Although Maimonides' discussion of creation is one of his greatest contributions - he himself claims that belief in creation is second in importance only to belief in God - there is still considerable debate on what that contribution was. Kenneth Seeskin takes a close look at the problems Maimonides faced and the sources from which he drew. He argues that Maimonides meant exactly what he said: the world was created by a free act of God so that the existence (...) of everything other than God is contingent. In religious terms, existence is a gift. In order to reach this conclusion, Seeskin examines Maimonides' view of God, miracles, the limits of human knowledge, and the claims of astronomy to be a science. The book attempts to develop an account of simplicity in terms of testability, and to use this account to provide an adequate characterization of induction, one immune to the class of problems suggested by Nelson Goodman. It is then shown that the past success of induction, thus characterized, constitutes evidence for its future success. A qualitative measure of confirmation is developed, and this measure - along with the considerations of simplicity - is used to provide an account of the consilience (...) of inductions, and also an inductivist account of the structure and progress of scientific theory. An appendix extends the treatment of simplicity to statistical distributions and provides a reasonable interpretation of the maximum entropy principle. Thus, this book is an attempt to characterize induction in terms of a well-defined notion of simplicity and to use that characterization as a basis of an account of empirical, and in particular, scientific reasoning. Doug Husak suggests that sometimes an actor should be deemed reckless, and not merely negligent, with respect to the risks that she knowingly created but has forgotten at the moment of action. The validity of this conclusion, he points out, depends crucially on what it means to be aware of a risk. Husak’s neutral prompt and counterfactual actual belief criteria are problematic, however. More persuasive is his suggestion that we understand belief, in this moral and criminal law context, as a (...) concept whose meaning is determined by its function as a culpability standard. Husak concludes that inadvertent actors are often less culpable than knowing-but-later-forgetful actors; this is plausible, but there are also numerous counterexamples. Holly Smith focuses on negligence cases in which an agent’s failure to notice a risk stems, not from a prior culpable choice, but from an objectionable attitude or set of attitudes. She is right to emphasize that genuine moral culpability does not depend on conscious choice. However, Smith also asserts that decisions that flow from an actor’s objectionable attitudes are only rarely culpable, because they often do not arise from a reasonably full configuration of the actor’s motives. This last requirement is, I fear, an unrealistic and unnecessarily demanding criterion of culpability. Even when many of the actor’s evaluative attitudes are inactive in Smith’s sense, the actor might deserve blame for not bringing them to bear on his decision. Michael Moore and Heidi Hurd thoroughly explore, and find deficient, H.L.A. Hart’s unexercised capacity theory of negligence. They are correct that that theory requires a further judgment: an actor’s inadvertence is culpable only if he had the capacity to have adverted if X where X is the source of the actor’s moral desert. They overstate, however, in suggesting that the capacity issue falls out of the picture once we identify that underlying desert basis. The authors also worry that if desert is grounded on an underlying vice, we lack a reliable way of ranking the different vices that might explain the actor’s inadvertence; this is not a fatal objection, however, because negligence determinations are quite feasible even in the absence of clear rankings. Moore and Hurd conclude by identifying eight distinct categories in which criminal liability for negligence is justifiable. Negligence is indeed a surprisingly complex and pluralist concept. The three articles in this symposium brightly illuminate some of the most fundamental conceptual and normative issues in the debate over whether it is just to blame and punish the negligently inadvertent. As austerity measures are put into place the world over and global restructuring is acknowledged by all as an attempt to bolster the economic system that lead to the crash, there is a great need to come to grips with the economic, political and philosophical legacy of Marx. Of particular interest are Marx's analyses of alienation and the cycles of boom and bust thought to be integral to the functioning of capitalism. Moreover, as the Cold War drifts into the history (...) books, it is possible to reconsider the lasting impact of Marx's analyses without the shadows cast by the Soviet version of communism. Equally, though, scholars are increasingly turning to Marx for insight into the rise of religion and the corresponding demise of political ideologies that seems to mark the contemporary age. Are we witnessing 'the return of Marx'? Few scholars have done as much to tease out the intricacies of Marx, ideology and religion and their overlapping concerns as the eminent writer and Marx biographer, Professor David McLellan. This book brings together a group of internationally renowned academics to reflect upon, develop and criticise McLellan's analyses of these three themes with a view to contributing more broadly to scholarly debates in these fields. This exciting and timely analysis will be of interest to scholars of political theory, the history of political thought, Marx and Marxism, sociology of knowledge, religion and theology more widely. How could social scientists and cultural theorists take responsibility in engaging with science? How might they develop an experimental sensibility to the links between the production of knowledge and the production of existence or forms of life? Critically outlining key fields in the social and cultural studies of science, we interrogate a number of approaches to these questions. The first approach tries to make sense of how science operates in relation to economic, political and cultural forces. The second analyses science (...) as a form of embodied work or practice. The third engages with science as collaborative-collective elaboration of events, ranging across cultural theory, contemporary art and participant ethnographies. This outline sketches a vector of responsibility across this diverse range of engagements, suggesting that contemporary movements between science and other knowledges constitute ethical and political imperatives. We argue that the projective geometrical component of the Projective Consciousness Model can account for key aspects of pre-reflective self-consciousness and can relate PRSC intelligibly to another signal feature of subjectivity: perspectival character or point of view. We illustrate how the projective geometrical versions of the concepts of duality, reciprocity, polarity, closedness, closure, and unboundedness answer to salient aspects of the phenomenology of PRSC. We thus show that the same mathematics that accounts for the statics and dynamics of perspectival character (...) also accounts for PRSC. More generally, we argue that introducing higher-level geometrical concepts into the theory of PRSC, and into the theory of consciousness broadly, as the PCM does, promises to break longstanding theoretical impasses and dialectical stalemates. Kenneth Dorter's Can Different Cultures Think the Same Thoughts? is a study of fundamental issues in metaphysics and ethics across major philosophical traditions of the world, including the way in which metaphysics can be a foundation for ethics, as well as the importance of metaphysics on its own terms. Dorter examines such questions through a detailed comparison of selected major thinkers and classic works in three global philosophical traditions, those of India, China, and the West. In each chapter Dorter (...) juxtaposes and compares two or more philosophers or classic works from different traditions, from Spinoza and Shankara, to Confucius and Plato, to Marcus Aurelius and the Bhagavad Gita. In doing so he explores different perspectives and reveals limitations and assumptions that might otherwise be obscure. The goal of Dorter's cross-cultural approach is to consider how far works from different cultures can be understood as holding comparable philosophical views. Although Dorter reveals commonalities across the different traditions, he makes no claim that there is such a thing as a universal philosophy. Clearly there are fundamental disagreements among the philosophers and works studied. Yet in each of the case studies of a particular chapter, we can discover a shared, or at least analogous, way of looking at issues across different cultures. All those interested in metaphysics, ethics, Indian philosophy, Chinese philosophy, and comparative philosophy will find much of interest in this book. (shrink)

The recent death of Peter McHugh becomes an occasion for the remembrance and recollection of the distinctive form of reflexive or analytic social inquiry, which framed his work and that of his longtime friend and collaborator, Alan Blum. Following dual appointments at York University, Toronto, Canada in 1972, Blum and McHugh’s partnership formed the basis for a community of scholars and students throughout the 1970s, 1980s, and 1990s. A brief review of McHugh and Blum’s works shows theoretical roots in social (...) constructivism and a deep appreciation of the linguistic turn, which in turn lead to the development of a form of social analysis that meets the stringent requirements of a reflexive sociology by repudiating any claim to a privileged exemption of theoretical speech (practice) from the hermeneutical circle of speech and language. Blum and McHugh are shown to embrace and not to evade the hermeneutical circle by a form of social inquiry that subverts the inherent possibilities available within speech and social convention to make available an encounter with the (moral) authority or form of life for that self-same speech. With each example of everyday life or conventional usage, McHugh (and Blum) move from theorizing which formulates the complexity of a particular instance of social interaction through its rules, to the question of the form of life that make that particular instance of the rules possible. It is the pursuit of transparency between speech and its roots in language that informed and continues to inform the distinctive style of social theory fostered at York-Toronto under the orchestration of McHugh and Blum. In the present article I have surveyed several approaches to modeling the clinical diagnostic process. I have argued that at this point of the field's development, logics which simulate the reasoning patterns and knowledge base of expert clinicians represent research programs that are most likely to succeed. No logic of diagnosis has yet attained the status of being definitive; in spite of striking progress much more research and testing is required. On the basis of various existing logics, I have attempted (...) to articulate a number of desiderata which an ideal diagnostic logic should satisfy. In spite of these criticisms, I would maintain that programs such as MYCIN and INTERNIST have already matured to the point where they are useful both in consultations and in teaching diagnostic reasoning. Ethical theories grounded in utilitarianism suggest that social welfare is improved when agents seek to maximize others' welfare in addition to their own (i.e., are altruistic). However, I use a simple game-theoretic model to demonstrate two shortcomings of this argument. First, altruistic preferences can generate coordination problems where none exist for selfish agents. Second, when agents care somewhat about others' utility but weight their own more highly, total social welfare may be lower than with selfish agents even in the absence (...) of coordination problems.
