Lockean accounts of personhood propose that an individual is a person just in case that individual is characterized by some advanced cognitive capacity. On these accounts, human beings with severe cognitive impairment are not persons. Some accept this result—I do not. In this paper, I therefore advance and defend an account of personhood that secures personhood for human beings who are cognitively impaired. On the account for which I argue, an individual is a person just in case that individual belongs (...) to a natural kind that is normally characterized by advanced cognitive capacities. Since “human being” is just such a natural kind, individual human beings can be persons even when they do not themselves have advanced cognitive capacities. I argue, furthermore, that we have good reason to accept this account of personhood over rival accounts since it is uniquely able to accommodate the intuitive concept of an impaired person. (shrink)

This survey of major developments in North American philosophy of science begins with the mid-1960s consolidation of the disciplinary synthesis of internalist history and philosophy of science (HPS) as a response to criticisms of logical empiricism. These developments are grouped for discussion under the following headings: historical metamethodologies, scientific realisms, philosophies of the special sciences, revivals of empiricism, cognitivist naturalisms, social epistemologies, feminist theories of science, studies of experiment and the disunity of science, and studies of science as practice and (...) culture. A unifying theme of the survey is the relation between historical metamethodologists and scientific realists, which dominated philosophical work in the late 1970s. I argue that many of the alternative cognitive naturalisms, social epistemologies, and feminist theories that have been proposed can be understood as analogues to the differences between metamethodological theories of scientific rationality and realist accounts of successful reference to real causal processes. Recent work on experiment, scientific practice, and the culture of science may, however, challenge the underlying conception of the field according to which realism and historical rationalism (or their descendants) are the important alternatives available, and thus may take philosophy of science in new directions. A version of nonstandard analysis, Internal Set Theory, has been used to provide a resolution of Zeno's paradoxes of motion. This resolution is inadequate because the application of Internal Set Theory to the paradoxes requires a model of the world that is not in accordance with either experience or intuition. A model of standard mathematics in which the ordinary real numbers are defined in terms of rational intervals does provide a formalism for understanding the paradoxes. This model suggests that in (...) discussing motion, only intervals, rather than instants, of time are meaningful. The approach presented here reconciles resolutions of the paradoxes based on considering a finite number of acts with those based on analysis of the full infinite set Zeno seems to require. The paper concludes with a brief discussion of the classical and quantum mechanics of performing an infinite number of acts in a finite time. (shrink)

Since the introduction of the concept of brain death by the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death in 1968, the validity of this concept has been challenged by medical scientists, as well as by legal, philosophical, and religious scholars. In light of increased criticism of the concept of brain death, Stephen Napier, a staff ethicist at the National Catholic Bioethics Center, set out to prove that the whole-brain death criterion serves as (...) good evidence for death in the Catholic bioethical framework, on the grounds that when whole-brain death has occurred the soul has already departed from the body. Opponents have argued that (1) brain death does not disrupt the somatic integrative unity and coordinated biological functioning of a living organism and (2) clinical tests outlined in the practice guidelines for determining brain death lack sufficient power to exclude persisting function and fail to detect elements of the brain that, although currently functionless, may retain potential for recovery under conditions of optimal medical care. It is therefore possible that heart-beating organ procurement from patients with impaired consciousness is de facto a concealed practice of active euthanasia and physician-assisted death, both of which, either concealed or overt, the Catholic Church opposes. To adequately model mathematical arguments the analyst must be able to represent the mathematical objects under discussion and the relationships between them, as well as inferences drawn about these objects and relationships as the discourse unfolds. We introduce a framework with these properties, which has been used to analyse mathematical dialogues and expository texts. The framework can recover salient elements of discourse at, and within, the sentence level, as well as the way mathematical content connects to form larger argumentative structures. (...) We show how the framework might be used to support computational reasoning, and argue that it provides a more natural way to examine the process of proving theorems than do Lamport’s structured proofs. The underlying problem addressed by Pope Benedict XVI’s first encyclical is how the modern state usurped and perverted the Church’s charitable enterprises. The Church invented public schools, hospitals, and family services and ran them for a millennium as the “better half” of Christendom’s aristocratic, oligarchic, and democratic regimes. Beginning in the sixteenth century, however, and culminating in today’s social justice movement, the Church’s institutions of discerning love have been supplanted by political agencies, operating on the basis of universal and homogenous (...) justice. This robbed the Church of its visible moral authority, metastasized the political administration, and corrupted both the charity and its recipients. In challenging Marxist theorists to confront the radical rebirth at the core of the fascist revolution, Roger Griffin has carried fascist studies to a new and valuable plateau. Likewise, David D. Roberts’s elaboration of Griffin’s model offers a provocative and fruitful avenue to rethink fascist political culture. This article seeks to advance the dialogue to the next level by considering what an international approach can add to these primarily nationalist interpretations of generic fascism. Drawing on examples from the history of (...) the United States, I argue that fascism is a fundamentally cosmopolitan process and that it needs to be placed on a broader continuum with the histories of slavery, racism and nationalism. Patients who are imminently dying sometimes experience symptoms refractory to traditional palliative interventions, and in rare cases, continuous sedation is offered. Samuel H. LiPuma, in a recent article in this Journal, argues that continuous sedation until death is equivalent to physician-assisted suicide/euthanasia based on a higher brain neocortical definition of death. We contest his position that continuous sedation involves killing and offer four objections to the equivalency thesis. First, sedation practices are proportional in a way that physician-assisted suicide/euthanasia is not. (...) Second, continuous sedation may not entirely abolish consciousness. Third, LiPuma’s particular version of higher brain neocortical death relies on an implausibly weak construal of irreversibility—a position that is especially problematic in the case of continuous sedation. Finally, we explain why continuous sedation until death is not functionally equivalent to neocortical death and, hence, physician-assisted suicide/euthanasia. Concluding remarks review the differences between these two end-of-life practices. (shrink)

This paper examines a central aspect of the relations between duration and quality of life by considering the moral right to voluntary euthanasia, and some aspects of the moral case for a legal right to euthanasia. Would widespread acceptance of a right to voluntary euthanasia lead to widespread changes in attitudes to life and death? Many of its advocates deny that, seeing it as a narrow right enabling people to avoid ending their life in great pain or total dependence, or (...) a vegetative state. I argue that the right cannot cogently be conceived as a narrow right, confined to very limited circumstances. It is based on the value of having the normative power to choose the time and manner of one's death. Its recognition will be accompanied by far reaching changes in culture and attitudes, and these changes will enrich people's life by enabling them to integrate their death as part of their lives. The literature on time perception is discussed. This is done with reference both to the ''cognitive-timer'' model for time estimation and to the subjective experience of apparent duration. Three assumptions underlying the model are scrutinized. I stress the strong interplay among attention, arousal, and time perception, which is at the base of the cognitive-timer model. It is suggested that a multiplicative function of two key components (the number of subjective time units and their size) should predict apparent duration. Implications for (...) other cognitive domains are drawn, and in particular an analogy is suggested between apparent duration and apparent movement. (shrink)

This article examines the phenomenological structures of the homo temporalis filtered through Augustine's illuminating, if unsystematic, insights on temporality and the imago Dei. It situates such a phenomenological interpretation of the Augustinian self in view of current interpretations that polarize or split the Augustinian self into an either/or scheme—either an “interior” self or an “exterior” self. Given this imbalance, the article suggests that a phenomenological evaluation of Augustine brings to light how interior and exterior spheres are deeply integrated. The article (...) elaborates this position by contending that the self's temporal streaming within the exterior world‐horizon is inescapable because it reflects basic constituents of a self created by God which is nevertheless capable of contemplating a God who transcends time. This seeming paradox is resolved by recourse to what is described as the “double entry” of the self. The temporal streaming of the self in the world‐horizon is porous to the eternal inwardly ; the eternal entry is thus interior and analyzable in terms of a non‐reflective self‐awareness on display in Augustine's De Trinitate; and finally Augustine's understanding of the temporality of faith indicates how the self of faith can be lived in light of Heidegger's emphasis on the future and Husserl's emphasis on the past. Husserl's (1970) discussion of "Galilean science" is often dismissed as naïvely instrumentalist and hostile to science. He has been explicitly criticized for misunderstanding idealization in science, for treating the lifeworld as a privileged conceptual framework, and for denying that science can in principle completely describe the world (because ordinary prescientific concepts are irreplaceable). I clarify Husserl's position concerning realism, and use this to show that the first two criticisms depend upon misinterpretations. The third criticism is well taken. Nevertheless, this is (...) consistent with Husserl's fundamental claim that the manifestations of things are important to discuss, but are inaccessible to empirical science. (shrink)

The tu quoque argument is the argument that since in the end rationalism rests on an irrational choice of and commitment to rationality, rationalism is as irrational as any other commitment. Popper's and Polanyi's philosophies of science both accept the argument, and have on that account many similarities; yet Popper manages to remain a rationalist whereas Polanyi decided for an irrationalist version of rationalism. This is more marked in works of their respective followers, W. W. Bartley III and Thomas S. (...) Kuhn. Bartley declares the rationalist's very openness to criticism open to criticism, in the hope of rendering Popper's critical rationalism quite comprehensive. Kuhn makes rationality depend on the existence of an accepted model for scientific research (paradigm), thus rendering Polanyi's view of the authority of scientific leadership a sine qua non for scientific progress. The question raised here is, in what sense is a rationalist committed to his rationality, or an irrationalist to his specific axiom ? The tradition views only the life?long commitment as real. Viewing rationality as experimental open?mindedness, we may consider a rationalist unable to retreat into any life?long commitment ? even commitment to science. In this way the logic of the tu quoque argument is made irrelevant: anyone able to face the choice between rationality and commitment is already beyond such a choice; it is one thing to be still naïve and another ? and paradoxical ? thing to return to one's naïveté. Steve Fuller's Social Epistemology offers a constructive program for integrating philosophy and sociology of science as normative knowledge policy, constrained by the linguistic, psychological, social, and political embodiment of knowledge. I endorse and elaborate upon Fuller's insistence that science studies should take seriously the embodiment of knowledge, but criticize his conception of knowledge policy on three grounds. Knowledge policy as Fuller conceives it seems committed to an untenable conception of a value?free or politically neutral social science. Knowledge policy studies are (...) also self?defeating, since they provide good reasons to ignore the recommendations of the knowledge?policy expert, and to prevent the successful development of a predictively adequate policy science. Finally, knowledge?policy studies cannot adequately respond to political conflict over knowledge production and dissemination. (shrink)

Goering and colleagues (2017) acknowledge closed-loop neural devices have the potential to undermine agency. Indeed, the authors observe that “the agent using the device may . . . sometimes doubt whether she is the author of her action, given that the device may operate in ways that are not transparent to her” (65). Still, the authors ultimately argue that closed-loop neural devices may be construed as supporting agency, especially when we view agency from a relational perspective. The reason? We often (...) manifest our agency in relation with others. For example, family and close friends sometimes step in to support us in setting and achieving our aims. In a similar way, then, the authors argue that “we can imagine [a closed-loop] device stepping in to support the user in achieving her aim” (67). Closed-loop neural devices, in other words, can be construed as supporting one’s agency in much the same way as other people can be seen as supporting one’s agency. The authors thus conclude that when we view agents from a relational perspective, closed-loop neural devices may be viewed as supporting rather than undermining agency. I largely agree with the authors’ conclusion. I also believe, however, that their discussion can be clarified by distinguishing three kinds of agency and viewing closed-loop neural devices from the perspective of each. By thinking carefully about agency, we can see more clearly the ways in which it is undermined by closed-loop neural devices, as well as the way in which these devices may support agency. (shrink)

Background The globalization of clinical research in the last two decades has led to a significant increase in the volume of clinical research in developing countries. As of 2016, Uganda was the third largest destination for clinical trials in Africa. This requires adequate capacity and systems to facilitate ethical practice. Methods This was a retrospective study involving review of laws, guidelines, policies and records from 1896 to date. Results Modern medicine evolved from 1896 and by the time of Uganda's independence (...) in 1962, a 1500 bed national referral hospital was in place and a fully‐fledged medical school was established at the Makerere University. As the practice of medicine evolved in the country, so did medical research that addressed priority health issues. The growth in modern medicine was not matched with development of research infrastructure and regulatory systems. The first documented regulation of research activities was in 1970 while the first research ethics committee established in 1986 was to facilitate review of research related to the HIV/AIDs pandemic. In 1990 an Act of Parliament was passed to facilitate development and implementation of policies, hence the development of the national guidelines in 1997, training, establishment and accreditation of research ethics committees, conferences and research site monitoring. Conclusion Over the past 120 years, the implementation and structural aspects of research ethics in Uganda have evolved through 70 years of no regulation, followed by 30 years of rudimentary regulation while the last 20 years have shown significant growth in the regulatory system associated with supportive laws, institutionalization of regulatory and training processes.
