The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received. Undergraduate projects may contribute new knowledge, but commonly their main purpose is an exercise in learning and applying simple research methods. They are usually short term and a first step into the research field. Support for undergraduate research experience is simple enough. However, integral to the research process is ethical scrutiny. A high standard of conduct of research is essential. The question of whether undergraduate student projects should be subject to full ethical review, to the same extent as that undertaken (...) for full scale academic work, is a matter of debate. The purpose of this study was to explore the views of academics on the nature and extent of ethical review considered appropriate for undergraduate research projects. This was done in order to identify which side of the above debate was favoured. Participants were undergraduate research project supervisors, drawn from a range of disciplines where research on human subjects is undertaken. A series of focus groups were undertaken, transcribed and subjected to thematic analysis. There was general consensus that some consideration should be given to the ethical issues relating to student projects. However, participants were limited in their explicit identification of such issues, with only extreme examples being specifically described. Some favoured a ‘light touch’ proportional to the size of the project as appropriate, while others considered the level ethical scrutiny not related to the size, duration or outcome of the work. Opinions were divided on where responsibility ultimately lay. Some considered it to belong at departmental, faculty or institutional level, but others held the individual supervisor accountable. The degree of involvement of undergraduate research in ethical review and approval is clearly an issue amongst academics. This study helps raise awareness of these issues and promotes debate on the appropriate level and format of review needed for undergraduate research training. (shrink)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

To commemorate 40 years since the founding of the Journal of Business Ethics, the editors in chief of the journal have invited the editors to provide commentaries on the future of business ethics. This essay comprises a selection of commentaries aimed at creating dialogue around the theme The Ethics and Politics of Academic Knowledge Production. Questions of who produces knowledge about what, and how that knowledge is produced, are inherent to editing and publishing academic journals. At the Journal of Business (...) Ethics, we understand the ethical responsibility of academic knowledge production as going far beyond conventions around the integrity of the research content and research processes. We are deeply aware that access to resources, knowledge of the rules of the game, and being able to set those rules, are systematically and unequally distributed. One could ask the question “for whom is knowledge now ethical’”? (See the Burrell commentary.) We have a responsibility to address these inequalities and open up our journal to lesser heard voices, ideas, and ways of being. Our six commentators pursue this through various aspects of the ethics and politics of academic knowledge production. Working with MacIntyre’s scheme of practices and institutions, Andrew West provides commentary on the internal good of business ethics learning and education. Inviting us to step out of the cave, Christopher Michaelson urges a clear-eyed, unblinking focus on the purposes and audiences of business ethics scholarship. As developmental editor, Scott Taylor uncovers some of the politics of peer review with the aim of nurturing of unconventional research. Mike Hyman presents his idiosyncratic view of marketing ethics. In the penultimate commentary, Julie Nelson attributes difficulties in the academic positioning of the Business Ethics field to the hegemony of a masculine-centric model of the firm. And finally, Gibson Burrell provides a powerful provocation to go undercover as researcher-investigators in a parallel ethics of the research process. (shrink)

Introduction: Healthcare practitioners have a legal, ethical and professional obligation to obtain patient consent for all healthcare treatments. There is increasing evidence which suggests dissonance and variation in practice in assessment of decision-making capacity and consent processes. Aims: This study explores healthcare practitioners’ knowledge and practices of assessing decision-making capacity and obtaining patient consent to treatment in the acute generalist setting. Methods: An exploratory descriptive cross-sectional survey design, using an online questionnaire, method was employed with all professional groups invited via (...) email to participate. Data were collected over 3 months from July to September 2015. Survey content and format was reviewed by the liaison psychiatry team and subsequently contained five sections (demographics, general knowledge and practice, delirium context, legal aspects and education/training). Descriptive, univariate and bivariate analysis of quantitative data and qualitative content analysis of qualitative data were undertaken. Ethical considerations: The study was approved by the institutional Human Research and Ethics Committee and informed consent was taken to be provided by participants upon completion and submission of the de-identified survey. Results: In total, 86 participants engaged the survey with n = 24, exiting at the first consent question. Almost two-thirds of respondents indicated that all treatments required patient consent. Knowledge of consent and decision-making capacity as legal constructs was deficient. Decision-making capacity was primarily assessed using professional judgement and perceived predominantly as the responsibility of medical and psychology staff. A range of patient psychological and behavioural symptoms were identified as indicators requiring assessment of decision-making capacity. Despite this, many patients with delirium have their decision-making capacity assessed and documented only sometimes. Uncertain knowledge and inconsistent application of legislative frameworks are evident. Many participants were unsure of the legal mechanisms for obtaining substitute consent in patients with impaired decision-making capacity and refusing treatment. Conclusion: The legal context of decision-making capacity and consent to treatment appears complex for healthcare practitioners. Professional, ethical and legal standards of care in this context can benefit from structured education programmes and supportive governance processes. An understanding of why ‘duty of care’ is being used as a framework within the context of impaired decision-making capacity is warranted, alongside a review of the context of Duty of Care within health policy, guidance and faculty teaching. Suicide attack is the most virulent and horrifying form of terrorism in the world today. The mere rumor of an impending suicide attack can throw thousands of people into panic. This occurred during a Shi‘a procession in Iraq in late August 2005, causing hundreds of deaths. Although suicide attacks account for a minority of all terrorist acts, they are responsible for a majority of all terrorism-related casualties, and the rate of attacks is rising rapidly across the globe. During 2000–2004, there (...) were 472 suicide attacks in 22 countries, killing more than 7,000 and wounding tens of thousands. Most have been carried out by Islamist groups claiming religious motivation, also known as jihadis. Rand Corp. vice president and terrorism analyst Bruce Hoffman has found that 80 percent of suicide attacks since 1968 occurred after the September 11 attacks, with jihadis representing 31 of the 35 responsible groups. More suicide attacks occurred in 2004 than in any previous year, and 2005 has proven even more deadly, with attacks in Iraq alone averaging more than one per day, according to data gathered by the U.S. military. The July 2005 London and Sinai bombings, a second round of bombings at tourist destinations in Bali in October, coordinated hotel bombings in Jordan in November, the arrival of suicide bombings in Bangladesh in December, a record year of attacks in Afghanistan, and daily bombings in Iraq have spurred renewed interest in suicide terrorism, with recent analyses stressing the strategic logic, organizational structure, and rational calculation involved. Whereas they once primarily consisted of organized campaigns by militarily weak forces aiming to end the perceived occupation of their homeland, as argued by University of Chicago political scientist Robert Pape in Dying to Win: The Strategic Logic of Suicide Terrorism, suicide attacks today serve as banner actions for a thoroughly modern, global diaspora inspired by religion and claiming the role of vanguard for a massive, media-driven transnational political awakening. Living mostly in the diaspora and undeterred by the threat of retaliation against original home populations, jihadis, who are frequently middle-class, secularly well educated, but often “born-again” radical Islamists, including converts from Christianity, embrace apocalyptic visions for humanity's violent salvation. In Muslim countries and across western Europe, bright and idealistic Muslim youth, even more than the marginalized and dispossessed, internalize the jihadi story, illustrated on satellite television and the Internet with the ubiquitous images of social injustice and political repression with which much of the Muslim world's bulging immigrant and youth populations intimately identifies. From the suburbs of Paris to the jungles of Indonesia, I have interviewed culturally uprooted and politically restless youth who echo a stunningly simplified and decontextualized message of martyrdom for the sake of global jihad as life's noblest cause. They are increasingly as willing and even eager to die as they are to kill. The policy implications of this change in the motivation, organization, and calculation of suicide terrorism may be as novel as hitherto neglected. Many analysts continue to claim that jihadism caters to the destitute and depraved, the craven and criminal, or those who “hate freedom.” Politicians and pundits have asserted that jihadism is nihilistic and immoral, with no real program or humanity. Yet, jihadism is none of these things. Do we really understand the causes of today's suicide terrorism? Do suicide attacks stem mainly from a political cause, such as military occupation? Do they need a strong organization, such as Al Qaeda? What else could be done to turn the rising tide of martyrdom? (shrink)

We argue that this restrictive isomorphic matching definition is deeply problematic because it deviates dramatically from traditional conceptualizations of empathy and unmoors the construct from generations of scientific research and clinical practice; insistence on an isomorphic form undercuts much of the functional value (...) of empathy from multiple perspectives of analysis; and combining the opposing concepts of isomorphic matching and self-other awareness implicitly requires motivational content, causing the RIM definition to implicitly require the kind of non-matching emotional content that it explicitly seeks to exclude. On July 18, 1988, workers at the Metropolitan YWCA Women's Services, a Chicago-area center designed to assist women and children who are survivors of violence and sexual assault, agreed to record in a journal their thoughts at a chosen hour during that day. Each section was written by a different worker. The purpose was to bring together separate voices, all connected through their common work with survivors to begin to understand the impact of this work on their own lives.

In this paper, I examine a heretofore ignored critic of Descartes on the heterogeneity problem: Anton Wilhelm Amo. Looking at Amo’s critique of Descartes reveals a very clear case of a thinker who attempts to offer a causal system that is not a solution to the mind-body problem, but rather that transcends it. The focus of my discussion is Amo’s 1734 dissertation: The Apathy [ἀπάθεια] of the Human Mind or The Absence of Sensation and the Faculty of Sense in the (...) Human Mind and their Presence in our Organic and Living Body. Amo’s discussion of the interaction, or lack thereof, of the mind and body hinges on the essential feature he identifies for the human mind—apathy, that is, impassivity. In this work, Amo engages explicitly with Descartes’s writing, which allows us to more precisely see the nature of his agreement and disagreement with the Cartesian metaphysics of mind. I proceed by treating Amo’s five stated criteria for spirit-hood which, in turn, reveal the kinds of causal connections that are possible for embodied spirits on his view. My aim is threefold: To lay out what I take to be Amo’s view of and arguments for the five criteria he takes to be required for a substance to be spirit. To locate Amo’s agreement and disagreement with Descartes. To suggest that Amo’s view on mind-body interaction involves a kind of occasional causation. (shrink)

This book is the most comprehensive and rigourous critique of the ways disciplinary boundaries still inhibit knowledge-production and integration.

In the recent methodological individualism-holism debate on explanation, there has been considerable focus on what reasons methodological holists may advance in support of their position. We believe it is useful to approach the other direction and ask what considerations methodological individualists may in fact offer in favor of their view about explanation. This is the background for the question we pursue in this paper: Why be a methodological individualist? We start out by introducing the methodological individualism-holism debate while distinguishing two (...) forms of methodological individualism: a form that says that individualist explanations are always better than holist accounts and a form that says that providing intervening individualist mechanisms always makes for better explanations than purely holist ones. Next, we consider four lines of reasoning in support of methodological individualism: arguments from causation, from explanatory depth, from agency, and from normativity. We argue that none of them offer convincing reasons in support of the two explanatory versions of individualism we consider. While there may well be occasions in which individualists’ favorite explanations are superior, we find no reason to think this always must be the case. (shrink)

Within the political economy of informational capitalism, commercial surveillance practices are tools for resource extraction. That process requires an enabling legal construct, which this essay identifies and explores. Contemporary practices of personal information processing constitute a new type of public domain—a repository of raw materials that are there for the taking and that are framed as inputs to particular types of productive activity. As a legal construct, the biopolitical public domain shapes practices of appropriation and use of personal information in (...) two complementary and interrelated ways. First, it constitutes personal information as available and potentially valuable: as a pool of materials that may be freely appropriated as inputs to economic production. That framing supports the reorganization of sociotechnical activity in ways directed toward extraction and appropriation. Second, the biopolitical public domain constitutes the personal information harvested within networked information environments as raw. That framing creates the backdrop for culturally situated techniques of knowledge production and for the logic that designates those techniques as sites of legal privilege. (shrink)

Pragmatism’s naturalism is inconsistent with the phenomenological tradition’s anti-naturalism. This poses a problem for the methodological consistency of phenomenological work in the pragmatist tradition. Solutions such as phenomenologizing naturalism or naturalizing phenomenology have been proposed, but they fail. As a consequence, pragmatists and other naturalists must answer the phenomenological tradition’s criticisms of naturalism.

Qualitative researchers sometimes talk about objectivity in relation to qualitative data sets. In this paper, I defend a reconstructed notion of objective qualitative data sets that may serve as a useful and reachable guiding ideal in qualitative data generation. In the first part of the paper, I develop the ideal. According to it, a qualitative data set is objective to the extent that it, in conjunction with true assumptions, possesses a combination of good-making features in virtue of which the data (...) set is suited to serve as evidence base for a satisfying answer to the research question under study. In the second part of the paper, I examine and reject two possible lines of objection to this ideal: One is that it picks out the wrong good-making features. The other is that the very focus on good-making features is misguided: the objectivity of a qualitative data set should instead be seen as a matter of how it was generated or evaluated. (shrink)

Because they contain idealizations, scientific models are often considered to be misrepresentations of their target systems. An important question is therefore how models can explain the behaviours of these systems. Most of the answers to this question are representationalist in nature. Proponents of this view are generally committed to the claim that models are explanatory if they represent their target systems to some degree of accuracy; in other words, they try to determine the conditions under which idealizations can be made (...) without jeopardizing the representational function of models. In this article, we first outline several forms of this representationalist view. We then argue that this view, in each of these forms, omits an important role of idealizations: that of facilitating the identification of the explanatory components within a model. In “Moral Luck” Bernard Williams describes a lorry driver who, through no fault of his own, runs over a child, and feels “agent-regret.” I believe that the driver’s feeling is moral since the thought associated with this feeling is a negative moral evaluation of his action. I demonstrate that his action is not morally inadequate with respect his moral obligations. However, I show that his negative evaluation is nevertheless justified since he acted in way that does not live up to (...) his moral values. I then use this distinctive negative moral evaluation to distinguish agent-regret from guilt and mere regret. (shrink)

In this paper the authors argue that the exploration of the nature of needs and rights should begin with the actually existing organization of care and of justice in society. The authors raise two key concerns with this organization: 1) the invisibility of care to some, and 2) the inaccessibility of rights to others. Recent work by care scholars has called attention to the ways the current organization of care work perpetuates the myth of self-sufficiency for some, while reducing others (...) to mere dependents. Law and Society scholars have demonstrated the problems of uneven access to legal remedies within the current organization of the legal system. Addressing these concerns simultaneously reveals both the problems of the current organization of needs and rights as well as illuminating alternative possibilities. The authors argue, first, that a justice perspective, based on rights is inadequate because its presumed universality is belied by the reality of the inaccessibility of rights to many. Second, the authors argue that a care perspective, currently formulated upon the assumption that only some people have needs, is also flawed because its presumed particularity distorts the human experience and subsequent policies. Instead, the authors need to conceive of care in a public way that permits both rights and needs to be understood as applicable to all. Building upon the foundations laid by Russell, Donnellan, Chastain, and more recently, Almog, this paper addresses key questions about the basic mechanism by which we think of worldly objects, and (in contrast to many connected projects), does so in isolation from questions about how we speak of them. I outline and defend a view based on the notion of bound cognition. Bound cognition, like perception, is world-to-mind in the sense that it is generated by the item being thought of rather (...) than by the mind doing the thinking. It is a direct, two-place, non-representational relation, and it is prior to any epistemic connection between the thinker and the object of thought. Although the paradigm case for bound cognition involves sensory perception of an individual, I argue that the cognitive relations falling under the heading of bound cognition also include non-perceptual cognitive relations (such as the relation between a thinker and a historical individual) as well as cognitive relations to non-individuals (such as pairs, pluralities, species, and features). Four illustrative cases are discussed, and anticipated worries about abstract and empty cases are addressed. (shrink)

It is currently common to conceive of the classic methodological individualism–holism debate in level terms. Accordingly, the dispute is taken to concern the proper level of explanations in the social sciences. In this paper, I argue that the debate is not apt to be characterized in level terms. The reason is that widely adopted notions of individualist explanations do not qualify as individual-level explanations because they span multiple levels. I defend this claim relative to supervenience, emergence, and other accounts of (...) the social world as levelled. Moreover, I discuss the consequences of this finding for the ongoing methodological individualism–holism debate. (shrink)
