Having learned my just war theory at Michael Walzer’s figurative knee, for many years I accepted the independence of jus in bello from jus ad bellum unthinkingly. Just war theory consists of two separate parts, one concerning the legitimate grounds for going to war and the other the rules of engagement once war had begun. This two-part view, the “independence thesis,” went hand in hand with the “symmetry thesis,” or “the moral equality of soldiers”: soldiers whose cause is unjust have (...) the same rights to fight and to kill as those whose cause is just. But troubling questions sometimes crowded in. Doesn’t the justice of a country’s cause affect what actions it can legitimately take? Can’t victims of aggression legitimately do things aggressors cannot? Most fundamentally, “how can there be permissibly violent means of pursuing impermissible ends?”[1] Walzer casts glances at these problems when he proposes the idea of a “sliding scale,” in which the rules of war yield “slowly to the moral urgency of the cause: the rights of the righteous are enhanced, and those of their enemies devalued.”[2] He rejects the sliding scale in favor of the weaker qualification, “supreme emergency,” in which the rules of war are overridden “only in the face of an imminent catastrophe.”. The recent arrest of Roman Polanski, the film director who fled to France from the United States in 1978 on the eve of sentencing for having unlawful sex with a 13-year-old girl, has caused an international ruckus. The French culture minister, Frédéric Mitterrand, and the French foreign minister, Bernard Kouchner, both issued statements of support for Mr. Polanski. But many others in France have expressed outrage at that support and said he should face justice for the crime.

The Science Museum, London, has recently acquired four fragments of a portable sundial with associated calendrical gearing. All the fragments are made of low zinc brass of substantially the same composition. The sundial is of a type known in other examples, some the products of recent archaeological excavations and all dated to the Late Antique or Early Byzantine period. Dating by the place names included in the latitude table, by the style of the heads of the planetary gods used to (...) identify the days of the week, and by the style of the script, all indicate that the instrument dates from the late fifth century of the Christian era or the first half of the sixth.The gearing, of which two arbors survive, carrying four toothed wheels and one ratchet, seems to have resembled that of a calendrical device described by al-Bīrūnī in about AD 1000. Like al-Bīrūnī's device and the geared calendar associated with a Persian astrolabe of AD 1221/2 now in the Museum of the History of Science, Oxford, the Byzantine instrument displayed the shape of the Moon and its age in days. Probably the calendar further resembled its Islamic counterparts in also displaying the positions of Sun and Moon in the Zodiac.The emergence of Byzantine mathematical gearing indicates that the Hellenistic tradition attested by the Antikythera machine continued to be active in the Byzantine period, and suggests that it may have influenced the Islamic tradition. Once again an artefact has shown up the inadequacy of the evidence derived from literary sources. (shrink)

To many people, the very idea of nationalism smacks of ethnocentrism or even racism. They suspect that violence, hatred, and distrust of the Other, embodied in a sharply divided world of "us" and "them," always lurk within the nationalist's heart. Recent world events have done nothing to allay these suspicions. Nationalism, on this view, is an evil to be overcome by a cosmopolitan stance that denies the significance of national boundaries. Yet positive values have also been associated with the nationalist (...) idea, as some recent accounts remind us.ii Democracy, autonomy, community, pluralism -- these goods have been connected with the development of nationalism over the past several centuries. Some of the values underlying nationalism also manifest themselves today in its dilute and more respectable cousin, multiculturalism. And it goes without saying that whatever its merits, nationalism exerts enormous power on the aspirations of many people around the world. (shrink)

This paper gives a short description of basic features of the dominating mindset in the Western world between the 1970s and today, often called “post-modern”, through a re-reading of John Ashbery’s poem “Self-Portrait in a Convex Mirror” . In doing so, it applies the viewpoint of an interdisciplinary history of ideas. Since collective mindsets have become the most important contextual political factors, the implications are multiple.

It is the encounter between Thomas Merton in the last year of his life with my Tibetan Buddhist teacher, Chogyam Trungpa, Rinpoche, early in his teaching career in (...) the West. This encounter has deeply influenced my life of dialogue, for they initiated what I came to understand as a new kind of interreligious dialogue—the dialogue of contemplative practice. It is the kind of dialogue Trungpa introduced to Naropa University in the late 1970s in Merton’s honor, and it has influenced our university ever since.Thomas Merton, Father Louis, was fifty-three years old when stepped off the plane in India for his much-anticipated Asian journey. Excited and jet-lagged, he met the twenty-eight-year-old Tibetan monk Chogyam Trungpa, who had returned to India and Bhutan for a retreat after five years of study at Oxford University and a new venture of teaching dharma to Westerners. Trungpa’s English would have been accented but comprehensible, and his curiosity about Christian monasticism was at its peak. Merton was “coming home” to a place he had never been, visiting Asia to look for true spiritual masters about whom he had read for so many decades. He was later to admit to a special attraction to the Tibetans.On Merton’s first day in India, he and Trungpa found each other over many gin and tonics at the Central Hotel in Calcutta, talking about the contemplative life and its challenges in the twentieth century. It was the first of a number of conversations over the next few months. In his journals Merton commented:the important thing is that we are people who have been waiting to meet for a long time. Chogyam Trungpa is a completely marvelous person. Young, natural, without front or artifice, deep, awake, wise. In the 1971 edition of his autobiography, he wrote, “Father Merton himself was an open, unguarded, and deep person. During these few days, we spent much time together and grew to like one another immensely. He proposed that we should collaborate on a book bringing together sacred writings of the Catholic and Vajrayana Buddhist traditions.”2 In another reflection, Trungpa commented, “Meeting Thomas Merton was wonderful; he was like a child, and at the same time, he was full of energy and life.”3 Still later, Trungpa was to conclude, “I had the feeling that I was meeting an old friend, a genuine friend … [Father Merton] was the first genuine person I met from the West.”4Later, Trungpa was deeply saddened by Merton’s premature death, feeling he had lost a heart friend, a genuine dialogue partner. Thirteen years later, Trungpa launched a series of seven landmark dialogue conferences at the fledgling university that he had founded, Naropa Institute in Boulder, Colorado. From the beginning, Trungpa dedicated these gatherings to “Fr. Merton” and said that he sought to cultivate the kind of conversations between genuine contemplatives that he had discovered with Merton. This article draws on the results of an inductive qualitative study on the microdynamics of framing corporate community involvement. Insight is provided into these dynamics by using the metaphor of a social movement and drawing on that literature’s framing perspective. Based on accounts of diverse organizational members, we identify several double edges in framing CCI as a strategic issue, and we develop a model that helps to understand why and how strategizing CCI may be controversial.

The pursuit of equal citizenship has been complicated by two recent developments: the emergence of multi‐level governance (and with it the growing importance of local, regional and global levels of citizenship practices) and the emergence of group recognition claims (which signal the growing importance of particularised experiences and multiple inequality agendas). These developments shape the way citizenship is both practiced and analysed. Mapping neat citizenship models onto distinct nation‐states and evaluating these in relation to formal equality is no longer an (...) adequate approach. Comparative citizenship analyses need to be considered in relation to multiple inequalities and their intersections, and to multi‐level governance and trans‐national organising. This, in turn, suggests that comparative citizenship analysis needs to consider new spaces in which struggles for equal citizenship occur and new dynamics interactions between them. (shrink)

The objective of Holmes Rolston, III’s writings has been the development of an “ecologically formed” environmental ethics based both on environmental values and ecological description. I show how recasting Rolston’s value theory in terms of H. Richard Niebuhr’s relational value theory can clarify and strengthen this project. Niebuhr developed a theory of value in which value is found in relationships and value systems are constructed in relation to centers of value. Niebuhr’s contextual method, with which Rolston’s methodology has substantial affinity, (...) is particularly open to the use of such sciences as ecology. I conclude that this recasting of Rolston’s important work in terms of relational value and contextual method can clarify the use of ecology in ethics and can contribute to ethical reflection on such difficult problems as the spotted owl controversy. The growing assumption thattransnational corporations (TNCs) will apply``best practice'''' and ``international standards''''in their operations in developing countries hasseldom been checked against close observationof corporate behavior. In this article, Ipresent a case study, based on field research,of one voluntary initiative to useinternational standards and best practice forenvironmental protection in the AmazonRainforest, by a US-based oil company,Occidental Petroleum (Oxy) in Ecuador. The moststriking finding is that the company refuses todisclose the precise standards that apply toits operations. This, and the refusal todisclose other (...) important environmentalinformation, make it impossible to verifyindependently Oxy''s claims of environmentalexcellence, or assess the effectiveness of theinitiative. At the same time, Oxy uses theinvocation of international standards to wrapitself in a veneer of corporate responsibility;reassure government officials and localresidents; cultivate confusion about standardsand practices that apply to the operations;deflect meaningful oversight and transparency;and arbitrarily legitimize norms that have beendefined by special interests. In short,international standards offer great promise forneeded environmental improvements; but can alsobe used to impede, rather than advance,corporate responsibility and the development ofeffective environmental law at the nationallevel. These findings suggest that for theapplication of international standards to bemeaningful, the international community needsto move beyond statements of principle anddevelop mechanisms that can be used toevaluate, verify, and monitor independentlyenvironmental claims by TNCs. Projective contents, which include presuppositional inferences and Potts's conventional implicatures, are contents that may project when a construction is embedded, as standardly identified by the FAMILY-OF-SENTENCES diagnostic. This article establishes distinctions among projective contents on the basis of a series of diagnostics, including a variant of the family-of-sentences diagnostic, that can be applied with linguistically untrained consultants in the field and the laboratory. These diagnostics are intended to serve as part of a toolkit for exploring projective contents across languages, thus (...) allowing generalizations to be examined and validated crosslinguistically. We apply the diagnostics in two languages, focusing on Paraguayan Guaraní, and comparing the results to those for English. Our study of Paraguayan Guaraní is the first systematic exploration of projective content in a language other than English. Based on the application of our diagnostics to a wide range of constructions, four subclasses of projective contents emerge. The resulting taxonomy of projective content has strong implications for contemporary theories of projection, which were developed for the projective properties of particular subclasses and fail to generalize to the full set of projective contents. One of the most talked-about scholarly works of the past fifty years, Judith Butler’s _Gender Trouble_ is as celebrated as it is controversial. Arguing that traditional feminism is wrong to look to a natural, 'essential' notion of the female, or indeed of sex or gender, Butler starts by questioning the category 'woman' and continues in this vein with examinations of 'the masculine' and 'the feminine'. Best known however, but also most often misinterpreted, is Butler's concept of gender as a (...) reiterated social _performance _rather than the expression of a prior reality. Thrilling and provocative, few other academic works have roused passions to the same extent. (shrink)
