Proponents of corporate moral responsibility take certain corporations to be capable of being responsible in ways that do not reduce to the responsibility of their members. If correct, one follow-up question concerns what leads corporations to fail to meet their obligations. We often fail morally when we know what we should do and yet fail to do it, perhaps out of incontinence, akrasia, or weakness of will. However, this kind of failure is much less discussed in the corporate case. And, (...) where it is discussed, the view is that corporations are less prone to weakness. Here, I argue that proponents of corporate responsibility should say that corporations can and often do instantiate weakness of the will, and that this is important to recognize. Weakness of the will requires certain capacities that these proponents typically take corporations to have. And once this is appreciated, we can assess how corporate weakness might proceed differently than how it does for individuals. We can also begin a conversation about how best to meet the distinctive challenges for recognizing and correcting corporate weakness, using a number of resources from management scholarship. In the present article I have surveyed several approaches to modeling the clinical diagnostic process. I have argued that at this point of the field's development, logics which simulate the reasoning patterns and knowledge base of expert clinicians represent research programs that are most likely to succeed. No logic of diagnosis has yet attained the status of being definitive; in spite of striking progress much more research and testing is required. On the basis of various existing logics, I have attempted (...) to articulate a number of desiderata which an ideal diagnostic logic should satisfy. In spite of these criticisms, I would maintain that programs such as MYCIN and INTERNIST have already matured to the point where they are useful both in consultations and in teaching diagnostic reasoning. One way that scientifically recognized properties are multiply realized is by “compensatory differences” among realizing properties. If a property G is jointly realized by two properties F1 and F2, then G can be multiply realized by having changes in the property F1 offset changes in the property F2. In some cases, there are scientific laws that articulate how distinct combinations of physical quantities can determine one and the same value of some other physical quantity. One moral to draw is that (...) in such cases we have the multiple realization of a single determinate, “fine grained” property instance that is exactly similar to another instance. As simple as this moral is, it has ramifications for a number of recent discussions of multiple realization in science. Taken collectively, these ramifications indicate that multiple realization by compensatory adjustments merits greater attention in the philosophy of science literature than it has hitherto received. What are legal fictions? Professor Lon Fuller discussed the matter at some length. One interpretation of his answer is this: they are lies that are not intended to deceive. This solution fails, in the end, to be convincing. But some remarks of Fuller provide the clue to another way of looking at the problem: fictions are means of changing the application of the law by relying on a tension between two classifications of fact.

The Gita at first appears to be a series of explanations of various kinds of yoga strung together in no apparent order, and several of its claims and arguments seem to contradict one another. I argue that the apparent contradictions disappear if we see the arguments as related to one another dialectically rather than analytically. From an analytic perspective contradictions are either merely verbal and can be disambiguated by a conceptual distinction, or else they render the statement meaningless. A dialectical (...) resolution, in the sense I am using the term, requires a change of perspective rather than a simple terminological clarification. We show that a set has an η-representation in a linear order if and only if it is the range of a 0'-computable limitwise monotonic function. We also construct a Δ₃ Turing degree for which no set in that degree has a strong η-representation, answering a question posed by Downey.

ABSTRACT There is a strong pragmatic argument that in our times, dominated as they are by continuous change, one's education needs to be a lifelong process. But can another, different, argument be made that lifelong education is a moral duty everyone owes to oneself irrespective of any other pragmatic justijication? The answer evidently depends largely on whether the notion of a moral duty owed to oneself is an intelligible one. In effect, it turns out, on examination, to be very problematic. (...) The contributions to this symposium raise several issues that extend beyond an examination of Tocqueville’s Democracy in America. For example, is the conventional distinction between ancient and modern in political philosophy too simplistic? Is religion necessary to preserve democracy, and if so, what kind of religion must it be? Theological and sociological sources both suggest that the fate of democracy in the modern world is inextricably, not merely accidentally, connected with the fate of Christianity.

Most interpretations of Orwell's political thought have concentrated on his critique of the ideology of totalitari-anism, especially as this ideology manifested itself in the 1930's in the Soviet Union under Stalin and in Nazi Germany under Hitler.2 These interpretations have provided valuable insights into Orwell's own perceptions of the dangers of cen-tralized state tyranny. However, they suffer from two weak-nesses connected with the concept of totalitarianism. First, the concept of totalitarianism as it has been developed in aca-demic political science has (...) been related specifically to the Soviet and Nazi experiences, and, thus, does not adequately account for other types of tyrannical regimes.3 Second, the application of the totalitarian model to the examination of Orwell's Nineteen Eighty-four tends to emphasize the pro-phetic aspects of the novel and to diminish its character as an investigation of contemporary political life.4 Instead of using the normal rubric of totalitarianism, I shall examine Orwell's political thought as expressed in Nineteen Eighty-four in terms of the conception of the modern state as a teleocracy, a con-cept which was elaborated by the political philosopher Michael Oakeshott. This book is written for the non-philosophy major taking 'Contemporary Moral Issues' or 'Intro to Ethics' courses. It provides a method to research any complex moral issue in hundreds of print, periodical, and Internet research sources, and gives a model of the method applied to the question of capital punishment.

According to the Myth of Er we are responsible for our character because we chose it before birth. But any choice is determined by our present character, sothere is an indefinite regress and we cannot be entirely responsible for our character. The Myth of Er can be seen as the first formulation of the problem of free will, which Aristotle demythologizes in Nicomachean Ethics III.5. Plato's solution is that freedom is compatible with causal determinism because it does not mean indeterminism (...) but rationality. The myth links the individual lives to the harmony of the spheres, so our lives are determined not by blind necessity, but by rational necessity that follows from the nature of the universe. Even so, the limitations of determinism prevent rationality from being a sufficient cause of happiness (although the opposite view is usually attributed to Plato), but it remains a necessary one. The New Orleans catastrophe and the subsequent allegation of homicides at Memorial Medical Center have complicated our thinking about end-of-life care. Can the conditions in a collapsed health care system ever excuse euthanasia? Following a review of current legal and ethical standards for the causation of death in the clinical setting, and an assessment of the most common argument for euthanasia — the argument from intractable suffering — a different argument is set out for the excusability of euthanasia, one based (...) on forced abandonment. While more familiar in battlefield medicine, this line of reasoning may have applied in post-Katrina New Orleans. When health care professionals are compelled to leave a hazardous clinical setting, and where it is impossible to evacuate patients who are not expected to survive, clinicians must choose between abandoning these patients to die unattended and unmedicated, or euthanizing them before leaving themselves. Because each of these options stands as an egregious violation of an important health care norm, and because there is no third option, neither violation can be rightly condemned. (shrink)
