A realist view of numbers often rests on the following thesis: statements like ‘The number of moons of Jupiter is four’ are identity statements in which the copula is flanked by singular terms whose semantic function consists in referring to a number (henceforth: Identity). On the basis of Identity the realists argue that the assertive use of such statements commits us to numbers. Recently, some anti-realists have disputed this argument. According to them, Identity is false, and, thus, we may deny (...) that the relevant statements commit us to numbers. The present paper argues that the correct linguistic analysis of the relevant number statements supports the anti-realist view that Identity is false. However, as will further be shown, pace the anti-realist, this analysis does not establish that such statements do not commit us to numbers after all. (shrink)

Many legal, social, and medical theorists and practitioners, as well as lay people, seem to be concerned with the harmfulness of discriminative practices. However, the philosophical literature on the moral wrongness of discrimination, with a few exceptions, does not focus on harm. In this paper, I examine, and improve, a recent account of wrongful discrimination, which divides into a definition of group discrimination, and a characterisation of its moral wrong-making feature in terms of harm. The resulting account analyses the wrongness (...) of discrimination in terms of intrapersonal comparisons of the discriminatee’s actual, and relevantly counterfactual, well-being levels. I show that the account faces problems from counterfactuals, which can be traced back specifically to the orthodox - comparative, counterfactual, welfarist - concept of harm. I argue that non-counterfactual and non-comparative harm concepts face problems of their own, and don’t fit easily with our best understanding of discrimination; hence they are unsuitable to replace the orthodox concept here. I then propose a non-orthodox - comparative, counterfactual, hybrid - concept of harm, which relies on counterfactual comparisons of ways of being treated. I suggest how such a concept can help us handle the problems from counterfactuals, at least for my account of discrimination. I also show that there are similar proposals in other harm-related debates. An upshot of the paper is thus to corroborate the case for a non-orthodox, hybrid concept of harm, which seems better able to fulfil its functional roles in a variety of contexts. (shrink)

The concept of a devil's advocate—a cooperative arguer who assumes the role of an opponent for the sake of the argument—serves as a lens to bring into clearer focus the ways that adversarial arguers can be virtuous and adversariality itself can contribute to argumentation's goals. It also shows the different ways arguments can be adversarial and the different ways that argumentation can be said to be "essentially" adversarial.

The term "teaching" is usually used in the Academy without a clear sense of what is meant, resulting in imprecise and ineffective teaching. The standard lines-that teaching is a matter of applying approved methods, that teaching is mostly a matter of teaching skills-as-means to some career or whatever-are reflective of failure in the Academy, measured in its "defect rate" of around 30 percent. The definition of teaching I sketch-skills adopted from a theoretical foundation, in turn based on a critique-is well (...) founded in the scholarly tradition. We discuss methodological problems and present our own empirical data on calculation tasks in toddlers. We propose to develop enriching theoretical models concerning quantity representations, based on empirical findings from developmental psychology. A revitalization of the debate is worthy, because it is reminiscent of the philosophical dispute on universal entities in scholasticism and Plato's theory of ideal numbers.

As the pre-eminent Enlightenment philosopher, Kant famously calls on all humans to make up their own minds, independently from the constraints imposed on them by others. Kant's focus, however, is on universal human reason, and he tells us little about what makes us individual persons. In this book, Katharina T. Kraus explores Kant's distinctive account of psychological personhood by unfolding how, according to Kant, we come to know ourselves as such persons. Drawing on Kant's Critical works and on his (...) Lectures and Reflections, Kraus develops the first textually comprehensive and systematically coherent account of our capacity for what Kant calls 'inner experience'. The novel view of self-knowledge and self-formation in Kant that she offers addresses present-day issues in philosophy of mind and will be relevant for contemporary philosophical debates. In Virtue, Piety and the Law Katharina Ivanyi examines Birgivī Meḥmed Efendī's (d. 981/1573) al-Ṭarīqa al-muḥammadiyya, a major work of pietist exhortation and advice, composed by the sixteenth-century Ottoman jurist, Ḥadīth scholar and grammarian, who would articulate a style of religiosity that had considerable reformist appeal into modern times. Linking the cultivation of individual virtue to questions of wider political, social and economic concern, Birgivīplayed a significant role in the negotiation and articulation of early modern Ottoman Ḥanafīpiety. Birgivī's deep (...) mistrust of the passions of the human soul led him to prescribe a regime of self-surveillance and control that was only matched in rigor by his likewise exacting interpretation of the law in matters of everyday life, as much as in state practices, such as the cash waqf, Ottoman land tenure and taxation. Because it is often argued that surrogacy should not be treated as contractual, the question arises in which terms this practice might then be couched. In this article, I argue that a phenomenology of surrogacy centering on the notion of trust provides a description that is illuminating from the moral point of view. My thesis is that surrogacy establishes a complex and extended reproductive unit––the “surrogacy triad” consisting of the surrogate mother, the child, and the intending parents––whose constituents are bound (...) together by mutual trustful commitments. Even though a trust-based approach does not provide an ultimate answer to whether surrogacy should be sanctioned or prohibited, it allows for at least some practical suggestions. In particular, I will argue that, under certain conditions, surrogacy is tenable within familial or other significant relationships, and I will stress the necessity of acknowledging the new relationships and moral commitments that result from this practice. German medical schools have not yet sufficiently introduced students to the field of good scientific practice. In order to prevent scientific misconduct and to foster scientific integrity, courses on GSP must be an integral part of the curriculum of medical students. Based on a review of the literature, teaching units and materials for two courses on GSP were developed and tested in a pilot course. The pilot course was accompanied by a pre-post evaluation that assessed students’ knowledge and attitudes towards (...) scientific integrity and scientific misconduct. A syllabus was designed that comprised the following six topics: theoretical foundations of GSP; scientific publishing; empirical data; scientific supervision and teamwork; clinical research; personal interests. The comparison pre versus post-intervention yielded statistically significant changes in regard to the participants’ knowledge and attitude toward all forms of scientific misconduct treated in the course. As the majority of participants was not familiar with the fundamental regulations or guidelines of GSP, it seems crucial to train students in actively applying such norms to real-world conflicts. Students’ unfamiliarity with the fundamentals of GSP can be linked to the fact that many students have already experienced forms of scientific misconduct. Thus, GSP syllabi should be closely adjusted to a student’s realm of experience. All in all, courses on GSP can be seen as a potential means to increase the number of young scholars. (shrink)

Linear depictions of the evolutionary process are ubiquitous in popular culture, but linear evolutionary imagery is strongly rejected by scientists who argue that evolution branches. This point is frequently illustrated by saying that we didn't evolve from monkeys, but that we are related to them as collateral relatives. Yet, we did evolve from monkeys, but our monkey ancestors are extinct, not extant. Influential voices, such as the late Stephen Jay Gould, have misled audiences for decades by falsely portraying the linear (...) and branching aspects of evolution to be in conflict, and by failing to distinguish between the legitimate linearity of evolutionary descent, and the branching relationships among collateral relatives that result when lineages of ancestors diverge. The purpose of this article is to correct the widespread misplaced rejection of linear evolutionary imagery, and to re-emphasize the basic truth that the evolutionary process is fundamentally linear. Richard Rorty and Stanley Cavell are both preoccupied with questions of contingency: whether conventions are ‘merely’ conventional, what kind of foothold they might provide, how to step away from convention, how to make convention one’s own. Not that the work of either philosopher could be described as conventional. Neither produced the philosophical equivalent of the ‘hackwork’ characterizing Thomas Kuhn’s ‘normal science’. Both philosophers invoke traditional philosophical argumentation, but do so only to depart from its terms. While Austrian social and healthcare service nonprofit organizations are key performers in the COVID-19 pandemic, we also notice their vulnerability in terms of struggling with this disruptive extreme context. The particularity of disruptive extreme contexts is that organizations commonly can neither anticipate them, nor prepare specific countermeasures or specialized resources for fighting against them. Thus, we regard organizational resilience based on non-specialized resources as an appropriate approach for dealing with disruptive extreme contexts. Organizational resilience refers to an organization's ability to (...) resist disruptive extreme contexts while maintaining and adapting functionality and ultimately learning from these extreme contexts by mobilizing and accessing the required resources, behaviors and capabilities. Based on 33 expert interviews with NPO top and middle managers we aim to explore individual-based and interactional resilience mechanisms of NPOs in the pandemic. The qualitative content analysis yielded to following results: Individual personality traits and attitudes constitute individual-based resilience mechanisms. Moreover, a shared understanding, social connectedness and managerial staff orientation as interactional resilience mechanisms helped to maintain and adapt NPOs' functioning. Overall, this study reinforces the multilevel nature of resilience in terms of the crucial combination of individual and interactional resilience mechanisms for facing adversity. Moreover, it emphasizes the evolving nature of resilience in terms of the required time for, e.g., building trust. (shrink)

Usually, rhetoric is supposed to provide a model of law which describes legal interactions as volitive, arbitrary, and void of any system. However, the Mainz School, founded by Theodor Viehweg, proves the contrary: without referring to any metaphysics, such as consensus or auditoire universel, it seeks to discover the systematic character and the more or less flexible structures of legal rhetoric.

In addition to the socio-relational framework of expressive behaviors (SRFB), we recommend integrating theoretical and empirical findings based on attachment theory. We advocate a dynamic interpretation of early caregiver–child interaction. The consequences of models from developmental psychology for the occurrence of psychopathology are demonstrated from a clinical perspective.

I argue that all rights exist by convention. According to my definition, a right exists by convention just in case its justification appeals to the rules of a socially shared pattern of acting. I show that our usual justifications for rights are circular, that a right fulfills my criterion if all possible justifications for it are circular, and that all existing philosophical justifications for rights are circular or fail. We find three non-circular alternatives in the literature, viz. justifications of rights (...) by consequences, by autonomy or by divine commands. I show that all three alternatives fail, and I conclude that all rights exist by convention. This ontological result has a surprising and beneficial consequence. A common argument against conventionalism is that it implies cultural relativism. I finish by showing that the suggested conventionalism is incompatible with cultural relativism. (shrink)

Summary In this contribution, I discuss the relevance of epistemological models for psychotherapy. Despite its importance epistemology is seldom explicitly dealt with in the psychotherapeutic landscape. Based on the presentation of “Critical Realism (CR),” the epistemological position of Gestalt Theoretical Psychotherapy (GTP), I intend to show to which extent this explanatory model supports a differentiated understanding of problems between human beings, arising from the differences in experiencing “reality.” The presentation deals explicitly with some conclusions that can be drawn from the (...) CR model for practical psychotherapeutic work. In particular, the aspects of basic therapeutic attitude, therapeutic relationship, and praxeology are highlighted. (shrink)

This paper examines whether Kant’s Critical philosophy offers resources for a conception of empirical psychology as a theoretical science in its own right, rather than as a part of applied moral philosophy or of pragmatic anthropology. In contrast to current interpretations, this paper argues that Kant’s conception of inner experience provides relevant resources for the theoretical foundation of scientific psychology, in particular with respect to its subject matter and its methodological presuppositions. Central to this interpretation is the regulative idea of (...) the soul, which supplies principles of systematicity at different levels. Firstly, the idea defines the way in which we must reflect on mental beings, i.e., those beings that fall in the domain of psychology. Secondly, it provides a principle for the unification of a systematic body of psychological laws. In consequence, by approaching the object of psychology from the perspective of the self-conscious subject, who––in virtue of being capable of inner experience––first constitutes a psychological reality, Kant’s theory offers an attractive alternative to reductionist conceptions of psychology. When we learn about a severe moral transgression that has been committed, we are often not only horrified but also puzzled. We are inclined to raise questions such as ‘Why did they do this?’ or exclaim: ‘I cannot understand why anyone would do such a thing!’. This suggests that there is something difficult to understand about severe moral wrongs. In this paper, I offer an explanation of the phenomenon that severe moral transgressions are often difficult to understand. I begin by (...) arguing that the relevant sense in which we try but often fail to understand morally bad action is that we try but fail to empathize with the agent at the time of the action. Then, I introduce a distinction between two broad kinds of morally bad action. Finally, I show that each of these kinds of morally bad action gives rise to obstacles to empathizing with the agent at the time of the action. Based on this explanation, I consider whether we should try to overcome this limitation to our understanding. (shrink)

In this paper, we argue that ‘good care’ in residential nursing homes is enacted through different care practices that are either inspired by a ‘professional logic of care’ that aims for justice and non-maleficence in the professional treatment of residents, or by a ‘relational logic of care’, which attends to the relational quality and the meaning of interpersonal connectedness in people’s lives. Rather than favoring one care logic over the other, this paper indicates how important aspects of care are constantly (...) negotiated between different care practices. Based on the intricate everyday negotiations observed during an ethnographic field study at an elderly nursing home in Germany, the paper puts forth the argument that care is always a matter of tinkering with different, sometimes competing ‘goods’. This tinkering process, which unfolds through ‘intuitive deliberation’, ‘situated assessment’ and ‘affective juggling’ is then theorized along the conceptualization of a ‘practical ethics of care’: an ethics which makes no a priori judgments of what may be considered as good or bad care, but instead calls for momentary judgments that are pliable across changing situations. Developmental psychology currently faces a deep puzzle: most children before 4 years of age fail elicited-response false-belief tasks, but preverbal infants demonstrate spontaneous false-belief understanding. Two main strategies are available: cultural constructivism and early-belief understanding. The latter view assumes that failure at elicited-response false-belief tasks need not reflect the inability to understand false beliefs. The burden of early-belief understanding is to explain why elicited-response false-belief tasks are so challenging for most children under 4 years of age. This article sets out to describe and solve two puzzles that emerge in segregated labour markets (e.g. the USA or Sweden). First, in many hiring contexts people profess to adhere to egalitarian norms, and specifically to a qualification norm according to which job qualification should be the basis of employment. Still there is evidence of frequent norm violations (discrimination). Surprisingly, the norm persists and people do not frequently protest against such norm violations. The second puzzle is that people are suspicious (...) of the hiring of minorities, perceiving such hirings as evidence that a ‘political correctness’ norm has replaced the qualification norm. The article proposes that both puzzles can be solved within a game-theoretical model of social norm-following, where implicit bias is introduced into an ‘employment game’. Within this model, implicit bias plays a double role. First, it interferes with employers' hiring decisions regarding ethnic majority and minority members, respectively. This is the standard way of understanding the effects of implicit bias. Second, implicit bias interferes with bystander evaluations of hired candidates' qualifications. This is a hitherto overlooked effect of implicit bias. The article concludes that once we understand the double role of implicit bias, the two puzzles are resolved. (shrink)

Recently some bioethicists and neuroscientists have argued for an imperative of chemical cognitive enhancement. This imperative is usually based on consequentialist grounds. In this paper, the topic of cognitive self-enhancement is discussed from a Kantian point of view in order to shed new light on the controversial debate. With Kant, it is an imperfect duty to oneself to strive for perfecting one’s own natural and moral capacities beyond one’s natural condition, but there is no duty to enhance others. A Kantian (...) approach does not directly lead to a duty of chemical cognitive self-enhancement, but it also does not clearly rule out that this type of enhancement can be an appropriate means to the end of self-improvement. The paper shows the benefits of a Kantian view, which offers a consistent ideal of self-perfection and teaches us a lesson about the crucial relevance of the attitude that underlies one’s striving for cognitive self-improvement: the lesson of treating oneself as an end in itself and not as mere means to the end of better output. This paper is concerned with an intuitive contrast that arises when we consider sentences containing empty definite descriptions. A sentence like ‘The king of France is bald’ appears neither true nor false, while a sentence like ‘My friend was visited by the king of France’ appears false. Recently, Stephen Yablo has suggested an account of this intuitive contrast. Yablo’s account is particularly interesting, since it has important consequences for the ontological commitments of number sentences like ‘The number of planets is (...) even’. However, the paper argues that Yablo’s account is not convincing and that it can thus not establish these consequences. Further, it develops a Strawsonian account of the intuitive contrast. The developed account allows us to draw important conclusions regarding the correct analysis of definite descriptions and of existence sentences containing definite descriptions. (shrink)
