Our capabilities in space are growing almost as fast as our ambitions. Liberalism’s concern with human freedom seems related to contractual freedom and thus contract law. There are, however, many strands of liberal thought and which of them best justifies contract is a difficult question. In The Choice Theory of Contracts, Hanoch Dagan and Michael Heller offer a vision of contract based on autonomy. Drawing on the work of Joseph Raz, they argue that extending autonomy should be the law’s primary concern, which requires that we extend the range of contractual choices (...) available. While there is much to admire in their work, I argue that autonomy as conceived by Dagan and Heller cannot justify contract law. First, there are reasons to doubt the coherence of autonomy as an ideal. Second, given the pluralism of liberal societies, which, for example, often include substantial numbers of religious believers who reject core assumptions of autonomy theory, it is doubtful that such a theory can legitimate contract law. A more modest version of liberalism concerned primarily with protection against cruelty and providing a modus vivendi in pluralistic societies is more tenable. Such a vision of liberalism yields a more modest vision of contract law. Rather than making it into another means of realizing the dream of a more autonomous self, it is enough that contract law facilitates commerce and the marketplace. Markets in turn can serve an important — albeit limited — role in sustaining the peaceful cooperation and coexistence toward which a more realistic liberalism should aim. (shrink)

True to his vocation as ferryman (passeur), Todorov guides (...) the reader over the vast expanses of historical, ideological, and intensely personal terrain that he has explored as an émigré of Bulgaria, a brilliant Structuralist, French citizen, father, spouse, and son caring for his aged father. The resulting mosaic composes a narrative itinerary rich in intellectual history.The exceptional range of Todorov's experience and research affords him a unique perspective. Having first lived and studied under Stalinism, he distinguished himself as a Parisian literary scholar stressing the primacy of the linguistic. Now internationally renowned, his books cover a broad spectrum of human experience, including the Holocaust, WWII, totalitarianism, the ethics of memory, the role and function of the intellectual, race and culture, ethnocentrism and conquest, and, most recently, human identity and a new humanism. Given Todorov's experience and erudition, such criticisms can neither be brushed aside nor attributed to being a rear-guard action. There has been much discussion of whether there could be objects A and B that are “individuatively vague” in the following way: object A and object B neither determinately stand in the relation of identity to one another, nor do they determinately fail to stand in this relation. If there are objects of this type, then we would have a genuine case of metaphysical vagueness, or “vagueness-in-the-world.” The possibility of vague objects in this sense strikes many as incoherent. The possibility’s (...) very description not only seems to talk of two objects but, much worse, it seems to point to a feature that distinguishes them: unlike object A, object B is not determinately identical to object A. This suspicion of incoherence is voiced in the famous arguments given against the possibility by Gareth Evans and Nathan Salmon. But the status of those arguments and others is uncertain. Here I present a new argument against vague objects — or more precisely, against the possibility of individuatively vague objects that satisfy an important and common additional condition that I will call “Democracy.” Since my argument turns on a connection between what is indeterminate and what is possible, I call it “the modal argument.”. Havel was a Czech anarchist at the center of New York’s political and artistic circles at the turn of the twentieth century. In his famous essentialist account of identity, Kripke holds that it is necessary to the identity of individual people that they have the parents they do in fact have. Some have disputed this requirement, treating it either as a reason to reject essentialism or as something that should be eliminated in order to make essentialism stronger. I examine the reasoning behind some of these claims and argue that it fails to acknowledge the complex and multi-faceted importance of biological process in (...) determining identity and distinguishing significant differences between biological and non-biological cases. In fact, this failure derives from an inherent tendency to treat the biological case in just the same way as the non-biological case at least at one important point in its history—the point of formation. This analysis offers a way of salvaging Kripke’s original claims. I focus in particular on the views of Graeme Forbes and Teresa Robertson, but also discuss the views of Nathan Salmon, M. S. To date, both the United States federal government and twenty-one individual states have passed Religious Freedom Restoration Acts that aim to protect religious persons from having their sincere beliefs substantially burdened by governmental interests. RFRAs accomplish this by offering a three-pronged exemption test for religious objectors that is satisfied only when (1) an objector has a sincere belief that is being substantially burdened; (2) the government has a very good reason (e.g., health or safety) to interfere; and (3) there is (...) a reasonable alternative to serve the compelling interest. Legal balancing tests like those found in RFRA are content neutral insofar as they sideline the belief-content of conscientious objections as irrelevant when determining the permissibility of granting legal accommodations. However, some theorists worry that this legal picture may be backward: perhaps balancing tests should be content non-neutral given the usual features of conscientious objections. For example, Yossi Nehushtan contends that, contrary to their typical codification, religious conscience beliefs seem undeserving of special legal accommodations because they possess uniquely strong empirical and theoretical ties to intolerance. Thus, the illiberally intolerant content of these conscientious objections might actually give the state a reason to refuse to grant legal exemptions. In this paper, I offer a cursory defense of content neutrality with respect to balancing tests like those found in RFRA. To begin, I outline Nehushtan’s argument for content non-neutrality. The cornerstone of his argument is that illiberal intolerance is intolerable such that conscientious objections that are based upon illiberally intolerant values provide the state with strong, normally prevailing reason not to grant an exemption. I argue that, even when the illiberally intolerant content of one’s conscience constitutes a weighty and relevant factor in determining the permissibility of granting a legal exemption, there remain significant problems. It is difficult, for example, to determine which views are illiberally intolerant and difficult to say whether illiberally intolerant views can effectively serve as the principled demarcating line in balancing tests. To conclude, I offer several cursory arguments in favor of adopting content-neutral approaches without necessarily making a comprehensive case. By drawing on the work of Amy Sepinwall, Nadia Sawicki, and Nathan Chapman, I show that content-neutral approaches can help to safeguard robust protections for conscience by permitting atypical exercises of conscience, protect minority thoughts and practices from being coercively supplanted by majoritarian understandings of morality, appropriately maintain the skepticism and humility that we owe each other as compatriots in a pluralistic society, and allow the kind of justifiable civil disobedience that has an important place in political history among other things. A classic objection to autonomous weapon systems (AWS) is that these could create so-called responsibility gaps, where it is unclear who should be held responsible in the event that an AWS were to violate some portion of the law of armed conflict (LOAC). However, those who raise this objection generally do so presenting it as a problem for AWS as a whole class of weapons. Yet there exists a rather wide range of systems that can be counted as “autonomous weapon (...) systems”, and so the objection is too broad. In this article I present a taxonomic approach to the objection, examining a number of systems that would count as AWS under the prevalent definitions provided by the United States Department of Defense and the International Committee of the Red Cross, and I show that for virtually all such systems there is a clear locus of responsibility which presents itself as soon as one focuses on specific systems, rather than general notions of AWS. In developing these points, I also suggest a method for dealing with near-future types of AWS which may be thought to create situations where responsibility gaps can still arise. The main purpose of the arguments is, however, not to show that responsibility gaps do not exist or can be closed where they do exist. Rather, it is to highlight that any arguments surrounding AWS must be made with reference to specific weapon platforms imbued with specific abilities, subject to specific limitations, and deployed to specific times and places for specific purposes. More succinctly, the arguments show that we cannot and should not aim to treat AWS as if all of these shared all morally relevant features, but instead on a case-by-case basis. Thus, we must contend with the realities of weapons development and deployment, and tailor our arguments and conclusions to those realities, and with an eye to what facts obtain for particular systems fulfilling particular combat roles. Considered a classic in the philosophy of language movement known variously as the New Theory of Reference or the Direct-Reference Theory, as well as in the metaphysics of modal essentialism that is related to this philosophy of language. This award-winning book is based on the author’s doctoral dissertation.

In his recent article, Ben-Moshe offers an account of conscientious objection in terms of the truth of the underlying moral objections, as judged by the standards of an impartial spectator. He seems to advocate for the view that having a valid moral objection to X is the sole criteria for the instantiation of a right to conscientiously object to X, and seems indifferent to the moral status of the prevailing moral attitudes. I argue that the moral status of the prevailing (...) moral attitudes is relevant, and that a good faith disagreement between those who condone the relevant act and those who object to it is a criterion for CO. In this light, I suggest that CO is a sociopolitical device for managing differing ethical perspectives, particularly in the context of collective moral change. Thus, it is misguided to equate having a valid moral objection with the recognition of a CO. (shrink)

The principle of proportionality demands that a war (or action in war) achieve more goods than bads. In the philosophical literature there has been a wealth of work examining precisely which goods and bads may count toward this evaluation. However, in all of these discussions there is no mention of one of the most certain bads of war, namely the psychological harm(s) likely to be suffered by the combatants who ultimately must fight and kill for the purposes of winning in (...) conflict. This paper argues that harms to one’s own soldiers must be included in proportionality judgments, and goes on to argue that one of the most significant harms one’s soldiers face are the psychological stresses and traumas associated with combat. The arguments draw on a growing wealth of psychological literature exploring the connections between combatancy and psychological trauma, and highlight, in particular, the uniquely negative impact which killing has on a combatant’s mental well-being. The paper concludes that these factors place an almost certain and rather weighty negative weight in any proportionality calculations concerning wars with ground combatants who must fight “up close and personal”, and that for more remote warfighters, there is also evidence to show that they may suffer deep psychological harm as a result of their combat roles as well. The argument, however, does not attempt to demonstrate that these factors render war impermissible. Rather, it merely shows that these harms, or bads, which can be quite significant, must be factored into our considerations of proportionality. The arguments themselves are rather uncontroversial, but they bring to light an element in the moral calculus which is sadly overlooked in most discussions of the ethics of war. (shrink)

With few exceptions, the literature on withdrawing and withholding life-saving treatment considers the bare fact of withdrawing or withholding to lack any ethical significance. If anything, the professional guidelines on this matter are even more uniform. However, while no small degree of progress has been made toward persuading healthcare professionals to withhold treatments that are unlikely to provide significant benefit, it is clear that a certain level of ambivalence remains with regard to withdrawing treatment. Given that the absence of clinical (...) benefit means treating patients is not only ethically questionable but also taxing on resources that could meet the needs of others, this ambivalence is troubling. Equally, the enduring ambivalence of professionals might be taken to indicate that the issue warrants further attention. In this paper, we review the academic literature on the ethical equivalence of withdrawing and withholding medical treatment. While we are not in outright disagreement with the arguments presented, we suggest that asserting theoretical and decontextualized claims about the ethical equivalence of withdrawing and withholding life-saving treatment does not fully illuminate the moral questions associated with the relevant clinical realities. We argue that what is required is a broader perspective, one rooted in an understanding that withdrawing and withholding life-saving treatment are different practices, the meanings of which are fully comprehensible only through an appreciation of their place within the practice of healthcare more generally. Such an account suggests that if one is to engage with the inappropriate protraction of life-saving treatment resulting from healthcare professionals’ disinclination to withdraw it, then the differences between these practices should be taken seriously. This book argues that Hume is a radical epistemic skeptic who gives only practical reasons for retaining belief in sensory beliefs and the deliverances of reason. He advises us to take a moderate approach to the demands of philosophy, since they sometimes diverge from the demands of life.

It is commonly thought that logic, whatever it may be, is normative. While accounting for the normativity of logic is a challenge for any view of logic, in this paper I argue that it is particularly problematic for certain types of logical pluralists, due to what I call the normative problem for logical pluralism. I introduce the NPLP, distinguish it from other problems that logical pluralists may face, and show that it is unsolvable for one prominent type of logical pluralism.

General consensus has it that contingencies lack the requisite modal umph to serve as explanations for the modal status of necessities. The central aim of this paper is to show that this received opinion is incorrect: contingent necessity-makers are in fact possible. To do so, I identify certain conditions the satisfaction of which entail the possibility of contingent necessity-makers. I then argue for two broad instances where these conditions are satisfied. Consequently, the associated necessities in fact have contingent necessity-makers.

It is argued that certain individuals can and should be considered 'morally exemplary' with respect to the environment. This can be so even where there is no universally applicable ethical principle they employ, and no canonical set of virtues they exhibit. The author identifies Henry David Thoreau, Aldo Leopold, Annie Dillard and Edward Abbey as potential 'environmental exemplars,' focusing for the purposes of the essay on individuals who have written compelling autobiographical works in defense of a way of life that (...) is both attuned to the values of a particular place and attentive to the humanistic concerns that have more traditionally been the locus of ethical thought. Smedes and Kevin Sharpe have challenged the theology-and-science enterprise and raised important questions about theological and scientific assumptions behind this work. Smedes argues that theology should be taken more seriously, and Sharpe believes that theology should be more scientific. A proposed middle way involves engaging in the dialogue itself and exploring the questions and methodological implications that arise in the context of problem-focused interactions.
