In this first installment of a three-part series, I focus on the critique of civility. In so doing, I do not defend incivility. In fact, part of my critique of civility extends equally to incivility. My position is that we must move our normative discourse beyond both the thesis of civility and the antithesis of incivility to a synthesis that reframes the discussion in terms of nonviolence.

Dimensions of the ethical work climate, as conceptualized by Victor and Cullen (1988), are potentially important influences on individual ethical decision-making in the organizational context. The present study examined the direct and indirect effects of individuals' perceptions of work climate on their ethical judgments and behavioral intentions regarding an ethical dilemma. A national sample of marketers was surveyed in a scenario-based research study. The results indicated that, although perceived climate dimensions did not have a direct effect on behavioral intentions, there (...) were significant moderating effects. Climates perceived as emphasizing social responsibility and rules/codes moderated the individual ethical judgment-behavioral intentions relationship such that individuals were less likely to say that they would engage in a questionable selling practice even when they themselves did not believe the practice to be unethical. Respondents were somewhat more likely to form intentions consistent with their judgment that the questionable practice was morally acceptable when the ethical climate was characterized by an emphasis on team/friendship. This paper examines how the Harper Government of Canada shut down both debate about threats and research into environmental risk, a strategy that Canadian scientists characterized as the “death of evidence.” Based on interviews with scientists who research risks to the marine environment, we explore the shifting relationship between science and the Canadian government by tracing the change in the mode of risk calculation supported by the Harper administration and the impact of this change. Five themes emerged from the interviews: (...) erosion of science research capacity, resulting limitations in understanding risk, declining influence on policy and regulation, redirection of public science funds to support the private sector, and the need to broaden the science knowledge base. The Canadian death of evidence controversy represents a challenge to science and technology studies scholars who wish to maintain a critical and reflexive perspective on the scientific enterprise without supporting attacks on evidence. While subsequent Canadian governments may simply return science to an unreflexively privileged knowledge status, we view this as equally damaging to broad risk calculation and democratic science. We suggest instead that a broader gathering of matters of concern will always be essential to risk assessment. (shrink)

Do firms benefit from their voluntary efforts to alleviate the many problems confronting society? A vast literature establishing a “business case” for corporate social responsibility appears to find that usually they do. However, as argued herein, the business case literature has established only that firms usually benefit from responding to the demands of their primary stakeholders. The nature of the relationship between the interests of business and those of broader society, beyond a subset of powerful primary stakeholders, remains an open (...) question despite this vast literature. This article develops a set of propositions that highlight constraints on firms’ ability to profit from CSR and outlines a set of managerial challenges on which researchers must focus their attention to truly determine whether and when firms can profit by responding to the needs of society. Milk, sand, plastic, uranium, wood, carbon, and oil are kinds of stuff. The sand in Hawaii, the uranium in North Korea, and the oil in Iraq are portions of stuff. Not everyone believes in portions of stuff.1 Those who do are likely to agree that, whatever their more specific natures, portions of stuff can at least be identified with mereological sums of their subportions.2 It seems after all trivial that a given portion of stuff just is all of its subportions (...) combined—not by a spatiotemporal or any other substantive unifying relation, but by a mere principle of summation, a principle requiring that, if some things exist, there exists the sum, or collection, of those things. This Special Issue commemorates the 60th anniversary of Business & Society with nine rigorous literature reviews that address important societal problems and provide opportunities for theory development in the business and society field; in this introduction we present an overview of the Special Issue. With the theme “Building on Its Past,” the nine articles address a host of contemporary issues, including climate change, wicked problems, business and human rights, human health, certifications standards, the governance of artificial intelligence, stakeholder engagement, stakeholder (...) theory, and corporate political activity. Together, these reviews offer a wealth of suggested themes, theories and approaches that can drive our research forward for the next decades in business and society research and practice. Using the lens of a miner-prospector continuum to categorize the diversity of articles within this special issue, a common theme emerges across the portfolio of reviews: they all call for a more systemic and integrative perspective toward studying the complex interactions that link business and society actors and issues. Building on these findings, we encourage future scholars to fill long-standing researched gaps through a more open systems approach, which supports both contextually sensitive and multi-level and multi-disciplinary approaches to address grand societal challenges. We conclude with specific suggestions as to how business and society scholars might use an open systems approach, including embracing methodologies to address complex causal pathways, theorizing with a view towards spanning external and internal elements of an organization, and reflecting on the temporal and spatial dynamics of complex systems. We investigate uncertain reasoning with quantified sentences of the predicate calculus treated as the limiting case of maximum entropy inference applied to finite domains.

A traditional association of judgment with "reason" has drawn upon and reinforced an opposition between reason and emotion. This, in turn, has led to a restricted view of the nature of moral judgment and of the subject as moral agent. The alternative, I suggest, is to abandon the traditional categories and to develop a new theory of judgment. I argue that the theory of judgment developed by Justus Buchler constitutes a robust alternative which does not prejudice the case against emotion. (...) We measure the influence of reputation rankings on individuals’ perceptions of firms. Through experimental design, we vary whether and how participants are exposed to a reputation ranking alongside other information about a firm. We find that rankings influence perceptions when they are negative and congruent with other information about the firm. These findings help explain how a firm’s reputation can change even if its characteristics remain constant and why change in a firm’s characteristics can be slow to produce change in (...) its reputation. Extending prior research on the characteristics potentially associated with adolescents’ tendencies to be a moral rebel, the present study found that adolescents themselves, their peers, and their teachers agreed on adolescents’ tendencies to possess a moral identity, possess moral courage characteristics, and be a moral rebel. Although moral identity did not consistently predict the tendency to be a moral rebel, all indices of the adolescents’ moral courage characteristics positively predicted the tendency to be a moral rebel.

In parts one and two of this three-part series, I developed a framework for ahimsic (nonviolent) communication (AC) as an alternative to the standard communicative norm of civility. The framework presented for AC offers various categories of resistance to violence, including nonviolent forms of negotiation, compromise, protest, verbal force, verbal distraction, argumentation, and communicative satyagraha (Gandhian nonviolence applied to communication). I also provided a range of real-life examples of successful AC resistance, including the stories of Derek Black, Daryl Davis, James (...) Lawson, and Antoinette Tuff. These examples demonstrate that AC “works” even against neo-Nazis, KKK grand wizards, angry punch-throwing bikers, and active school shooters. In this third and final installment, I will explain why AC works—better than any form of violent communication (VC). My main claim is that AC derives strategic power from its moral power. As various components of my argument are drawn from the nonviolence tradition more generally, what follows will double as a primer on the morality of nonviolence. However, we will also see significant differences in how we must adapt nonviolent strategy and morality to the case of communication. (shrink)

Rather than a certain decline into workaholism or materialism, the world of business becomes a necessary step on the path of enlightenment, through the transcendant philosophical models of the Hindu householder and the Native American Medicine Wheel.The householder concept, including mastering the material world and the resulting spiritual growth, stresses the importance of action, also a criterion for success in business. During the past two decades Metaphysics of Natural Complexes has exerted a strong a growing influence on the continuing development of contemporary philosophy. This new and expanded edition acknowledges this influence and brings together much material. Included are the previously published articles “On the Concept of ‘the World,’” and “Probing the Idea of Nature,” which Buchler wrote subsequent to Metaphysics of Natural Complexes as extensions and completions of the system. Previously unpublished work on the key concept of contour has also (...) been added. In addition there are excerpts from Buchler’s replies to his critics, a set of editors’ notes to facilitate cross-referencing, and an updated index. This work presents a bold and forceful metaphysics and general ontology. It provides a systematic framework for understanding the broadest features of the world and nature, and for locating our understanding of human nature, selfhood, and society as complexes in and of nature. Buchler’s detailed analysis of identity, ordinality, nature, world, and validation advance our understanding of the basic categories to be used in defining and exploring whatever is. Unlike other contemporary philosophers that confine themselves to narrowly defined problems in hermeneutics or theory of knowledge, Buchler is unrelenting in his drive toward a more encompassing perspective, simultaneously combining interpretive precision with sheer breadth of vision. Interest in subjective values and decision responses are investigated empirically, including statistically testing the predictive relationships between subjective values, other independent variables such as level and area of executive responsibility, and decision responses.

Objective: To assess the adequacy of the process of informed consent for surgical patients at the University Hospital of the West Indies. Method: The study is a prospective, cross-sectional, descriptive study. 210 patients at the University Hospital of the West Indies were interviewed using a standardised investigator-administered questionnaire, developed by the authors, after obtaining witnessed, informed consent for participation in the study. Data were analysed using SPSS V.12 for Windows. Results: Of the patients, 39.4% were male. Of the surgical procedures, (...) 68.6% were scheduled, 7.6% urgent and 23.8% emergency, 35.2% were minor and 64.8% major. Information imparted/received was acceptable in 40% of cases, good in 24% and inadequate (unacceptable) in 36% of cases. Almost all (97.6%) patients stated that they understood why an operation was planned and 93.3% thought that they had given informed consent. Most (95.2%) thought that they had free choice and made up their own mind. A quarter (25.2%) of all patients were told that it was mandatory for them to sign the form. There was a discussion of possible side effects and complications in 56.7% of patients. Conclusions: This study clearly indicates that surgical patients at the University Hospital of the West Indies feel that they have given informed consent. However, it also suggests that more information should be given to patients for consent to be truly informed. (shrink)

This introduction provides an overview of the life, career, and social thought of Gerhard Lenski. Following a preliminary description of Lenski's contributions, this essay is divided into two sections. The first section examines the origins, education, and biographical influences on Lenski as a major social theorist as well as the intellectual foundation of his sociological theories. The second section presents Lenski's work, impact, and legacy and sets the stage for the original essays that are grouped around four of six key (...) areas of Lenski's work, which has had enormous impact on both American and international sociology: (1) teaching sociology; (2) "status crystallization" and "status inconsistency"; (3) sociology of religion and "the religious factor"; (4) social stratification, "power and privilege"; (5) gender stratification in comparative-historical perspective; and (6) ecological-evolutionary theory. While these six areas do not correspond neatly to the progressive phases of Lenski's theory development and sociological career, they are interconnected and reflect Lenski's central concerns in asking the big questions about human societies and in providing explanations for understanding the processes of social change, differentiation, and inequality among and within human societies, across time and space, from hunting and gathering to postindus trial societies. “Due process of law” is arguably the most controversial and frequently-litigated phrase in the American Constitution. Although the dominant originalist view has long been that Fifth and Fourteenth Amendment’s Due Process of Law Clauses are solely “process” guarantees and don’t constrain the “substance” of legislation at all, originalist scholars have in recent years made fresh inquiries into the historical evidence and concluded that there’s a weighty case for some form of substantive due process. In this Article, we review and critique (...) these findings employing our theory of good-faith originalist interpretation and construction. We begin by investigating the “letter” of the Due Process of Law Clauses — that is, the original meaning of their texts. Next, to develop doctrine by which this meaning can be implemented, we identify the clauses’ original function — their “spirit” — of barring arbitrary exercises of power over individuals that rest upon mere will rather than constitutionally proper reasons. We contend that the original letter and spirit of the “due process of law” in both clauses requires federal and state legislators to exercise their discretionary powers in good faith by enacting legislation that is actually calculated to achieve constitutionally proper ends and imposes a duty upon both state and federal judges to make a good-faith determination of whether legislation is calculated to achieve constitutionally proper ends. Finally, we confront hard questions concerning the scope of the states’ reserved powers, acknowledging the flaws in the “police-power” jurisprudence associated with the so-called “Lochner era” and we delineate an approach that will better safeguard all “person(s)” against arbitrary power. By so doing, we assist state and federal legislators by providing clarity concerning the constitutionally proper ends that federal and state legislators can pursue; aid state and federal judges by equipping them to review legislators’ pursuit of those ends; and help members of the public by enabling them to monitor the performance of their legislative and judicial agents. This article examines the regalist reforming critique and the curial defence of papal temporal dominion in the eighteenth-century Italian peninsula. The discussion examines the little-explored links between the justification for papal supremacy in the Church and the historico-theological defence of its theocratic rule. The refusal of the Curia to grant reform gave rise to a radical reforming movement which produced some astoundingly bitter anti-curial polemics little known outside Italian studies, but of some significance in the history of political thought.

The two standard theories of vagueness—vagueness-as-ignorance and vagueness-asindeterminacy—agree on the following principle: if you are certain that it is clearly vague whether p, then you clearly should not believe p and you clearly should not believe not-p. I argue against the principle, and thus against the two standard theories. I offer an explanation of the initial appeal of the principle. And I show how a rival principle helps to better explain a recalcitrant trio of widely accepted data.

Osiurak and Reynaud offer a unified cognitive approach to cumulative technological culture, arguing that it begins with non-social cognitive skills that allow humans to learn and develop new technical information. Drawing on research focusing on how children acquire knowledge through interactions others, we argue that social learning is essential for humans to acquire technical information.

Barnett responds to three articles that put the thought of Søren Kierkegaard in conversation with modern popular media. He argues that each of these pieces demonstrates that Kierkegaard's criticism of the burgeoning free press remains relevant today, particularly in the areas of journalistic practice, mental health, and political responsibility. At the same time, however, Barnett wonders if the radical nature of the Dane's critique has been fully considered. Feminist theory has enhanced and expanded the agency, influence, status and contributions of women throughout the globe. However, feminist critical analysis has not yet examined how the assumption that religion is natural, timeless, universal and omnipresent supports sexist and race based oppression. This book proposes radical new thinking about religion in order to better comprehend and confront the systematic disempowerment of women and marginalized groups. Utilising feminist and post-colonial analysis of access, equity and violence, contributors draw on recent critical theory (...) to collapse accepted boundaries between religion and secularity with the aim of understanding that religion is a technology of governance in its function, meaning and history. The volume includes case studies focusing on how the category of religion is deployed to perpetuate male hegemony and racist inequities in Australia, Mexico, the United States, Britain and Canada.
