This issue includes a number of papers on reproductive ethics, broadly construed. In a recent book, Anja Karnein proposed that embryos created in vitro should be offered up for adoption before being discarded or used in research;1 here Timothy Murphy offers a critical response . Elsewhere, Tak Chan and Stark & Delatycki debate the role of medical professionals in providing parentage determination. Chan argues that doctors are obliged to provide parentage tests when this is requested by parents, provided there is (...) a low risk that the child will be abandoned . Stark & Delatycki discuss some difficulties raised by the ‘risk of abandonment’ condition . Finally, papers by Kate Greasley and David Lang discuss the controversy surrounding the criminal prosecution of abortion doctor Kermit Gosnell. Greasley criticises the way in which some commentators capitalised on horror at Gosnell's extreme practices to advance more general anti-abortion objectives . Lang argues, against Greasley, that the dominant pro-life response to the case was neither self-contradictory nor intellectually dishonest .The issue is dominated, however, by discussions of ‘bioenhancement’ – the use of biomedical technologies to augment human capacities. A common criticism of bioenhancements is that they are anti-social: though they may benefit the user, they will have a negative effect on society-at-large. Such concerns are perhaps well placed in relation to the most obvious contemporary examples of bioenhancement: doping in sport, aesthetic medicine, and the use of stimulants to enhance examination performance. The Marxist history of science has played an enormous role in the development of the history of science. Whether through the appreciation of its insights or the construction of a political fortress to prevent infusion, its presence is felt. From 1931 the work of Marxists played an integral part in the international development of the history of science, though rarely have the connections between them or their own biographies been explored. These networks convey a distinct history, alongside political, methodological and (...) personal implications, impressing on us a greater understanding of the possibilities that were present and were lost in the most turbulent of decades. Two of the most notable were Boris Hessen, a founder of Marxist history of science, and J. G. Crowther, one of its most prolific exponents. My examination explores aspects of the dialogue between these controversial figures, starting with brief biographical sketches. Their lives became briefly entwined following the Second International Congress of the History of Science and Technology in 1931, demonstrated with reference to the meeting and the correspondence between them until Hessen's death. In doing so, some new facts and old controversies surface, though most importantly the nature of the correspondence carries implications for the Marxist history of science and for the wider movement of which it is part. Scare Tactics, the first book on the subject, provides a theory of the structure of reasoning used in fear and threat appeal argumentation. Such arguments come under the heading of the argumentum ad baculum, the `argument to the stick/club', traditionally treated as a fallacy in the logic textbooks. The new dialectical theory is based on case studies of many interesting examples of the use of these arguments in advertising, public relations, politics, international negotiations, and everyday argumentation on all kinds of (...) subjects. Many of these arguments are amusing, once you see the clever tactic used; others are scary. Some of the arguments appear to be quite reasonable, while others are highly suspicious, or even outrageously fraudulent. In addition to the examples taken from logic textbooks, other cases treated come from a variety of sources, including political debates, legal arguments, and arguments from media sources, like magazine articles and television ads. The purpose of this book is to explain how such arguments work as devices of persuasion, and to develop a method for analyzing and evaluating their reasonable and fallacious uses in particular cases. The book shows how such arguments share a common structure, revealing several distinctive forms of argument nested within each other. Based on its account of this cognitive structure, the new dialectical theory presents methods for identifying, analyzing, and evaluating these arguments, as they are used in specific cases. The book is a scholarly contribution to argumentation theory. It is written in an accessible style, and uses many colorful and provocative examples of fear and threat appeal arguments that are suitable for classroom discussions. The matters treated will be of interest to professionals and students in law, critical thinking, advertising, speech communication, informal logic, cognitive science, rhetoric, and media studies. This paper explains the importance of classifying argumentation schemes, and outlines how schemes are being used in current research in artificial intelligence and computational linguistics on argument mining. It provides a survey of the literature on scheme classification. What are so far generally taken to represent a set of the most widely useful defeasible argumentation schemes are surveyed and explained systematically, including some that are difficult to classify. A new classification system covering these centrally important schemes is built.

Many philosophers hold that the achievement of one's goals can contribute to one's welfare apart from whatever independent contributions that the objects of those goals or the processes by which they are achieved make. Call this the Achievement View, and call those who accept it achievementists. In this paper, I argue that achievementists should accept both that one factor that affects how much the achievement of a goal contributes to one’s welfare is the amount that one has invested in that (...) goal and that the amount that one has invested in a goal is a function of how much one has personally sacrificed for its sake, not a function of how much effort one has put into achieving it. So I will, contrary to at least one achievementist, be arguing against the view that the greater the amount of productive effort that goes into achieving a goal, the more its achievement contributes to one's welfare. Furthermore, I argue that the reason that the achievement of those goals for which one has personally sacrificed matters more to one’s welfare is that, in general, the redemption of one's self-sacrifices in itself contributes to one’s welfare. Lastly, I argue that the view that the redemption of one's self-sacrifices in itself contributes to one's welfare is plausible independent of whether or not we find the Achievement View plausible. We should accept this view so as to account both for the Shape of a Life Phenomenon and for the rationality of honoring "sunk costs.". (shrink)

Use of argumentation methods applied to legal reasoning is a relatively new field of study. The book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. Several diagrams and tables from review articles during the Ox-Phos Controversy serve as an occasion to assess the nature of competition in models of theory choice in science. Many models follow "Super-Bowl" principles of polar, either-or, winner-take-all competition. A significant alternative highlighted by this episode, however, is the differentiation of domains. Incommensurability and the partial divergence of overlapping domains serve both as signals and context for shifting frameworks of competition. Appropriate strategies may thus help researchers diagnose the status of competition (...) and shape their research accordingly. (shrink)

Hamblin distinguished between formal and descriptive dialectic. Formal normative models of deliberation dialogue have been strongly emphasized as argumentation frameworks in computer science. But making such models of deliberation applicable to real natural language examples has reached a point where the descriptive aspect needs more interdisciplinary work. The new formal and computational models of deliberation dialogue that are being built in computer science seem to be closely related to some already existing and very well established computing technologies such as problem (...) solving and decision making, but whether or how dialectical argumentation can be helpful to support these systems remains an open question. The aim of this paper is to examine some real examples of argumentation that seem to hover on the borderlines between deliberation, problem solving and decision making. (shrink)

Dual-ranking act-consequentialism (DRAC) is a rather peculiar version of act-consequentialism. Unlike more traditional forms of act-consequentialism, DRAC doesn’t take the deontic status of an action to be a function of some evaluative ranking of outcomes. Rather, it takes the deontic status of an action to be a function of some non-evaluative ranking that is in turn a function of two auxiliary rankings that are evaluative. I argue that DRAC is promising in that it can accommodate certain features of commonsense morality (...) that no single-ranking version of act-consequentialism can: supererogation, agent-centered options, and the self-other asymmetry. I also defend DRAC against three objections: (1) that its dual-ranking structure is ad hoc, (2) that it denies (putatively implausibly) that it is always permissible to make self-sacrifices that don’t make things worse for others, and (3) that it violates certain axioms of expected utility theory, viz., transitivity and independence. This paper attempts to synthesize the Winchian stress on constitutive rules with the Marxian stress on material relationships by developing the concept of emergently material social relations. Such relationships, it is argued, arise from the constitutive rules that constitute a group's way of life. Although such relationships thus are derivative from the conscious rule-following behavior of actors, nevertheless they have an objective existence independent of actors' specific awareness. It is argued that such material relations are an important mechanism beyond the (...) cultural rules through which our behavior is constrained, enabled, and motivated. Yet the Winchian tradition in general and contemporary structuration theory in particular have tended to peripheralize the notion of material relations, treating them largely as epiphenomenal abstractions. This, it is argued, is a mistake and the source of an important lacuna in structuration theory. In particular, because structuration theory decenters the actor, conflates the distinction between regulative and constitutive rules, and peripheralizes social relations, it lacks an adequate explanation of motivation, as symptomized by its inordinate appeal to the unconscious. The concept of emergently material social relations overcomes this problem and offers a reintegration of the Marxian and the Winchian traditions. (shrink)

In this paper it is shown how plausible reasoning of the kind illustrated in the ancient Greek example of the weak and strong man can be analyzed and evaluated using a procedure in which the pro evidence is weighed against the con evidence using formal, computational argumentation tools. It is shown by means of this famous example how plausible reasoning is based on an audience’s recognition of situations of a type they are familiar with as normal and comprehensible in their (...) shared common knowledge. The paper extends previous work on this example by using three new multiagent argumentation schemes closely related to the scheme for argument from negative consequences. (shrink)

Amphiboly has been widely recognized, starting from the time of Aristotle, as an informal fallacy arising from grammatical ambiguity. This paper applies the profiles of dialogue tool to the fallacy of amphiboly, providing a five-step evidence-based procedure whereby a syntactically ambiguous sentence uttered in a natural language text can be evaluated as committing a fallacy of amphiboly. A user applies the tool to a natural language text by comparing a descriptive graph, representing how the argumentation actually went, to a normative (...) graph, representing how the argumentation should ideally have proceeded. This article seeks to answer why there are two different versions of Meno’s Paradox. I argue that the dilemma contained in Socrates’s version is a pre-existing puzzle, familiar to both Meno and Socrates before their discussion. The two versions of the paradox are thus different because Meno’s version is a mistaken attempt to remember the puzzle contained in Socrates’s version. Although Meno’s version is a mistaken attempt to state Socrates’s version, it is a philosophically richer puzzle that makes three interesting (...) points about inquiry and recognition. After arguing that Socrates’s version is unsound and that Meno’s version is an attempt to recollect or remember it, I analyze Meno’s version in detail. In closing, I consider the relationship between the notion of recognition, which figures prominently in Meno’s version, and the theory of recollection, suggesting that the latter may have arisen as an attempt to explain the origin of moral intuitions. If you look up οἶκος in Liddell and Scott, you find the instances classified in three main divisions: first those meaning a house, or sometimes other kinds of building; secondly ‘one's household goods, substance’, for which I shall generally say ‘property’, though Liddell and Scott do not actually use that word; and thirdly ‘family’. This threefold distinction is sound, and I shall adhere to it here. Admittedly one sometimes finds an instance where it is not easy to decide which sense (...) the word has. This book illuminates contemporary educational reform discussions regarding teacher education programs and pre-K-12 schools by providing a clear analysis and application of John Dewey's relevant educational writings and ideas. The volume addresses issues of how future teachers should be liberally educated as well as prepared to be professional educators. Pre-K-12 education is evaluated through a Deweyan lens, involving a discussion of such topics as the teacher's responsibilities, charter schools, a common curriculum, professional development schools, new curricula, school administration, and cooperative (...) learning. This essay focuses on one aspect of the social thought of Martin Luther King, Jr.: his social ethics. Specifically, it poses the question whether, in what sense, and from what time it is correct to consider King a democratic socialist. The essay argues that King was in fact a democratic socialist and, contrary to the implications of some recent interpreters who have focused on transformation and radicalization in King's thought, that King's democratic socialism was rooted in his formative experience of (...) the black religious tradition and was manifested from his student days at Crozer Theological Seminary forward. The change that may be discerned in King's later years was only a refinement, not a transformation, of his basic orientation. (shrink)

Over last half of the twentieth century, a silent revolution in post-material values made significant advances around the world. The formation of post-material values also resulted in expanded participation in post-material experiences such as joining voluntary groups, pursuing creativity and independence in the world of work, and engaging in political actions—experiences that go beyond a strict focus on accumulating economic wealth and material possessions. Because social class position matters for being a post-materialist, a class divide exists between middle-class post-materialists and (...) working-class materialists who occupy the lower end of the social class spectrum. This article will show that such a divide occurs, first for participation in post-material experiences and second for the attainment of life satisfaction. Using data from the World Values Survey, evidence will be provided in this article showing that members of the working class participate less in post-material experiences than others and, as a consequence, enjoy lower life satisfaction than others, especially post-materialists. In light of working-class-supported right-wing populism’s recent emergence in the USA and Europe, this social class divide takes on a special significance in explaining shifting trends in politics and public policy. This article experiments with multimedia storytelling to re-vision difference outside biomedical and humanistic frames by generating new understandings of living dis/artfully with illness. We present and analyze seven short videos created by women and trans people living with illness as part of an arts-based research project that aimed to speak back to hegemonic concepts of disability that create barriers to healthcare.1 We call for a welcoming in of disability studies’ disruptive and re-imaginative orientations to bodily difference to unsettle medicine’s humanistic (...) accounts. This article considers what can be learned regarding the ethical acceptability of intrusive interventions intended to halt the spread of infectious disease (‘Infection Control’ measures) from existing ethical discussion of intrusive interventions used to prevent criminal conduct (‘Crime Control’ measures). The main body of the article identifies and briefly describes six objections that have been advanced against Crime Control, and considers how these might apply to Infection Control. The final section then draws out some more general lessons from the foregoing (...) analysis for the ethical acceptability of different kinds of Infection Control. (shrink)

Values intersect with science in three primary ways. First, there are values, particularly epistemic values, which guide scientific research itself. Second, the scientific enterprise is always embedded in some particular culture and values enter science through its individual practitioners, whether consciously or not. Finally, values emerge from science, both as a product and process, and may be redistributed more broadly in the culture or society. Also, scientific discoveries may pose new social challenges about values, though the values themselves may be (...) conventional. Multimorbidity, the presence of multiple health conditions that must be addressed, is a particularly difficult situation in patient management raising issues such as the use of multiple drugs and drug-disease interactions. Clinical Guidelines are evidence-based statements which provide recommendations for specific health conditions but are unfit for the management of multiple co-occurring health situations. To leverage these evidence-based documents, it becomes necessary to combine them. In this paper, using a case example, we explore the use of argumentation schemes to reason (...) and combine evidence-based recommendations from clinical guidelines, expected effects, conflicts stemming from said recommendations, and preferences regarding treatment goals. We compare the results of reasoning using the schemes for practical reasoning and argument from negative consequences in the Carneades Argumentation System with those of ASPIC-G, an extension of the artificial intelligence system ASPIC+. In his "A Neglected Argument for the Reality of Goc" (1908), Charles Peirce argued for two dimensions of belief in God's reality. On the one side, he maintained that this belief would be useful for guiding the conduct of life; on the other side, he maintained that the belief could function as the first stage in a scientific inquiry. My suggestion in this paper is that we examine the last of Peirce's 1903 lectures on pragmatism at Harvard to see how (...) the possibility of this dual function arises out of his late theory of cognition in which the functional certainty of perception is brought to close quarters with the provisionality of hypotheses. The upshot is that for Peirce a healthful religious belief should internally "marry" science and religion —theory and practice — by allowing provisional and vague conceptions of God to carry on the work of guiding conduct. /// No texto "A Neglected Argument for the Reality of God" (1908), Charles Peirce defende que há duas dimensões de crença na realidade de Deus. Thoreau responded by saying that his religiosity pervaded his works but that no one noticed it. This result was enabled by the cultural belief that religiosity entailed formal religion, creeds, fixed rituals, and overt discussions of God or gods.
