Raymond Kelly’s widely cited _Warless Societies and the Origin of War_ (University of Michigan Press, 2000) seeks to explain the origins of two central signatures of human society: war and segmented—i.e., multilevel—societies. Both, he argues, arose with the emergence of a social-substitutability principle, a rule that establishes a collective identity among a set of individuals such that any one member becomes equivalent to, and responsible for the actions of, the others. This principle emerged during the Holocene, when population increase (...) gave rise to the first lethal ambushes. By its nature, ambush obscures attackers’ identities. Those attempting to retaliate for the ambush were therefore obliged to target members of the ambushers’ group indiscriminately—i.e., based on a social-substitutability principle. Kelly’s proposals draw welcome attention to a widespread, deeply influential, and unsettling human behavior, the disposition to hold everyone in a group culpable for the actions of a few, a proclivity that all too often results in mass slaughter. His general argument, however, is logically and empirically deficient, and cross-cultural evidence on ambush in contact-era New Guinea undermines his anonymity-of-ambush hypothesis. What then accounts for war and multilevel society? The New Guinea evidence strongly supports a contention that social-substitutability behavior arose not from offensive military action (i.e., ambush) but from the defensive military response to ambush. These findings render the social-substitutability argument’s unconventional definition of war superfluous, undermine its chronology for the emergence of war, and underwrite an alternative scenario for the origins of multilevel, segmented society. A comprehensive and systematic reconstruction of the philosophy of Charles S. Peirce, perhaps America's most far-ranging and original philosopher, which reveals the unity of his complex and influential body of thought. We are still in the early stages of understanding the thought of C. S. Peirce (1839-1914). Although much good work has been done in isolated areas, relatively little considers the Peircean system as a whole. Peirce made it his life's work to construct a scientifically sophisticated and logically rigorous philosophical (...) system, culminating in a realist epistemology and a metaphysical theory ("synechism") that postulates the connectedness of all things in a universal evolutionary process. In The Continuity of Peirce's Thought, Kelly Parker shows how the principle of continuity functions in phenomenology and semeiotics, the two most novel and important of Peirce's philosophical sciences, which mediate between mathematics and metaphysics. Parker argues that Peirce's concept of continuity is the central organizing theme of the entire Peircean philosophical corpus. He explains how Peirce's unique conception of the mathematical continuum shapes the broad sweep of his thought, extending from mathematics to metaphysics and in religion. He thus provides a convenient and useful overview of Peirce's philosophical system, situating it within the history of ideas and mapping interconnections among the diverse areas of Peirce's work. We employ the Social Signaling Model and life history of a Western Dani big-man, Tibenuk, to analyze a neglected curiosity in the career of the big-man type. The big-man is renowned as an economic entrepreneur, the master of material displays. In New Guinea, however, big-men had invariably first gained fame and some influence as eminent warriors. The SSM accounts for this two-part career path by proposing that small-scale social organization rests on honest, competitive signaling of individual and collective fighting strength, (...) with leaders being those who excel in these contests. The performances for which big-men are already known, conspicuous ceremonial displays, broadcast this strength indirectly. Explicitly conceptualized as symbolic fighting, they constituted indexical proxies for their sponsors’ individual and collective willingness and ability to fight. Success on the battlefield, though, signaled fighting strength more directly. Men therefore had to demonstrate strength on both the battlefield and the ceremonial ground if they were to become big-men. This was Tibenuk’s achievement. When he was young and at his physical peak, he demonstrated outstanding capability in war. War is a young man’s game, however, and as his physical capacities waned, he shifted to politics, an older man’s game, honing his political talents and developing extensive political networks that allowed him to sponsor massive pig feasts, the principal form of conspicuous ceremonial display. Tibenuk’s career also reveals synergies between warrior and political talents that hitherto have been overlooked in big-man analysis. (shrink)

We are, Julia Kristeva writes, strangers to ourselves; and indeed much of contemporary theory describes the human condition as one of alienation. Eloquently arguing that we cannot explain the developement of individuality or subjectivity apart from its social context, Kelly Oliver makes a powerful case for recognizing the social aspects of alienation and the psychic aspects of oppression.

Roscoe Pound, former dean of Harvard Law School, delivered a series of lectures at the University of Calcutta in 1948. In these lectures, he criticized virtually every modern mode of interpreting the law because he believed the administration of justice had lost its grounding and recourse to enduring ideals. Now published in the U.S. for the first time, Pound's lectures are collected in Liberty Fund's The Ideal Element in Law, Pound's most important contribution to the relationship between law and (...) liberty. The Ideal Element in Law was a radical book for its time and is just as meaningful today as when Pound's lectures were first delivered. Pound's view of the welfare state as a means of expanding government power over the individual speaks to the front-page issues of the new millennium as clearly as it did to America in the mid-twentieth century. Pound argues that the theme of justice grounded in enduring ideals is critical for America. He views American courts as relying on sociological theories, political ends, or other objectives, and in so doing, divorcing the practice of law from the rule of law and the rule of law from the enduring ideal of law itself. Roscoe Pound is universally recognized as one of the most important legal minds of the early twentieth century. Considered by many to be the dean of American jurisprudence, Pound was a former Justice of the Supreme Court of Nebraska and served as dean of Harvard Law School from 1916 to 1936. This book makes a case for the permissibility of reactive blame – the angry, harmful variety. Blame is a thorny philosophical problem, as it is notoriously difficult to specify the conditions under which an agent is deserving of blame, is deserving of blame in the basic sense, and furthermore why this is so. Kelly McCormick argues that sharpening the focus to reactive, angry blame can both show us how best to characterize the problem itself, and suggest a possible solution (...) to it, because even reactive blame is both valuable and deserved in the basic sense. Finally, McCormick shows how, despite the many facets of the dark side of blame, adopting an explicitly victim-centered approach highlights a powerful argument from empathy for retaining reactive blame and its attendant attitudes and practices. While I deeply appreciate the painstaking and often generous remarks in R.N. Berki’s review of my book Hegel’s Retreat From Eleusis, [OWL, September 1978], I should like to correct two of his misapprehensions. First, the point is not that I try to “steer a middle course between ‘antiquaries’ who relegate Hegel to history books and ‘renovators’ who believe that Hegel is directly relevant,” but between the former and those who warp Hegel out of context in support of their preferred vision (...) of social and political action and/or explanation. Second, I do not conclude negatively about “the contemporary value of Hegel’s doctrine of the state;” If I had, the book would scarcely have been worth writing. It is simply that, in line with the first point, I counsel caution and salutary “archaeological” reflection. Current reality is messy: Hegel guides us and teaches us, but he furnishes no coup de foudre for solving our institutional problems. If this is irresolute, so be it. Does Mr. Berki propose bringing back monarchy, estates, and early 19th century municipal life? My own position is stated on pp. 109, 142–144, 183, 222–223. Although this may be, in Hayden White’s language, a Rankean trope, my option is surely not for “the historical dustbin.”. (shrink)

In ____Womanizing Nietzsche,__ Kelly Oliver uses an analysis of the position of woman in Nietzsche's texts to open onto the larger question of philosophy's relation to the feminine and the maternal. Offering readings from Nietzsche, Derrida, Irigaray, Kristeva, Freud and Lacan, Oliver builds an innovative foundation for an ontology of intersubjective relationships that suggests a new approach to ethics.

This book is a tribute to Kevin Kelly, who has been one of the most influential British theologians for a number of decades. On its own merits, however, it is groundbreaking collection of essays on key themes, issues and concepts in contemporary moral theology and Christian ethics. Defense of incompletable grounding and discussion of implications for ontological economy.

Epistemic luck has been the focus of much discussion recently. Perhaps the most general knowledge-precluding type is veritic luck, where a belief is true but might easily have been false. Veritic luck has two sources, and so eliminating it requires two distinct conditions for a theory of knowledge. I argue that, when one sets out those conditions properly, a solution to the generality problem for reliabilism emerges.

Kevin T. Kelly and Clark Glymour. Inductive Inference from Theory-Laden Data.

The moral/conventional task has been widely used to study the emergence of moral understanding in children and to explore the deficits in moral understanding in clinical populations. Previous studies have indicated that moral transgressions, particularly those in which a victim is harmed, evoke a signature pattern of responses in the moral/conventional task: they are judged to be serious, generalizable and not authority dependent. Moreover, this signature pattern is held to be pan‐cultural and to emerge early in development. However, almost all (...) the evidence for these claims comes from studies using harmful transgressions of the sort that primary school children might commit in the schoolyard. In a study conducted on the Internet, we used a much wider range of harm transgressions, and found that they do not evoke the signature pattern of responses found in studies using only schoolyard transgressions. Paralleling other recent work, our study provides preliminary grounds for skepticism regarding many conclusions drawn from earlier research using the moral/conventional task. (shrink)

Drawing extensively on Bentham's unpublished civil and distributive law writings, classical and recent Bentham scholarship, and contemporary work in moral and political philosophy, Kelly here presents the first full-length exposition and sympathetic defense of Bentham's unique utilitarian theory of justice. Kelly shows how Bentham developed a moderate welfare-state liberal theory of justice with egalitarian leanings, the aim of which was to secure the material and political conditions of each citizen's pursuit of the good life in cooperation with each (...) other. A striking and original addition to the growing literature on Bentham's legal and political thought, this incisive study also makes a valuable contribution to contemporary political philosophy.
