious expression of an intent to commit an act of unlawful violence to a particular individual or group of individual.” The Second Amendment, like the First, should (...) not be read to protect those who threaten unlawful violence. And to the degree that the constitution requires a culpable mental state in such circumstances, the appropriate standard should be recklessness. (shrink)

Leavis was hoping to find when looking for support for his critical approach to literature after failing to find the support he sought for his argument in the dominance of logical positivism at that time.

The title of the film by Steve Kloves (1989) refers to the dual-piano, languishing lounge act performed by two brothers. The resurgence and demise of the musical team is brought about by the addition of a sultry, female vocalist--Susie Diamond. Embedded within the story is an exploration of integrity and its augmentation by the virtues of courage and honesty. Integrity marks an individual whose self is a coherent, consistent whole. Important elements of the individual’s personality are mutually supportive rather than (...) being disparate or in conflict. The integrity scrutinized by the film is Jack’s; it involves the younger brother’s inconsistent fidelity to his considerable musical talent. Late in the story we learn that he despises performing the popular musical fare with his brother and that he really wants to be creative, playing jazz. Although Jack is shown playing piano with modulated passion at a jazz club, we infer that he does so infrequently. Jack’s older brother is not in conflict with himself because his talent is suited to playing the bland tunes that are the staple of the act. Jack’s integrity is compromised because his commitment to his art is half-hearted; he cannot make the leap of faith--in himself. He knows that he hates playing the lounge music, is moved by jazz, and has considerable ability. Jack therefore realizes, however vaguely, that he ought to give himself to the music he loves, despite the risks this would entail. The trajectory of the film-story can be viewed as Jack finally summoning the courage to honestly confront his struggle with integrity and deciding to do something about it. (shrink)

. In this paper I present two ways in which climate modelers use general circulation models for exploratory purposes. The complexity of Earth’s climate system makes it difficult to predict precisely how lower-order climate dynamics will interact over time to drive higher-order dynamics. The same issues arise for complex models built to simulate climate behavior like the Community Earth Systems Model. I argue that as a result of system complexity, climate modelers use general circulation models to perform model dynamic exploration (...) and climate dynamic exploration. MDE and CDE help climate modelers to better understand the dynamic structure of the general circulation model system and the actual climate system, respectively. (shrink)

Bioregionalism is an environmental movement that attempts to create decentralized, self‐determined communities connected to landscape and ecological features. Activists and scholars have used the phrase “becoming native” to describe the process of belonging to place. Despite its cultural appropriation, not only do bioregional writers still use the metaphor, but it has also been defended within religious studies. Instead of relying on these arguments to address ethical issues, claims to place need a decolonial framework. Looking at various voices within bioregionalism through (...) Indigenous critiques displays both the movement’s issues as well as decolonial processes for local adaptation. Wendell Berry exemplifies the problems of bioregional ethics but also shows bioregionalism's capacity for decolonization. (shrink)

The philosophy of physics literature contains conflicting claims on the heuristic significance of general covariance. Some authors maintain that Einstein's general relativity distinguishes itself from other theories in that it must be generally covariant, for example, while others argue that general covariance is a physically vacuous and trivial requirement applicable to virtually any theory. Moreover, when general covariance is invested with heuristic significance, that significance as a rule is assigned to so-called “active” general covariance, underwritten by the principle of background (...) independence, rather than to general covriance as Einstein understood it. While agreeing with the latter group of commentators that general covariance indeed carries heuristic significance, I argue that a background independent theory need not be generally covariant and that instead the Principle of Equivalence as Einstein understood it provides the key to understanding the heuristic power of general covariance as a “mathematical sieve” for determining the gravitational field law. However, heuristic significance accrues to general covariance only indirectly, by its encompassing the relativity of frames underwritten by Einstein's principle of equivalence. (shrink)

Physicists were asked the question, “What do you think are the most important qualities needed to be successful at the type of work you do?” The results demonstrate which qualities physicists value and how values vary among the qualities they identified. The results also show how physicists’ beliefs about success vary by the rank of their department, age, productivity, and gender. What did the twentieth century threaten in the deepest way? What were those who were eventually defeated at such staggering cost fighting from the start? The individual, the sacredness and value of the individual, and spirit itself, seen in us in being seen as an individual, and seen beyond us. The home in the secular world for both these, the individual and spirit, is the legal mind and the legal form of thought. The individual in modern law is a mystery (...) because its presence runs counter to the thrust of what are called modern efforts to understand the world. But it will be the legal mind - rooted in and the possession of people in circles out and out from those professionally involved with it - that can protect humanity and the rest of the sentient world from reliving the twentieth century in the twenty-first. Opening with an essay entitled »Faust und die Sorge«, the first issue of the DVjs entered the world in a year of economic crises, national bankruptcy, and hyperinflation. This situation suggests viewing the project of Geistesgeschichte as reflecting stories of care (Sorge) and crises of the spirit (Geist). The thematization of such stories is here traced with respect to various scenes: Goethe’s Faust II, conflicts regarding hermeneutic power, and finally the history of political economy itself.
