A cardinal rule of academic research with human participants is to protect their confidentiality. While there are limits to confidentiality, universities and researchers will make strenuous efforts...

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Directional deep brain stimulation contacts provide greater spatial flexibility for therapy than traditional ring-shaped electrodes, but little is known about longitudinal changes of impedance and orientation. We measured monopolar and bipolar impedance of DBS contacts in 31 patients who underwent unilateral subthalamic nucleus deep brain stimulation as part of a randomized study. At different follow-up visits, patients were assigned new stimulation configurations and impedance was measured. Additionally, we measured the orientation of the directional lead during surgery, immediately after surgery, and (...) 1 year later. Here we contrast impedances in directional versus ring contacts with respect to local anatomy, active stimulation contact, and over time. Directional contacts display larger impedances than ring contacts. Impedances generally increase slightly over the first year of therapy, save for a transient decrease immediately post-surgery under general anesthesia during pulse generator placement. Local impedances decrease at active stimulation sites, and contacts in closest proximity to internal capsule display higher impedances than other anatomic sites. DBS leads rotate slightly in the immediate postoperative period but otherwise remain stable over the following year. These data provide useful information for setting clinical stimulation parameters over time. (shrink)

ObjectivesBuilding on what is known about the non-random nature of crime problems and the explanatory capacity of opportunity theories of crime, this study explores the utility of using existing university administrative data to detect unusual patterns of performance consistent with a student having engaged in contract cheating (paying a third-party to produce unsupervised work on their behalf).MethodsResults from an Australian university were analysed (N = 3798 results, N = 1459 students). Performances on unsupervised and supervised assessment items were converted to (...) percentages and percentage point differences analysed at the academic discipline-, unit-, and student-level, looking for non-random patterns of unusually large differences.ResultsNon-random, unusual patterns, consistent with contract cheating, were found at the academic discipline-, unit-, and student-level, with approximately 2.1% of students producing multiple unusual patterns.ConclusionsThese findings suggest it may be possible to use existing administrative data to identify assessment items that provide suitable opportunities for contract cheating. This approach could be used in conjunction with targeted problem-prevention strategies (based on situational crime prevention) to reduce the vulnerability of academic assessment items to contract cheating. This approach is worthy of additional research as it has the potential to help academic institutions around the world manage contract cheating; a problem that currently threatens the validity and integrity of tertiary qualifications. Reductionism and holism, that is, antireductionism, are two of the prevailing paradigms within the philosophy of biology. Reductionists strive to understand biological phenomena by reducing them to a series of levels of complexity with each lower level forming the foundation for the subsequent level, by mapping such biological phenomena inasmuch as possible to the principal phenomena within the fundamental sciences of chemistry and physics. In this way, complex phenomena can be reduced to assemblages of more elementary explananda. Holism, in counterpart, (...) claims that there independently exist phenomena arising from ordered levels of complexity that have intrinsic causal power and cannot be reduced in this way. When dealing with the nature of biology and its unique foundations of essentialism, determinism and ethics, the pedagogical lens through which these foundations are conveyed to learners could provide a limited perspective if only the reductive approach is followed as it would not sensitise learners to the true complexity of the phenomenon of life and the study thereof, and it is the purpose of this article to frame the reductionist–antireductionist debate in order to illustrate this.Contribution: This article contributes new knowledge to the field of the philosophy of science; more specifically, the philosophy of biology by critically evaluating the pervasive dialectic between the theoretical frameworks of reductionism and antireductionism and alluding to the pedagogical consequences thereof. Our capabilities in space are growing almost as fast as our ambitions. Many nations, companies, and private actors are currently vying to secure historic “firsts” in space, raising complex social and ethical questions. There is surprisingly little serious analysis of these issues, however, and they are rarely discussed in undergraduate class discussions, despite their popularity with students. To help correct this deficit, a student research team designed 11 case studies to help instructors across the curriculum introduce space into their classes. (...) We argue that the complexities of Rousseau's political thought illuminate important connections between his works and the programs put forth by deep ecology. In Part One, we explore the (...) theoretical connections between Rousseau's account of the human fall from nature and major works of radical environmentalism. In Part Two, we offer suggestions for a reconsideration of Rousseau's work that may illuminate the paradoxical political requirements of deep ecology's recommendations for a more ecological human life. American pragmatism, religion, and race form a strange yet generative constellation. Figures like William James, John Dewey, and George Santayana, for instance, famously reimagine religious piety in the aftermath of Darwin’s revolution against traditional metaphysical attachments. For these authors, religiosity does not require a commitment to supernatural powers or agents but can be expressed in gratitude and awe toward the immanent, natural sources of human existence. There is a vulnerability to moral injury through violence that is grounded in the way persons imagine themselves and the world. This is the sequel to my paper 'Against One Form of Judgment-Determinism' ( IJPS , May 2001), wherein I argued that theoretical rationalization, that is, the forming of judgments by way of inference from other judgments, cannot simply be identified with any kind of predetermination of conclusion-judgments by premise-judgments. Taking 'free' to mean 'neither mechanistically explicable nor random' (where something is mechanistically explicable if and only if it is either predetermined or probabilified in a certain way, and is random if (...) and only if it is not why-explicable at all) I attempt here to establish that all judgments, whether rationalized or not, are necessarily free. Both mainstream and disability bioethics sometimes contend that the self-assessment of disabled people about their own well-being is distorted by adaptive preferences that are only held because other, better options are unavailable. I will argue that both of the most common ways of understanding adaptive preferences—the autonomy-based account and the well-being account—would reject blanket claims that disabled people’s QOL self-assessment has been distorted, whether those claims come from mainstream bioethicists or from disability bioethicists. However, rejecting these generalizations for a more (...) nuanced view still has dramatic implications for the status quo in both health policy and clinical ethics. (shrink)

There are many variants of deflationism about truth, but one of them, Paul Horwich’s minimalism, stands out because it accepts as axiomatic practical variants of the equivalence schema: 〈p〉 is true if and only if p. The equivalence schema is epistemologically fundamental. In this paper, I call upon empirical studies to show that practical variants of the equivalence schema are widely accepted by non-philosophers. While in the empirical data there is variation in how non-philosophers and philosophers talk about truth and (...) how they judge that a proposition is true, a significant amount of data collected over the years reveal that the ordinary or folk view of truth is compatible with the epistemological fundamentality of alethic minimalism. This, I take it, suggests that people share in the same intuitions that form the bedrock of Horwich’s minimalism. (shrink)

Beyond Decolonial African Philosophy dives into decoloniality discourse, challenging some of its shortcomings and offering alternative perspectives on the nature of Africanity and Afrotopia (Africa's better future) from leading African philosophers. Beginning with an overview of philosophy in contemporary Africa, the first half of the book goes on to critically interrogate and rethink decoloniality's deconstructivist approach. The second half of the book considers a range of alternative new conceptualizations of Afrotopia and Africanity that transcend decolonial theory, drawing on constructivist and (...) creative approaches. The book considers key questions such as: Is Africanity immutable (essentialism), or mutable (nominalism)? Should we emphasise idealist, identitarian concerns, or pragmatic, developmentarian concerns? Should we prioritise African agency, or structures and circumstances? Should Africa embrace hybrid interculturality and creative self-manifestive identity or essentialist purity? Drawing on rich insights from African philosophers across the continent, this book challenges students and researchers to think beyond the concept of decolonization to alternative forms of African identities and African futures. Although this conference, held at Oxford on September 6–7, 1993, did not completely fulfil the ambitions of its subtitle, it nonetheless provided a stimulating forum for the presentation and exchange of ideas on various topics arising from Hegel’s Phenomenology. In the first paper, “Rupture, Closure, and Dialectic,” Joseph Flay dealt with the Phenomenology in its role as an introduction or beginning to the system. David Duquette then discussed the master/slave dialectic and the political significance of Hegel’s concept of recognition (...) in the Phenomenology. Following this, Jay Bernstein focussed on Hegel’s treatment of conscience and guilt, and related this to his views of ethical action, arguing that Hegel leaves room for moral autonomy and hence tragic suffering even within his conception of Sittlichkeit. In the fourth paper, “The Presence of Aristotle in Hegel’s Phenomenology,” Nicholas Walker analyzed the relation between Hegel and Aristotle, and the complexities of the latter’s influence on the Phenomenology. H.S. Harris then offered a sketch of his own view of the Phenomenology in “Let’s Not ‘Leave out the Ethical’: A ‘Conscientious’ Response to S.K.”, starting from a discussion of Hegel’s theory of truth and how this shapes the structure of this work. Finally, in “The ‘Unhappy Consciousness’ and Conscious Unhappiness,” Simon Jarvis examined Adorno’s critique of Hegel, and emphasized the continuing importance and value of this critique for any truly living contemporary Hegelianism. In the Phenomenology of Spirit, Hegel discusses marriage in his analysis of the first shape of Spirit, Ethical Life. Since it is analyzed in terms of a particular shape of spirit and set in Ancient Greece, it is difficult to understand both its use in the Phenomenology as well as what claims, if any, he is making about the institution of marriage as such. In lieu of an abstract, here is a brief excerpt of the content:Joseph Margolis THE OPTIONS OF CONTEMPORARY ETHICAL THEORY It may be said, with some prospect ofbeing not altogether idiotic, that the global philosophical question ofour age concerns the possibility of legitimating the conceptual grounds for legitimating claims about anything. The formulation has no interest in the abstract. It merely registers the possibility of an infinite regress; and in that form it has been with us forever. But our (...) own world has inexorably subverted all the standard forms of confidence regarding legitimation—not so much perhaps by intellectual confrontation as, more indirectly, by coming to believe the deep contingencies of human history, by discovering again and again the astounding diversity of actual human societies, by reflecting on the incompletely managed self-manipulation of our immense technology, by the natural fear entailed in the growing chaos of the entire terrestrial world we mean to put into serviceable order. These considerations are certainly local to moral theorizing. But since they have a general currency as well, they lead us to suppose that speculations about legitimizing moral claims cannot be more satisfactory than those of philosophy in general, though they may be weaker. This, in its turn, encourages us to imagine that a reduced assessment of the larger claims of philosophy may conveniendy justify a greater respect for the inherendy modest prospects ofmoral theorizing. Furthermore, the characteristic triple thinking of our age, always incipient in any reflexive appraisal of cognitive powers, has been raised to a particularly fine art — if that is the right term. It is quite impossible nowadays, unless by a confidence or innocence bordering on the Martian, simply to proclaim the principles or grounds or foundations of moral judgment and moral commitment. Nevertheless, what one cannot help noticing is that wher37 38Philosophy and Literature ever theorists are morally serious — and they seem never more serious than when they are theorizing about morality— they are understandably inclined to believe that they absolutely must give some sense of the accessibility of reliable and valid grounds for judgments and commitments of the most important sorts. In yielding to that touching obligation to serve others in the capacity of philosopher, however, they usually yield as well in the direction ofinsinuating— ifnot openly announcing— what their own sense of professional history would otherwise have readily shown to be in desperate need of a smidgen of support. Notably in the last generation, the retreat from older forms of confidence, in moral philosophy, in philosophy in general, and in all those intellectual disciplines either pleased or displeased to be linked to the fate of philosophy, has decidedly accelerated. There is no resisting the current, though that is hardly to say we understand its implications or are obliged to subscribe to its madder exemplars. But when, to take a counter-specimen from the Anglo-American tradition of the last decade, a moral philosopher like Alan Donagan attempts to restore something like the Kantian moral system, we sense its unlikely and alien body even before we prepare our instruments for the required dissection. Thus, Donagan, who can hardly be accused of failing to sustain a most humane document, speaks at the beginning of The Theory ofMorality of his having been persuaded — by George Orwell and others — "that any acceptable form of social order, whether socialist or not, must rest on moral foundations, which are in principle ascertainable at any period, and permanendy valid."1 Donagan had hoped to recover in a compelling way the "common morality" of mankind, the rationally accessible portion of the Biblical tradition, presumably congruent with the classical tradition, ordered in a conceptually convincing way for the first time by Immanuel Kant reflecting, apparently, on his own Pietist upbringing. Donagan is, of course, among other things, a careful student of R. G. Collingwood's work, and here may be thought to exhibit Collingwood's confidence that the historian is capable, under favorable conditions, of "reenacting" at any period the motivating thought of effective historical agents of the past.2 At any rate, Donagan is quite explicit that: (a) social orders must have moral foundations or first principles; (b) social orders do have such moral foundations; (c) those foundations are ascertainable; (d) they are ascertainable in principle at... In the first place, Hans Albert is famous as the spokesperson of Karl Popper’s critical rationalism in the German-speaking world. This is chronologically a bit odd, given that Popper’s first vintage, his Logik der Forschung, appeared in German in 1935 and that his The Open Society and Its Enemies of 1945 appeared in German in 1958. Yet Albert did much to earn this fame: his decades-long indefatigable response to criticisms of Popper’s views in the post-war German philosophical literature and his (...) constant contrast between Popper’s critical rationalism and competing views that were popular in Germany at the time. Les commentateurs n’ont pas décelé le premier, ni remarqué que le second est un performatif adressé aux Grecs; ils ont tenu, à tort, le troisième pour explicite. J’examine ici quatre passages : un catalogue des classes sociales dans la cité grecque ; l’interdit pesant sur l’esclavage des Grecs accompagné du maintien de l’esclavage des barbares ; l’affirmation que la cité idéale est possible partout et en tout temps ; et l’affirmation que l’esclavage est injuste. Este artículo intenta contextualizar la interpretación de Agustín de Hipona de dos versos de la pasión Joánica, Juan 19:23-24, dentro del legado de la recepción bíblica norafricana y especialmente en diálogo con la posición donatista respecto a la naturaleza de la Iglesia, su relación con Cristo y su rol en el mundo presente. Las principales preguntas que serán examinadas acá serán: 1) ¿cómo la “túnica de Cristo” sirve como inspiración para la interpretación simbólica entre los autores latinos; y 2) ¿cómo (...) una lectura tan “tipológica” de Juan 19:23-24 —y su antecedente en el texto de los Salmos 21:19— tiene lugar en un campo más amplio como lo es el de la polémica antidonatista de Agustín? Presentando evidencia relevante, comienzo por discutir varias referencias de Agustín acerca de la tunica desuper texta cronológicamente, que se encuentran principalmente en el Tractatus in Iohannis Evangelium, al igual que en sus sermones. La perspectiva esencial de Agustín a la imagen de la túnica del Cristo nunca se aleja radicalmente de sus propias lecturas tempranas, aunque surgen más tarde algunas diferencias. En consecuencia, continúa la preocupación por el impacto del per totum en Juan 19:23 sobre el desarrollodel entendimiento de Agustín de la redención del Cristo, del regalo del Espíritu Santo y acerca de la extensión de la Iglesia por el mundo. A la luz de estos elementos, a pesar de que podamos comenzar a sospechar que Agustín promueve una forma de universalismo, su catolicidades una descripción mucho más justa y acertada de este esfuerzo por superar el exclusivismo donatista. Entre estos dos extremos, el catolicismo de Agustín puede ser detectado dentro del horizonte de este parde versos y de su relación con la Iglesia de África del Norte. (shrink)

The “Hobbesian turn” is an invention out of whole cloth, a device by which to oppose the usually supposed autonomy of the aesthetic, the moral, the political, and the factual; to recover the collective holism of civilizational life; to feature the existential historicity of the human career, which is incompatible with any strict universalism and all the forms of transcendentalism; hence, also, to feature the adequacy of a contingent Lebensform in collecting the affinities of creative expression and agentive commitment within (...) the terms of human solidarity; to abandon strict universality and necessary synthetic truths; and to favour the fluxive world of pragmatist construction rather than the indemonstrable fixities of rationalism and transcendentalism. The article proceeds largely by examining aspects of Picasso’s career and the history of Western politics spanning the sixteenth century to the present. (shrink)
