Kant's views on revolution have been widely discussed, and commentators have long been astounded that the philosopher who made famous the principle that persons are ends in themselves could reach such abhorent conclusions as that citizens owe unqualified obedience to their supreme ruler. I address an important and ignored sub-issue of this topic: the relations between Kant's doctrine of the division of governmental powers and his doctrine of absolute obedience. I argue that these two doctrines are not compatible; Kant's defense (...) of absolute obedience undermines his own division of powers. Examining exactly why this is the case leads to several further results. First, a constitutional court is crucial to a republic. Second, Kant is closer to a consistent view of government and obedience than first appears. Third, Kant's account of the division of powers was theoretically behind his times. Fourth, there is a crucial distinction between the separation of governmental powers and a system of checks and balances among the three branches of government. Fifth, Kant did grasp the relevant principles governing impeachment - a far more drastic measure than a constitutional court. Finally, most of the principles needed to revise Kant's constitutional theory are already contained in his published writings. Kants Thesen zur Revolution sind viel diskutiert worden, und lange Zeit waren Kommentatoren darüber verwundert, daß der Philosoph, der das Prinzip berühmt gemacht hat, wonach Personen Zwecke an sich selbst sind, insbesondere zu der abschreckenden Schlußfolgerung kommen konnte, die Bürger eines Staates hätten dem Herrscher unbedingten Gehorsam zu leisten. Ich befasse mich mit einem wichtigen und regelmäßig übersehenen Aspekt dieses Problemfeldes: Dem Verhältnis zwischen Kants Lehre von der Gewaltenteilung und seiner These vom absoluten Gehorsam des Staatsbürgers. Ich behaupte, daß diese beiden Lehren nicht miteinander vereinbar sind; Kants Verteidigung des absoluten Gehorsams unterminiert seine Gewaltenteilungsthese. Eine genaue Untersuchung der Frage, warum das so ist, führt zu weiteren Resultaten: Erstens ist ein Verfassungsgericht wesentlich für eine Republik. Zweitens ist Kant näher an einer konsistenten Auffassung von Staat und Gehorsam als dies auf den ersten Blick zu sein scheint. Drittens bleibt Kants Auffassung zur Gewaltenteilung hinter der Entwicklung seiner Zeit zurück. Viertens besteht ein wesentlicher Unterschied zwischen der Trennung der Staatsgewalten einerseits und einem System von "checks and balances" der drei Zweige der Staatslenkung andererseits. Fünftens hat Kant durchaus die relevanten Prinzipien eines "impeachment" erkannt - eine wesentlich drastischere Einrichtung als die eines Verfassungsgerichts. Schließlich sind die meisten der Prinzipien, die für eine Revision von Kants Verfassungstheorie notwendig sind, bereits in seinen eigenen Werken enthalten. (shrink)

The institution of the family and its importance have recently received considerable attention from political theorists. Leading views maintain that the institution’s justification is grounded, at least in part, in the non-instrumental value of the parent-child relationship itself. Such views face the challenge of identifying a specific good in the parent-child relationship that can account for how adults acquire parental rights over a particular child—as opposed to general parental rights, which need not warrant a claim to parent one’s biological progeny. (...) I develop a view that meets this challenge. This Project View identifies the pursuit of a parental project as a distinctive non-instrumentally valuable good that provides a justification for the family and whose pursuit is necessary and sufficient for the acquisition of parental rights. This view grounds moral parenthood in a normative relation as opposed to a biological one, supports polyadic forms of parenting, and provides plausible guidance in cases of assisted reproduction. Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

Many philosophers argue that explanatoriness plays no special role in confirmation – that “inference to the best explanation” (IBE) incorrectly demands giving hypotheses extra credit for their potential explanatory qualities beyond the credit they already deserve for their predictive successes. This paper argues against one common strategy for responding to this thought – that is, for trying to fit IBE within a Bayesian framework. That strategy argues that a hypothesis’ explanatory quality (its “loveliness”) contributes either to its prior probability or (...) to its likelihood. This paper argues that this strategy fails because it must give different treatments to two hypotheses that are unlovely for the very same reason. The strategy therefore loses the insight into scientific reasoning that its reconstruction in terms of IBE is supposed to provide. The paper then provides a Bayesian account of the confirmatory role of explanatoriness that represents explanatory quality as having an impact in the same place for two hypotheses that are unlovely for the very same reason. This approach works by “putting explanation back into IBE” – that is, by invoking hypotheses that refer explicitly to scientific explanation and by invoking the agent's background opinions regarding the kind of explanation that the evidence is liable to have. On this approach, there is no list of “explanatory virtues” the possession of which always helps to make an explanation better. Rather, for different facts, there are different characteristics that our background knowledge of other explanations gives us some reason to expect the given fact's explanation to possess. (shrink)

Much has been written about what corporations owe society and whether it is appropriate to hold them responsible. In contrast, little has been written about whether anything is owed to corporations apart from what is owed to their members. And when this question has been addressed, the answer has always been that corporations are not worthy of any distinct moral consideration. This is even claimed by proponents of corporate agency. In this paper, I argue that proponents of corporate agency should (...) recognize corporations as worthy of moral consideration. Though particular views of moral status are often taken for granted in the literature, corporations can satisfy many views of moral status given the capacities often ascribed to them. They can even meet the conditions of the views assumed. I conclude by suggesting that recognizing the moral status of corporations may not be as drastic or harmful as we might imagine. (shrink)

ABSTRACTConventional wisdom holds that there is no lucky knowledge: if it is a matter of luck, in some relevant sense, that one's belief that p is true, then one does not know that p. Here I will argue that there is similarly no lucky understanding, at least in the case of one type of luck, namely environmental luck. This argument has three parts. First, we need to determine how we evaluate whether one has understanding, which requires determining what I will (...) call understanding's evaluative object. I argue that as the evaluative object of knowledge is a belief in a proposition, the evaluative object of understanding is a mental representation of a relational structure. Next, I show that arguments that environmental luck is incompatible with understanding miss the mark by considering cases in which one has a belief in a proposition is lucky to be true, instead of ones in which one's mental representation of a relational structure is lucky to obtain. I agree, then, with those who argue that one can have understanding when one's beliefs are environmentally lucky to be true, but that this compatibility is not relevant when considering the question of whether one can have environmentally lucky understanding. I then present what I take to be a properly constructed case which shows the incompatibility of environmental luck with understanding. (shrink)

Very little has been done to find out what corporations have done to build ethical values into their organizations. In this report on a survey of 1984 Fortune 1000 industrial and service companies the Center for Business Ethics reveals some facts regarding codes of ethics, ethics committees, social audits, ethics training programs, boards of directors, and other areas where corporations might institutionalize ethics. Based on the survey, the Center for Business Ethics is convinced that corporations are beginning to take steps (...) to institutionalize ethics, while recognizing that in most cases more specific mechanisms and strategies need to be implemented to make their ethics efforts truly effective. In this book, Westphal offers an original interpretation of Hegel's moral philosophy. Building on his previous study of the role of natural law in Hume's and Kant's accounts of justice, Westphal argues that Hegel developed and justified a robust form of civic republicanism. Westphal identifies, for the first time, the proper genre to which Hegel's Philosophical Outlines of Justice belongs and to which it so prodigiously contributes, which he calls Natural Law Constructivism, an approach developed by Hume, Rousseau, Kant, and (...) Hegel. He brings to bear Hegel's adoption and augmentation of Kant's Critique of rational judgment and justification in all non-formal domains to his moral philosophy in his Outlines. Westphal argues that Hegel's justification for the standards of political legitimacy successfully integrates Rousseau's Independence Requirement into the role of public reason within a constitutional republic. In these regards, Hegel's moral and political principles are progressive not only in principle, but also in practice. Hegel's Civic Republicanism will be of interest to scholars of moral philosophy, social and political philosophy, philosophy of law, Hegel, eighteenth- and nineteenth-century philosophy. (shrink)

In Bayes or Bust?, John Earman attempts to express in Bayesian terms a sense of "projectibility" in which it is logically impossible for "All emeralds are green" and "All emeralds are grue" simultaneously to be projectible. I argue that Earman overlooks an important sense in which these two hypotheses cannot both be projectible. This sense is important because it allows projectibility to be connected to lawlikeness, as Goodman intended. Whether this connection suggests a way to resolve Goodman's famous riddle remains (...) unsettled, awaiting an account of lawlikeness. I explore one line of thought that might prove illuminating. This book is written for the non-philosophy major taking 'Contemporary Moral Issues' or 'Intro to Ethics' courses. It provides a method to research any complex moral issue in hundreds of print, periodical, and Internet research sources, and gives a model of the method applied to the question of capital punishment.

The most influential theory of law in current analytic legal philosophy is legal positivism, which generally understands law to be a kind of institution. The most influential theory of institutions in current analytic social philosophy is that of John Searle. One would hope that the two theories are compatible, and in many ways they certainly are. But one incompatibility that still needs ironing out involves the relation of the social rule that undergirds the validity of any legal system (H.L.A. Hart's (...) rule of recognition) to Searle's notion of codification: the idea that institutions need official declarations of their constitutive rules in order to enjoy the full benefits of institutions. The incompatibility arises from the fact that, in order to do its institutional work, the basic validity rule must be codified in Searle's sense—yet, given the particular role it has in legal positivism, it may be impossible to codify in the Searlean sense. In this paper I develop the incompatibility in detail, consider and reject consigning the basic validity rule to Searle's “Background” capacities that support institutional facts, and conclude that the best route to eliminating it while doing a minimum of damage to the two theories is to make a slight emendation to Searle's theory of institutions. Characterizations of the Anthropocene often indicate both the challenges that our new epoch poses for human well-being and a sense of loss that comes from a compromised environment. In this paper I explore a deeper problem underpinning both issues, namely, that decoupling humanity from the world with which we are familiar compromises human flourishing. The environmental conditions characteristic of the Anthropocene do so, I claim, by compromising flourishing on two fronts. First, the comparatively novel conditions of the Anthropocene risk rupturing (...) our narratives, putting at risk our sense of self and connections to familiar environments. Second, by undermining the connections between our environmental background and the sense of well-being conditioned by that background our ability to exercise options that constitute a recognizable good life are compromised. This paper argues that to the extent humanity is decoupled from their environments humans are not only less able to access opportunities our understanding of who we are, our identities, and our capacity to make sense of the world around us through those identities is compromised. I conclude that the Anthropocene does more than challenge our ability to utilize resources, it challenges our understanding of who we are in the world. (shrink)

Scientific realism is the view that one can be justified in believing, of some theory about unobservable entities, that the entities it posits are real and accurately described by the theory, in the same sense as one can be justified in believing that the theory’s empirical predictions are accurate, and that so to believe is what it means for a scientist to “accept” that theory, because the goal of science is to describe reality, even its unobservable features. The first part (...) is an epistemic claim, whereas the second concerns the rational reconstruction of scientific practice. Together they suggest that evidence justifying scientific acceptance of a theory justifies belief that the unobservable entities it posits are real and as the theory purports them to be. Anti-realism denies ; it holds that claims about unobservables are either unjustified or justified in a different sense from predictions of observations. It also denies ; it maintains that in her scientific work, as rationally reconstructed, a scientist who accepts a claim about unobservables believes that it yields accurate predictions of observables, not that it describes unobservables. In addition to being a founder of American pragmatism, Charles Sanders Peirce was a scientist and an empiricist. A core aspect of his thoroughgoing empiricism was a mindset that treats all attitudes as revisable. His fallibilism seems to require us to constantly seek out new information, and to not be content holding any beliefs uncritically. At the same time, Peirce often states that common sense has an important role to play in both scientific and vital inquiry, and that there cannot (...) be any “direct profit in going behind common sense.” Our question is the following: alongside a scientific mindset and a commitment to the method of inquiry, where does common sense fit in? Peirce does at times directly address common sense; however, those explicit engagements are relatively infrequent. In this paper, we argue that getting a firm grip on the role of common sense in Peirce’s philosophy requires a three-pronged investigation, targeting his treatment of common sense alongside his more numerous remarks on intuition and instinct. By excavating and developing Peirce’s concepts of instinct and intuition, we show that his respect for common sense coheres with his insistence on the methodological superiority of inquiry. We conclude that Peirce shows us the way to a distinctive epistemic position balancing fallibilism and anti-scepticism, a pragmatist common sense position of considerable interest for contemporary epistemology given current interest in the relation of intuition and reason. Corporate Social Responsibility amongst Small and Medium Enterprises is often characterised in the literature as unstructured, informal and ad hoc discretionary philanthropic activities. Drawing insights from recent theoretical/analytical frameworks :52–78, 2010), and on empirical data collected from both Nigeria and Tanzania, we found that CSR practices in SMEs are much more nuanced than previously presented. In addition, SMEs undertake their CSR practices to varying degrees in multiple spaces—i.e. the workplace, marketplace, community and the ecological environment. These CSR practices go beyond (...) philanthropy and in some instances involve institutional works aimed at addressing some of the institutional gaps in the environments where these SMEs operate. The paper makes a contribution by drawing attention to the multiple spaces of CSR practices amongst SMEs, and the institutional works they do, which are often taken for granted in the extant literature. We provide a unique perspective—by arguing that what is frequently conceptualised as philanthropic CSR in Africa is ‘institutional works’. (shrink)

Jack Goody’s work on the origins, spatial extent and defining characteristics of modernity has vigorously questioned claims that only European history led to assorted modern characteristics: capitalism, science, democracy, romantic love, and inwardly-motivated personal restraint. He argues that many societies which experienced the Bronze Age urban revolution share certain important material similarities (and some differences) which set them apart from others, and are best understood by constructing an analytical grid rather than categorical stages. With respect to alleged affective differences, Goody (...) takes a more strongly relativist stance, rejecting any developmental divide in the prevalence of romantic love, internalized self-discipline, etc. These useful steps nonetheless generate new problems. One concerns the relationship between material/technical changes, which seem to suggest a few very general historical periods (one marked by early metallurgy, writing, etc., and another by the modern energy revolution), and affective traits, which have no history in this schema. A second concerns periodization itself; while agreeing that periods defined by the experience of one region (e.g. a feudal era) are usually unhelpful, some general terms (such as early modern) do seem essential for conceptualizing developments that, though less epochal than writing or fossil fuels, are nonetheless important. Digital duplicates reduce the scarcity of individuals and thus may impact their instrumental and intrinsic value. I here expand upon this idea by introducing the notion of collective scarcity, which pertains to the limitations faced by social groups in maintaining their size, cohesion, and function.

According to Lange,?Really Statistical explanations? constitute an important kind of non-causalscientific explanation. However, Roski has argued that all alleged RS explanations are either causalexplanations or not explanations at all. In so arguing, Roski has invoked Kahneman?s interpretation of onealleged RS explanation. I employ Roski?s arguments as an opportunity to elaborate and defend RS explanations. Iargue that?RS explanations? genuinely explain rather than deny the presuppositions of why-questions. I argue thatthe RS model is not excessively permissive in allowing some explanations to (...) work purely statistically rather than bydescribing causal relations. I argue that Roski?s view that some?RS explanations? operate by describing causalrelations fails to capture the kind of explanatory insight that RS explanations provide. I elaborate the notion of a?characteristically statistical phenomenon? that figures in the RS model and thereby explain how an RS explanationreveals that its explanandum is independent of any causal facts or specific chances, but rather depends only on ageneric sort of arrangement of chances. Finally, I argue that Roski misinterprets Kahneman, who actually holds thatthe explanation he discusses is a non-causal explanation that nicely fits the RS model.
